Julius Malema argues that South African magistrates should rule based on law rather than political views or personal feelings, and that judges are not above the Constitution but are products of it, with the Constitutional Court deriving its existence from the Constitution and having a duty to respect it; he criticizes what he perceives as racism and political influence in judicial decisions, emphasizing that all are equal before the law.

Julius Malema Reveals Why He Believes The Court Was Against Him.Hinzugefügt:
South African politics is heating up again as Julius Malema now claims the magistrate who sentenced him was driven by politics, racism, and outside influence.
But what does this explosive accusation really reveal about trust in the country's justice system? Stay tuned. be a dichotomy uh for some of us.
No, no. I will not know better than you as a potential graduate of uh law how to challenge a misdirection. I leave that to you as lawyers.
I speak as an accused and I speak as a politician.
So, political speak is not giving a lecture in a room.
It has got its way uh you ought conduct it because if a politician was to speak like lecturers, then uh there's no need for politicians. So, there's a way politicians speak.
Uh uh and that has got nothing to do with the disrespect for the uh the rule of law.
I I I I earlier on demonstrated to you how racist she was in my case.
Uh I I demonstrated uh how I must uh how justice must be done to me and how I must see it being done to me.
So, and and that's why I've seen injustice meted to me and and and the basis of that and rationality behind that is racism that is advocated by AfriForum.
Look at Look at her telling when he mentioned AfriForum how she reacted.
It was not her reacting.
It was the subtle racism in her that reacted.
So, if you need anything, go and look at her.
You couldn't speak about AfriForum front of her.
She was not prepared to hear about a free forum.
And why is that not racism? So, a magistrate that rules based on political views and personal feelings has got the right to fear for her life.
But a magistrate that rules according to law, and you want to kill her because she ruled according to law, she must be prepared to die for the laws. And say, "I'm I don't care. I didn't do anything wrong. I will die with my conscience very clear that I used the law to convict this person. And therefore, it doesn't matter what they say." But once you use other things outside the law, you've got all the reasons to fear.
I protect judges everywhere.
Everywhere. Magistrates everywhere.
But I criticize judgments by magistrates, which is allowed.
The The judges are not above the Constitution.
They themselves are a product of the Constitution, including the Constitutional Court. Constitutional Court is not a Constitution.
It derives its existence from the Constitution. And it has got a duty to respect the Constitution. And the Constitution says to only fear all are equal before the law.
And that's what I'm challenging, and those are my values.
So, I'm not acting outside my values, and that's why I said to you, this finger did not go up when she was doing what she was doing because I knew this is not law.
It's something else.
Okay. Thank you, Tulas Wiza.
