Citizens have the constitutional right to record government activities in public spaces, and local ordinances that prohibit such recording cannot supersede the United States Constitution; when police attempt to enforce unconstitutional policies, citizens can assert their First Amendment rights and refuse to comply with unlawful orders.

Do you know how it's going?
Hello.
Hey. How can I help you?

You guys really have it uh dark where you can't see anything in here.
Yep, it's for your protection.
Yeah. So, I'm just going to get some uh public records Yep. Are you recording?

I'm sorry. Are you recording? I make it obvious. Okay.
One moment. So, now you can be on your best behavior, okay? Okay.
Do the right thing.
Here we go.
Hi, sir. Hey, how's it going? Good.
Well, how are you? Are you guys here to help me with my public records request?
>> Sure. What can we help you with?
I need to submit one with you guys and I think I get it within a reasonable amount of time. Okay. Are you recording?
I am. Okay. I'm going to have to ask you to step outside, okay?
>> I can't document my public records request? Well, you can document on my camera, but you can't film in the lobby here. Have you read this before? I don't need to read that. Have you read it? I don't need to read Can you step out with us?
>> Can I Can I speak with a uh American-loving patriot, please? Do you guys have those here?
>> Can you step outside?
I don't speak to communists. Can I Who are you, sir? My name is Corporal Donnelly. Nice to meet you, Corporal.
And who are you? Sergeant Racine. You're a sergeant? Yes, sir.
So, you haven't read the Constitution.
I'm asking you to step out of the lobby.
You can't record in here. Why be Am I being trespassed?
If you're refusing to leave, you will be, yes. I'm not refusing to leave. I just trying to document my lawful business.
Well, but you can't request for body cameras.
But, I'm here to submit my records with with them.
>> take care of of that, but you can't record in the lobby. You're going to have to step out.
>> Why is that?
It's right on the door.
>> [snorts] >> Yeah, but it says on the first In the First Amendment, we can observe our government. We can I'm press.
I'm here on official business.
>> says different. Well, does the ordinance supersede the United States Constitution?
>> Can you please step out?
Do you believe in the constitution, Corporal?
>> I do. Okay. Do you know Are you aware of the First Amendment?
>> I am. Are Are you aware of the First Amendment, ma'am?
Yes or yes or no question. I'm just asking. I'm not going to ask you to define it. Just if you know. Okay.
>> please step outside? I I I will in a moment. Um is that a lawful order though? Or is that a request? Or just to be clear.
>> you to step outside. Is that a lawful order or is that a request?
There's no recording. So what I'm saying to you is if you're refusing to leave the lobby >> I'm not refusing. we're going to trespass Okay. What happens when I get trespassed? Then if you refuse to leave after that you will be placed under arrest. Okay. Well, I won't refuse at that point. I'm not refusing now.
I just want to be able What was the What's the big deal about recording inside of a public lobby? I do this all the time in public lobbies and police departments and city halls and DMVs and what have you. So what's what's different about this place? What makes this place special or more tyrannical than you know, North Korea? We can have this whole conversation outside.
Am I being trespassed at this point? Not right now, you're not.
Okay. But I am asking that you step out.
If you're requesting, I'm just appreciate you being respectful. You're saying it a respectful way, but respectfully I want to decline any request that you make regarding going outside. Okay. Then I need you to stop recording.
Is that a request? No.
Am I being trespassed? Are you refusing to stop recording? No.
Okay. It sounds like you want me to ask you that several times.
>> Well, can you let me know when I'm being trespassed? Because at that point I will leave under threat of arrest. Okay.
So can you let me know when I'm when we're at that point?
>> to continue to record right now?
I'm asking you I'm asking you a question. What >> I'm asking you a question.
If I don't leave right now, am I being trespassed? I'm asking you to step outside. We can have this whole conversation outside. I mean, what's the time frame?
>> in here.
>> [snorts] >> But what's the time frame that I can be in here recording until I can't record?
>> to step out. right like like right now.
Yes, step out. Is that a lawful order?
Step out.
Am I being trespassed? Step outside. Am I being trespassed?
Step outside.
Okay, if I don't step out just to be clear, okay? Just want to be very clear.
If I don't step out, will I be arrested?
Can you break through that door a little bit?
You want me to go through it? I just want you to see this.
And listen, I'll I'll leave under threat of arrest. I just don't want to leave willingly, you know, without without that so I can take it to court. Okay. Okay.
>> Fantastic. So, I need you to step outside and stop recording in here.
Okay, I will once we get to that point.
Might might be in trespass.
Okay. So, if I don't leave right now, I'll be under arrest. If you don't leave right now, I'm telling you you're going to be trespassed. Are you refusing to leave right now?
>> No, no, I'm not. I'm not. So, if I if I don't leave right now, am I being trespassed? You're being trespassed.
Okay. So, just walk me through the process one more time.
Once we get to that point.
>> We're at that point.
