When a family member endangers a child's life through assault, legal accountability is essential regardless of family relationships; the victim has the right to pursue charges and demand consequences rather than accepting inadequate apologies, as demonstrated by a mother who successfully pressed charges against her father-in-law who shoved her into a pool while she held her newborn, resulting in a 2-year jail sentence and 5-year probation.

“My Father In Law ‘Playfully’ Shoved Me Into The Pool While I Was Holding My Newborn BabyAdded:
Hi, I'm Mabel. 3 weeks ago I became a mother for the first time and let me tell you nothing prepares you for the exhaustion, the joy, or the overwhelming need to protect this tiny human you've created. My daughter Lily was perfect in every way. She had these big blue eyes and the softest dark hair you've ever felt.
She looks just like you did as a baby, my mother-in-law Karen said during one of her visits, cradling Lily gently.
Same little nose.
I see more of Mabel in her, honestly, my husband David replied, squeezing my shoulder. Especially when she gets that determined look.
We were hosting a small family gathering at our house that Sunday. Nothing fancy, just burgers on the grill and some time by the pool.
David's father Frank had been going on and on about meeting his granddaughter.
Come on Mabel, bring the baby outside, Frank called from the patio. Let me get a good look at her in the natural light.
I picked up Lily from her bassinet, supporting her head carefully.
She was so small, barely 7 lb.
Emma, my best friend, was helping me in the kitchen.
You sure you want to go out there?
Emma asked, her voice low.
Frank's been drinking since noon.
It's just a couple beers, I said, though I'd noticed the same thing.
Besides, David's out there.
Girl, I'm just saying. Last Christmas he thought it was funny to pull my chair out from under me while I was pregnant.
I landed hard.
He did what?
David told him off, but Frank just laughed it off, said I needed to lighten up.
I frowned, but headed outside anyway, Lily nestled against my chest.
The afternoon sun was warm and family members were scattered around the patio and pool area.
David's sister Sarah was lounging in a chair scrolling through her phone.
There she is, Frank boomed, standing up from his seat near the pool. He was a big man, over 6 ft with a loud voice that seemed to fill any space.
Let Grandpa see her. Sure, just let me sit down first, I said, heading toward the patio chairs. Oh, come closer. I can't see her from here, he insisted, waving me toward him. He was standing right at the edge of the pool. Frank, back up a bit, David called from the grill. Give her some space.
I'm fine. I'm fine, Frank said, but he didn't move. I walked over carefully, keeping a firm grip on Lily. I stopped a few feet from the edge, but Frank stepped forward.
Look at this little angel, he cooed, reaching out. Then his expression changed to that mischievous look I'd seen before when he was about to do something he found amusing.
Frank, don't, Sarah started from her chair.
It happened so fast. Frank's hands came up and shoved my shoulders hard. I stumbled backward and suddenly I was falling. The shock made me lose my footing completely, and I went straight into the pool, Lily still in my arms.
The water closed over us. Cold.
Terrifying. I kicked upward immediately, holding Lily above the surface as soon as I could. She was screaming and I was gasping, trying to get to the edge. Oh my god! Emma's voice cut through everything. She was already running, jumping into the pool in her clothes.
David was there, too, reaching down.
Give her to me, David shouted, and I lifted Lily up. He grabbed her, pulling her out. I scrambled up the ladder, my entire body shaking.
She's not breathing right, David said, his face pale.
Call 911, now! It was just a joke, Frank said, his hands up. I didn't think You didn't think! Emma yelled at him. She was holding a baby, a newborn!
Sarah had her phone out, talking rapidly to emergency services.
Karen was crying, trying to see Lily. I grabbed my daughter from David, checking her airways. She was coughing, water coming from her tiny mouth.
"The ambulance is coming." Sarah said, her voice shaking.
"I was just playing around." Frank said, and I heard it in his voice. He was scared now, but also defensive.
"Maple knows I joke around."
"You shoved her into a pool with a 3-week-old baby." Emma said, her voice ice cold. "That's not a joke."
The paramedics arrived within minutes, and everything became a blur of questions and examinations.
The hospital was freezing.
I sat in the emergency room, still in my damp clothes, watching as doctors examined Lily.
David was next to me, his knee bouncing nervously.
"She's aspirated some water." Dr. Chen said, her expression serious.
"We need to monitor her for secondary secondary drowning. She'll need to stay overnight, possibly longer."
"Is she going to be okay?" I asked, my voice breaking.
"We're doing everything we can.
The next 24 hours are critical."
After she left, David put his head in his hands.
"I can't believe he did that. What was he thinking?"
"He wasn't." Emma said.
