Uh so you know they're good. Anyway, so let's just talk about what let's tell a little history who Kodak Black is. So Kodak Black grew up in Pompo Beach, Florida.
And I bought my boat right off of um Compass Avenue in PMPO Beach. $5 million house. So it's a it's a nice area. So it's not the hood. I don't think is the hood. Maybe maybe somebody could school me on that. I I don't know. But he's he grew up in Florida, but he's a Haitian uh dude. And he wrote some songs. You heard the Cardi B song? You know, I got my bloody shoes. You know that one? He wrote a song that she sort of ripped off. It seems like anyway, but he wrote No Flocking and Skirt. Remember that one? Skirt, you know. Um, play that for me, will you, Robert?
>> Anyway, um, so he's he's riding dirty.

So everybody can kind of tune out. If you're a black guy, listen to me up.
Don't sit on the [ __ ] side of the road. If you're standing there, you're going to get DWB driving while black or sitting while black or in this case, a sleep while black. So, let's go through the indictment. He's charged with possession of some MDMA and having $37,000 in cash. Why you need that kind of, you know, why don't you just have that that that black card with you, you know, because guess what? You have the black card. Nobody can [ __ ] with you. Can't seize that, right? Give it a try.
>> You can't put it to here, though.
>> Yeah. You can't go You can't go like this with with the [ __ ] black card.
Although, it's more impressive when you just do that.
>> I don't got no money, man.
The ho ask me for money. They be like, "Let me get some money, babe." I say, "Man, I ain't got no money. That money you be seeing me with on Instagrams, that be fake money, man. That be prop money. That this is not my money, girl.
I do not have nothing."
Um so on November 24th approximately 0047 regarding multiple callers hearing several gunshots and seeing multiple numerous vehicles parked where the uh shots originated. Your fine I love how they these cops talk because this is a cop writing this affidavit. Your was wearing a full OPD patrol uniform which consisted of a black Kevlar vest with the word police. Police. Uh you got you got to pronounce that. You got to have the emphasis on that first syllable. The police on the front and back.
Additionally, your uniform has the Orlando Police Department shoulder patch that stated Orlando police. Your was readily identifiable as law enforcement officer. Okay, great. So he so there were two running vehicles. They searched the one vehicle. Now upon searching the BMW, you find located a bag in the trunk containing 56 grams of cannabis.
Cannabis is marijuana, you know. uh marked as cannabis bags and metal container containing a pink pill substance. The pill tested positive for MDMA using OPD issued Nick kit. Uh additionally in the bag you are fine located a passport belonging to Carrie Trayvon Hardy and $60 in cash. 60 bucks.
Well, two other guys, one guy had 14 grand and the other one and Kodak Black had $37,000 and this guy's riding around with 60 bucks in his pocket. The money, bag, cannabis, and MDA were placed in the OPD property and evidence. While searching the BMW, a male leader identified as Bill Capri uh approached officers and began observing uh the search. Capri is professionally music artist and goes by the name of Kodak Black.
Mr. Black, Mr. Capri, if you see the cops searching, tiptoe the other way.
[ __ ] what are you doing there? When your fiance finished searching the vehicle, they went over to the second vehicle, a green loud Lamborghini SUV that was occupied by a sole rear passenger identified as James Demetrius Twitty.
Twitty was sleeping.
Um, you know, if you're sleeping in a motor vehicle, just so you know, and you've been you just want to get in the driver's seat, just I I shouldn't drive.
just it's a it is a DUI. You're in physical control of a motor vehicle. But if you're getting all [ __ ] up and and you're sitting sleeping in the driver's seat and you got some dirt dirty dollar bills rolled up next to you, guess what that means? So Twitty was sleeping in the left rear seat. Uh next to Twitty was a white leather bag. I walked around to the rear passenger side uh to an open front passenger door. I mean, could you look any more like I think there's some [ __ ] going on here? Uh, without entering the vehicle, of course, you didn't want to enter the vehicle. Viewing from the outside, your if I could see a white powdery substance on a $100 bill on the floorboard, it should be noted that the next to the $100 bill with narcotics on it were were a pink pair of scissors.