>> Okay. And if I don't leave, so I'm I'm officially trespassed currently, correct? That is if you're If you don't leave now.
>> Okay. Okay, so if I'm currently trespassed, if I don't leave now, I'll be under arrest. Okay. That's all I needed to hear.
You'll take my request outside? I will.
Hello. Thank you, brother.
You sure you don't want this?
You want it, sir? What's that?
>> You want this constitution?
What record can we assist you with, sir?
Um >> [snorts] >> I'm going to need to know how much this costs right here. Video and audio recording in the police department lobby is prohibited except for law enforcement personnel in their law enforcement capacity.
The cost of the decal, yeah, on the door. How much it cost taxpayers to put that sign on there we didn't want?
Also, Can you give me just a 2 seconds so I can write it down? Yeah, sure. Go right ahead.
Now, is it just the lobby or is it the entire property?
And why is it just the lobby?
You're just following orders.
That's what the Nazis said when they were unaliving Jews.
Well, I mean All one request.
Please.
All right. Next one would be How many people so far have been trespassed under this constitutional ordinance for recording inside a public taxpayer-funded lobby?
And who who were the officers involved?
And how much money the city has spent on trying to uh fight back on those challenging the ordinance.
I'm curious how much the city has spent in attorney fees and whatnot to try to drag this out in court and stuff with multiple people. Yeah, and all that.
Um the first and last names of all public employees, law enforcement officers, receptionists, front desk, whatever uh for fiscal year 2025.
Of all public employees here for the police Longwood Police Department. I do have another request.
It's not specifically this kind of request.
But I want to know You know what? Actually, I I do want to add a couple more things. I want to get your your sworn oath to the Constitution as well as um sergeant over here.
Corporal.
Yep. Corporal, yep.
As well as I want to know, I don't know if this is possible, I want to know who Is there anybody who still works here in law enforcement that has expressed any sort of disagreements or has presented any sort of challenge to this unconstitutional ordinance.
>> know if you would get that out of the public.
>> I don't know if I would either, but thought I'd give it a shot anyway. If you want to write that down just to How about this? Any responsive records Okay. relating to public officials presenting a challenge to in relation to the ordinance for this year 2025.
For fiscal year 2025 or calendar?
Fiscal. Fiscal. And also the ADA Title II coordinator.
ADA Title II coordinator? Any names of anyone who's on the Brady list?
Names of the Brady list? For >> For Longwood? For Longwood. Yeah, everything's going to be for Longwood.
Uh let's see what else.
What's the uh sergeant's name that was that kicked out the last couple folks that were here?
What's his name?
>> He's a >> see what he looks like, I can't He's got gray hair.
I would recognize it if you said it.
What's another sergeant?
>> you all the sergeants' names. You know that. We got Bryant, Racine, uh Gelm, uh Finch. I think it's Gelm. Gelm? Okay.
Yeah, I want his disciplinary record, please.
>> Sergeant Gelm's disciplinary record? Oh, and also the people want to know when was the last time this department has had a training on the First Amendment? I can make that as well.
So, was it just Chief Daughtry that wanted to pass this ordinance or was it like everyone kind of got together?
There were certain complaints coming from within the department that pushed him or kind of compelled him to want to you know, move forward with that.
Nothing happens in the police department without the chief.
But was there was there anybody that Is there anything leading up to that as far as you know that that within law enforcement?
recall. Okay. Do you agree with the ordinance yourself? Can't say if I do or not. Can you comment on that?
You're not allowed to or you just won't?
Not allowed to. You're not allowed to.
Is Chief Daughtry here? He is not. Okay.
When will we When will he be here next time?
>> Uh that's a good question. They're all at a funeral right now. So, if I'm being totally transparent >> funeral? Here in Longwood? They are at a funeral. I don't know if it's here in Longwood. If that I can't answer. But I know they're at a funeral.
Um can I schedule an appointment to uh have a chat with um Daughtry, please?
You can. I would suggest that to email him. I don't make his appointments. So, I can't say that the chief has to make an appointment with you. That's I'm a corporal, he's a chief. Okay, there's no way I can do that in person while I'm here or is that something I just have to call in and and >> either call his secretary or email him directly and see what you can set up.
Again, if it comes from me, he's going to go, "Yeah, I don't have to make an appointment because Corporal Daughtry told me to." Okay. And this is consistent with anybody who comes in here recording, they're going to be trespassed. That's that's the protocol that you guys are going to go with every time. Yes, sir.
Does your conscience allow you to do that? Does any any issue at all with that?
I don't know. I If I were in law enforcement, I would that would make me lose sleep at night if I was That's what I'm saying.
That's it for the records. My only other request I was going to say earlier was to um you know I would encourage you to honor your oath.
Just honor your oath. Tell Chief Daughtry like, "Listen, I I'm I I'm in good conscience, I can't be kicking people out of here for exercising their First Amendment rights. It's constitutionally protected and you can't convert that into a crime.