She'd driven to the hospital behind the ambulance.
"He was drunk and being an idiot."
The waiting room door opened, and Sarah walked in.
Her eyes were red.
"How is she?"
"They're monitoring her."
I said flatly.
"She aspirated water because your father thought it would be funny to push me into a pool while I was holding her."
Sarah sat down heavily.
"I know. I'm so sorry. He's devastated."
"He's devastated?"
Emma stood up.
"Are you kidding me right now?"
"I'm not defending what he did, Sarah said quickly.
I'm just saying he didn't mean for this to happen.
Then what did he mean to happen? I asked, my voice rising.
What was the best-case scenario when he shoved a woman holding an infant into water?
He's always been like this, David said quietly.
The pranks, the jokes that go too far.
I've told him a hundred times.
This isn't a prank, I said.
This is assault.
He put our daughter's life in danger.
Mabel's right, Emma said.
You need to call the police.
Sarah's eyes widened.
The police? He's family.
He endangered a baby, Emma shot back.
Family doesn't get a pass for that.
David looked at me.
What do you want to do?
I want him held accountable, I said. I want to make sure he never does this to anyone else.
Over the next few hours, more information came out.
I talked to Emma in detail about what had happened.
You saw his face before he did it? Emma asked.
He had that look. That same look he gets before all his pranks. Sarah even saw it. She tried to warn him.
And he was drinking?
Started at noon, according to Karen.
Emma pulled out her phone.
I took photos at the party before everything happened.
I've got timestamps showing him with beer bottles.
And I got video of the aftermath, of him trying to justify it.
You recorded that?
Girl, I always record things when Frank's drunk. He pulled this kind of stuff at your wedding, remember?
I've learned.
The door opened again, and Officer Martinez walked in.
David had called the police from the hospital.
Mrs. Collins, I'm here to take your statement about what happened today.
I told him everything, every detail.
Sarah corroborated the story, even though I could see it pained her.
"Has he done things like this before?"
Officer Martinez asked.
"He pushed Emma when she was pregnant last Christmas." I said.
"She nearly fell."
Emma nodded.
"I didn't report it because it was family, but yeah, it happened."
"And there's a pattern of this behavior?" the officer asked David.
"Yes."
David said quietly.
"My whole life.
He thinks boundaries don't apply to him."
After Officer Martinez left, Sarah pulled me aside.
"Are you really going to press charges?"
"Yes."
"Mabel, he's David's father. He's Lily's grandfather."
"He endangered her life.
He could have killed her."
"But he didn't. And he feels terrible."
I looked at her directly.
"Does he?
Because from where I'm standing, he's more worried about getting in trouble than about what he did to Lily."
Sarah didn't have an answer for that.
Emma touched my arm.
"Whatever you decide to do, I've got your back. I've got evidence, I've got testimony, and I've got time."
"Thank you." I said. "Because I'm not letting this go."
Two days later, Lily was stable enough to go home.
The doctors said we'd gotten lucky, that it could have been so much worse.
Frank had called David's phone 30 times.
Karen had come by twice, crying and begging me to talk to Frank.
"He just wants to apologize." She said at our doorstep.
"I don't want to hear it." I said.
"Please, Mabel, he's beside himself."
"Good." But David convinced me to meet with Frank, if only to tell him directly how I felt.
We agreed to meet at Sarah's house with Sarah and Emma present. Frank looked terrible. He'd aged a decade in two days.
"Mabel, I "No." I cut him off.
"You don't get to talk first. You listen."
He closed his mouth.
"You shoved me into a pool while I was holding my 3-week-old daughter.
Do you understand what could have happened?
It was supposed to be funny.
He said weakly.
Funny? What part was funny? The part where she aspirated water?
The part where she spent 2 days in the hospital?
The part where she still might develop complications?
I didn't think No, you didn't think. You never think.
You just do whatever you want, and everyone's supposed to laugh and move on.
Frank's face reddened.
I've apologized.
What more do you want?
I want you to understand that your apology means nothing.
You're sorry you got caught. Sorry there were consequences.
You're not sorry you did it.
That's not true, Frank said, his voice rising.
I love my granddaughter.
You have a funny way of showing it, Emma interjected. You nearly killed her.
It was an accident.
Pushing someone isn't an accident, I said. You made a choice. You chose to put your hands on me and shove me.
Sarah spoke up.
Dad, you need to take responsibility.
I am. I'm trying to apologize.
Your apology isn't accepted, I said flatly, and it never will be. You don't get forgiveness for this.
Frank stood up abruptly.
You're going to hold this over me forever?
I made a mistake.