And the same pair of scissors were seen in an Instagram post from Kodak Black with Capri seven days prior uh to the incident. So why why would you do this?
Why why would you?
I I don't know, man. I don't know. I just These aren't the smartest street criminals on the planet, are they?
>> Look at that goddamn hair. What did you do to that? It looks like a damn wig.
Are you hurt?
>> You can't do that to look at mine. You want mine?
>> Uh, it should be noted that in the picture that the two rings on the floorboard match the rings worn by Capri. Based on my training experience, you're find identified the substance to be narcotics.
Uh, I've taken a drug course, blah blah blah. So, Twitty is asleep and he's got a gun on it. He's got a gun in a holster. Dude, you know this is what happens. This is what happens when you do drugs. You don't make good decisions.
I had a case a while back. My client was charged with a homicide, right? And he and his brother were charged with the death of his brother's girlfriend. And they put her on a motorcycle and, you know, dumped her, whatever. But prior to that, I I probably could have beat that case, but prior to that, my client was sitting in a parking lot, passed out with a [ __ ] mountain of cocaine, sitting on a clipboard.
Now, tell me, what am I going to do with that? How can I change those facts? You can't. So, his goose was cooked. Um, and so Twitty is sitting there. He's got a rolled up dollar bill and he's just all [ __ ] up and he's his door is open and they're just sitting there. Cops love this [ __ ] because it's like shooting fish in a barrel. Twitty was exiting the vehicle. He reached down towards his waist and his shirt came up slightly which allowed your to see a holstered firearm um on his front right side. You can't have a gun and drugs together.
That's a separate offense. It's an enhancement. Your fire immediately remove the firearm to prevent this from turning into a deadly force situation.
The firearm was a Glock 19 9 millimeter bearing whatever seal number. Based on my training this I love this. I just love the way this is worded. Um based on my training and experience because the average [ __ ] couldn't figure this out. Based on my training experience, it is my opinion that this weapon will is designed to, or may be readily converted to expel a projectile by the action of an explosion.
I bet this guy's fun to have dinner with. Um, can you please pass me the rounds uh thing in the pan that looks uh to be almost like a turkey?
Uh, Twitty was placed Twitty was placed in a handcuffs and searched. Twitty had extended magazine in his jacket because you know you got to have yeah a ruler you know that's what they call that thing is a ruler um in his jacket pocket and 14 thou or 13,985 in his possession. The cops probably took the other $15.
Um he was read his Miranda rights and he stated he understood uh stated that the firearm was his and that he had concealed firearms license which is invalidated if you're intoxicated.
Twitter say that he had nothing inside his vehicle. Oh, nothing inside the vehicle was his. It's all that guy's.
Nope, not mine.
Even though I was [ __ ] up and sleeping. Uh TW Twitty said he won the money at the casino, but could not show any receipts besides the one dated November 14th, 2025. So, that's a little while ago. Additionally, some did not add up to the amount in his possession.
Now they they did another search of the Lamborghini and they removed the white leather bag next to Twitty and inside the bag they located 28 grams of cannabis and uh what else did they find? Uh they found some MDA and and and they charged him with possession of cannabis over 20 grams and possession of a concealed firearm in commission of felony. So you have drugs and a firearm together.
That's a separate offense alto together.
A continued search of the vehicle resulted in another bag not belonging to Twitty cuz that [ __ ] ain't mine.
Inside the bag, a plastic uh bag containing a substance later identified as FDLA as MDMA was located. The bag weighed 27 gram. So again 27 gram one.
They must have taken a hit just a little bit short of an ounce. 28 grams is an ounce. Um, inside the same pink bag, you'll find located $37,000 in multiple denomination. Also inside the bag were numerous documents with the name Bill Capri on them, aka Kodak Black. A prison identification card was located on the prison identification card. That looks really bad at trial, by the way. You got to have your prison identification card with you. Um, well, I would I would get rid of that so [ __ ] fast. The reason that that's important is because it shows ownership of the bag. So a bottle of promethazine hydrochloride which is my understand uh standing as part of lean an alcohol level of 7% was inside the bag as well.
