Immigration Update for July 22, 2026

[00:00:07][music] Hello everybody. It's great to be with you today. We are excited. Uh we have a fun show for today and we're got a lot of things to talk about. There's uh, of course, right after our show last week, the immigration service came out and published two regulations that we talked about that we knew were coming, but all of a sudden they they took effect. So, we're going to talk about those today.

[00:00:35]First, I want to talk uh about um about DACA and DACA update. There has been uh no massive changes. The litigation in Texas is still frozen uh by Judge Hannon. Uh and so there's nothing going on. Uh, but I've had conversations with at least three people this week that have taken my suggestion and filed mandamus actions, including one who's a law student out in California. Uh, and they have successfully gotten their mand gotten their DACA approved. So, um, unfortunately, the folks at Justice Action Center have not published as they told me they would a sample mandamus and I haven't put mine up because I was waiting for them to put theirs up. I just confirmed they're not putting theirs up. They just said contact us, which we talked about a couple weeks ago. Um, so you can reach out to Justice Action Center and ask them. Um, but I do know that at least a couple of three folks on Dreamers Together have done mandamus actions. Um, and I I guess I just got I'm going to have to put one together. I'm sorry. I have to pull mine out and make it make it a template. Uh, but I do recommend that uh obviously you if you you must have filed at least 120 days before it expired. You must be about to expire or expired and uh you must be able to show hardship. must show that you've contacted immigration at least once. Show that you've contacted a congressman at least once. That'll all be written about in your mandamus and you file that with the court. Now, keep in mind a mandamus when you file it yourself does cost $45. That's the filing fee to file a mandamus in immigration court. But I would I would tell you it's certainly good to do at this point if you lost your job. Um, I talked to somebody yesterday. They hadn't had a doc. Their doc expired four months ago. And I'm thinking, what what have you been doing? You for now you have four months of unlawful presence.

[00:02:18]Um, unless immigration backdates your EAD. And that's what I haven't heard. I haven't heard from people that tell me whether or not their EADs were backdated to the expiration of the prior event, which they should be at this point because if you filed beforehand, that's where they should be. Uh, now somebody had asked me yesterday that they're they filed almost a year in advance like I suggested. Um, and it's been six months or seven months. They haven't heard yet.

[00:02:41]Should they sue? I said, "No, you shouldn't sue because your DACA is not expiring until December." But, uh, I suspect that this glut, this problem will have resolved itself hopefully within the next 30 days or so. I do know that they're approving a lot of them.

[00:02:54]Uh, they they are definitely not doing it in order. Even though they say they are, they're definitely not doing an order. Um but uh you know I I I've seen a number of November seen some December seen January, February, Marches. Then of course I've seen July case I saw a July case approved yesterday. You know immigration is a model of inconsistency.

[00:03:13]But just to keep you updated on that.

[00:03:15]Yes, I know I've got to put something on my website. My website's immigration.net. Keep checking that. Uh and uh if I do put it up, I'll certainly load it the link up in dreamers together. But I've got so much other stuff going on. [laughter] I haven't had time to do it. Um, so that's our dock up for today. Just just not much going on.

[00:03:32]Uh, the other next thing I really want to talk about is this whole uh, ICE. ICE is now arresting records number of people, actually arresting them, actually detaining them, record number of people detained in terrible conditions all over the country. People um, that have removal orders, people that don't have removal orders for whatever reason they can make up. Uh, they're doing it. The key is where you live. If you live, for example, in the 11th circuit where I live, which is Georgia, Alabama, and Florida, you can file for bond. But if you live in the fifth circuit, and if you're undocumented, if you live in the fifth circuit, you can't. And what immigration is trying to do is move everybody that possibly can to the fifth circuit, that would be bond eligible. So, they are forced to stay in custody while they fight their case. Um, so I want to prepare you. the faster you can get a bond filed, the faster you can get it filed, uh it means the that it's the faster you can get in front of a judge uh that uh that will hear your case. So, let's talk about the documents uh so that uh we can we can let's see I got to find here put up an image here.

