Citizens retain fundamental constitutional rights during police encounters, including the right to record interactions, demand identification, question officers about probable cause, and challenge unreasonable escalation tactics; police must have reasonable suspicion or probable cause to detain individuals, and officers cannot arbitrarily escalate situations or change enforcement reasons mid-encounter.

Cop Tries To Intimidate Homeless Man By Putting On GlovesAdded:
Yeah, I'll give you the ID. This dude putting on his gloves getting all extra fake aggressive for what? I don't know.
Dude, I'm getting my ID. Don't Don't harvey me. I'm getting my ID. I'm getting my ID. You You're You're intentionally trying to escalate the situation. You You're intentionally trying to escalate the situation so you can have a falsified reason to arrest me. I'm getting my ID. So, how can you say I'm obstructing? How am I obstructing anything with this mad way for people to move and go about freely?
>> This cop shows up to a homeless man demanding ID, and the man is already reaching to give it. But before the interaction even properly begins, the officer starts pulling on gloves and showing aggression right from the start.
But it does not go as planned. It starts outside in the rain while a homeless man is setting up a temporary shelter near a public sidewalk in Minneapolis. Before he can even fully get settled, police officers suddenly walk up and immediately begin questioning him about the tent setup. The officers claim setting up shelter on the public sidewalk violates city ordinance rules and could result in a citation. But the man points out he had been doing the exact same thing in the same area for a long time. and officers previously drove by without saying anything about it. The man repeatedly accuses officers of trying to provoke a confrontation while recording everything happening around him. Meanwhile, officers continue insisting they are enforcing city ordinance laws involving shelters and obstruction on public sidewalks. The man agrees to provide his ID and is already reaching for it. But before he can even hand it over, one of the officers starts pulling on gloves, already acting like the situation is about to turn physical.
But this is where the entire encounter completely backfires. Watch the full video and see for yourself.
Sir, what's >> going on?
>> All right. So, we're not doing this.
>> You can't set up tents. It's against city ordinance. You got some ID on you?
I have some ID. What's going on? Why you >> ID?
>> Why you acting like I'm doing something wrong?
>> You are doing something wrong. You can't set up a shelter on a public sidewalk.
It's against city ordinance. So, you're going to get cited for it. Do you have ID?
>> I'm going to get cited for it.
>> That's correct. Do you have ID?
>> What I'm going to get cited for?
>> I told you for violating a city ordinance. How did I violate it, sir?
>> You're setting up a tent on a public sidewalk, setting up shelter. You can't do that.
>> All right, but sir, I was doing this all last year. None of y'all said nothing to me. A whole bunch of >> it today, sir. Do you have >> You're enforcing it today. Is it What's your name? Jay McDonald.
>> J McDonald 1044. With gratitude and respect for your service to and for the community, I here back accept your oath as a open offer to enter to a private binding contract with me to secure my rights and liberties.
>> Okay. Now, what do you say you want, sir?
>> I don't remember your name. What's your name?
>> What do you said you want, sir?
>> Your name?
>> All right. You want the ID, sir?
>> Uh, do you have an ID? That's cool.
>> Yeah, I'll give you the ID. This dude putting on his glove getting all extra fake aggressive for what? I don't know.
And uh I just accepted your oath. That's an open offer. I hope you remember article six, y'all.
>> That's great.
>> All right. So, uh any violation of my I am recording, too.
>> Yeah, sure we >> tell you what, just give him your name.
I'm giving him my ID. I'm not spelling nothing. I'm giving him my ID. That's what ID is for. So, you're not going to tell me how to do this.
>> All right. Well, let's get the ID.
>> That's what we're going to do.
Don't try to intimidate me or none of that stupid.
>> Let's go.
>> All right. We going to part of harassment. This the same from the other night that came with the young guy. Dude, I'm getting my ID. Don't Don't hurt me. I'm getting my ID. I'm getting my ID. You You're You're intentionally trying to escalate the situation. You You intentionally trying to escalate the situation so you can have a falsified reason to arrest me.
I'm getting my ID as you can see me getting my ID. That's what he's trying to escalate the situation intentionally.
That's his problem. That's what he's doing.
>> Deescalate.
>> He's trying to escalate. You're trying to escalate, not deescalate.
>> I am deescalating. I'm getting my ID.
You're not going to get mad because you're mad and try to abuse your powers on me. I'm recording. That's what you're doing. All right. All right. You could be a criminal if you want to. You're under oath. Remember Article 6. Remember your oath of office. for affirmation, my man. Remember that. So, you go ahead and act up if you want to. Just cuz you mad right now because I'm telling you the truth or you don't like what I'm saying.
You go ahead and do that. That'll be your problem, not mine. Here's a court notice when they uh rescheduled my hearing and stuff.
>> Oh, that's in your system. Once you look that up, yo, you're not going to Henry.
