[00:00:12]11 days after Tusha Sharma's death, absconding accused in the case, Tusha's husband is finally now in police custody. Bhopal court has sent Samut Singh to police remand for 7 days after he was brought to Bhopal from Jabalpur.

[00:00:27]In fact, Samad Singh's police remand came a day after he made a very dramatic appearance at a Jabalpur court to ostensibly to surrender. That triggered massive chaos and confusion across the courtroom even as the court made it clear that he will not surrender in Jabarpur. Police are now investigating several key angles in the case with Samad Singh now in police custody. The probe is essentially going to focus on key major discrepancies that have come up so far. the possible potential role, if at all any, of the family members, the access to the rooftop, and most importantly, the exact sequence of events that do not seem to be adding up.

[00:01:09]In fact, in the latest, NDTV has accessed exclusive images of the terrace where Tusha's body was found inside her in-laws residence. Before we open this up and get you the uh some uh exclusive perspective about how things are really looking like, which way the co the case could actually go from here, what will the probe throw up? Let me now play out some of those important sound bites and including a ground report that's been filed by my colleague. Thank you so much both of you. Now, as things stand right now, Tusha Sharma's husband is in police remand for 7 days. There are some very glaring uh lapses that have come to light with regard to the first autopsy report, the reason why a second one has been ordered. And the biggest question of all, why is it that Sam Singh was on the run? Let me first ask this to you Vikram Singh. How do you see this probe going on from here?

[00:04:52]>> Uh good evening Gori G and Milali G.

[00:04:55]Well, you have already flagged the most significant horrible fault lines in the investigation and it was framed from day one itself. Number one, the delay in the FIR of 2 days. I for one cannot understand why the delay police should have been proactive in such sensational cases. Number two, you really have to try very hard to bungle up in this manner that the cord with which the deceased is alleged to have committed harmed herself that was left at the scene of crime. What more do you expect?

[00:05:23]I had expected a lot more. This is the essential part of an SOP and a part of investigation plan. How was it abandoned and left at the scene of crime? The scene of crime stood compromised and therefore I would say the investigation stood compromised. I'm happy that the second autopsy has been ordered because everything from day one seemed to have a a derailed investigation, a compromised investigator. And then what would you expect? And to see that Giribala called up 46 people. Yes. Not once did she call up 112, not once did she call up the closest police station or the police outpost, nor the control room. Goes to show that he was already lobbying for a defense mechanism. And to top it all, my last point, she tried to approach the salon owner, the beauty parlor owner, and wanted to know how the payment was made and how whether there's a CCTV. And when she did say that there's a CCTV covered uh beauty parlor, she sent a team of advocates. No, we have a very illustrious advocate on your panel and she would say nobody has a right to capture that CCTV footage. It is only the investigators who have a right to get the the CCTV recording. Therefore I would say not only a CBI investigation but a court monitored investigation in se to it because the accused in this case are absolutely very powerful people who have arrived in Bopal and >> they they are powerful influential people and I think that's the reason why Thesa's family has been asking for a a Delhi to actually conduct the postmortem. So it's the team that is going the postmortem is still happening in Bopal simply because it's been 12 days since the uh death of Tesa Sharma.

[00:06:58]Having said that there are two aspects now Manali Deshmok that need to be identified. One is of course the pro peray which way is it headed from here.

[00:07:07]Second are some of the other aspects that Vikram Singh is pointing out the behavior the behavioral patterns of Giribbala Singh as well as Sam Singh.

[00:07:16]Your first reaction Manali on the fact that what happens to the probe from here on which way is it going to go now that Samad Singh needs to answer that one biggest question. Why was he on the run?

