[🅽🅴🆆] JUDY JUSTICE HD Season 4 💗💋💗 Episodes 9914 Best Amazing Cases Season 2026 Full Episode HDAdded:
suing her daughter Jessica Crane for personal items and money from a GoFundMe fundraiser.
>> Court come to order. All rise.
>> Have a seat, please.
>> Kevin approaches Judge Judy.
>> Hello, judge. Case 2119, Crane versus Crane.
>> Thank you very much.
>> You're welcome.
>> Well, Miss Crane, this is a very sad case. This is your daughter.
>> Yes, it is. And I don't know how many children that you have, but I know that you had a son who was in medical school who was how old? 25 years old.
>> 30.
>> 30. Sounds as if he was popular young man. Was in an outing with friends and sadly he drowned.
>> Yes, he did. And that happened.
>> Just a second. And that happened when?
>> That happened July 29th of this year.
>> This is what the case is about. His friends in his memory started a GoFundMe page.
>> Correct.
>> And there is approximately $40,000 in that GoFundMe page.
>> There was. Yes. I said approximately.
Yes, >> it was. And your daughter is, for want of a better word, in charge of that Facebook page, GoFundMe proceeds.
>> Correct.
>> And it is your claim that is the next of kin because he died without a will. You are entitled to some or all of that Facebook page. It doesn't even matter about the GoFundMe funds. I mean, that would be nice in a perfect world, but my daughter took everything from the day my son passed when they found his body at the river. The corner gave her the keys to his truck and she went to his apartment and emptied it. So, I didn't get my chance to be Josh's mom for the last time. I didn't get to empty his apartment.
>> I can't cure that, madam.
>> No, >> I can't cure that. And you can't put any sort of a value on anything that your daughter might have taken from that apartment because you don't know what was there.
>> Correct.
>> So I can't help you with that. In a perfect world, maybe she would have gone with you to the apartment, but she didn't.
>> Correct.
>> Based upon what I read, you were not there during the search for your son or the discovery of his body. Is that correct?
>> I was at home.
>> Okay. And your daughter was there?
>> Yes, she was.
>> And I assume that you were close to your brother?
>> Absolutely. close to my brother.
>> Just curious, what prevented you, you were notified that your son was missing.
What prevented you from going there?
>> My daughter was at the house the day Josh went missing and we had my car torn apart. Um, she left after they called her and I I definitely would have hitched a ride, but I didn't have a vehicle.
>> Your honor, I got just a second. Did you say she was at your house?
>> Yes, she was.
>> Well, then why didn't you go with her?
>> They didn't call till after she had left, apparently. And rather than come back and get me.
>> You mean she left to go someplace else?
>> She left to go home. Yeah. We were working on my car. She left to go home and she got a call from search and rescue. I hadn't been answering my phone.
>> Oh, well that's a different story. You hadn't been answering your phone. It wasn't as if nobody called you.
>> No. No, she didn't. She didn't call.
>> It wasn't as if nobody called you. Did somebody call you?
>> Right. From search and rescue. Yes.
>> Somebody called you.
>> Yes.
>> Okay. Mrs. Crane, this is your problem.
If your son passed away without a will, and I'm sure that somebody else, maybe a professional has told you that, the legal professional has told you that if your son passed away without a will, depending upon the laws in your jurisdiction, you as his parent might be construed as next of kin and any property that he owned at the time of his death would transfer to you.
>> Right. Correct. Yes.
>> He didn't own the GoFundMe page at the time he died.
>> No, he did not. So you don't get it.
Okay. Any part of it? Okay.
>> Your honor, you receive funds from the GoFundMe as well.
>> Just the people that set up the GoFundMe page, I assume were classmates of your brothers.
>> Yes, they were his other fourth year medical students that had reached out to me and asked if they could >> Don't tell me what they asked you. They set up a GoFundMe page. Do you have the paperwork for the GoFundMe page? I'd like to see it. Jessica produces a document, then hands it to Kevin, who brings it to Judy. She reviews it.
>> Okay. So, they raised $39,287.
>> Correct.
>> Okay. Is there anything that is in writing that makes you either the beneficiary of >> the organizer of >> Would you do me a favor? Look it up >> underneath the photo. It it does say that I am the beneficiary listed on there.
>> Thank you.
>> Sarah looks at the document then hands it back to Judy.
>> You're Jessica.
>> I am. Okay. Is organizing this fundraiser on behalf of Jessica Crane.
>> Mhm.
>> That's her.
>> That has changed. Initially it was for Joshua Crane and with the legal >> Just show me.
>> It's never been for >> Show me just a second. Just a Mrs. Crane.
>> Yes. It wouldn't make any difference.
But I'm willing to look at something that originally it was on behalf of >> somebody else.
>> The reason I'm here today is not because of the GoFundMe.
>> Your honor, that's exactly why she's here. It's the money. It's >> always been about the money.
>> Carol shakes her head. Caption coming up.
>> All right. How are you going to pay the note on a $14,000 truck?
>> I plan on returning to work. This incident has taken my job, believe it or not.
>> Actually, I don't believe it. Your honor, I work just three jobs. Just a sec. Actually, I don't believe it.
>> And later today, >> what kind of narcotics were found inside the vehicle?
>> It's alleged that it was a >> No, it's not alleged. This is a police report. I'm asking you, what kind of narcotics were found in your car?
>> A woman shakes her head.
A courthouse. The Judy Justice logo appears in the courtroom. Carol and Jessica. Carol Crane claims her daughter, Jessica Crane, is wrongfully keeping her son's property and money from his GoFundMe fundraiser.
>> This is your complaint. I'm suing the defendant, Jessica Crane, in the amount of $10,000 for my portion of my deceased son's GoFundMe account and personal items, including my son's guitars and his vehicle.
>> Correct.
>> Okay. Now, you're not looking for his GoFundMe account. I never really was cuz I never knew the law on GoFundMe. I tried to find out and speak to someone about it and get legal advice and I could never find anyone.
>> Well, it's very easy. He didn't own this property while he was alive. So, you have no title to it. If they said that they're starting a GoFundMe page in the name of your son to be for the benefit of animal rescue, you wouldn't have any control over.
>> No, it was meant for his funeral costs, which which I also paid for just a second. on behalf of Jessica Crane.
>> Right.
>> On behalf of Jessica Crane, just for my own curiosity, I'd like to know your son was buried at some point.
>> He was cremated.
>> He was cremated.
>> And I have the receipts. I paid for his obituary, his cremation.
>> Okay. So, what I'm asking you is there were no serious funeral costs.
>> I got everything donated on my funeral.
Just >> that's not true as well.
>> Just a second. I'm asking you, Mrs. praying. Did you pay anything for your son's funeral?
>> No.
>> Okay, that's all. So, it's not as if you had any outlay of money for this. You know what I find sort of troublesome? I find troublesome that his friends, cuz that sometimes happens. It's human nature. You feel so badly about something, you want to do something. And probably the easiest thing to do is to raise money. And the easiest thing for probably these people who are in their 20s and 30s is to start a GoFundMe page.
I mean, it just would seem to me if they wanted to do a scholarship for him at the school, if they wanted to do something else. This is for those people out there who are watching who will GoFundMe people. I've seen some of the more ridiculous ones, you know, and there are good-natured people out there who see these things and will donate $5 and $10. Oh my goodness, they need funeral costs. Well, in this case, there were no issues and almost all this money, $40,000 is left. What are you going to do with it?
>> So, there's a couple things that I planned on doing with it. It's why the money has been sitting in account.