You made a choice that endangered my child, my newborn child. So, yes, I'm going to hold it over you forever.
David, talk to your wife, Frank said, turning to his son.
She's right, Dad, David said quietly.
You went too far this time.
This is ridiculous, Frank shouted. I'm not going to be punished for the rest of my life for one stupid moment.
You're not the victim here, Emma said.
"Lily is. Mabel is."
"And what? You're pressing charges?
You're going to send me to jail?"
"Yes," I said simply.
Frank's expression changed.
"You're serious."
"Completely." "Over an accident?" "Over assault and child endangerment." He took a step toward me, his finger pointing.
"You're trying to destroy this family."
David moved between us.
"Don't." "She's being vindictive," Frank snarled. "She's being cruel."
"I'm being protective," I said.
"Something you should understand, but clearly don't." Frank's hand shot out and grabbed my arm, pulling me toward him. "You need to listen to me."
Everything happened at once. David shoved his father back. Emma jumped up.
Sarah screamed. Frank stumbled, but then came at David taking a swing.
"That's enough," Sarah yelled, getting between them. "Dad, stop."
But Frank pushed her aside.
Hard. She hit the coffee table, crying out in pain.
"Did you just hit your daughter?"
Emma had her phone out recording.
"Did everyone see that?"
Frank froze, looking at his hands like he didn't recognize them.
"Get out," Sarah said from the floor, holding her side. "Get out of my house."
Officer Martinez added the assault on Sarah to the charges.
With Emma's video evidence and multiple witnesses, the case was solid. Frank had also violated the no-contact order by showing up at our house the day after the hospital, which we'd gotten on camera.
"The district attorney wants to move forward," Officer Martinez told us at the station.
"With the video evidence and medical records, this is a strong case."
"What's he looking at?" David asked.
"Assault, reckless endangerment of a minor, violation of a restraining order.
He could see jail time."
Karen called me one final time.
"Please," she begged.
"He's getting help. He's going to therapy."
"Good," I said. "He should have done that years ago."
"Can't you find it in your heart to forgive him?"
"No, I can't. And I won't." "You're tearing this family apart."
"He tore this family apart the second he put Lily's life in danger. I'm just making sure there are consequences."
The court date was set for 3 months out.
Frank's lawyer tried to negotiate a plea deal, but I refused to budge.
The prosecutor told me he'd offered to plead guilty to lesser charges.
"Absolutely not," I said.
"He needs to face what he did."
Emma was with me every step.
"I'm so proud of you for standing your ground."
"Some people think I'm being too harsh."
"Some people are wrong. You're protecting your daughter.
That's what matters."
The preliminary hearing was brutal.
Frank's lawyer tried to paint it as a tragic accident, a moment of poor judgment. But the video evidence from Emma was damning. You could see Frank's deliberate action, could hear his dismissive comments afterward.
The judge set bail high.
"Mr. Collins, you endangered an infant and assaulted your own daughter. The court takes these matters very seriously."
Sarah testified against her father.
It cost her, I knew.
Half the family stopped speaking to her.
But she looked at me afterward and said, "It was the right thing to do."
David struggled with it all.
"He's my father," he said one night, holding Lily.
"But he's also the man who nearly killed our daughter."
"You can feel both things," I told him.
"But we did the right thing."
"I know."
3 months later, Frank took a plea deal.
2 years in jail, 5 years probation, mandatory anger management, and substance abuse treatment. He wasn't allowed contact with us or Lily for the duration of the sentence plus probation.
On the courthouse steps, Karen tried one more time.
"He's learned his lesson. Please, just tell the judge you forgive him."
"No." I said.
"Because I don't. And I never will."
"You're so cold."
"I'm a mother protecting her child.
There's nothing cold about that."
Frank was taken away in handcuffs. He didn't look at us. Six months later, Lily is thriving. She's hit all her milestones, and the doctors say there's no lasting damage from the incident.
David's relationship with his father is over. And while that saddens him, he knows it's necessary.
"I can't have someone around her who thinks endangering children is a joke."
He said.
"Exactly."
Emma came over with coffee one afternoon.
"How are you doing with everything?"
"Better." I said, watching Lily play on her mat. "I don't regret any of it."
"Good. You shouldn't."
"Some people still think I went too far."
"Some people value keeping the peace over keeping kids safe. Those people are wrong. Sarah visits regularly. She and her father don't speak. He made his choice." she told me. "He chose his pride over his family. That's on him. I look at Lily every day and know I made the right decision.
She's safe. She's loved.
And she'll grow up knowing that her mother protected her, no matter the cost."
What would you have done in my situation?
Would you have pressed charges? Or would you have accepted the apology?
