Wonutumi Jubilate As AG First Witness Confess This To Court After...Added:
[music] >> Be the first to know in Sam TV.
>> [clears throat] >> Yes, the witness himself had spoken to the fact that he had ever represented uh A1 uh first accused person in the company of Akonta Mines in court in a civil matter.
And he had earlier on also indicated that in Chairman Wontumi's nature, he doesn't deal in documents, and that he never used documents in transactions.
But we're trying to prove that that is not the case because he himself has signed documents for and on behalf of uh A2 and A1 in civil court And are seeking to tender that document that he signed.
Uh in his witness statement in that civil court to uh vindicate uh A2 A1 that when necessary they deal with documents.
And that when somebody makes an allusion to a fact that is not supported by document we seek to challenge it that in the modus of A1 and A2 they always deal in documents. And in that witness statement that he has signed he had tendered a a document authored by the A1 and signed for A1 by A2 which goes contrary to the position he wanted the court to believe that we don't deal in documents.
Documents are going to be important going forward. So, we need to challenge that assertion. That is why we are seeking to tender that document that he himself signed for and on behalf of A1 and A2 and a document that he attached to that witness statement that had been signed by A2 for and on behalf of A1.
So, what was the outcome of that? Uh the court wants us to uh just introduce it for him to answer the questions which he did in a permit. And come back uh through the process to tender the document to be record of the court for us all to rely on. So, we will do that on the next adjourned date when we come.
It will have been tendered, discovered, and uh filed, and served. And then uh we can use it by way of tendering it to him.
And so, and then now lawyer A2 told uh the first prosecution witness or the Abidjan court the name and uh court in Nigeria and on the 13th of this month >> [snorts] >> documenter attended through a lawyer prosecution witness first accused and the third second accused person one time for in court same in the chamber lawyer challenging to say any A2 and then a local case to be a summary test for A1 and A2 in the same case you know no psychic I say or the new witness statement and that document I just signed for and on behalf of A2 A1 by A2 and so so and I know lawyer person this document in our phone one case that so and the two court in the limb and the umbrella concert because I say while I lay foundation no I can't say about the civil attorney general for now you back on the 13th now you better to our cross examination also now Um Okay, now 10th prosecution witness uh this is the second day on the cross-examination.

[clears throat] >> criminal court one Mhm. I heard the Nimri forest you know and uh criminal court four and uh Uh share Samar boy there you know. Now Samar boy there you know so I drew in and also what you call cross-examination so Uh Samar boy there you know uh prosecution completed the case and uh you file a submission of no >> Of no case, okay. submission of no case you know uh court rule against us say [clears throat] you have established Mumia defense, Appeal is not there. As in the FM. Now you are probably still on proceedings.

Cross-examination, I see. Mhm. But but so far uh state's no if you freeze your client's accounts in the sunny amano, that freeze no is still active, right?
And we are in another matter of uh uh you cool versus uh Paradise Jewelers. Oh, okay.
>> so we are on appeal on that one.
And there is a civil matter. Yeah, not a civil matter. But still I will not only access to the accounts in the BBA. No no yet.
Wow. Yes.
>> [clears throat] >> Mhm. Wow.
And the passport in the other so is in is in the custody of the court in the war.
Maybe I The passport in the other no.
>> And the passport, yes. The passport in the in the war court in the custody in the set of public business account mining company and chairman won't to me I want um criminal court four. Oh, criminal court four do you know? Okay. Okay.
Some other way. Mhm.
Wow. But court no say court no Emma client say say a year say or say or two client You mean of you make an application to the court. Uh in all cases as I said court to remove remedy there. You have to come by way of >> Come by way of application.
Uh That is a billionaire who doesn't bring out his application.
In all of the In all of these cases now, our client uh yeah, client said on yeah on yeah any of the charges and the allegations against him.
Indeed, some of them were there.
Uh the prosecution has not accused him of involving himself in all the company in illegal mining. Okay.
The allegation is that he has signed the mineral rights to a certain company.
Uh >> [clears throat] >> Uh yeah, didn't to so far your own document there is speaking to any assignment. Mhm.
That is a lonely lonely person, I mean uh [clears throat] some of them were there.
>> Yes. And lonely person now allegations said one could treat him VIP. And they said over there I didn't forest him without authority. And they said the business is said where mining and also said and I will uh court one criminal court one. Mhm.
Now we say the American Yes. I wish [clears throat] you could come because >> no, no.
because number one is Ofori Atta Manu Ofori Atta.
Timberland Ofori Atta.
He said if it was Ofori Atta, the console would be higher.
All those same time the same same Ofori Atta Ofori Atta. If Ofori Atta on cancel time Ofori Atta.
So it is not true.
>> [clears throat] >> And same Mr. Leone lawyers for me in office were there and senior lawyers for the GPP.
>> [clears throat] >> Mhm, Mr. Leone >> Yeah, Richard Zombie. Yeah, I'll tell you criminal procedure. Yes, I'll tell you criminal procedure. Yes. A very experienced practitioner about 10 years at the bar.
Uh or or senior partner or dummy partner. Oh, okay. Or you two are I know Um Mark Wahlberg is You think you know Gary? Think again.
No, but wait.
Let me tell you what my That is yet to do. Uh Tuesday That's Saturday.
Tuesday I'm going to start from 1:00 p.m.