The bottle was turned over to OPD CST for latent fingerprint processing. A sample of the contents of the bottle was taken and placed to Orlando PD property and evidence. A Frisbee was in the same bag.
[ __ ] Frisbee. You know this is serious [ __ ] When you find a Frisbee, you know what Frisbee means. And if you don't, I'm not going to tell you. I don't want to give you any ideas. Fris frisbee just means frisbee golf.
Um, and your fine uh retrieve four laden print uh print cards from it. These will be submitted for testing. A tablet was also located uh narcotics money. So now here's the thing. Kodak has had his history, right?
um he kind of popped in 2014 and he's had a lot of trouble before that and a lot of trouble since. So, let's just take a look at this. So, 200 So, he has three juvenile detention um sentences in a single year. [ __ ] Uh 2015 to 2018, multiple arrests, including probation violations and armed robbery and child neglect. In 2016, he had a criminal sexual conduct charge that he pled down. Um, in two 2019 and 2021, sentenced for federal uh firearm sentence commuted by the Donald.
>> I got the lyric. It said, "I changed my life tonight if Donald Trump reduced my sentence." He not only reduces, he pardon you.
>> All that good hard >> never been done before. Yeah. How how did that happen? Like you you in the cell and they just >> he Gemini gemini like me his birthday 3 days after my >> and I like he be vibing down here too.
>> What?
>> Committed by Donald Trump. Um and then 22 to 26 arrest for drug trafficking, oxycodone and uh trespassing. Who cares about the trespassing? So, you've got a guy who has been popular but refuses to be law-abiding.
And, you know, so he's got 27 grams, you know, one gram short of an ounce.
He's got 37,000 in cash. He's hanging out with people with guns and um, you know, I mean, what are they gonna do with this? The only you can do is send him to Spin Dry. You know, in other words, have him go to treatment and and say, "Oh, I'm so sorry." The good thing about it, I don't think we have any guns associated with with Kodak Black. That's a good thing for him. And on the large scheme of things, this is probably one of his smaller cases, but you know, [ __ ] You'd think he would be tired of this, you know? I mean, you dealt with it as a juvenile. You dealt with it. And typically, guys grow out of this [ __ ] you know? Um, you make dumb decisions.
How old is he, by the way? Just about 28. almost 29 years.
>> So he's 28 years old and he's been in he's been and out of trouble since 2014.
What does that tell you? I mean that's half his life almost, you know. Um but in all reality, I mean you hear these splashes on the news about this [ __ ] Uh he'll get out of jail and he'll do a little bit of time. I I don't know that he'll go to prison for this. Honestly, if he's got a good lawyer, all the lawyer has to do is put him in spin dry and all of a sudden, hey, I'm sober.
I've seen the light. I talked to Jesus myself and I am a convert. Lord, Lord, save me, Jesus. That's all he's going to do. Uh, on the treatment side of things, I don't mean to make fun of Jesus. I love Jesus. So, don't all you Jesus lover out there, I'm a Jesus lover, too.
So, don't don't give me any grief now.
So, let's let's take a look at at uh Kodak Black in court.
>> Good afternoon, sir. or if you can just tell me your name and your date of birth.
>> Capri, sir.
>> All right. Date of birth.
>> June 11, 1997.
>> All right. Thank you. All right. Mr. Capri, you are here for your initial appearance. You were arrested pursuant to an arrest warrant. So, probable cause was previously determined by Judge Murphy. Uh we are here for purposes of today for determining your bond and as well as conditions of bond. Uh >> so, two things they do at the initial appearance. They determine uh they review your complaint on the record.
Typically, you wave that and then they determine conditions of release and that's what they're doing here and determining bonds.
>> You do that. Is there anything um that the defense wishes to add?