[00:04:59]That's what I'm looking for. And, uh, I am looking for this. Here we go. So, I want to talk to you guys about the bond request checklist. So, when we get hired by a family for somebody who's detained, we provide this checklist to them. Uh, and what we want want people to do is we want you to have these documents ready.

[00:05:21]The first thing we're going to need is the A number. So, typically when somebody's detained within 24 hours, they get assigned an A number if they don't already have one. Now, this of course people that don't have removal orders. You have a removal order, you're not getting a bond. If you're an arriving alien, that means you were not parrolled or admitted to the United States and it's within the last couple years you're not getting bond. But if you've been here a while, more than two years, you should be eligible for bond in the 11th circuit where I live, that's or in the Ninth Circuit, California, Arizona, um up in New York, but other places like the the eighth circuit, uh or the fifth circuit, which is Texas, or Texas, Mississippi, Alabama, where a ton of detention centers are, you can't do this. I need to know how you entered. I need to know your immigration history. I need to know your criminal history, any arrests, convictions. I need all that information and we need certified copies of any arrests or convictions. We need a copy of your birth certificate. We need a copy of your passport. We need a copy of any entry document that you have. We need a copy of letters of support from families and we give you a sample letter for that. Any medical records for yourself or families about chronic illness or other other issues with your with your med with your physical or mental health. We need to prove how long you've been in the United States. The longer the better. 10 years even better.

[00:06:38]Um, if you've been working, we get a letter from your employer or recent [clears throat] payups. Hopefully, you haven't been working illegally and you can't get that stuff. Uh, records for your US citizen children and their birth certificates for them. Uh, papers. If your spouse is a resident or citizen, we want copies of that documentation. If your kids are in the military, we need that information. If you own a house, a car, a business, we need that information. Of course, we need your marriage certificate. We need all that stuff. Um, people are taking far too long to gather this information. We need this information now. So, if you are or somebody in your family could be picked up by immigration, these documents should be sitting in a folder that you can hand to the lawyer the day the person is detained. So, bond request has been made. We need these papers to file bond requests. Please, I'm begging you, uh, get out there and get these done.

[00:07:30]And of course, you can email me if you want in advance. And this is on our website as well under bonds. Uh and we I'll help you be to email this to you.

[00:07:38]So uh that's uh I wanted to talk about bonds today because immigration is uh detaining so many people and it's really important to be to be prepared before you get detained and not running around like a chicken with your head cut off after you're detained. Okay, so that's that. Let's uh let's talk about the public charge rule. Now this is important. this public charge rule when it came out, people were people started calling me, "Oh, what what what does this mean? Does this mean that I uh that I can't uh I can't apply for a green card because my kids used Medicare once?" No, it doesn't. It doesn't mean that that definitely not what it means.

[00:08:19]Um, what it does mean, and I think here's the kicker here, what immigration did here, what's really important about this, is immigration basically deleted the rules that defined public charge. That's right. They didn't redefine public charge. They deleted the rules that did define public charge. The Biden administration had specific rules about what was a public charge, what were government benefits. specifically put it in the law and it honestly it was consistent with the statute. So now immigration comes along and says yeah you know we don't the Trump administration we don't want that. Now, this is a different rule than the rule the first time the Trump administration put which which was dismissed by the turned over by the courts where they had listed all these things that were public benefits uh things like food stamps and CHIP which were in fact legally authorized for the st for the for the for the kids the US citizen kids or spouse who are eligible for those things. Now, um, now basically what they're saying is this rule says the officers will make a determination. It's going to be up to the officers based on quote guidance that USCAS will publish. There is no published guidance that we're aware of. Okay. What this is designed to do is terrify families out of using public benefits. It's exactly why they publish this. This is why it exists.

[00:09:50]Now, if you're a family and let's say you are your spouse is a citizen, you had DACA, for example, you have four kids and your kids got food stamps. Does this mean you can't get a green card?