>> I just want the people who donated this money to know what you're going to do with it. It's not for you to buy anything for yourself. That would be ridiculous. That's not what was in their minds. So, I want to know who I'm dealing with. your honor, after all of Josh's expenses were paid for, which I paid for using that money. I am very close with the dean at UC Davis, um, who was a good friend of my brothers as well, and they have talked about setting up a scholarship fund for my brother, and I was going to donate a portion of that money back if UC Davis decides to set that up on his behalf. And then I also wanted to set up scholarship funds for my sons who my brother was very close with. So what you're telling me is you're going to give a little to UC Davis for a scholarship in his name and you're going to use some for your two sons for their education.
>> Absolutely.
>> Well, that's really not what it was intended to do. I'm just telling you it was not what it was intended to do.
>> I mean, at the end of the day, that's how GoFundMes are set up. People can set them up for an intended purpose and they're used for anything >> and then Well, but I'm just telling the people out there before you spend money on a GoFundMe page, make sure it's going to go to a place where you want it to go. going for the intended purpose you wanted, which is to somehow celebrate the life of this young man that was cut short so tragically. And it would seem to me, Miss Crane, you don't have to do anything because they made you the beneficiary of this money. But it would seem to me that a standup person would take whatever is left of that and create a scholarship in his name at UC Davis, which is where he went to school. I can't order you to do that, but I'm just telling you and everybody else out there, make sure if you have a good heart and a good spirit, you know where your money is going. Okay? So, you're not entitled to any of the money. Now, did you take your brother's guitars?
>> I cleared out my brother's entire >> Just a second. Just answer the question.
And how many guitars did you take?
>> Three.
>> Where are they?
>> They're at my house.
>> Now, I don't have to do this. Would you like one of your son's guitars?
>> Very Yes. Very. Would you like one of your son's guitars? Do you have any of your son's guitars?
>> None.
>> Your honor, my mom has a long history of substance abuse. She's boughten gifts for me in the past and she's pawned them off. And I would like to keep them in my family. So that's where they stay. So that's why I have possession of them because I don't want them going to a pawn shop.
>> I was told I could visit one of my son's guitars at her home.
>> Do you just a second? Do you play guitar?
>> No, I just want it because it's my son's and I bought three of his guitars for him. None of these guitars were purchased by her. They're very expensive guitars. My brother purchased.
>> I can't order her to do anything. I'm just asking her whether she would give you one of the guitars. And she said no.
The next thing we have here is a vehicle. Now, tell me about the vehicle.
>> So, Josh didn't have a lot. He was a fourth year medical student. He has a truck, a Toyota, a 2019 Toyota Tacoma that he still owes about $14,000 on. I have that here. $13,841.76 on.
>> Uh-huh. And at the time his truck was at the boat launch where they found him. So when I met with the sheriff's, they gave me possession of the keys. They found his keys on his body and they gave me his keys. So we brought the truck up to where we live in Northern California.
Took the truck up there and it's been kept in storage until this is all sorted out. I personally wanted to keep the truck. I have the means to finance the truck in my name. I have the means to make a payment. She does not have the means to make a payment. She doesn't have a job. She doesn't have a driver's license. She can't provide insurance for it. I mean, she has driving.
>> That's not particularly relevant.
There's $14,000 left on it. Are you employed?
>> Um, I was until the answer is either yes or no. Are you employed?
>> No.
>> All right. How are you going to pay the note on a $14,000 truck?
>> I plan on returning to work. This this incident has taken my job, believe it or not.
>> Actually, I don't believe it.
>> Your honor, I work just three jobs.
>> Just a second. Actually, I don't believe it.
>> Okay. So the answer is if you can't afford to make the payments on this truck and the only thing that's going to happen is it's going to be repossessed by the bank. Have you been making payments on the truck?
>> I have not made a payment.
>> Who is the finance company?
>> Credit union.
>> Where is the truck currently stored?
Give me the address.
>> I don't have an exact address.
>> And later today, >> you don't understand something, sir.
Even though she was high on drugs and passed out in her car and you were not at fault, it's not windfall day. That's ridiculous. And I'm not stupid. A man's size.
A courthouse. The Judy Justice logo appears in the courtroom. Carol and Jessica.
Carol Crane claims her daughter, Jessica Crane, is wrongfully keeping her son's property and money from his GoFundMe fundraiser.
>> I want to see the paperwork on the loan.
>> Jessica produces a document, then hands it to Kevin, who brings it to Judy. She reviews it.
>> Okay, Sarah, when we finish with this case, call Credit Union. Advise them who has the truck. Let them go repossess the truck. We're finished here. Your case is dismissed.
>> This court is adjourned.
>> Outside the courtroom, Carol, I had an addiction problem and she's just angry.
She's angry at me and I've tried to make amends. I've tried to get this better and she's she won't have it. My daughter got away with taking absolutely everything and she wasn't entitled to it. Judy and Sarah.
>> I think that if there's any lesson to be taken away, aside from the fact that you're not supposed to fight, you know, when you lose somebody so young and so vital, the one innocent party is the credit union who loaned him the money to buy the truck. She's been hiding the truck now for 5 months, hasn't made a payment on it. The right thing to do was for her to turn that truck into the credit union because I can't control that except that I can advise the credit union where she is, who she is, that she has possession of the truck and they should go and repossess it. Anyway, it's all very sad. Before you donate money to a GoFundMe page, make sure you know where the money is going. I think that that's the takeaway from this.
>> Case 2161, Shaheen versus Larry. All parties, please step forward. Shamal Shaheen is suing his neighbor, Sabrina Larry, for car damage after Sabrina hit his vehicle and a house.
>> Mr. Shaheen, tell me where you live.
>> I live in Morhead, Minnesota.
>> And on September 8th of this year, you parked your relatively new car that according to you, you got a week before.
>> No, your honor, >> I had just purchased a Sequoia a week before.
>> No, actually, it's not it's not the new car. I mean, it's an older It's a used car, but it's I purchased it maybe a year before that. Not exactly a week.
>> Okay. So, it's not a new car and you didn't purchase it a week before.
>> No, >> but you parked it in front of your house. Do you have a photograph of the car?
>> I do.
>> I'd like to see it. And it is your claim that the defendant, Miss Larry, while under some sort of influence of some sort of substance, was driving her car, had an accident, hit your car, and caused it to move 25 ft and it was damaged.
>> Yes.
>> And the damage to the car was the rear bumper.
>> Yep.
>> Not Yep. Yes. Is the answer.
>> Yes. Yes.
>> Yes. Is the answer. Okay. Miss Larry, what time did you have your accident?
>> 9 or 10 a.m.
>> On the 8th? Yes.
>> Where were you coming from?
>> Uh the grocery store.
>> Where were you going?
>> Home.
>> What kind of drugs had you taken?
>> I was taking Benadryil, prescription medication. Um that's that's all I had.
That's what I took. And >> can I see the police report? You remember hitting his car?
>> No.
>> You remember the police coming to where your car stopped?
>> No. No, I don't remember the police coming like >> Well, did the police come?
>> They did. Yes.
>> And you don't remember that?
>> I don't remember that.
>> Were you taken to a hospital?
>> I was. You have the discharge notes from the hospital.
>> We do.
>> Wait to see it. What kind of narcotics were found inside the vehicle?
>> It's alleged that it was a >> No, it's not alleged. This is a police report. I'm asking you, what kind of narcotics were found in your car?
>> They said that they found a round blue pill that had an M30 on it. That's what it stated.
>> Sarah, do me a favor. Look up under illegal drugs M30.
>> Sarah turns to Judy. So M30s imitate oxycodone obtained from a pharmacy, but when sold on the streets, the pills routinely contain fentanyl.
>> Look up this name, Percoet.
>> You smoke Percoet? How do you smoke Percoet? That's the only thing you remembered. You didn't remember the accident. Patient remembers smoking Percoet pill just prior to allegedly passing out and crashing her vehicle.