10:30 to 8:00 p.m.
Mhm. Then it continued again on Wednesday night.
And then from 12:00 a.m.
up to uh 6:00 a.m.
I'm sorry.
Indeed.
Nobody told me the lawyers.
I can this is a friend of mine.
He not 10:45. Not 7:00.
I found me something to do anything.
I don't [clears throat] know what you did. It's another question.
No, see Okay.
But he was denied access to the council.
I saw you in the Nana.
I didn't know.
You don't know he doesn't even know the facts.
I'm putting him.
You don't even know it's Tuesday.
Okay.
No.
Around every after 1:00 or 2:00 maybe.
I started some from my team or three or three normally in the core hospital.
>> [clears throat] >> Now, why So, he's senior to him.
And then That's what I don't know what you're going to say.
And then I'm going up. Lawyers and then I don't know the core in your core office now.
>> [laughter] >> No meeting can take place.
And and also with me in the engagement we are No more core. We are back office now. No more your phone. Almost almost I'm back.
No more something back.
No more core no more core interrogation.
No more beer bear about an hour or two hours ago.
Yeah. In the interrogation Interrogation Yes, and then and then in our core there was was a meeting and then about my report here the same fact same old matter same charges there's no new charge.
Fresh evidence fresh evidence new fresh charges be First evidence we are my out.
I will be from A property.
First evidence. First time first evidence in my life.
Someone first conference.
We have the evidence here. And they did it to take so much time.
What's that first evidence? Nothing at all. Mhm.
Until you see our client were in Cecilia.
Only see I'm in the bar office, my office.
And we were you know That's it. I'm not granting you bail, man.
Let [clears throat] me take conditions.
Why am I to say if if if I don't question No more saying no more going on. Then why were they keeping him?
If I'm moving you say I'm going to tell you me and interview him or interrogate him or ask him questions in the absence of his lawyers. And then why were they keeping him? Why did they keep him for 2 days?
That's because I mean there's no way any meaningful interrogation or examination or interview of an accused person who is represented can take place in the absence of his counsel.
So suspect you are such a person or lawyer.
Now this person I am saying lawyer no lawyer.
So it cannot take place. Yes. It will be in the cell. Then why were you keeping him for 2 days?
Then no person no almost to say it doesn't matter of telling the person to If it's a lawyer by a lawyer referral.
I am a lawyer. Mhm. First accused is my referral. Yes. I am a lawyer. Yes. Why is that? In fact I am a lawyer [clears throat] and I am a firm same 45.
I tell them all.
I am a firm.
I am a firm referral. That's what I am saying. I am a lawyer without him posting any bail condition.
uh national at all if at all we [clears throat] can maybe say if you are saying but there was nothing at all. I also I also believe him. So believe him. I'm locking him up.
>> [clears throat] >> I'm so already the same old charges are into him.
No coffee.
questions and they say nothing new has happened.
Mhm. Would that would that be probably because uh uh now on my money bail that that earlier in the day thoughts that that would suffice?
Um yeah, I don't know because as far as I'm concerned they they all charges Mhm.
So all charges were withdrawn. Yeah, all were withdrawn, sure. So there's no case pending. Yes. And yeah Mhm.
It is the same for more than more time the next move from either Yoko and the national attorney general, right? Yes, yes, yes. Mhm. But today they be I can only say they they have always been available. They've been fully cooperative.
Yes, they have been doing the most. Mhm. How can you prosecute somebody when you have frozen all his assets?
Essentially you are tying the person's hands behind his back.
And even that is contrary to law. Mhm.
Because you have to change all the person's fees or the assets.
I will be in my own business.
In this case [clears throat] all money to what is he doing?
Completely.
Anyway. Yeah, it it is a Sierra uh Attorney General I withdraw charges not from court.
Apply for uh any assets to be unfrozen and after that what will be your next move?
education. Yeah.
>> This is what they want to do. Yeah.
Now all because they made an oral promise.
Now how can I bind it me back?
Members of the um outgoing government.
Now for >> [clears throat] >> the mass manufacture or the mass dream up some cases.
So they are dreaming up the cases. And you can't prosecute dream up cases.
Do you understand? But but we are Yeah.
But but I would say in terms of prosecuting cases.
What I'm saying is that the oral must be understood for the dishes. Okay. We must accept it as a policy of the NDC and we agree to this.
Because it was a major campaign promise.
And the question is how can a party seeking to win power set out their promises as a major policy the fact that when they come they will to embark on prosecutions of of the outgoing government >> Mhm. and for the corruption.
You have not even mentioned investigators.
You have not even the investigators.
You have not even mentioned the director of the CID.
You haven't mentioned the director general of the investigators of the BNI or Boku.
Or you haven't met anybody at all. You have not appointed anybody to talk to.
You have not changed your mind. Yet you really have more policies in mind than prosecuting members of the opposition.
How is that possible?
I mean, so so clearly, you must find some cases to do.
And that's what we are seeing. So all these cases really are just a product of the propagandists and policies of of the NDC.
Anyway.
Into You you believe say say Amugo by the report now oral committee in the submitted to AG, you know.
If anyone foundation for more prosecutions there are then in Kusiega.
now. Nobody And baby I in line of what you want to know. Baby I see baby I cannot miss the area of the area of the area of the area.
I'm not missing you.