[00:10:00]No, it doesn't mean that. But what it does mean is you need to be better prepared for the interview for the interview uh when this comes down. Um so it remove it took out the bright line rules and give this kind of totality of the circumstances. The officer is supposed to look at your age, your health, your family status, your financial resources, and your skills alongside the use of non-cash means tested public benefits supposedly.

[00:10:34]But these rules are only effective for applications for green cards filed after September 18th, 2026. So if you've used these benefits, you want to file now or before September 18th. and the new rule will not be applied to you. Okay? Now, there are exemptions to this rule. Uh adjustment of status for TU visa holders, refugees, asles, they're exempt from the from this rule. So, it doesn't apply to them. Uh so, it just and it only applies in the United States. It does not apply at the console. So, if you're conscessing, these rules don't apply to you. The other rules from the Department of State apply to you. So, it's really really important to understand um that there's new rules, uh but there's the ability to still use the existing rule if you file now. And if you're under a new rule, just talk to a qualified lawyer. Talk to a lawyer who's got lots of experience in this field that can train you and help you for that interview preparation and and mold your case so that you're presenting the best case to the officer, especially if there's an interview. Uh now the the the last topic I want to talk today is the student visa rule.

[00:11:46]Yeah, I know. Uh we talked about this a lot uh that they were going to be doing this and what shocked me this rule first of all is not effective for 60 days. So it's not effective till September which means all the students starting this semester are still under the old rules and will be going forward. So let's talk about this. Under the old rules, students did not get a fixed departure date. Now, there's a fixed departure date. So, let's let's talk about this.

[00:12:15]Um, for a 4-year undergraduate program, come as an undergraduate, you will be given an admission period of four years on your I94 card.

[00:12:26]If you're coming for a master's or PhD program, you'll get two years. Now, two years is obviously not enough to do a PhD in any rational area. Uh so what this means is you if you are transferring programs and and of course you can't transfer programs uh you can't change your major which is crazy as a freshman um of course you're going to change your major. If you change your major you have to apply for an extension of your status uh which immigration under Trump will likely try to deny. Uh now this doesn't mean you have to leave in four years. It means you need to try to complete your program in four years. But always check your I94 card. That's the other big kicker.

[00:13:07]Students have never had to worry about the date on their I94 card because there's never been a date. Now, there will be dates. CBP makes errors on their I94 cards. They do. They make errors on the stand, the American system. Every time you travel on your student visa, you need to make sure you go to cbp.gov and check your I94 card. Now, universities should be explaining people difference between a visa, an I20, and an I94. Okay? They need to identify zooms likely to need more than four years. There are some programs that take more than four years. Schools need to build reliable extension systems, reminder systems. Schools especially need to expand their their immigration advising capacities. They don't they many of them don't have good ones at this point. And then avoid predictable PhD timelines, exceptional cases. So, um let's let's really look at this in more detail. the, you know, the policies are changing, but at the end of the day, there is still a lot of ability for students to study in the United States.

[00:14:09]Students just really have to make sure that they are complying with the rules.

[00:14:15]And also, you know, students aren't rich. You're not going to have a lawyer on standby. Make sure that you're familiar with and know with and are friends with the foreign student advising staff at your school who I can assure you all have outside lawyer contacts. I know we have contacts in many universities around the United States and we get called frequently from students to ask to from advisors can you help this and can you advise and we always do that. Um, so just make sure that you're following the rules as written. And if you're going to change a program, let's say you're you're ending your program, you're going to get into school, go now. Go now because currently you can change programs. Currently you can change majors. Currently you can change schools without going to the immigration service after September 17th. That's not going to be possible without doing a 539, which is going to take time and costs going to cost thousands of dollars to do. So really focus yourself on these things right now. Really really important to do that.