It's going to cost this town a lot of money. I'll listen to you. And I'm probably not going to be the last one coming in here. Just to venture out venture and say that, you you know, I'm not going to be the last one coming here and and uh trying to document my my official business, which is legitimate business or um whatever, so.
>> What I'm going to do with your request, I'm going to send an email to our records department, and then I think it takes them 24 to 48 hours turn around to get it. Right, that's a reasonable amount of time for them to get the records. Okay.
All right, and also your body cams, I'm sorry, your body cams as well for for today. Okay. Today's date.
That should >> For this interaction?
Yeah, anything related to this, yeah.
Today.
>> That'll be it.
All right, I don't want to call you Mr. Troll, but that's what you gave me, so That's fine, you can call me Mr. Troll.
And then can you make me a copy of that uh copy of the what you wrote down there? Yeah, you want a copy of this?
Yeah, just sign it real quick.
>> you can't I can wait here. You want it right now? Yeah, give me just a minute.
Did you want to provide any information to us as far as your identification or anything like that? Of course not. Um that press pass would be valid for 1 year.
1 year.
Yeah, I value my rights, my first amendment, but also my fourth amendment, so yeah, I wouldn't give up my personal identifying information without any kind of crime involved relating to me.
So if I go around the back and record, I'm not going to be hassled out there, am I?
I got to imagine there's got to be at least one cop here that has an issue with this ordinance. I mean I used to think cops especially provided that they No fair, you get the shade over there.
Can I switch places with you? You sure can, we can both use it.
Uh you know, you guys all swear an oath to the Constitution.
I don't know, I it would just bug me to not uphold the Constitution.
Cuz you guys didn't swear an oath to policy uh to procedures or an ordinance even.
You know?
It should other other cities, other towns have had the similar ordinances and they end up falling apart at some point.
You know? I would love to see a hero inside the police department stand up and say, "Listen, um this is wrong."
And maybe, you know, make it known.
Something.
I wish you the best of luck if you can read my chicken scratch. Hey, it's all about whether you can read it or not.
>> I can't. Cuz if I if I were to write it, you you could later go back and forth.
Yeah, be like, "I don't I can't read this." So, that that's fine. As long as as long as you can read it.
Okay. Let's get a shot of this.
Um is there like going to be When's the next time Is he an elected official, the chief? No. He's not elected? He's appointed? Oh, crap. That's right. Yeah, sheriffs are elected. How much longer does he have?
>> He's not a sheriff. I mean chief. Sorry, chief.
>> That's it's not it's not a time frame.
It's he's at the will of the city council. So, essentially they meet every 2 weeks and give the yay or nay. Not like officially, but if he's not terminated, then he continues on for another 2 weeks. Kind of how it works.
Well, tell Chief Dowda, please, that Zach >> see this, so >> Tell him that Zach or Mr. Troll said to honor his oath and stop being such a tyrant. Okay?
>> Zach? My name's Zach Troll. You can call me Trolls or Zach Troll, whatever. It's what people call me. Shane I'm Zach. You can call me Zach, that's fine. Um but yeah, tell him to stop start honoring his oath and stop being such a tyrant.
Okay? Tell him I said that.
>> Okay. All right. You can just be the messenger. I don't think he can fault you for that.
All right. All right, Zach. Have a good day, bud. See you.
In this video, our auditor heads into the Longwood Police Department lobby in Florida to submit a public [music] records request and instantly runs into a brick wall. Staff and officers try to stop him from recording, citing a city ordinance [music] that flat-out bans video and audio in the lobby except for law enforcement. The kicker, this ordinance is straight up unconstitutional. From the start, the tension is real. Officers repeatedly ask him to step outside, threaten trespass, and try to intimidate him, yet he stays calm, clearly stating he's exercising First [music] Amendment rights. He's on public property, documenting public business, and asking for records. The officers dodge questions, refuse to cite law, and insist [music] on enforcing this ridiculous rule while the auditor points out the Constitution sitting right there in their lobby. Throughout the encounter, the auditor presses for details. How many people have been trespassed under this ordinance, officer names, disciplinary records, and even cost of the lobby signage meant to stop recording. The officers give [music] vague answers, avoid accountability, and lean on just following orders. Classic bureaucratic overreach. By the end, he's officially trespassed, but it's clear this is a First Amendment clash. No crime was committed, yet the city is wasting time and taxpayer money enforcing an ordinance that doesn't hold up legally. The video exposes the absurdity of city rules trumping the Constitution and highlights why public oversight and [music] recording government activity is essential.
Hey guy.
Can I talk to you a Hey.
Can I talk to you for a second?
You say who?
What about me?
I can barely hear you, man.
Can you come here for a second?
You want me to cross the street?
How you doing? Hi.
It's going on? 113, go ahead.
Yeah, we have a wanted the bank. We have a suspect with the description. Suspect?
A what?