>> I I do judge. I just want to point out a couple things with the arrest and the uh the affidavit for arrest. I know the PCOS are already to be found. Yes, sir.
>> Generally speaking, um I always like to make the court aware of the strength or weakness of the case because I think that goes towards the bond in this case.
Judge, this was uh this happened in November. Oh, before I get to that, we also self-surrendered uh for the court's edification. We self-surrendered. He was in California. I had him fly back specifically for this case. I was notified by the US Marshall Service um and given the opportunity to surrender him. US Marshall Service was beyond professional in this case, just for the record. Um but if you read the uh the affidavit that is attached to the warrant judge, um essentially what happened here was there was two vehicles.
>> Yes, sir. Neither of the vehicles are registered to Mr. Capri personally. An officer approaches the vehicles. One vehicle he says smells like marijuana.
He searches that vehicle, find something in that vehicle that is unrelated to Mr. Capri. The second vehicle and he doesn't even see Mr. Capri on the scene at this point. This >> So he doesn't even see Mr. Capri on the scene at this point, which means he should have just walked away.
>> Second vehicle. They then inspect.
There's one person in that vehicle.
There's two bags next to that person, both in the passenger side of the vehicle. One bag has um drugs in it and some other items. The other bag has uh what he initially says, and he doesn't put this in his affidavit. He initially says that he tests it and it tests 27 grams of cocaine, which is just under the trafficking amount of 28 grams. When he then sends it in, allegedly, it becomes MDMA. Um, so I also have his original report that says when he originally tested it, it tested his cocaine. Inside that bag, there's some items that he says belong to Mr. Capri, uh, a an identification and some paperwork. He then sends things off to get printed. None of the things in that bag come back to Mr. Capri as his fingerprints. I think there were several latent prints taken off. None of them matter.
>> So like a Frisbee, remember the Frisbee?
That's why the Frisbee was kind of important because if his fingerprints aren't anywhere near any of this stuff that isn't his, I mean, we do have the prison, you know, card Mr. Capri at that point. Then Mr. Capri uh approaches the officer um and is now on the scene, was not in the vehicle, and um doesn't make any admission that the bag is his or anything like that.
The officer then goes one step further and goes on Mr. Capri's Instagram and on one picture in his Instagram there's a picture of him standing next to a bag that looks like the bag that was in the car. Now I know PC was already found so I'm not going to argue PC but it's really screaming at me but I won't argue it. But I >> sounds like he's arguing it.
>> I mean the case law on this is so very clear and I use two very very I think esteemed cases. Um, one of them is Edund v. State and the other one is McCrae v.
State. And I'll just give you a very brief on it.
>> Right. So, let me ask you this before we get into the cases. One, has a copy been given to the state?
>> I I'll give her a copy. I'm sorry.
>> Because certainly last thing we want to do is have a hearing by Ambush.
>> I use these in a lot of the construction cases, construction possession case. So, the Edmond case is kind of an amazing case. The police raid a house on a warrant. The guy's in hiding in a closet with wet cocaine next to him in a hole that his head is within one foot of the hole. On the stove is cooking cocaine.
Next to the stove is his ID and some paperwork. In a bedroom in the house is more paperwork that belongs to him. The court found that's still not enough for constructive possession. It's kind of an amazing case and I'll give you the exact site for it, but it's Edmund. So you can have actual possession or constructive possession. Active possession is when you know take something out of my pocket. I had full dominion and control over it. Constructive possession is by the totality of the circumstances that you possessed uh dominion and control over that item. So you can say um I wasn't home at the time but the cocaine was found in my house and it was my house and it was on a table and that's an area that I have dominion and control over. So you can say I have con I'm constructively possessing that cocaine >> v state and the state has a copy of it.
The other one is McCrae in McCrae.
They're pulling a guy over. They pull him over. He jumps out of the car and makes a run for it. As he's running the officer sees that he's playing with his waistband and makes a throwing motion.