[00:15:12]All right. So uh let's talk let's do an update on the cases. Uh first want to talk about the Dorcas case. The Dorcas case. Today the government filed a an emergency motion on their emergency stay asking for more more space to file a brief. The government actually lied in their brief. They said they only had 7,000 words and they had 8375 words thanks to Curtis Morrison. He counted these things. Curtis is so good on this stuff. He's so good. Um, and so they've asked more time from the First Circuit on their emergency stay appeal.

[00:15:48]Not I don't know what's happened.

[00:15:49]Nothing's happened as a result of that yet, but it's there and they are trying to move forward with an appeal as quickly as they possibly can. So just understand I don't think the first circuit's going to give an appeal. You somebody will ask that here. So for the for the U USCIS pause, these are the pause memos, the nationality discrimination memos, uh the terrorism, all those are paused. Uh that pause is off and immigration continues to adjudicate. So what that means in the context of our cases of our 39 country cases is that they continue to be adjudicated. Uh I know we reached out to a couple of our plaintiffs this last week uh in a couple of our cases where in one case 53 of the 89 plaintiffs in our Georgia case have been adjudicated.

[00:16:38]Rajie had like 54 of 87 people. Others have been we're not waiting for an update of of our our Maryland case but I'm sure they're adjudicating those. We know our clients are telling us they're being adjudicated. So we know they're adjudicating cases but keep in mind somebody's going to be the last person adjudicated.

[00:16:54]they are. They might be you don't it's not you're not targeting you. It's not intentional against you. Um maybe and keep in mind we don't know what's in your cases. Maybe you screwed up with something in your case. Maybe there's an issue with your case. Maybe it's an issue with your background. But they are adjudicated. They're the easiest cases first the 589s. I mean the 539s and the EADs um and some some H's some adjustments. But many of our clients were adjustment applicants. And keep in mind their adjustment cases on their website. They're saying 8, 10 or 12 or 25 months depending where your case is.

[00:17:27]Take that with a grain of salt. That is just madeup information that is not really tracking real-time data. And we know cases are taking longer than that in many circumstances. That's a country who banned cases uh inside the United States. USCIS uh their those pauses are lifted and remain lifted at this point on the 75 ban case 100 banned cases.

[00:17:49]Still waiting on a decision on Massu just waiting patiently for a decision.

[00:17:55]What can I tell you? I do know uh that yesterday Curtis put this on his website and put it on his his Twitter feed but uh they published the data on judges uh by individual judges. how many judges had and how came how many cases are over six months on motions. I have to go back and look at those for each of our judges. I'll do that before tonight before we do our hearing uh before I do our our our six o'clock live for our impact clients. But uh it's not surprising that a complicated motion is still taking a little bit longer.

[00:18:25]Hopefully this is the week. Hopefully this is the week. The litigation on on $100,000 fee still pending. still out there and as is the F1 visa revocation lawsuit. We're still waiting on the judge's decision.

[00:18:39]Now, that's been pending since since March. That's a long time, but still she that judge probably has a number of cases from mid-March. When you look at their calendars, they're doing criminal cases all day long on all this crap the Trump administration is bringing, and that takes them away from writing. Uh, and then last but not least, we have our DV lottery cases. As everybody knows because we've emailed our clients um that the cases have been consolidated with even our two cases Saitto and Nairo are with Evanov all in Judge Leon. Uh Curtis did tell us yesterday that he was told by the government lawyer that they're going to oppose consolidation.

[00:19:16]Now some of our clients asked are you going to oppose consolidation? I said why?

[00:19:22]At least in in the Sato case that means it's fully briefed. They're part of the briefings in the other case. They're fully briefed. They're plaintiffs in Ivangh now. That's what the judge did. I don't think the judge is gonna unwrap that. I really don't. And when I reached out to our government council in Seaitto, I said, "Well, what are you going to do?" He never responded to me.

[00:19:41]You know, different different aas, different situations. So, uh, we remain hopeful we'll get a decision. This is actually good move by Judge Leon. I think it means he's getting ready to issue a decision. He clearly means he clearly knows about the cases. He clearly knows there's a deadline because heaven forbid he doesn't he certainly is reading Curtis's notices all the time.