I'll explain it to you. Okay. So, there's a guy or the bank called said you were out here filming the bank and cars is here. They were just kind of wondering what you're doing. I was just recording in public. Okay. Peacefully. I haven't even spoke to nobody. Perfect.
Is that I heard you say suspect? I'm like suspect of what? Sorry. So, no, like just making sure that you're not like casing the bank or anything like that.
Come on, man.
>> Hey, crazier things have happened. And and I I don't think those are That's not even a black man's crime, man. They'd do like a liquor store or gas station for $20 before they actually go to like a bank. Right. You know what I'm saying?
I'm just recording, you know? It was cold this morning. It got a little better. Still got a little chill to it, but this is a little bit more of my weather if you got to walk. You know what I'm saying?
>> Got you. But yeah, man, I'm not on nobody's property. I'm just We're just recording in public if that's okay.
Okay. And who are you, sir? I'm Lieutenant Malcolm from police department.
>> A Lieutenant who, sir?
>> Malcolm. Do you have a business card?
Not with me, no. You don't have a business card?
>> No, I don't.
To to Okay.
But And you you a sh- you're in the sheriff's department?
>> with the police department. Okay, yes, sir.
Um do you have your ID I can see real quick and I'll get you on your way?
Here.
Right here. Okay. Do you have an ID I can see real quick and then I can get you on your way? Did I commit a crime?
Hm? Did I commit a crime?
You were called in as a suspicious person. I have the right to ID you, man.
But but but for wh- for what crime though, sir?
You were called in as a suspicious person. I have the right to ID you, okay?
Would you like to Can you read this for me real quick, please, sir?
Maybe this will help you out. This will help you out.
>> Mhm.
Yes, sir.
>> Okay. What's going to help you out is giving me your ID and I can get you on your way.
Can I get like the chief out here or some maybe like your supervisor, please, sir?
Cuz I don't want nobody to make a mistake or anything like that. 114 113.
I thought this would be like real simple. It is. Yes. I was just trying to show you this.
You 25 with me.
Uh the front of the bank.
The right of the people to be secure in their houses, papers >> Yeah. Mhm. and effects. Mhm. You need reasonable ticketable suspicion of a crime to to to to get my ID.
>> I can identify you right here. Okay, I just identified as good citizen. Okay.
If if if if that's okay, we >> No, that doesn't work for me.
That doesn't work for you.
>> I need a government name ID, all that good stuff. So Are you one of those?
This is something so basic.
Right. I agree with you. It's really basic. Yeah, yeah, I mean You can just hand over the ID and we'll get you on your way. Yes, sir. You got a you got a guy standing in public conducting a First Amendment protected activity.
You know, holding the Constitution. By a bank That that that that that called you in.
>> But but listen, sir, they don't mean anything. You supposed to go educate them like, "Hey, he's not doing anything wrong. He's in public. He has a right to record."
>> standing.
I was standing in public, Officer. Did you want to go speak with them first?
One another unit here. I would That that would have been good. I waited for you to get here. Mhm. [laughter] Yeah, I was just standing in public, sir. I was actually standing right there. Is it if that's if that's a if that's like a public alleyway? Just right here.
Yeah.
And your name one more time cuz you ain't have a big Usually I get the business card and I can just You got like a different name. Mhm.
Wow, man.
You must do this a lot. Is there a bonus for getting the ID?
Is it? There's no bonus, man. So why do cops push it so hard to get the ID? You just talking to a good citizen, sir.
Okay.
You're a public servant. I'm a private citizen. Un- unless I'm suspected committing a crime. They just scared of someone just having a camera. But that's where you and your knowledge You said you were a lieutenant.
>> Mhm. You supposed to just come in educate them, sir. I wish you would have went I don't know where you were standing.
All I'm doing is asking for your ID.
Yeah, yes, yes, sir. I'm just It's that simple.
>> Yes, sir.
Would you like to go speak with them now? I'd be happy to. And that's my boss right there. Yes, sir. How you doing, sir? Good. How are you? I'm I'm fine, man. Nice firm handshake, man. So, what is your what is your your shield? Like, what is your rank? Uh operations commander is what it's called. Yeah.
>> Commander. Yes, sir, man. How are you doing? My first name's Troy. Uh I'm doing okay.
Uh well, I thought I'm just in public Mhm. recording conducting a constitutionally protected activity. Mhm. I haven't even spoke with anyone. Yeah. I've been standing in public. Has anybody come out and spoke to you? Nobody Nobody said nothing to me, sir. Okay.
So, uh this gentleman pulled up. I was standing I was I was walking. There's no sidewalk.
He told me to come to him. I did. Mhm.
And I I shared with him just what I'm sharing with you. Mhm. Uh where I requested for you, he's demanding my ID.
And I asked him, "Did I commit a crime?"