That's what they say from your doctor.
Yeah, that's what they're that's what they're saying. That's >> Well, that's what they're saying. The history is provided by the patient. The history is limited by condition of the patient. History is limited because the patient does not remember the actual automobile accident, remember smoking percoet pill just prior to allegedly passing out and crashing her vehicle.
You think the doctor made that up and they just so happened to have found this blue pill in your console in your car?
>> That's what they are saying.
>> Okay. You actually know you could have killed yourself. Yeah. Okay. And you don't remember anything about it because that's what you told them. You don't remember anything about anything after you smoked a little blue pill, which is what they said. So, your car was moved.
That's the damage to your car.
>> Yeah.
>> So, can I see the estimate for the damage, please?
>> I think you gave it to me. Yeah.
>> Okay, great. Have you had the car fixed?
>> Just the back tail light that I had to put it on. I was trying to fix it, but don't have any money to do it. Sarah, look up, please. Would you?
>> I'm looking it up right now.
>> Oh, great. Thank you. Oh, it's a 21-y old car. It's got 226,000 miles on it.
How much did you pay for it, sir?
>> I paid 10.
>> We're not going to spend seven to fix it.
>> Well, that's how much it cost.
>> You find somebody to do it less.
>> Well, now I am without a car.
>> You're not without a car, sir. You put on the tail light so that you could drive it. This car is not not drivable.
>> That car was dragged. That back axle, it shakes. Exactly.
>> Between two and 5,000.
>> Between two and 5,000. You paid too much for the car, sir. You don't understand something, sir. Even though she was high on drugs and passed out in her car and you were not at fault, it's not windfall day. If you can buy the car for 2,000, buy a old 22y old car for 2,000. She's not paying you $7,000 to fix a $2,000 car. That's ridiculous. And I'm not stupid. Do we understand each other now?
Between >> 2500 and 5,000 based off of a $250,000 mile 2002 Toyota.
>> So you have to find somebody who's going to fix your car for $3,000. Sir, that's $1,000 more than you could buy it for.
We're done here. Judgment for the plaintiff.
>> This court is a journ.
>> Outside the courtroom, Shamal then Sabrina.
>> I would remember if I hit a car and I didn't.
>> She ran into my car, run into a garage.
>> I I know exactly what I took and it definitely wasn't narcotics. That area that I was living in, it's a really bad area. A lot of drugs are going on over there.
>> I am very, very lucky. I'm very blessed.
Like she said, I could be dead.
>> Sarah and Judy.
>> Just the audacity of some plaintiffs to come in here with almost 20 no over >> and property damage.
>> Court come to order. All rise.
>> Have a seat, please.
>> Kevin, >> case 21109 Noble versus Akuna.
>> Thank you.
>> You're welcome, >> Miss Noble. This is your sister?
>> Yes, ma'am.
>> Older or younger?
>> Younger.
>> Any other siblings?
>> Many.
>> How many?
>> I have five sisters and four brothers.
>> And you have kids. How many children do you have?
>> I have three daughters.
>> How old are they?
>> 18, 15, and almost 12.
>> And you?
>> I have three children, and they are 10, five, and two. There came a time when that was in August of 2021 according to your complaint that you were having some housing difficulties with your children.
>> No, that's not true.
>> Well, Miss Noble, what led you to believe that your sister was having some housing difficulty because you start your complaint by indicating that she was about to become homeless?
>> Her house that she was living in was being put up for sale.
>> So, the house that you had been renting, >> correct?
>> For how long?
>> About 2 years. I'm not really sure it was well >> being sold.
>> Well, I didn't know that until I gave her my notice after I'd already previously asked my sister if we should move in.
>> So, you approached her about you moving in with her?
>> Yes, correct.
>> And do you own your own home, Miss Noble?
>> I do.
>> Where you were living? You were living there alone with your three children?
>> Yes.
>> Okay. And how much rent were you paying?
>> 750.
>> Now, when you decided to move in with your sister, what rent was discussed?
Well, she had told me about 400 is what she wanted.
>> Okay. So, she said the rent was $400 per month and that was starting August 1st.
>> Right.
>> So, this is what's part of this case is about part of the case is about rent.
You lived with your sister from August 1st, 2021 to a date in 2022 when you finally removed all of your property.
>> Kind of. I did not remove all of my property, but I removed what she allowed me to >> to remove. On what date? I'm going to say it was miday, but I'm not sure.
>> May of 2022.
>> So, we have August, September, October, November, December, January, February, March, April, May. So, between nine and 10 months for the nine or 10 months that you were there, how many times did you pay her $400 in rent?
>> Um, >> she's going to have a list.
>> I And I have a list, too, of our >> And you have a list. So, take a look at it and give me the exact number of months. The time I paid her 400 was I think only one time and there was other times I paid her different amounts but our agreement was because I bought all the groceries. We just kept track on this app which has a list. I paid way over 400 in total.
>> Well, >> so our agreement had changed.
>> Just a second.
>> Okay.
>> You have an app 10 months.
>> Mhm.
>> How much did you spend on that app?
>> 122,000 something is right in here on this list.
>> Take a look cuz you're going to show it to me. I paid total $10,411.
>> Okay. And she >> she total was $11,291 >> and that was to cover groceries, food, gas money.
>> Her phone was underline.
>> This is something that I'm going to have to simplify. There came a time when there were issues with regard to you not paying her $400 a month rent and you discussed it with her. Correct. And in what month was that? April.
>> It was before April. It was before I had gone on vacation.
>> What month and year?
>> December of 2021.
>> So, what I'm reading in December of 2021, you had a dispute about how much you were spending, how much you weren't spending, and that $400 was not being forthcoming just for rent. You see, I can understand that the two of you decided to split bills, everything other than the $400 in rent. You each have three children. You're two adults. Let's get to December. Was it the beginning or middle of December that you had this discussion about just pay $400 a month and we'll deal with it?
>> Maybe the middle.
>> Okay. So, we have January, February, March, April, and you moved out in May.
>> Correct. I was kicked out illegally.
Yes.
>> In May. Left in May. So, that's five months. It was suggested by your landlord that just give me $400 a month and we'll split groceries >> in April. I have the proof of the text.
>> Just a second. So, we have January, February, March, and April. Four months.
Did you give her $400 a month for those four months?
>> Nope. It was never discussed before.
Then I have the proof that it was discussed in April.
>> I'd like to see it.
>> Thank you.
>> It was discussed in April again.
>> Okay, just a second. I just want to see the proof. will show me if you have proof of an earlier conversation. I believe that there was an earlier conversation. Let me see the one that occurred in April.
>> It was mainly the receipts.
>> I'm not getting involved with that at all. Right now, you had a place to live with your three children for much less than the $750 a month that you were paying at another residence.
>> Right. And I spent way more on groceries. I did all the groceries.
>> Whatever. Your children didn't need more, >> right? And my children didn't live there the full time.
>> I don't care.
>> Okay. I'm sorry. Can I look on my phone?
Is that It might be faster. Is that okay if I show you the text?
>> I don't care. Will you show it to me?
Just show it to me.
>> Thank you. I'm sorry.
>> Oh, yeah. Yeah. Apologize.
>> Okay. Apologize. Sorry.
>> Tiffany hands her phone to Kevin >> on April 24th. So, if you want and then you can scroll down because she kind of keeps for a couple days.
>> Heaven brings the phone to Judy who reviews it.
Oh, that wasn't an agreement, madam.
These were final acts of desperation to get you to pay $400 a month here.
>> That was the first time I'd heard Yeah.
about her.
>> Oh, no, no, no, no. That wasn't the first time you heard about it because the first line is $400 better be under my door, >> right?