>> Sir, it's right there for you, sir.
>> What's your date of birth? It's right there, sir. When you when you check it up in your computer, it pop up, sir.
>> What is it?
>> I do not consent to that. All that information is right there. Here go the picture ID for you. There. There you go.
>> Perfect.
>> That's Ramsey County and all that. All that going to pop up once you do all that.
>> All right. So, since we're confused, I'll explain it to you.
>> We're not confused about nothing, sir.
We're not confused. I'm not confused.
>> So, you understand you can't do this.
It's >> No, I don't understand. I can't do this because I did this all last year and no none of y'all said nothing to me.
>> None of you guys said nothing to me.
Now, right now, what you're doing is trying to interfere with the civil rights process by acting like you your your your how you say, executing your ministerial duties. Because this is his second time with a different partner harassing me for no reason at all. And I knew you guys know I did this cuz y'all just sat there and watched me do this.
Then you're coming. It ain't against nothing. I I am homeless. I set this up here for the night so I could be here.
No, it's not illegal. No, it's not illegal. Who did I hurt by doing this?
Since you saying it's illegal cuz for something to be illegal, you have to hurt somebody, >> man. I'm not black or nothing. this mad space right there. As you can see, so how can you say I'm obstructing? How am I obstructing anything when this mad way for people to move and go about freely?
>> Like I said, once you get sighted, we're going to have you pack this up and move along.
>> Once you have this right here, you see this? All right. In order to block something, you have to be blocking it.
If you're cighting me, I'm staying the night here. Right here until it stopped raining or something. I'm not just leaving like this.
>> If you're doing that, we'll just arrest you for obstruction and we'll go that way.
>> Arrest me for obstruction. That that was your plan. That's why you came here then. It was your intention to come here to arrest if you're not going to cooperate.
>> All right. Well, I'm going to leave, sir, but it's raining. When it get done raining, I'm going to leave. I can't take my down the rain cuz I have valuable stuff in here. I'm going to leave. I'm going to leave. You're going to give my citation. I'm going to leave you. Right.
>> That's correct.
>> You right.
>> And what you said your name is, sir, cuz I want to see I want you to keep this same attitude and zeal. Okay. Keep the same energy.
>> I got the same.
>> Keep the same energy, sir. Keep the same energy.
>> Donald, keep that same energy, Donald. Keep that same energy, Donald. Keep that same energy. I like I like people like you.
Big Donald.
>> McDonald's.
>> McDonald's.
>> Yeah. on your own with that.
>> You on your own. You got the Big Mac. We got the Big M. Just to let you know.
Now, you see right now, I want y'all to pay attention to this. Yo, pay attention to how since I went and grabbed them documents from the uh from the courthouse, how they've been harassing me intentionally. This is how they interfere with the civil rights process.
You see what I'm saying? They look for any and everything to try to charge me up cuz they know I I do my own matters own on myself. I present my own matters, my own cases. So they try to have me cased up to have me like just doing to try to make me quit or but what they're doing this is conspiracy against civil rights is interfering with the civil rights process and this is how they go about it acting like they uh how you say under the guise of executing the ministerial duties because I have videos all last year when I was put my tent up here every night in the morning I wake up and take it down early in the morning. The other officer that I talked to he said he a have no problem with it unless as long as I take it down. You see what I'm saying? But now this dude talking about he want to sight me. And this the same officer I have him on video. The one that's in there with the car thing now. I have him on video as well harassing me on Friday.
>> You understand?
>> Thursday. I'm not talking to you my man.
I'm talking to my audience. All right.
That's who I'm talking to.
>> You talk to your audience.
>> I'm talking to my audience.
>> My audience. So what was you saying now?
>> Do you want to hear me?
>> What was you saying?
>> Okay. Difference in officer discretion.
Just because they let you do it last year doesn't mean it's no longer illegal.
>> Yeah.
>> You understand that right?
>> It's never illegal, sir. It's never illegal. I'm homeless. You can look up the >> It's no longer illegal. I'ming homeless.
I'm homeless. There's no It's not There's no such thing as a home. Where the Come on, man. Be homeless, but you can't set up a shot.
>> Knock it off. There's mass space right there. I'm not obstructing nothing.
Still public. I'm not obstructing nothing. I'm not obstructing nothing.
I'm not obstructing nothing. Who did I hurt by being here?
>> Did I hurt any? Was anybody injured?
>> Are these matters civil or criminal, sir?
>> That's not how it works.
>> Are these matters civil? All right. Are your charges, is it civil or criminal?
Your city or Is it civil or criminal, sir? Criminal. It's criminal.
>> It's a city ordinance. Yeah.
>> Hey yo, federal rules of civil procedure said there's only one cause of action.
That's a civil action. Yo, so how do you have me in in a criminal act?
>> I mean, I don't understand.