He said, "You haven't committed a crime." He said, "You just got called in for suspect suspicious activity." And I'm like, "Sir, I'm just recording. I'm I'm I'm holding the con I'm asking, "Do you Would you like to read the Fourth Amendment?" No, he don't want to read it. I'm sure he don't even know it. Cuz you wouldn't be demanding my ID. Fourth Amendment is for me to be secure in my persons, papers, houses, and effects.
And I'm very peaceful, sir. So, do you have a business card on you? I don't, but I'd be happy to like repeat anything you need. Unfortunately, as you can see, like I'm supposed to be sitting at my desk here. Do you have a pen on you and a piece of paper? Nope. I don't even have that. Not even in the car? No, I'm supposed to be sitting at my desk typing right now.
>> Well, for the record, for my camera, can you state your name, your rank, and his for me one more time? Cuz he's he's acting a little Yeah, so I'm Operations Commander Troy Shedel. And that's uh Patrolman 10, Nick Goff. And do you have a badge?
I appreciate you being professional so far, man. You just never know how these turn out, man.
That's why I called you here. You know, and when I do my recordings, I'm always in public. And it got so bad now >> You called us here? I didn't call you guys here.
>> Oh, I got I got I must have misheard you cuz you said that's why I called you here.
>> No, no, no, no. Oh, yeah, I requested for I requested for his boss. Oh, okay.
>> Because I don't want him to make a mistake. Officers make mistakes, man.
You know, and I hold the Constitution so they won't make a mistake. When he's demanding me for my ID, I'm like, "Do you want to read the Fourth Amendment?"
He say he don't want to read it. He say, "Just to get you out of here I I just need your ID." You know? I I want to if I can exercise my Fourth Amendment right to be secure in my person, papers, housing, and effects. I asked him did he have RAZ?
I should have asked him, "What What do RAZ mean?"
Reasonable articulable suspicion of a crime.
Just, you know, to see cuz I asked him, "Is this what you do? Do y'all get bonuses for getting IDs?
Is it a bonus?"
No, I think probably what happens is like if you're standing outside a bank with a camera, people that work at a bank like have procedures. I'm guessing. I don't work for the bank. I don't know. I don't know these people at all.
>> Yes, sir. Yes, sir.
>> Uh but I would guess like if you were taking pictures outside of a bank, that causes them like some measure of alarm.
And whether that's right or wrong, like >> Yes, sir. And that's what I was telling him.
>> Maybe if they would have came out and asked And I'm not saying they called. I don't know. They Oh, they called and and I was That's what I was sharing with this guy. I didn't mean to cut you off, but that's what I was sharing with him.
I said, "Did you want to go speak with them first?" Because once they told you the story and told you where I was standing, with you being law enforcement, with your knowledge, you'll be able to educate them like, "Hey, he's in public.
He have a He have a right to record in public."
>> And I mean, so much of our job is is the educating of people like of the thousands and thousands of calls that we get in a year, how many of them result in like arrests?
Mhm. Uh you know, some of them but definitely not 18,000. Mhm. A lot of them are Yes, sir, man.
>> for education and engineering just to improve public safety, so You You way more chill than him, man. I tell you that. But that's probably why you're the boss. Yeah. I just got back from lunch and I'm tired.
>> [laughter] >> Oh, so you sleepy.
Yeah, man.
If I tell you what's going on, would you let Wait and see how your partner going to play this out?
Say that again? I'm sorry. No, no, no, let's just see how your partner. I was I was I was about to share something with you, man.
Yeah.
I'm just teaching right now, man. I go around teaching.
Public, law enforcement, everybody.
>> Yeah. What What What year is it? Right now? Right now. 2025. In 2025, where can you go and you're not being recorded?
Uh you know, that's a fair question. I'm sorry.
>> We live in a glass bowl, man.
>> Yeah. The moment you leave your your house, you're on camera. From the doorbell rings, all the further you get away from home, you're even more on camera. I don't see you guys with body cam footage or any body cameras. Hey, he doesn't have one.
Let's see what he say. Just just sit back. Let's see how he's going to escalate this, man.
>> have time to put mine on, man. I apologize, but you're recording, so it's all good.
What you got for us? I got I got to talk with him for just a minute.
>> We just in public. I might have to sit in the car for that.
I wasn't going to sit in the car, but I'm going to walk over there.
>> Okay. I may I may walk over there.
>> You're not You're not walking over there. I I just I'm just going to be in public, man. Just walking back and forth in public. Okay. So, don't walk over where I'm standing is all I'm asking. Is that a lawful order?
>> Yes, it is. Okay.
He said that's a lawful order to not walk in public.
>> Yo, you know I I I just I you know when when I do that because I show people lawful orders and unlawful orders. Cuz the whole thing is and before you get out of here, sir, can I please get the call for service number for here, the CFS? Mhm. Please.
That's why I was wondering like why did he pull you to the side? I was looking for you guys body cameras. I'm just going to pull the body cam footage. So, when you talking secrecy and all that I I I don't get it. Right. And there's nothing secret about it per se because it's going to be recorded as you pointed out. So, if you foyer that Absolutely.
gives you that. You'll know exactly what we said. Absolutely.