>> So, that that's not the first time you heard about it, right?
>> That's a that's an act of desperation.
Okay. So, you had this conversation with her in December and she was there until May. And according to you, you only paid $400 once. That's $2,000. By the way, how are your children supported?
>> I work Well, I I work. Yes.
>> Is that a full-time job or a part-time job?
>> It was part-time.
>> Well, you don't support yourself and your three children with a part-time job. Do you get any child support for them?
>> I did get child support for two of them.
Yes, >> for two of them.
>> How much child support do you receive?
>> 300. 300 a watt >> a month.
>> Do you get any other assistance?
>> Yes, I had food stamps.
>> Do you still have food stamps?
>> Yes.
>> How much a month?
>> For something. I'm not exactly sure.
>> And when you bought food for the household, you used food the food stamps as well as your other money from your part-time job and got it. $400. So far, you owe your sister $2,000. That's for back rent. Now, you want to go through the damages that you alleged that your sister caused?
>> Yes. So, I had two couches and those went away. Um, >> what do you mean both went away? What does that mean?
>> She got rid of them >> while she was living there.
>> Mhm.
>> And you knew about it in what month?
>> It was when I came back from vacation.
My my things were gone.
>> I'm not following. You were supposed to be gone for two weeks according to her.
You were gone for a little half week.
You were gone for almost a month. She was babysitting for your children. She was >> They don't really need babysat. They're older. Well, your 12-year-old can't live by herself without a mother for a month.
>> No.
>> Okay. And your 18-year-old does what?
>> She works at a hotel.
>> So, she works during the day or at night.
>> She didn't at the time. She was a 17 at the time.
>> You're not going to leave a 17 or 14 and an 11year-old alone for a month?
>> Of course not.
>> Okay. So, they home with your sister.
>> Yes.
>> Let's get back to the initial question.
I forgot what my question was before I went off on this tangent. Couches.
>> The couches. That's where we're at. So, you went away for a month >> and when you came back, couches were gone.
>> Couches like the whole house had transformed into basically her house.
>> I don't care. Basically her house. I want to know what was missing.
>> So, the couches were missing.
>> Okay. Which couches? Couches from where?
Which?
>> So, the couch from the living room, it was a sectional and the couch from the basement.
>> Living room and basement. What happened to those couches?
>> Oh, they were gone a long time before.
And I can prove you a text of her saying that we'll get they were gone before I even moved in. actually in August. She knew and her daughter and her boyfriend helped me load them up and take them to the dump. She in fact told me she was getting rid of a lot of old furniture she did not care about. I have pictures.
>> Just a second. What you have is proof that those two items were disposed of before she went away on vacation.
>> Way before before I moved in.
>> Okay. Now, Miss Noble, your sister says that she has proof that those two couches were disposed of well before you went away on vacation. If she does, I'm not going to be happy with you. Do you understand?
>> Were those two couches gone before you went on vacation?
>> I can't recall, but I believe she wanted to make room for her furniture.
>> Just a second. Were those two couches gone before you went on vacation for a month?
>> I know the basement couch wasn't.
>> Okay, I think you're full of baloney.
>> Caption coming up. She started giving my niece video games, movies, my food storage containers. She was just giving my things away.
>> Okay. I went to graduate school after I finished with high school for 9 years.
I'm not dealing with Tupperware.
>> A courthouse. The Judy Justice logo appears in the courtroom. Lucinda and Tiffany. Lucinda Noble claims her sister Tiffany Akunia owes for rent in property damage. Tiffany is counter suing for an illegal lockout and filing a false CPS report.
>> Okay, let's go. Property taken without permission. What property did she take without your permission?
>> Okay, so >> far she owes you for rent.
>> The TV stand. She broke it and threw it under the trampoline.
>> What's next?
>> The weed trimmer. She took that. Um, she started giving my niece my belongings while I was gone. She started giving my niece video games, movies, my food storage containers. She was just giving my things away.
>> Okay. She owes you for rent. I went to graduate school after I finished with high school for nine years. I'm not dealing with Tupperware. So far, she owes you $2,000 for rent.
>> Okay. And then there was also the wall damage, the windows, uh, the blinds.
>> Just a second. Just a second. What wall damage and where? The wall damages from the room that she was staying in and the room that her boys were staying in.
>> May I see the damage that you're referring to?
>> Lucinda produces photos, then hands them to Kevin.
>> Here's the one more of that. And then here's the blinds.
And this was damages from her cat.
>> Kevin brings the photos to Judy who reviews them.
>> Well, this I can't see at all. Okay. So that I can't see at all. And if you're talking about nail holes, I'm not interested in nail holes. Where there were pictures, putty them up. I don't know what this is a picture of. Tell me.
>> That's where her cat clawed up the carpet to get into her room.
>> Did you replace the carpet?
>> Not yet.
>> Do you have an estimate for replacing or patching that carpet?
>> They don't make that carpet anymore.
>> Okay. I don't know that. How did these blinds get broken?
>> I'm not sure. Are those the ones that were in my bedroom or the kids' bedroom?
Um, I really don't know to be honest, but I do feel like I remember them being broken, but I just don't remember if they were broken when I already moved in or not. I really don't know, ma'am. I mean, honestly, I I knew they were broken. It's like a I'm remembering, but the house, like I said, was not in a good condition when I moved in.
>> Okay. I'm not talking about the rest of the house.
>> My daughter is actually Tiffany told her that she knew they were >> She doesn't remember. You tell me that these blinds were in good condition before she and her family moved in.
>> Yes.
>> She says she doesn't remember. I have to rely on what you say to me because that's not ordinary wear and tear. No.
>> Do you have a bill for new blinds >> from Lowe's? I have the estimate of what it will cost to replace them.
>> Okay. I'd like to see it.
>> Linda hands a document to Kevin.
>> You do have a cat?
>> Yes, I have one cat. Okay.
>> She has multiple. Kevin hands the document to Judy who reviews it.
>> So, we're talking about $47.98 >> times two.
>> Okay. Anything else? Any other >> for two blinds?
>> I only see one.
>> No, those are two different windows.
>> Oh, times two. You're right. Anything else?
>> I have to remove the junk that she left at my house.
>> I was not allowed at her house.
>> What else?
>> That's okay. If you have to think that hard, then we're finished. We're moving over to the counter suit.
>> Counter claim is for an illegal lockout.
Okay. Let me run through this illegal lockout and dispose of it quickly. The illegal lockout that you're referring to happened when your sister, who shouldn't have, took the door off your bedroom.
>> Correct.
>> She says she took the door off your bedroom because you weren't paying close enough attention to your children.
Correct.
>> And I assume she's talking about the two-year-old.
>> Correct.
>> And when she took the door off your bedroom, you called the police, >> right? Yep. I called the police. I have the in the office. Yes. You called the police >> and the police came and when the police came on, do we have the date?
>> 26 April. The police arrived and they told her she couldn't lock the door and you were let in.
>> Correct.
>> Okay. So, not egregious enough for me to have to deal with two sisters fighting.
But the other part of your claim is that your sister filed a false CPS report, >> right? And first, how do you know a CPS report was called in?
>> Well, they called me real quick.
>> Child protective services, >> right? They did call me, but first I actually had the phone call from my sister, my witness who is here right now because she had pre-warned me because she had gotten the phone call from the sister saying, "Lucy is going to call on you."
>> Okay. Do you want to step up?
>> Sure.
>> Tell me your name.
>> My name is Stephanie Alet. I'm the older sister.
>> Yeah. When did you have a conversation with Miss Noble about the defendant's children?
>> The same night that the cops were called. Tiffany had called me because Lucy's daughter had crawled through the window and open the door.
>> So, you spoke to Lucinda?
>> Yes.