>> You said the city ordinance.
>> Minneapolis city ordinance. You can't set up a shelter on a public sidewalk.
>> All right, check this out. So, which jurisdiction is this under? Which constitution? Which constitutional jurisdiction is this under? It's under Is this Is this equity? Is this equity?
>> Is this equity? Is this common law?
>> City ordinance.
>> Is this equity common law?
>> City ordinances. Equity, common law, mory, or amarit time? Which jurisdiction are you operating under?
>> We're not under water.
>> All right. So, which jurisdiction are you operating under, sir? Cuz ignorance is about to hurt you. Yo, >> nothing's going >> You're ignorance. You're ignorance.
You're ignorance. You're learn you're right now. You're in school. I'm trying to teach you something so you don't hurt yourself in the future. But I know you got people that need your ignorant arrogant ass cuz you try to get extra ignorant arrogant with me. A fake aggressive like that was supposed to scare me out of >> agon. What are you saying?
>> Ignorant arrogant mother. You you heard what I said. You heard exactly what I said. And you just try to, you know, throw that sneak disc.
>> I don't think you understand the law.
That's the major issue. Yo, don't worry.
You and your gang about to understand it real well. It's some high It's some high people that's about to teach y'all because y'all don't listen. Y'all don't learn. Y'all just continue harassing harassing. So therefore, it's some people about to teach y'all. You'll see what I'm talking about.
>> Okay?
>> You'll see exactly what I'm talking about. You them judges, crooked ass judges y'all got down there and all around the Yeah. any any of these little jurisdictions like the second judicial, fourth judicial like that district.
Yeah. And oh, the United States District, y'all got some people that's about to teach y'all a major lesson, y'all.
>> Okay, >> don't worry. And guess what?
Everything's going to be lawful and legal. And guess what? Y'all can congratulate yselves cuz y'all work so hard for it. Y'all work extra hard for it. You I'mma pack up and leave, sir, but I'm going to pack up. I'm not I'm not expecting nothing.
>> Let's pack it everything up. Let's go.
>> All right. I got you.
>> I got you. At the end, the homeless man packs up his tent and leaves the area while continuing to record and argue that the officers were unfairly targeting him over the sidewalk setup.
This man is simply walking outside in broad daylight when a police officer suddenly swoops up on him. First, it's supposedly about curfew. Then, seconds later, the officer suddenly starts asking him whether he has a gun on him.
The man is already recording while walking down the street during an argument with the officer. By the time the video begins, the confrontation is already heated. The officer had driven by, noticed him outside, pulled over, and immediately began questioning him.
At first, the stop is supposedly about curfew, but the man instantly shuts that down by reminding the officer he is a grown adult. And right after that, the interaction changes direction completely. After mentioning curfew, the officer suddenly starts asking whether the man has a gun on him. The second the gun question gets asked, the entire confrontation explodes. The man immediately starts demanding probable cause while repeatedly questioning why the officer swooped up on him so aggressively in the first place.
Meanwhile, the officer continues trying to question him while also moving closer physically during the encounter. Watch how this escalates further and share your opinion in the comments.
>> Stupid ass boy. Dumb ass boy. Come on, bro. What's wrong with you?
>> Don't touch me.
>> Don't touch me. Back up.
>> Back up. You don't got You don't got nothing. You got a probable cause. If you got a probable cause, let me know.

>> Like I said, they don't have when they don't have no reason. They I got y'all.
I said, >> "All right, you too, sir."
>> Today's two encounters raise major constitutional questions involving police escalation, homelessness enforcement, stop and frisk authority, ID demands, and the right to question government officials during public encounters. The first clip becomes intense almost immediately once the homeless man agrees to provide ID and is already reaching for it. But one of the officers starts pulling on gloves and escalating the energy of the situation right from the beginning. The encounter raises major first amendment protections involving the right to record police and openly question officers during public interactions. It also raises fifth amendment protections involving the right to remain silent and refuse answering unnecessary investigative questions beyond basic identification during ordinance enforcement. The encounter also turns into a larger debate involving civil versus criminal enforcement, homelessness laws, public sidewalks, and whether police discretion is being used fairly once somebody is already cooperating. The second clip raises another major issue involving officers constantly changing the reason for the stop. First, it is supposedly about curfew. Then the conversation suddenly shifts toward guns, identification, and investigations without the officer clearly explaining any actual crime. The frustration from the man becomes obvious once the officer continues demanding ID while physically blocking his movement and refusing to clearly establish probable cause. The encounter raises major Fourth Amendment questions involving stop and frisk authority, lawful detention, and whether officers can demand identification without clearly articulating a crime first. It also raises First Amendment protections involving the right to record police, question officers, demand badge numbers, and openly challenge police authority during public encounters. The original videos are linked in the description. Make sure to go through them. We'll see you in the next video.