13705 13705 Is nothing in front of those? Two, there you go.
And and the thing is this I want to share it with him, man. It When you leave, I want to just share something with him and uh and then we we all just 10-8.
Sure. Yeah.
All right, you can 10-8 and I just have a brief conversation. He'll probably share it with you.
Let me get out of here. Would you like to inform him of the things we spoke about? Okay. All I was talking about with him is you'll find out when you you foyer If you don't mind me just standing right here. Now, if you can stand right here, you look better on camera. That's the first time I've heard that. So, all I was saying to him is like uh whatever he spoke to them about >> Yes, sir. um it was exactly the concerns I think that we were both both alluding to is like it's a bank, so they're concerned, but they feel better now. So, they're been they've been educated and informed.
Sorry, the traffic's very loud. So, >> they've been educated and informed, and then the other half of that is that we just passed along some education and information to you, which is as you pointed out, you're not doing anything wrong as long as you don't go onto the parking lot property.
>> No intention.
>> there like close to their windows or anything like that that disturbs their occupation.
>> man.
>> Then you are just perfectly golden. Yes, sir. And that's it. And that's all I wanted to >> And what I needed to share with you And one thing I realized and I uh I I definitely think you probably would have to have another conversation with him. You're going to You're going to see my video.
I can just see in maybe other calls where this guy can just escalate it to something. Cuz I say this, when you get a call by a guy just recording in public, nothing's going on. But what he was doing is he's escalating. When y'all was taught to de-escalate, he's so he's so locked in to search for a crime, he's going to be the one end up committing the crime. He's going to be the one doing the violation. I'm aware that they take this out of school.
Not just this, cursive writing. You have any children? Like in elementary or anything? Yeah, I mean, far from learning any of that. They just ask it They just have them write their name and you know, they take cursive, they take the Constitution. How important is this to you?
Yeah, and the cursive thing like that's got to be kind of long gone by now, right? Much less 5 10 years from now.
>> You know, and this is just one of the things that I come to the conclusion of cuz it can be many reasons why they taking Why are they taking the cursive writing?
You know, I heard and I come to the conclusion is uh AI can't read it.
So they just taking it out all together, but I still try to teach mine and hopefully everybody's teaching theirs, too.
>> I hadn't thought about the AI thing.
That's kind of Yeah, and yes, sir. But man, I I'm very polite. I know how officers feel about guys that just record in public. I do it in a very respectful way. I typically give what I get and I just felt like the other officer, he was about to really force it, maybe even put put in cuffs or detain me to get that ID, man. When that would be unlawful and it just make y'all department look bad when that's not what I'm here to do. I'm actually here to highlight my government official in the course of their duty. Now, whether you look good or bad, that's going to be 100% up to you because I'm not going to provoke you. I'm not going to do any of that cuz when you ask me for my ID, I turn to the Fourth Amendment and I say, "Hey, do you want to read this? Maybe it'll help you out."
He won't want to read it. And it's okay.
A lot of officers never want to read it.
Only two chose to read it out of 100.
So, you know, and there's nothing wrong with not reading it if you I guess if you know it, but I challenge him. I don't think he know it, man.
Uh if you don't mind me asking you just couple more three questions before I get you out of here, man.
Uh what is 27 minutes to 7:00?
I don't understand that question. But What is 27 minutes to 7:00?
I'm not sure what you're trying to ask me.
You're trying to get me What time would it be? 27 minutes to 7:00 p.m. What time would it be? I'm not going to entertain that. I think you already know the answer to that one, but I mean is there like a a question related to what we're talking about here? No, if if I can if I can share that with you. I didn't even get to get there with him. Okay. Because when y'all get these phone calls, I'm aware that you have a task list you got to go down. And with me and I deal with law enforcement all around, I deal with so many law enforcement when they go through their task list, it make you feel like a robot to me. So, to take you out of robot mode and reset mode, I like to ask thinking questions, man. It's just just a small critical thinking questions and I tell people share them. Share them with your fellow officer, man. I think they kind of They they just great thinking questions, man. The >> [clears throat] >> The The other question I was going to ask you is and these are just thinking questions. What is 550 divided by two?
550 divided by what? Two.
I don't know. Half of 550 and half of whatever you said.
Yep, these are just thinking questions.
Whenever you do look it up, pass it along, man. These are thinking questions, man. That's all. We can just wrap up out of here. 10-8 and uh just stay safe out there, man.
>> to try. And uh just have another I would still have another conversation with the guy. Maybe after you see the video, you can probably see and feel it a little bit more. And Is there like a like a channel I would go to to watch or anything like that where you where you post your information?
I You To me, I think you was doing a A+ would not you down to a B is when you gave me that unlawful order to me don't follow you, man. But you going to find the video. I swear to God you're going to find it. Well, you're welcome to message us on social media.