He puts him down on the ground, arrests him, and tells the other cop, "Hey, go back and see what he threw." They find a baggie of cocaine, no fingerprints on it. They print it, no fingerprints on it. And the court says that's not enough for constructive possession. Those cases are so much closer to constructive possession than this case. And I would just ask the court in considering a bond to look at the case to look at the >> So the two cases that he just cited would not hold up in federal court. I'm just saying. Um, but you can see where he's going with this. So, they'll file a motion to suppress and a motion to dismiss based on those two cases.
>> Um, the affidavit that's with the case.
And I understand that the t the typical bond on this is $50,000. I'm asking for a $10,000 bond. Um, I I I on my way here on the train, I was typing up a motion to dismiss. It's just there there is not enough here. I get >> and I'll and I'll stop you there. I mean obviously you know that the motion to dismiss is for another day. We're here for so for the sole purpose of judge >> uh determining bond and conditions of bond. Your client >> and I appreciate judge and uh he is he is a a proud Haitian American but he is an American. He has a US passport. Uh he doesn't have any plans on leaving the country. Uh, I I wouldn't I mean, we've faced cases that are 10 times this case, and I've won, by the way, but we'll put that in another bucket, but the fact that he's a rapper doesn't give you a a legal purpose to raise the bond. So, I would still ask for a $10,000 bond, judge.
>> All right. Well, I appreciate all the argument. Again, Mr. Capri, you're charged with trafficking and methamphetamine or MDMA uh more than 10 grams, less than 200 gram. That is a first-degree felony. Uh, again, you are entitled to a bond. So, I am going to give you a bond. I have considered uh the strength of the case as well as everything that was set forth in the arrest affidavit. Um I understand the arguments presented by your council. I think one of the things that was left out was uh well, you weren't necessarily claiming ownership of the bag.
You were requesting that the funds within the bag be turned over to you.
So, there at least is some tie seems like to the court to that bag.
Nonetheless, um >> Oh, he requested that the funds in the bag be returned to him. Oh.
That's my money. Those are my drugs, but that's my money.
>> Um, I think uh in terms of bond, I am going to slightly increase the bond. I think based upon your uh not the fact that you're a rapper. I think that has no binding. But the other factors that the court considered is your prior criminal history, including 12 uh prior felony convictions.
>> 12 prior felony convictions.
They add up fast when you're [ __ ] around and finding out. two misdemeanor convictions, one failure to appear. That was quite some time ago, so I'm not giving a a ton of weight to the failure to appear, but I think an appropriate bond in this case would be $75,000. So that's going to be what the court sets the bond.
>> So the so they set bond at 75 grand. So he's got to come out 10% of that $7500.
So So that now what's the next step? The next step is to have a hearing on the motion to dismiss. And it's not going to go anywhere. I mean, there's enough to get to trial at least at the very least.
>> Look at me. Hey, I don't stay in projects anymore. I'm not a project baby anymore. I'm a suburbs kid. I'm a suburban.
>> I'm a suburban dude.
>> Um, so he's a suburban dude now. He's not a project baby. Um, although Pompo Beach I it's a nice area. I But maybe they do have a you know a bad area. I don't know. So, it's a firstdegree felony in Florida. I mean, the maximum, I think, is 40 years.
So, he could get a lot of time, you know, on this, but I would venture to guess he'll get some time, but they'll spin him dry and and uh and he'll he'll get probation. But although although although his [ __ ] history is so bad, you know, they you heard the judge say he's got 12 prior felony convictions.
one one alleviated by by Donald Trump who commuted his sins.
I wouldn't you get sick and tired of this [ __ ] after a while, you know? I mean, in and out of jail, in and out of trouble in, you know, waking up doing [ __ ] drugs constantly, you know? The one thing I don't get about drugs is and people who do a lot of drugs don't really put a rational thought to the way they're doing drugs or the way they're living their life. So, just the fact that you're a rapper, popular, a lot of money, um, doesn't mean that you're not falling victim to your old lifestyle, you know, it takes your money, takes your health, takes your freedom, but god damn it, I have to have more of it.