[00:19:59]Um so we're in good shape there. We're in constant we're in con contact with Curtis and his team. We're grateful to work with Red Eagle. Uh we've done this before. We've won before. We remain confident we'll win this case. So there you go. That's our updates for today.

[00:20:13]Let's take a look at some of the questions we have here. Sure. We got some good questions. Um is this about a country pause? Well, I just updated on that. Amy Pike, good to see you, my friend. Um, Messi, yeah, Messi is not upset. You know, you know what? Messi had a good run. A lot of people are upset with Argentina. They They said they played dirty.

[00:20:34]Look, I I think half of soccer's fake anyway. If they would just not fake all the dying, I got hit. Played regular regular stuff. You did that in the NFL, you'd be mocked out of the league. Be mocked. Come on, put your big boy pants on. Let's play some soccer. But it was a great game. Happy for Spain. They got a great team. Um, and looks like they have a great team in four years, too. Since all DD lawsuits are now in one, any plan to lead council together? Yes, we already talking. We already got this.

[00:21:17]That's where you make an appointment and we prepare you for the interview and you have a lawyer go with you. That's the advice I give. DACA 2027. Uh [clears throat] I don't know what that means. I don't know what that means. Uh any good news for us this week? Uh there's been no news. That's the thing.

[00:21:33]Other than the bad news from USCIS, there's no news on anything else. DV L, what timeline you expected to come? I I expect an early ruling. I mean, hopefully this month the judge will rule. Hopefully this week he'll rule.

[00:21:45]The government's gonna government's trying to delay. They're going to push to consolidate.

[00:21:49]You know, I think we'll just say, "Judge, you do whatever you want." Our response is, "Judge, you do whatever you want. You want to consolidate? Great.

[00:21:55]You don't want to consolidate. Doesn't matter to us. We think the government's delaying here by We'll even say we think the government's delaying this case intentionally to not get a decision."

[00:22:05]And this is simply one more delay that makes no sense. Uh, what's going 100,000K? Nothing. Just nothing. How long do you think it will take for some to get their green cards? Their citizen husband petitions them and they are one of the people whose initial doc app got stuck. So basically, you have to do a 601A waiver. That's about a four-year process because you do the I130 which takes about a year. You do the waiver which takes two years and you got an appointment at the consulate in Mexico.

[00:22:31]It takes a year. So about four years.

[00:23:27]Uh, do they have authority to impose visa bonds similar to those selective embassy non visas? uh they do have that authority, but it's not to the level of authority they think they have. Plus, the moment a new administration comes in that's Democrat, they will likely end the bonds and return the money. Yeah, it sucks. Again, anything to reduce legal immigration uh any updates on the yellow case? None.

[00:24:21]What happens if someone with active DACA and old removal bond? Nothing. If you have active DACA, you will not be detained. You won't. If you are, your calls will get you out of me. will get you released immediately without bond.

[00:24:31]What's happens if someone with active docket owner gets detained by ICE? You call us immediately and we'll get you released. Uh you're welcome guy. It's my pleasure. Uh Tasin Mitro Monstar my brother file for docker renewal in May. He was summoned fingerprints while doc. How long it takes to get approved right now? It's about five months. Oh, it could be a week.

[00:25:39]Mr. Charles, I have DACA and applied AP in August 2025. You're not getting it. They're just not doing AP right now. They're just not. DV plaintiff interview canceled in March due to war. Should I try to get interview in Turkey? Yeah, I would try to get interviewed in Turkey.

[00:25:59]Absolutely. I mean, you got to get an interview. Get the interview. That's your chance. If you're never interviewed, then you're not getting it if we win. Study, perfect insight though. I'm glad to be joined. What's your plan? Thank you very much. Uh I expected that I mean the government's going to oppose. We will simply say we don't care. Just make a decision. It's vitally actually you give us a chance say judge. It's vitally important you make a decision. Doesn't matter whether they're consolidated or not. No difference whatsoever. The cases are all the same. Make a decision now. Doesn't matter. Actually, it gives us a chance to say something directly to the judge.