>> If I had your If I had your business card, I typically send it to you. Right.
You know, directly, but but you you you going to find it. I promise you every officer does. But definitely stay safe, man. I come in peace. I don't antagonize anybody, man. Everything is natural.
Everything plays out how it plays out.
So. All right, man. Yes, sir. You take care, man.
In this video, we see a citizen peacefully recording in public near a bank minding his own business. A completely lawful First Amendment activity. Suddenly, police show up acting like he's a suspect demanding ID and questioning him about suspicious activity. The situation is tense. The auditors repeatedly ask if he's committed a crime, but there's no evidence, no probable cause, just a nervous bank call. Officers try to justify the demand for ID while the citizen calmly asserts his rights, even offering the Fourth Amendment as a reminder that his person and property are secure from unreasonable search.
Lieutenant Gock and the operations commander arrive [music] and and situation begins to de-escalate.
The officers are professional, open to discussion, and eventually understand he's doing nothing illegal. There's an important lesson here. Even in public spaces, misunderstandings can escalate quickly, but knowledge of your rights and respectful [music] communication can diffuse potential abuse. In the end, no arrest, no citation, just a citizen exercising his rights while highlighting the balance between public safety and constitutional freedoms. This is exactly the type of encounter CT 3 covers.
Citizen standing their ground, rights tested, [music] and the law put into real-world context.
Stand down.
Stand down. You don't get my idea. I haven't committed a crime. 38 Texas Hey, let me tell you something. What crime did we commit?
You're not You're not furnishing me your ID. I have not 3802.6. I only need to show my ID if I'm being lawfully arrested.
Are you going to give me your ID? What crime do you suspect me of committing? I need ID. I need to know what crime you're suspecting me of committing because if you arrest me let me talk let me talk and then you talk.
Let me talk let me talk let me whoa whoa whoa let me talk and then you talk.
Whenever you arrest me for not having committed a crime, I'm going to attach my hip to your hip for decades to come.
Now, let me tell you something. Texas, do you know what Texas 3802 is? Do you know Texas 3802? Yes or no? Texas 3802, I'm going to educate you, sir. Hold it.
I'm going to educate you, sir. I don't know. Wait wait wait. Texas 3802, don't touch me. Don't touch me. Okay, what's your name? Don't touch me. My name is good citizen. What's your name? Don't call What's your name? You need your ID or you're going to get arrested. For what?
For not displaying your ID. That's that's that's a secondary charge. You can't arrest me for a secondary charge.
You have to lawfully arrest me for actual crime. Listen, you're You're going to make a bad mistake. You're making a bad bad mistake. And this is what we do for a living. Okay? This is why we do this, y'all. You're going to arrest me for Texas 3802. Look it up.
Sir, this isn't Nazi Germany. You can't just ask This isn't Nazi Germany. Stand down, sir.
Yes, sir. Talk some sense into him.
We're going to own him.
We're going to Let me see your ID and I'll show you mine. Name and ID. What is your name and badge number? I'm going to ask you one more time. Stand back away from me.
Stand back away from me. You're going to be arrested if I don't give you my ID.
Okay, so under threat of arrest, I'm going to give you my ID. But no, I'm going to see you in court. For forcing my ID If If I don't give you an ID, are you going to arrest me?
Are you going to arrest me if I don't ID? I'm afraid so. You don't you don't have ID. Is that what you say?
That's the threat of arrest. I'll give it to you, but I'm going to take you to court.
>> Yes. We're going to own you. You don't care. We're going to own everything you own. DO YOU UNDERSTAND THAT?
NO, WE DON'T HAVE DE-ESCALATE HIM.
SIR, social distance. Back up.
I got the call to come here.
You were disturbing the peace. I wasn't disturbing the peace.
Well, that's that's that's what That's what they said. You come do your investigation. You find out that I'm actually engaged in a constitutionally protected activity. But I need your ID.
You don't need my ID unless I've been lawfully arrested.
3802. Texas 3802. My name is James. You do not need my name or ID unless I've been lawfully arrested. I haven't broken a law, so I need your I need your supervisor, sir. Guys, if you ever find yourself in this situation with law enforcement, it is quickly escalated. It goes from zero to 100 really fast.
Remember, everyone adrenaline is pumping. So, it's always a good idea to take a deep breath and not go back and forth with the officer who escalated the situation. In my opinion, I'd do exactly what Political Trance just done, and that's request for a supervisor. Guys, that's pretty much the only hope right now for some de-escalation.
I haven't broken a law, so I need your I need your supervisor, sir.
He is the supervisor. He's the supervisor, okay? So, it's the count it's the county attorney here. I need to speak with the county attorney. I need your supervisor. I need the sheriff. Who is your supervisor? Call the sheriff now. I need >> and call the sheriff now. Okay, what's your name? My name is your name is defendant.
Yeah. Okay, that's the name that you have now as defendant. I want the sheriff here right now. I'll sit here and wait. I'll sit here and wait. Call the sheriff.
