And that thing just dropped in my mind that if the fathers in the home have delegated [music] the responsibility of praying Yes, more because women pray more.
And we decide to [music] go and step aside.
It's a Personally, I think is something that my spirit has woken up to. I don't just want to be saying Jacob sold his birthright.
Even me, as a husband in the home, have I not sold what was given to me as a responsibility even from the beginning that God created man?
Have I not sold some spiritual things?

At every point that Jesus made or decided to heal somebody or do a miracle, the scripture says he will do what? He will go into a solitary place, and he will he will seek the face of God.
The scripture says, "Where two or three are gathered in God's name, he is he's there."

As a matter of fact, when we were when we were in primary school in the primary school, we attended the same primary school together to be honest. So, we were classmates all through our primary schools. So, it's my honor So, professionally he had worked with different legal companies around the country.

Well, the options I think is available to you is obviously you come up with it when you want to run file of the Home Office there.
So, the options will be to make an application for extension of leave to the Home Office. Immediately.
Immediately before that month is out.
Pending the time you are able to secure probably is here somewhere else.
Alternatively, you can speak to your employer.
So, how soon can you How soon can you um apply? Like I said, 1 month. Is it too late?
No, it's not too late.
An application can be submitted even a day before. Oh, okay. A day before. So, you can still write it. Yes, let's do a little arithmetic now. Okay. For example, if the COS expires tomorrow Okay. the Home Office would have expected an application to be submitted probably 11:59.
Okay. 11:12 midnight.
Otherwise, I'm illegal.
Otherwise, you won't be covered under section 3C of immigration law.
So, while you're waiting, that means you cannot work.
Of course, you can work. Oh, when you The 1 1 month is expired Yes, once you have made an application, application is pending. Yes, you can carry out your work. Oh, I didn't know that. Open at the ear.

So, you can carry on seeing.
So, what does section section 3C say? It says is that it means that your previous legal status carries on until the determination of your any application you submitted.

You don't need an office to respond to that application. No, no, you don't need Once an application has been made, make sure such an application is an extension is made before such an application is expired. But, can they come back and now say refused?

Well, that's a good question. Uh of course, an office can come back to say an extension is not granted.
You know, an office they have their exclusive jurisdiction to say, "No, we're refusing you on so so grounds."
Yeah? But, once that happens, what next do you do?
Make an application for administrative review.
Stating reasons why you why you want an office to grant your leave to remain.
Perhaps there are some cases whereby an office will will come back to say your appeal was submitted late, or you become an overstayer.
Provided your application is made before that time expires, yeah?
Print out the application form.
It will show on the application form the time and the date the application was made.
Then, you can proceed for your administrative review.
But, most importantly, consult legal advice for that, please.
So, assuming somebody forgot to even renew, and it and it starts to lapse, what are the options available?
Very unfortunate, sir.

The thing is The thing is an Office did not want to see you.
You can't You can't declare asylum that period.
Well, that's another question again.
When you're talking about asylum, it's another type of immigration rule you're trying to bring to the notice of Home Office.
Okay? Asylum Asylum claim, we're going to discuss that if you If anyone of you have any question on that, but asylum is a different one.
Do you understand? Which can be discussed extensively if you have any question on that.
So, when you say you cannot apply for that to remain Yeah, but what is the next option for you if your application is on process?
Does the further leave to remain Is it uh Well, is it a guarantee that it can You can get it?
Or what do you need to do while you are waiting? Because sometimes they say it is being refused.
Well, even an immigration judge will never say to you any application you submit to the Home Office is guaranteed 100%. No lawyer If any lawyer say to you, "Don't worry, this application is 100%." Please run away from that lawyer.
Even Home Office caseworker will never come to say to you, "Your application is 100%."
So, what we normally do is well, we can't guarantee 100%, but we actually can guarantee 50 50%. Most cases we always say to you is 20%.
It's better we put it that way.
Do you understand? Just to prepare your mind.
Do you understand? So, we don't normally guarantee 100%. An immigration judge will never say to you "Your application is 100%." Unless until your asylum or probably immigration appeal is heard.
As we are being listening to you you are able to push up your case and immigration judge can decide on your claim on your evidence on the evidence before the immigration judge. So, it is not 100%, sir. Nobody can guarantee 100%.
Is that clear? Sorry, before you go Before I come back to it. Is that clear?
Yeah, yeah. I know you don't want to hear that.
But it is not Nothing is 100%. It's only almighty God that can guarantee 100%.
Um I just want to ask her from your experience, what are the common mistakes people make during application, you know, that makes um most of their applications rejected?
Good question again. Well, if you read through again to Home Office website, what Home Office usually advise people is ensure that your applicant and make sure you contact or seek legal advice.
Okay?
Now, Home Office is not stupid when they make that comment.
Now, there are a lot of mistakes.
Even a professor can make mistake when you make an application. I'm not saying the truth. Even we lawyers sometimes we make mistake.
Do you understand? There are a lot of common mistakes. Sometimes there are some mistakes can never never be ignored by the Home Office. For example, failure to disclose.
Okay?
If you fail to disclose some material information, material facts, then what what what message are you passing on onto the Home Office?
You are practically telling Home Office you have something to hide.
Okay?
So, there are some mistakes which can probably be overlooked.
For example, I don't No, don't make mistake. Let me put it there. Let me put it that way.
Don't make any mistake when you're making an application because the thing is Home Office decide on your application based on your application form.
They don't want to see your face.
Do you understand? So, what they want the application is submitted to the Home Office will be printed or will be opened by the case worker. They read through your application form.
Your application is like something we call in law the facts speak for itself.
The application form before the Home Office determines who you are, speaks volume of who you are.
Do you understand? Any mistake you make, for example, if you travel out of the country, they will say to you, "How many times have you visited or have you traveled to to your own country?"
You decided to wave it. Wave it or ignore that question. Mhm. Common mistake to you.
Now, Home Office will say to you, "That means you have something to to I mean, you have something to hide."
Okay?
So, they will not overlook that.

