[00:00:00]The problem is he lost that argument in the trial court. He lost that argument in the court of appeals and when he had an opportunity to raise it again, he failed to. So, the courts ruled that he waived it and can never raise it again.

All for something I said that I had the right to say as a senator, as a veteran, but most importantly, as an American. Yeah. So, Glenn, it appears from, you know, yesterday that they're leaning I don't know when the ruling is on this, on the the Mark Kelly's talking about?

[00:01:58]Yeah, so that he won a preliminary ruling and now he's waiting for the court of appeals. Steph, I have a $1 betting limit. I'm not a high roller. I'll put the full buck on the court of appeals affirming. This case is going nowhere and with every loss Donald Trump gets weaker. Yep, and I loved I loved this that he ended with.

If you say something that the president or this administration does not like, they're going to come after you. President is trying to silence us and I can't think of anything that's more un-American. And that openly uses profanity on holy holidays.

[00:03:13]>> [laughter] >> So a panel of federal judges yesterday blocked Trump from imposing a 10% tariff on most US imports dealing it another legal setback to the White House in its efforts to tax foreign goods and wage trade war without the express permission of Congress.

[00:03:27]Uh, I I I don't Can you explain this to a layperson? I Didn't he already lose at the Supreme Court? Yes, he lost on a different kind of tariff that he was trying to impose. Um, but you know, and I can explain it very simply that Congress has the power to levy taxes and tariffs are taxes. End of story. So much losing by Donald Trump.

[00:03:52]Okay, so much losing. Can we all right, let's can we talk for a second? So DOJ will ask the Supreme Court to allow it to step in on Trump's appeal of his verdict in the E. Jean Carroll case, a move that would doom Carroll's case. It would require just dismissal of the case because the federal government can't be sued for defamation. I once again, I really don't get this.

[00:04:12]Someone else said two juries found Trump liable for sexual abuse and defamation, 88 million in judgment. Uh today is Trump's DOJ asked the Supreme Court to make us pay it. His argument calling E.

[00:04:22]Jean Carroll a liar was part of his official presidential duties. The Supreme Court he stacked will decide.

[00:04:28]And and it's even worse. I mean let let me let let's not bury the lead. Donald Trump will lose this one again. So and here's what it boils down to. If you act in your official governmental capacity, then if you're sued, the Department of Justice can come galloping in. They can become the defendant in the suit and you get pushed out of the suit. The problem is he lost that argument in the trial court. He lost that argument in the court of appeals. And when he had an opportunity to raise it again, he failed to. [00:05:36]It means I I think the Supreme Court will probably get this one right. And again, who loses? Trump loses. So, you know, that this is all kind of a part of a theme that is emerging. Trump gets more desperate and he still has a judge or two on the federal bench across the country, Aileen Cannon types, who are willing to say, "You know what? The heck with the law. I'm just going to do whatever Trump wants me to do ideologically." But listen, the Supreme Court is even This was Alito who put this pause on. And I mean, if you're starting to lose with Sammy the Bull Alito, you got real problems.