>> On April 26th?
>> Did you call her or did she call you?
>> She had called me because she wanted to let me know that the cops have been >> Do you recall that conversation?
>> Yes, I do.
>> Okay. Tell me about the conversation.
She called to let me know that she was letting me know that since I was the only one probably capable or in this position to take on a child if CPS was involved because the two-year-old would not be able to go to his father. He was in prison at the time. And I was like, "Why are you calling and telling me this? Tiffany's a good mom. What's going on?" And she goes, "No, she's not. I've already called CPS and forewarned them that this is happening. She needs to be taken care of."
>> What's happening?
>> Apparently, there was lice on her daughter when she was at her father's house. And the 2-year-old, apparently he was running around with a wet diaper.
>> Who was taken to their father's house?
>> The daughter that had the lice was that >> the daughter is the 5-year-old.
>> Yes. And >> Okay. Not the 2-year-old.
>> Yeah. She supposedly had lice while she was at her dad's.
>> Went to her father's and that was sometime in April. Is that correct?
>> Yes.
>> And got head lice.
>> Well, he told me. I wasn't for sure, but I'd let my sister know just in case that she may have lice. Let's check the girls.
>> Okay. And your sister was home at the time? Well, no, she was never home.
Everything was over text message because >> just a second. Was that when she was away?
>> She was not staying at the house.
>> She was not at the residence. She was staying at her boyfriend's house that was there.
>> Lucinda was staying at her boyfriend's house.
>> Yes.
>> Okay. And that's on the 26th. Yes.
>> Is that after the police were called?
>> That was prior to supposedly the lice was prior to and that's why she had called them prior to that night. And she was letting me know that she had called them and that I needed to be prepared to take on a 2-year-old.
>> What did you tell her? I asked her why she would call them, what was going on, and I said, "This is ridiculous. You know that this is ridiculous." And she goes, "No, it's justified." And I said, "I don't understand."
>> Stand. Did she tell you why?
>> Yeah, she tried to tell me that.
>> Well, tell me exactly what she said to you. Why is this made comment that so she told me has not been there?
>> Okay. You had to ask her.
>> To her were, "How do you know this when you're never there?"
>> And she said, >> "I just know."
>> And gave you no more specifics.
>> No.
>> Okay. You want to tell me about that conversation?
>> I never said I was calling CPS. I said someone will. I know the person who did.
It wasn't me.
>> Okay. Well, >> but I knew it was going to be happening.
>> Okay. Stephanie, let's get clear. Okay.
When you spoke to Lucinda and she said to you, in effect, "Are you prepared to take on a 2-year-old?" Did she tell you that someone was calling CPS?
>> No, she did not. She said that she would be the one calling and that she has already contacted them because of the situation at her home.
>> Okay. Now, assuming you and your sister lived alone together, whether you spent time with your boyfriend or not, you have older kids, but you were away. When you were away for that month, were you staying with your boyfriend?
>> Yes.
>> Okay. And you left your kids alone, correct?
>> With my sister.
>> With your sister.
>> Yeah. Why would you feel comfortable about leaving your own children with your sister if you felt that she neglected her own children?
>> They didn't need the amount of care that a 2-year-old does.
>> Are you telling me that a 15year-old doesn't need a lot of care and watching these days >> or a 12y old or an 11year-old doesn't need a lot of watching and supervising?
Is that what you're suggesting to me?
>> Not as much as a 2-year-old. Well, one is a physical watching to make sure that it eats and drinks and is bathed periodically. The other two are far more difficult. You got to have eyes all over the place to watch a 15year-old and an 11year-old. Got to have your eyes on their computer. You got have your eyes on their iPad. You have to have your eyes on their schooling, on their homework, on their everything else. You take a month to go off with your boyfriend. That to me is not participating with your children, especially since you suggest that your sister with whom you left your children was neglecting her own children.
>> Your honor, I would just like to say that I was reaching out to her a lot of the time too where I would get one week there was nothing. She said I'm sorry I had no Wi-Fi. Her children were skipping school. They were not listening to me.
They would not do their I I do I need you to reinforce what I just said? I I Yeah, I don't need you to reinforce what I just said.
>> Caption coming up.
>> You would had a history with methamphetamines. You refuse to meet with case workers according to the report you gave me.
>> I have other reports too if I may, please.
>> Just Thank you.
>> I'm not finished.
>> A courthouse. The Judy Justice logo appears in the courtroom. Lucinda and Tiffany.
Lucinda Noble is accusing her sister Tiffany Akunia of refusing to pay for rent. Tiffany claims Lucinda wrongfully reported her to child protective services.
>> Now you have something you want to say.
>> Many things actually.
>> Well, many things. I don't want many things. What I want stand up. What I want to know is your her daughter.
>> Yes.
>> Your first name?
>> Anna Noble.
>> Anna, what do you do?
>> I work front desk at a hotel.
>> Graduate from high school?
>> No.
>> Why? I was pulled out and moved to Missouri.
>> Pulled out by whom? By your mother.
>> Yeah.
>> And when your mother pulled you out, how old were you?
>> 17.
>> Had you been going to school before?
>> Yes.
>> In what jurisdiction?
>> It was alternative school.
>> When you say an alternative school, what kind of an alternative school?
>> For troubled youth.
>> Tell me about your trouble. Was it behavior trouble?
>> Course you seem >> many things. I was a very wild teenager. I >> until until when were you a wild teenager?
>> Until I sent her to live with her dad.
>> I didn't ask you any questions. So now you can sit down.
>> Okay.
>> I'm not going into anything else.
Lucinda, so so far you went away for a month with your boyfriend, >> leaving your three children who you say don't need supervision. How long were you home before you took the door off her bedroom?
>> I got back from vacation in February, early February, and the door was removed in April for a few hours. Okay. Do you have any proof other than this conversation that the plaintiff called CPS?
>> I believe it is proof. Just the the thing that was reported is something she would only know. Would that be considered proof?
>> Well, okay.
>> Let me hear what was reported.
>> It was reported that I would not treat my child with lice. That was what the CPS report was. And it was unsubstantiated. And I have that all proved. This >> when your 5-year-old went to her father.
She went to visit with her father. And children do get headlights. It happens periodically. Lots of children who go to school who interact with other children come home and they get head lice. Had a lot of children, a lot of grandchildren and it happens >> and you usually treat it. I assume that her father did not treat it. Is that right?
>> He did treat it. He told me he told me immediately. I have >> So he treated it.
>> So how do you know that the head lice was the nature of the complaint?
>> That's what was on the report. I was >> Yeah, I see it. Your children weren't removed except for your boy.
>> My one son. Uhhuh. And then the that lady >> and then returned.
>> Oh, three boys. All three kids were taken.
>> Okay, there you go, sir.
>> Tiffany hands a document to Kevin who brings it to Judy. She reviews it.
>> Okay. You had a prior history with Child Protective Services, >> which I was unaware.
>> That's either a yes or a no.
>> Yep. Yes. And during the course of those prior proceedings, which were relatively current child protective proceedings, because that was in 2021, you were clearly drug tested by the Department of Social Services or Child Protective Services >> in 2018 or 19. This was at my doctor's prior when I was and they reported it that I had one of my >> and at that time, well, you had an open case and you tested positive for serious drugs, >> right?
>> Very serious drugs. And this says that while under the influence of those drugs, you drove your children to the doctor's office while under the influence, >> right?
>> That's the report, >> right?
>> Okay. These reports all seem to indicate that they tried and tried to see you, but you kept cancelling appointments with them and were a no-show.
>> Well, >> okay. That's what this report says. You gave me the report, >> right?
>> So, let me understand this. After coming in and making an assessment, Child Protective Services determined to file a petition on behalf of your youngest child.