[00:07:30]>> Absolutely. I think that's the most crucial question that anybody uh in authority would ask him that why was he on the run and why did he go from from Bopal to Japur and then so-called have a whole theatrics of surrendering in doubleur and that was something which was not the jurisdiction as Vam Singh would would agree with me. Now how does a probe go from here? Now you know I heard a small clip at the beginning of this program where the lawyer of Tisha was saying that they had 10 days to plant all kind of evidences to support the contentions of Giribada because what interviewed through the social media and the print and the electronic media she gave she she painted a picture of the lady being of a a terrible character who was into substance abuse who was who was a psychiatric patient who had mental health issues and so on and so forth. So to justify her claims whether this the house where it was she was all by herself and did and being a excellent judge and connection and well connected and >> knowing the law >> not only the law the connection see law most of us know but the question is the connect that she had and the way she took the help of everybody who was concerned is to cover her bases and to and to so whatever she's saying will be a she'll be able to prove that and to do it the the first needle of suspicion would have been someone so she very meticulously ensured that he ran away from Bopal thankfully and I'm saying thankfully that he was in India I I thought in the initial date when I saw it that having left the country because she could have done managed anything that was possible fortunately he was in Madhya Pradesh he was in he was in Bopal and the rest is history now how the probe will go down is going to be completely different probe. It's going to be more meticulous. It is going to be more focused. It is going to be clean thorough investigation which is required.

[00:09:37]>> How much how much will the second autopsy the CBI probe how much of that is now going to uh dictate the future course from here? He is of course right now in Madhya Pradesh police remand but there is now a CBI probe that has been ordered by the chief minister. There's a second autopsy report that has been ordered attent essentially to plug in the gaps that have existed so far. How much of that is now going to decide which way this case goes from there?

[00:10:04]>> It's going to be it's going to be very clinching because the second autopsy report would would give a more thorough report of what actually the cause of the death was. Uh the only unfortunate part and I'm not a medical person but the only unfortunate part is that it's been around 10 days after the death of uh of Kisha. So that could be a kind of a little handicap for them. Yes. But I think this investigation which would be done by the by the aids which is directed by the court would be more thorough and would be more detailed and that would throw more light on the actual reasons or how she has died because see there is a belt which is there which is nowhere taken as a part of the investigation and secondly they say that it is suicide by the belt that is also not there and the most important thing which I can see on your screen and I think that's that's what has led to it that uh the the uh the learned solicitor general of India when he says in a very categorical manner with the authority and the power that he has that it was done in a very hurried manner the anticipatory bail given was done in a very h har h har h har h har h har h har h har h har h har h har hurried manner and then >> so I think that itself I think speaks a lot about how the investigation was done earlier how things were done and now it's going to a different thing hopefully and most uh importantly >> you're making a very valid pointal dish very valid point Vikram Singh I want to understand this from you that here is a family of lawyers people you know those who understand the law fairly well they've of course meticulously planned why is it that he was on the run for 10 days why did he want to suddenly surrender in Jabalpur all of this must have been meticulously thought through and which is why it played out the way it did what exactly do you think Sam Singh may have been thinking when he orchestrated all of it and which way do you think the probe is going to go when it's going to ask that number one question why were you on the run why were you orchestrating the way you did that entire sequence of events >> Gori G there are very insidious plans to all the conspiracy that has happened some going underground for 10 days and a poulry amount of reward of rupees 10,000 summer is no pickpocket you normally amounts a reward of 10,000 20,000 on pickpockets and petty thieves a minimum award of rupees five lakhs would have been imperative. There was no will and therefore there was no way. Now there was a battery of lawyers who not only got the CCTV recordings from the beauty parlor but they were also advising them.

[00:12:37]They were browbeating the deceased family and lo and behold the shocking part is when the deceased family had gone to court they the women folk they were molested by some people there. What can be a bigger tragedy than this that first of all there's a death there's a tragedy and the women folk are insulted like this. Now the third the manner in which he surrendered on a Friday evening and Mali would be able to tell us that is a very critical time and period when the courts are about to close down so that there is no caveat there is no appeal for the next two days and then you can make hay in the weekend part.

[00:13:10]Therefore, it is a very well-c calibrated strategized surrender, so-called surrender, orchestrated surrender and then you manage to get arrested also again and outright. You surrender in a court of law that has a jurisdiction. You just can't go because you're operating in Bhopal and surrender in Kalikat. It's not going to happen that way. It doesn't work that way. You have to be wanted in the designated court. Now, in this case, you can see that an entire battery of legal minds were behind his going underground. He's appearing in Jabalpur. is orchestrating a surrender and then as people said Tushar Mati has said the solicitor general that this was without any thought or without application of mind even when the FIR was not registered Girwala managed to get anticipated >> that's a very important point you're making sir extremely important sequence of events that will now be under the scanner of the police I'm afraid I'm completely out of time I'm going to leave it there thank you so much uh Dr. Singh and Advocate Milani for joining me on this edition of the
