Hello again everyone. Welcome to Washington Gun Law TV. I'm Washington Gun Law president William Kirk. Thanks for joining us. Hey, we're going to talk about the National Firearms Act again.
It is the bane of our existence. And when the big beautiful bill was passed and we went down to zero dollar taxation, there were many out there claiming that this would ultimately be the end of the National Firearms Act.
Well, here we are today and it is still completely intact. In many ways, the only way we're really going to be able to undo it is probably through legislation, but there is a congresswoman who is willing to start that process. And that's what we're going to do today is we're going to get you educated about a House Resolution which has just been introduced, has the backing of some very large Second Amendment organizations. Not sure if it's going to go anywhere, but we need to check it out. So, today we'll spend a few minutes and we'll talk about a bill to start dismantling the NFA.
Okay, America. We're talking about the National Firearms Act again. Now, if we go back into our time machine to last summer when House Resolution 1, better known as the big beautiful bill, passed, we had massive tax relief as it related to short-barreled rifles, short-barreled shotguns, and suppressors. Many thought and some even promised that that would begin the end of the National Firearms Act and yet here we sit today with the National Firearms Act completely intact.
Now, there are several legal challenges going on currently, but none of them have gone anywhere yet. Really, probably the only way we're going to undo ourselves from the NFA is through legislation. Well, enter into the fray today a newly sponsored House Bill by Representative Lauren Boebert out of Colorado. It It does not have a number yet, but you're going to love the title of it because this is the Freedom from Taxes Act of 2026.
What this does is it actually eliminates three different taxation cuz as we know, there were still a couple of NFA items that were still being taxed at the $200 clip even after the passage of House Resolution 1.
What the Freedom from Taxes Act of 2026 does is it then changes the Internal Revenue Code of 1986. So, this doesn't have anything to do with 18 United States Code Section 920 anything, okay?
It does not have anything to do with firearm laws. This amends IRS codes, specifically Section 5811 A1. And what it really does for the remaining taxable items under the NFA, that being machine guns and other destructive devices, is it takes the tax from $200 down to $0.
In addition to that, and this is really big as well, is it would eliminate or repeal the special occupational tax on FFLs. This would provide tremendous tax relief for the firearm industry as a whole, and ultimately would provide tremendous tax relief for you because many of those costs, of course, are passed on to the consumer.
Now, does this bill have a chance to get out of the House of Representatives? It most definitely does. Does this bill have a chance to get out of the Senate?
In its current makeup, not a snowball's chance in hell. Could that change? It is certainly subject to change at the midterm, but we will see. Now, the bill has been met with great support, in particular from NRA as well as the Gun Owners of America, who are quoted as saying, "Gun Owners of America is proud to endorse Representative Lauren Boebert's bill introduced today on the week of the 40th anniversary of the Hughes Amendment becoming law.
The Freedom from Taxes Act of 2026 would reduce the $200 NFA tax on machine guns and destructive devices to $0.
For the last 92 years, law-abiding Americans have had their Second Amendment rights infringed through a draconian and unconstitutional $200 sin tax on the transfer of each machine gun.
Representative Boebert's bill would finish what Congress started in the one big beautiful bill last year reducing the National Firearms Act excise tax.
Gun Owners of America president Erich Pratt was quoted as saying, "From its inception GOA opposed the Hughes Amendment when it was signed into law.
40 years later GOA still opposes any infringements on the right of the people to keep and bear arms.
That's why Gun Owners of America is proud to endorse Representative Boebert's bill that would reduce the $200 NFA tax on machine guns. Under this GOA backed legislation, the right to own a machine gun without paying a sin tax would be fully restored just like the founding fathers intended." Okay, now if actually passed into legislation, this bill would go have an enactment date 90 days from the date in which the president signs it. As I mentioned earlier, there is a possibility even a strong possibility that this could make this out of the House of Representatives in its current political makeup. I do not see how this bill has a snowball's chance in hell of getting out of the United States Senate with its current makeup. Representative Boebert, in support of this bill, who I think all of us could get behind this. This is legislation that is definitely moving us in the right direction, was quoted as saying, "Taxing our constitutional rights is unacceptable and unconstitutional.
The Freedom from Taxes Act builds on the progress we made in the One Big Beautiful Bill by completely eliminating the final NFA taxes on machine guns and destructive devices. My bill also eliminates the burdensome special occupational tax that's been crushing our small businesses and manufacturers.
The government should not be imposing penalties on law-abiding citizens exercising their Second Amendment rights. And listen, I know the focus is going to be on reducing the taxation on those items that are still being taxed under the NFA, in particular automatic weapons, but the repeal of the SOT tax on the FFL industry would have nationwide benefits, all of which we would actually feel. Okay, as soon as we have a bill number, we will let you know.