[00:26:31]What happens if you had DACA before having a green card approved and then I visit gets automatically revoked without any status change? You're fine. Uh if you got your green card, right? So, what's been happening this week and last week, USCIS has been sending notices out to people, hey, we canceled your your 765 and your 131.

[00:26:49]Yeah, good. You have a green card.

[00:26:50]Doesn't matter. Basically, they're doing what they should have done a year or two years ago. Yeah, it's crazy, right?

[00:26:59]Katie, been two weeks since my mandamus has been sent or at least a civil process served having her back. Renew dock renewal, December renewal. Tough a went well though. Good. I'm glad your AS went great. Uh, that's good news. You I if a government lawyer, what you can do if you've served the US attorney, you could call the US attorney and ask for the civil chief. Call the local ask for the civil chief and they ask the civil chief who is assigned to your case and ask them if they can ask immigration to adjudicate your case. You could do that.

[00:27:28]That's what I would do. My DACA doesn't expire till mid December. I sent my renewal February 8th. You would contact them in September. Hopefully, you'll be approved by then. Six. Give them five or six months. My DACA doesn't show expired till mid December. I said, "Oh, you already asked that question. Do you think they will venture to get against?"

[00:27:45]Yes, they will. when either they get sued and forced to or we have a new president.

[00:27:52]Is a child with asthma considered health condition to have ready? Well, it depends on the level of asthma.

[00:27:59]They have exercise induced asma. No, that's a nothing burger. Have DACA waiting renewed. Married citizen January came as a child with tourist visa. I tried to do a US. They scared me to wait. No. Look, if if you if you have DACA, file your adjustment. You have a legal entry. Get it done, man. You're fine. I don't know who scared you. What are the pros and cons of this cousin of 3DB cases?

[00:28:21]It's irrelevant. I mean the the pro is the judge writes one decision instead of three.

[00:28:34]I mean I it doesn't matter. It doesn't have an impact. It doesn't. I think it's actually helpful to us in some aspect because now fully in my opinion is fully briefed. That's what I told Government Council, hey, this consolidated caitto's fully briefed. His his brief is due Friday, so maybe he's wasting his time writing a brief. I don't know. Seems like he's got better things to do at this time. I have DACA and applied for AP in August for dental care. Um, the status inquiry keeps getting pushed back. Yeah, well, they're just not approving DACA APs right now. They're just not. They they flat out tell people when you call them. Lawyers in Kansas City is Missouri. That would be Matt Hoppak. H O P O C. Matt Hopuck, my coworker from Salvador got picked up by ICE this morning. He tried finding him on the ICE did no luck. Takes 24 hours to get an ICE detainy locator. Um, but you need to follow the bond stuff and get a bond filed for him. Hi, attorney.

[00:29:30]They received my forms on March 20th. By the way, I got a new I got a new microphone thing here. So, now I'm I'm talking live. You can all hear me.

[00:29:37]Question. I applied for 45. I received my form on March 20th. Now I have to interview August 7. Normal to get interviewed fast. That's great news. You know, again, it's normal. Everything.

[00:29:48]There's no such thing anymore about normal or abnormal. It's just whatever it is. Consider yourself lucky. Sorry.

[00:29:55]Inquir. It's now November 2027. Yeah, because you're not adjudicating them. Is it hard to win cancellation removal with super clean record children? Well, cancellation removal requires you to show that your parent and or children will suffer extreme and highly was exceptional and extremely unusual hardship. If they don't have cancer or some terrible illness, you're not going to get approved. Sorry, you're just not.

[00:30:20]Extreme hardship is extreme hardship.

[00:30:22]Somebody's dying of cancer that can't be treated abroad for DACA. Does adopting a highway? Yeah, great. You adopt a highway. That's awesome.