Do you understand? So, the question is whether you can marry or you can change your status.
Remember you're on a COS route.
You're not married. You're not You're not married where you are coming. No excess baggage. Fair enough. But, you're not here. You're not You got married to a British national. Now, the question again is is that British national not married before at the time you got married?
If he's single If that person is single, that's fair enough.
Once you're married, you got your marriage certificate.
Then, it means you're changing from uh what's it called? COS route to spouse route. Then, there are requirements which you need to meet.
You're married. You meet certain requirements. That's number one.
Number two, look at the financial threshold.
There are some cases whereby you might not meet the threshold, but Home Office can exercise their discretion to say if you meet the um financial threshold, it means you apply under the 5-year route.
If you don't meet that financial threshold, Home Office can decide to say, "Okay, we're considering your application under 10-year route."
At least you have something.
Then again, you've moved away from wallet through to one.

So, having done the whole thing, we all left we all came back to Birmingham.
Work in Birmingham.
So, while in resume on Monday, he now came to me that the wife advised him to do extension.
Which I was like um since she's on COS, I don't know what which of the code the COS she is on.
But since she's on COS, she can um put you the the the the the the conversation you guys had earlier was you're going to move to the lady's COS.
I mean, after I marriage go back to work on Monday, the guy approached me. He was saying the lady advised him to do extension. I said, "Fine, if you're doing extension, no problem. But now, the problem Yeah, now the lady now said she has to move he has to move to Chesterfield. Which means he's going to leave this job and move to Chesterfield now on extension. I know if um because I have colleague who are on extension, they still continue to work with the organization which I work with. But now, if you have an extension, can you use an extension to look for job elsewhere?
Because now, there are a lot of people out there who have um genuine um papers and they are still looking for job. When applying for job, they will tell you what graduate are you or what visa are you on.
Now, you being on extension, I don't think there's any provision for that.
But one to me, I feel it's going to be very difficult for you to get a job with extension elsewhere. Why not continue on this job pending when you move to the lady's COS. I mean, so So, sorry. If I can get the question again, so Mr. A is on COS. To cut the short to the long story short, can you on extension look get another job with an extension?
It's a bit complicated, to be honest.
I think the answer to that is no because I currently have someone who is on extension and who have not been able to secure a job.
I don't know if home office uh per se is a rule in home office that they cannot give it to you, but I think what they the employers are are are looking is just like a way of Yeah, they look at you extension just 6 months, you are not stable. How long can you work with us? I think it's just that's the area they are looking into.
Even if you are currently working and you are on extension, you can continue to work where you are working.

They have their own right to do whatever they want.

Um have the rules changed for a 10-year route um spouse spouse pathway um in terms of obtaining um settlement or is it still 10 years up to now cuz I know somebody who first applied in 2021.
Um but again, I don't know if there's any truth to this. Um if the rules have changed that you one can apply earlier than the 10 years. Could you shed some light on that, please? Right. Okay. Now, rules under indefinite leave to remain.
Some people, if you're married to your spouse or you're British, you want to apply. If your application is under if home office decide your application under 5-year route, you maintain your 5-year route.
If your application is decided under 10-year route, you stay on the under 10-year route. But there are some cases whereby you are granted leave to remain under 10-year route, but you want to change, you want to shorten your leave to remain time of the leave to remain, for example, to 5 years. There are some certain requirement you need to meet.
Does that make sense now? Yes. Back to your question, have they changed any rule? Nothing changed. Still the same.
Okay? Nothing changed. So, the if you're married to your British spouse, you were initially granted leave 2 and 1/2 years under 5-year route.
Stay on your 5-year route.
There are some cases there are some exceptional cases whereby your 5 years can be extended to 10 years.
Don't forget.
If you don't if you do not meet the requirement to continue your 5-year route or take for instance your you're separated, you're divorced with your wife, and you have a child you have children with that person. Okay? Home Office can decide to say consider your application under 10 years. But at the same time, there are sometimes where where you submitting the application form, it will be written there, do you want your period to be considered under 5 years or 10 years?
Do you understand? So, if you meet the 5-year requirement, yes, your application will be decided will be considered under 5 years route.
But back to the question, are they changing any rule under 5 or 10? It's still the same. But whether you you meet the requirement or not, it is you that will decide.