>> Yes, they did.
>> Okay. Yeah.
>> Well, after everything I read there, I think that that was probably a good idea. I don't know what happened with that. I assume that the petition was ultimately dismissed if you have your children back with you.
>> Do you have your children back with you?
>> Yeah, right away. As soon as I went to court that day.
>> That's okay. They determined >> after they spoke to you and irrespective of either her motivation or anybody acting on her behalf or somebody that she knew or her >> call child protective services. The question that I'm presented with, was there a basis for concern about your children? No. And based upon the reports that I've read here, and those are reports that you gave me, >> right, >> that those serious questions about what was going on with the young children in your house, deserved a second look. You would had a history with methamphetamines.
You had a serious weight loss. You refused to meet with case workers according to the report you gave me.
>> That is I have other reports too if I may, please.
>> Just Thank you. I'm not finished.
>> Okay, good. Thank you. Because if you've been in family court, as I was for 25 years, often incidents are called in of suspected child abuse and neglect. A case worker goes out, takes a look, and says, you know, I'll continue to watch it, but I don't have to file a case. It hasn't reached the level where I think that I should file a case and remove a child. In this case, child protective services came and tried to do an investigation, which according to the worker, you evaded. You missed appointments, you rescheduled, you didn't show up one time, >> and then not one time. They also had a history, a prior history of you involving drugs, involving driving your children under the influence of drugs.
Recent history. It didn't happen 20 years ago. If it happened 2019, this says 21. If it happened 2019 or 2020, that's still recent history. So, whoever called, it was worth, according to this case worker, >> they had sufficient information based upon what they saw and what they knew to remove the 2-year-old. So, that part of your case is dismissed, which is the only part of your counter claim that I was really entertaining. You owe your sister $2,96.
$2,000 for rent and $48 for I forget what what it was. Blinds.
>> Thank you. We're done. my report.
>> Tiffany, >> I had drug tested every month during the time that this happened and it was like a oopsie under my doctor's supervision.
I just helped her and helped her and she takes advantage and takes advantage.
>> You don't call CPS on your sister when you're the one that took off to Africa for 3 weeks, 4 weeks. And this whole thing wasn't about money. It just I needed someone to tell her, "Look, you you can't take advantage of people anymore."
>> She's still the outcast that everyone's upset with.
>> I'm not the outcast, though, but I'm definitely not helping her anymore.
Sarah and Judy.
>> So, we've seen it a lot here, claims for unsubstantiated CPS reports being filed and people seeking damages for that. So, I'm just wondering, do you think there was a basis? Is that why obviously you didn't rule in her favor on the claim of the false CPS report? So, there must have been something in there that, >> you know, when people use child protective services as a retaliation for other behavior, that's always abhorentt.
But there are some situations where CPS may be called because someone knows that there is an abuse or neglect and has not done it until the other person irritates them.
>> Well, that's not a false CPS report.
Maybe motivated by something else, but that's not a false report. And so in this case, the defendant had a history with CPS, >> current history with CPS that was relatively serious. Well, then it was a good thing that CPS >> Yeah.
>> went >> because that would be basis itself. It's basis itself. Yeah. Basis itself.
>> That alone. And just because she was cleared at the end of the day and has her children back now doesn't mean that it was an unsubstantiated claim.
>> Oh, no. They're watching.
>> Yeah, >> they're watching and they should be watching. I don't think any of them are bargaining. The 18-year-old daughter >> for property damage and stolen belongings.
>> Court come to order. All rise.
>> Judge Judy enters.
>> Have a seat, please.
>> Kevin.
>> Hello, judge. Case 2121, JN versus Pine Jagum.
>> Thank You're welcome.
>> Judy turns to Carlos.
>> Mr. Gillan, you rented a room in a house that you were renting or that you own?
>> Uh, that I was renting.
>> It's a three-bedroom house, and you live there with whom?
>> At the time, it was me and my sister.
Um, and then my cousin.
>> How long have you been living in that house?
>> I was living there previously with my sister for about uh 5 years, and then she then moved and then um it came over to me in 2020.
>> So, you've been living there for seven years.
>> Uh, about 5 years. Yeah.
>> When did you decide to rent a room? She came to me around early May um saying that she was going through a situation with her previous roommate.
>> She that would be >> sorry Nisha. Yeah, sorry about that.
>> How did you know her?
>> We worked together uh as servers. Uh but then she came to me um on the job saying that she heard that I had a room available and that she was going through it with some of her previous roommates before. She said she needed some place to stay. So I told her that she could stay with me um until she got on her feet.
>> Is that the conversation?
>> No.
>> Okay. So let me hear your version of the conversation.
>> So someone did tell me he was renting a room. I did need a room for rent. Um, as we all know, CO did happen. So, I wasn't in my place. I had stayed previously. I was moving. And so, I went to him and I said, "Hey, I heard you had a room for rent." He's like, "Yeah, girl." I'm like, "Yeah, yeah." So, I could pay like I can move in now, basically. So, I came to him um May 31st, moved in June 1st, which was the next day. He was like, "Yeah, girl. Just pay $800 a month. Just give me $1,000 to move in. You're going to love it. You're going to love it."
I'm like, "All right, for sure." So, it'll be monthtomonth. And that was it.
It was never like a till you get back on your feet. It was never like a helping hand. I paid to move in with him.
>> He never said it was a helping hand.
>> Well, he did just state that um I was going to be staying until I got back on my feet, which was never the case. It was I was staying there.
>> But you needed a room.
>> Yes.
>> Okay. And the rent was $800 a month.
>> Yes.
>> And he asked you for $1,000 upfront as security?
>> Yes.
>> And when did she move in?
>> She moved in on May 30th, your honor.
When did she pay you for June's rent?
>> Immediately. So, the day that she moved in is when she gave me the money.
>> So, she paid June's rent.
>> Yeah, she did pay June's rent. Yes.
>> And what about July?
>> She paid for July's rent as well. Yeah.
>> And what about August?
>> She did pay for August rent, but she does owe me for utilities. She's about 2 months backed up on utilities.
>> What about September?
>> We weren't there for September cuz the altercation already occurred on August 27th and 28th.
>> Okay. So, she was there for 3 months and she paid you for 3 months.
>> Yes, ma'am. Your complaint is that there was an altercation and at some point during her tenency, she brought in her boyfriend who's going to uncross his arms.
>> Yes.
>> Who was living with her?
>> And when was that?
>> So, she told me previously to her movie again that she did have a boyfriend and that he would be there from time to time. I allowed it. Um during his stay and while they were there, they were always arguing. It was like commotion like every other night. He would punch holes in the wall. They would constantly get into like fights. So what happened to how this whole thing got about? One day I had came home and I actually have the messages here.
>> Those are the messages you had on your phone between me and her men. Yeah.
>> Okay. May I see?
>> So he was outside of the building. I came home around just a second. I have to read them first, sir.
>> Yeah.
>> Kevin brings Carlos's documents to Judy who reviews them.
>> I don't understand what this is.
>> So I was pulling up to my house around 7:00 a.m. in the morning. He was outside sitting on the steps crying and smoking a blunt. He walked up to my car asking if we can have a conversation. I said, "Sure." He gets in my car. Um, we're talking. He tells me that him and Niga just got into a fight. Niga kicked him out again.
>> He and his girlfriend got >> Yeah. He and his girlfriend Niga um had got >> This was on August 27th.
>> Yes. August 22nd. Yeah. Um, so we had the conversation. He told me that Niga >> What were you doing at Look at me. What were you doing out at 7:30 in the morning?
>> So me >> No, no, no. Just >> me and Niga, like the night previously, we had went out together. We got in pretty late. We were out drinking. We did get into a situation, but it wasn't a situation.