James.
Do. Sheriff.
Sheriff.
Sheriff, will you please have them back up just a little bit so we can talk without them interfering? What's that?
Will you have them back up just a little bit so we can talk without them interfering?
>> is escalating the situation. I don't feel I don't feel safe now. He escalated. Thank you, sir.
Okay, the problem is is these officers do not know the Bill of Rights and they do not know that they cannot arrest us for no cause. There has to be a lawful reason to arrest us before we ID. And I have to be lawfully arrested in order to show my ID.
>> 3802 states that I only have to give my ID if I be unlawfully arrested. Go read the law book. Now, he almost we almost owned your department. Cuz I almost had to give him my ID under threat of arrest.
Yeah, he's saying he's going to arrest you. He jumps out of his qualified immunity.
He jumps out of his qualified immunity at that point. And whenever This is what we do. This is why we do this. We show this to the whole country that our country is being slowly rolled into tyranny because people have no idea what the Bill of Rights are. He's saying that because they called and said I disturbed peace. How did I do that? By filming?
No. Supreme Court already said that I can't be disturbing the peace by being engaged in my constitutionally protected activity. I'm a little bit elevated right now because of that crap.
Okay. Okay? Now.
>> [clears throat] >> So, for what reason do are we being forced to give ID under threat of arrest? That's a violation of fourth amendment rights. I have the right of my person's papers and effects and it would be a pure violation of that if you snatch my ID when I've broken no law.
It's irrelevant because he's got to give tyranny. Tyranny. Now you get to deal with the repercussions that your officer caused.
What I'm saying though is when you have people that work like this for you De-escalate. Talk to me without yelling at me. We de-escalate. I would like to be able to film and practice my First Amendment right in public without being harassed by this Quit pointing your finger at people. He's the one guilty.
I'm just You're talking to me right now.
I'm talking to all of you.
>> Okay, listen. What's his name?
I'm going to point the camera. He never even told me his name and ID. Stop pointing fingers. We'll get a name.
What's your name, sir?
See? You don't have to You're my public servant. You put that badge on, you don't have rights. You have You have duties. You have duties and you have limitations. Yes, I want to film and be left alone. Film what you want and then >> Okay, and then tell them to leave me alone. All right. Film what you want as long as you don't bother people. Thank you.
You're not getting my ID. Thank you.
Film what you want and and go on. This is public property.
Go on. I have the right to go.
If I'm free to go, I'm free to stay.
Whenever I'm ready to leave town, I'll send you an email and identify myself.
Well, no. The chief already spoke. I don't want to talk to you. You're a tyrant. Get out of here. No. I will never There's no expectation of privacy in public. I'm going to point this camera in public wherever I want to point it.
If I'm free to go, I'm free to stay.
If y'all would leave me alone and let me get my rest of my film in. Y'all have badge numbers, sir? I need his name and badge number so Y'all have badge numbers?
What is his name and badge number so I can follow up with a formal complaint?
Oh, oh, about what? About trying to force me to give an ID. He said he did.
He tried. We need ID He tried to put me in a cage if I didn't give him my papers like a Nazi soldier. If you keep yelling at me, you will be arrested. Well, that's freedom of speech. I'm not yelling at This is freedom of speech.
Well, no, no. It's not freedom of speech to come yelling I have freedom of speech. You're not going to be yelling at me.
>> have a decibel meter to say that I'm being too loud? It It It It bothers me.
It is That's all you need to know. It bothers us that that that our law enforcement is practicing tyranny. Do what you got to do and move on. You're You're getting my ID unless I'm lawfully arrested. I need identification, sir. I need it now to follow You don't have you got and move on. I need his name and identification number. You don't have to do. We do. We do have to.
The judge is watching, sir.
I'm not asking you to identify. It's part of the procedure to identify yourself when when you It's not It's not It's not part of It's not part of our policy to identify unless we've been lawfully arrested.
And it's also Texas 3802 law that you can't demand our ID from me unless I'm lawfully arrested for having committed a crime. Which means there's got to be a victim. Where's the victim?
No, there's no victim. There's nobody hurt. There's no bodily harm. There's no harm. Like I said, go film. But when somebody tells you to move your camera I am not an indentured servant. I can point this camera anywhere I want it.
It's my God-given My family and your family bled their blood to protect.
Okay. All right, I'm going to go film.
Walk away, James. Go film.
Am I free to stay?
Am I free to go?
Why? I don't have a gun. You all got guns. I got a camera. Am I free to go?
Am I free to go? I'm free to stay.
I'm free to stay then. If you're afraid of a guy with a camera, turn in your badge. If you're afraid of a guy with a camera, turn in your badge. And if you're afraid of a guy with a camera, get the hell out of here.
It's already escalated. Things have already been escalated by this tyrant.
Don't you know you're going to make a funny face like you want a tyrant? You didn't give me your ID though, did you?
Police.
Wee wee wee.