>> I just want to know what you were doing out 7:30 in the morning. That's my question.
>> I was just leaving and walking to my car.
>> Did you have a conversation with Mr. >> We had a brief two to three minute conversation.
>> Okay. But you had a conversation with him. Now, you had had an argument with your girlfriend the night before you just said. What kind of an argument did you have with her?
>> It was basically we went out. We were trying to have a good time together. It didn't really kind of end up the night how I wanted it to go. She felt how she felt. It was never an argument of, you know, yelling at her or like we were going at it. It was just like, >> well, you had been out drinking.
>> Yeah.
>> And when you were out drinking the night before, did you have any altercation with your girlfriend while you were out?
No.
>> So, you had the altercation with her in the house?
>> Yes. In that apartment.
>> Okay. Now, he works nights. What were you?
>> I work nights and days. Yeah. I'm a server bartender, your honor.
>> Okay. Now, he wasn't home when you were having these fights with this argument with your girlfriend.
>> Fight. Not even an argument, but no, ma'am. He was home.
>> He was not at home. And when he came home that morning, you were outside.
>> I was walking to my car.
>> He was outside on the steps crying.
>> Just steps. Sorry.
>> Wasn't on the second.
>> You have to understand I move slowly but methodically.
>> Got you. Sorry, your honor.
>> Okay. Now, do you work?
>> Yes, I do.
>> Where?
>> Security.
>> Security for whom?
>> I lied.
>> What time do you report to work? On the 27th? On the 27th, I went to work late because of the situation that had happened previously that day with the cops. And we have the text messages of me texting my supervisor.
>> What situation? Previously that day, he wasn't home. So, what situation previously that day?
>> What happened previously that day was that?
>> Previously what day?
>> Earlier during the day, he had >> That was 7:30 in the morning. You hadn't seen him?
>> I'm I'm having my >> This is the 27th.
>> That wasn't the 27th when that happened.
We had the conversation on the 26th early coming back. It was 7 that day because we had got into it. I didn't see her at all. After me and her had our little uh falling out. I'm walking to my car. We have the conversation. I go home with her.
>> You went home for what?
>> He said that I was living with her. I was never living with her.
>> You were?
>> You went You went home for what? At 7:30 in the morning. What did you go home for?
>> To sleep.
>> To sleep. So, what you're saying is it wasn't on the 27th. It was the 26th.
this altercation that happened with me on the steps. It might have it either was the 26th or the 25th, but this happened way prior before the day on the 27th. The 27th is the day where the first police incident happened where there was the actual dispute over him and her. He said that she didn't pay the first month's rent, which we have in the police report.
>> Okay. I've already determined all the rent was paid.
>> Right. But he has the dates wrong cuz the 27th is not the day that we got into the altercation.
>> What was the date?
>> It was the 22nd.
>> It was the 22nd. 22nd of August, 2022.
>> Yeah.
>> And I'm off Mondays and Tuesdays. So, I was off. I went home to sleep after I left the apartment.
>> So, on the 22nd, your honor, >> on the 22.
>> Yeah. On 22, which is a Monday morning at 7:30. I pulled into my garage. He was outside crying.
>> So, it wasn't on the 27th.
>> No, it was on the 22nd. Yeah. 22nd in the morning. Yes, ma'am. It was 7:30 in the morning. He's sitting there crying.
I come in. He asked, "Can he come in my car to talk to me?" We talk. He tells me that him and Nija got into another altercation. She hits him. He like stops her from doing what she wants to do. He said that Niga expressed that she's talking to other people and that she just wants him to leave her alone. He then asked me, "Do I know about her dealing with any men or anything?" I tell him, "I've only seen her with one guy. It was some light-skinned dude who she went to the bowling alley with. Um, but other than that, I didn't see anything." I told him, you know, with me being 25 and him being 20, I said, "You know, you're a young man. You know, you have your own car. You got a place.
You're doing stuff. You should be living life. You shouldn't be, you know, getting beat or dealing with all this stuff. Just be young and live your life, you know. That's when he then >> Okay.
>> Yeah.
>> Did you have that sort of a conversation with him?
>> Not at all.
>> Okay. Tell me.
>> Conversation was two to three minutes. I never entered his car. I was walking.
>> Oh, no. Tell me what you said to him.
>> I told him that me and her got into it.
You might not see me around here. I don't know what the situation is. And he did tell me, "Focus on yourself. Y'all will be good."
>> Okay. So, it's pretty much So, whatever.
That was a discussion. you would had a fight with her on the 22nd and there was some registering some complaint.
>> Mhm.
>> Sir, if you say you might not see me around here, we had an argument. It was registering some sort of a complaint.
You didn't leave there happy on the 22nd.
>> Yes.
>> Is it right? You didn't leave there happy.
>> I never was upset how he's trying to make it seem. We didn't have this conversation of me being beat on or me crying.
>> You didn't leave >> Mr. June. You didn't leave there happy that morning.
>> Yes.
>> Is that right?
>> That's correct.
>> You would had an altercation with her the night before or earlier. Had you stopped and had a brief conversation with him. I don't have to get into the nuances of it. You weren't happy.
>> Okay. That's the 27th. And you say you told him you're a young guy.
>> You don't live your life. Yeah.
>> Live your life.
>> And then he then thanks me in those messages that I gave you. Right.
>> Okay. Caption coming up. Would you tell me what you know with regard to the vandalism?
>> Once I opened the door, I seen shattered glass all over the floor. His room was completely vandalized. There was a knife in the wall.
>> Can you explain these photographs to me?
>> I can't explain the photographs. I didn't do it.
>> A courthouse. The Judy Justice logo appears in the courtroom. Carlos, Niga, and Gallo. Carlos Gillian claims his former roommate Niga Pine and her boyfriend Gallow June vandalized his property. Niga is counter suing for a false arrest, tire damage and cyber bullying.
>> Now 22nd moves into the 23rd, 24th.
Anything happened the 23rd, 24th, 25th?
the 26th, I had got a phone call from one of my friends saying that Niga at the place that we were working at was going around telling people that I was trying to sleep with her boyfriend, saying that I'm trying to make him gay and that I go for straight men. Just a second. All this stuff. That's all hearsay, by the way, unless you have a witness to that.
>> Yes.
>> And I assume that you could have a witness to that if you like. Did you, Miss Pine, have any conversation at work with any of your colleagues about discussions that the plaintiff may have had with your boyfriend?
>> Yes.
>> Okay. Your honor, >> do you remember who?
>> It's actually another coworker >> a mutual friend between us.
>> Okay. And without going into the text of the conversation, were you registering complaints about Mr. Gilliam?
>> Yes.
>> Okay. That's all. That's all that's >> So, with that being said, um that following morning on the 27th, I then walked up to her room around 8:00 because, you know, she's living in my house. I'm helping her out. She's talking about me at my place of business. So, I went up there to go ask her, you know, what's going on, what's happening. The moment I go up there, she's like, "You're a you're this and this and this." We start arguing at this point. Like, we're both yelling at each other. It's getting heated. She then tells me that she's going to have some dudes come and beat me up. Uh, since I want to argue with a girl and all this stuff, men then come to my home. Six dudes come to my house.
>> How much later after the conversation?
>> This is probably like literally 10 minutes after the conversation. Like, this was very fast. She had these men come to my house. Um, I saw one of the dudes outside. I was trying to, you know, go outside and just be like, "Look, I'm not trying to do anything to her." We got into an argument. I'm hearing stuff. gallow out of nowhere comes from a corner and tries to swing at me. Once he does that, I then go inside my house. I go into my room and I look at my window and it's six men outside my home. She then lets these men inside the house. They're banging on my door, talk about bring outside and all this stuff. Oh, you want to fight women?
All this mess, banging on my door and stuff.
>> Was anyone else in the house other than the two of you?
>> It was my cousin with me at the time. He >> That's not your cousin.
>> No, this is my witness. Um, it was my cousin at the time.
>> A witness to what?
>> A witness to the next day, your honor.
Um, but back with this day, my cousin was with me. He wanted to go out and fight and do it. I said, "No, we're going to sit here and wait." The police end up getting called from the neighbors cuz it's six men outside banging and cussing and making a scene. The police then get there. There was an officer who I don't know if she already knew previously or who she was cool with, but the officer said that because I'm a 68 man and she is a woman, she feels intimidated by me and all this stuff. So he told me that the men who were there is allowed to stay there because she is a tenant there and that's her place. So they're considered her guest. Once that was said, your honor, I immediately got everything that I could and I booked a hotel at the Weston. I stayed there at the Weston for 9 days. That day she was going around on social media saying that I was scary and that I ran in my room and that I called the cops just basically talking smack about me on the gram. Um, hold on, your honor. I'm trying to find it.
If I may interject, if I may.
>> Not yet.
>> All right.
>> I'm sorry, honor, but she went on social media. It's >> okay. Just a second. So, was what you're telling me you don't have that in?
>> It might be in that file. Yeah. Sorry.
But it's like a message of her saying like, "Oh, y'all won't believe who who caught the police and ran in the room crying and like just talking smack." You >> Okay, here it goes.
>> Yeah, that's what she posted. Once she posted that and you know, people start hitting me up. I see it. Yeah.
>> Once she started posting that, people started hitting me up. They're like, "What's going on? what's going on this and this. So, I then went on Instagram and I had made a comment. I called her uh for short stands for because she was going around saying that I was dirty.
She went around telling me that I was dirty. So, I just let it be known on social media that the only thing dirty was her. You know, since she was talking about me on the gram, I decided to, you know, react.
>> I The truth of the matter is, although it's not pleasant, that's what people do on the internet. Yeah. And >> I was just matching energy, you know.
Yeah.
>> Got it. Let's get to your lawsuit, sir.
So far, she's lived there three months and she's paid three months rent.
>> Okay. Your claim is that during the time that you were in the hotel when you were out of the apartment, there was damage done to the property, right?
>> Do you have photographs of the damage that was done to the apartment while you were out at the hotel?
>> Yes, ma'am.
>> May I see it, please?
>> Here you go.
>> Carlos hands photos to Kevin, who brings them to Judy. She reviews images of vandalized rooms.
Where did you go when you finally left the plaintiff's house?
>> After I got my U-Haul, he dropped me off to my uncle's house and I stayed >> on what date?
>> So, I went there 20 the night of the 27th, August 27th, 222, and I came back the next day on the 28th to get my things.
>> Okay. So, he left on the 27th, you left on the 27th after he did.
>> Yes, ma'am.
>> Did you leave as well with your girlfriend? Correct. Where did you go?
>> I went to my grandfather's house where I was staying.
>> And how long have you been staying with your grandfather? all my life.
>> Where do you live now?
>> With my grandfather.
>> And where do you live?
>> With my uncle.
>> When you finally got back into your house, Mr. William, this is the way you found it.
>> Yes.
>> On what date did you come back, did you find it? This condition?
>> That was August 28th, your honor. I >> August 28th.
>> Yes, ma'am.
>> Okay.
>> I had woke up to a whole bunch of phone calls from my witness, Imani, and a family member saying that they were there. They found the place.
>> You want to stand up? Yeah.
Immani rises.
>> Would you tell me what you know about what happened on the 27th/28th of August with regard to the vandalism?
>> Um, I wasn't there the 27th, but we had a conversation that led to me coming to the apartment. So, I came to the townhouse, retrieved the key to get inside of the house. Once I opened the door, I seen shattered glass all over the floor. His room was completely vandalized. There was a knife in the wall, but this was all like downstairs.
Once I realized >> I'm going to show you these photographs, and I'm going to ask you if these photographs are a true and accurate representation of what you saw when you walked in on the 28th.
>> Kevin brings the photos to Imani, who reviews them.
>> Yes.
>> May I have them back, please, Kevin?
>> Kevin returns the photos to Judy.
>> Have you been to Mr. Gilan's house before?
>> Yes. Was it always in good order?
>> Yes. He's a clean freak.
>> You moved out on the 28th for how long?
>> I moved out on the 28th. I didn't come after that. Yes.
>> Permanently?
>> Yes, your honor.
>> Have you seen these photographs?
>> Uh, yes, I did actually. His family member sent them to me.
>> Okay. Can you explain these photographs to me?
>> I can't explain the photographs. I didn't do it.
>> Okay, fine.
>> I wasn't there, actually, and I have proof I wasn't.
>> That's a lie you're on.
>> Don't you lie?
>> Okay.
>> Just a second.
that's crazy.
>> She may not have personally done it.
>> The question is he certainly didn't do damage to his own property.
>> Oh, >> there is no Well, if you have proof that he did damage to his own property, then I'd certainly like to see it.
>> Caption coming up.
>> I do have proof I was not there. And >> I don't care whether you were not there or not. He can't show me he wasn't there. And your brother is not here. He can't show me he wasn't there. So, I have to decide if it was a stranger, the plaintiff, or this side. Maybe not you, but someone acting on your behalf.
Carlos smirks.
>> A courthouse. The Judy Justice logo appears in the courtroom. Carlos, Imani, Niga, and Gallo.
>> Carlos Gillan is accusing his former roommate Niga Pi and her boyfriend Galloju of destroying his property. Niga claims Carlos had her falsely arrested and damaged her tires.
>> Right now, I have damage.
>> What I would like to say, >> No, I don't want you to say anything. I want you to tell me what proof you have.
That >> damaged property.
>> I would like to restate. I have proof that he did not care about the apartment. That when I moved in, it was in horrible condition actually, and he's not a clean freak, and I wasn't there to vandalize the apartment at all.
>> Oh, just a second. I just asked you a question. Can't you give me an answer?
It's a simple answer. You said to me I have proof that he vandalized his property. Is that what she said?
>> Well, I have, your honor, if I may. I >> just a second. I want to make sure that that's what you said. I have proof that he vandalized his property.
>> His property was vandalized when I moved in is what I'm saying.
>> Oh, no, ma'am.
>> And I didn't Oh, ju just a second.
>> She says, "I have proof, your honor. He damaged his own property."
>> Okay. So, all I want you to do is show me proof that he damaged his own property.
>> Okay. So, I do not have video proof of him doing it, but based on my counter suit and the fact that I was falsely arrested and the harassment, the lies, even the online post that I haven't been able to show you yet, that he is framing me and that he did vandalize his own apartment. He didn't care about it.
>> Just a second. I'm willing to look at proof of any proof that you have that he vandalized his own apartment.
>> So, around the time, >> not so around. Just show me.
>> Okay. Okay. Sure.
>> Niga with documents.
>> So, what I have in my hand here, your honor, if I may, >> Kevin, >> is this proof that before I moved in, the apartment was not well taken care of. And I, like I said, I don't have proof that he went in and did it himself. But I do have proof that the apartment was never cared about to begin with. And after he actually moved all his things out, which he claimed and stated on social media, >> Yeah.
>> he took every all his money.
>> You can you can take these back. This is not what I'm talking about, madam.
That's a That's a dirty bathroom that you shown me. This is vandalism.
>> I didn't do that.
>> There is no question in my mind that this is vandalism. This isn't dirty house. It's disgusting. Somebody took powder and liquid. This isn't just sloppy and messy. This is clearly vandalism. So, is that all the proof that you have? You said I have proof that he vandalized his own property. I'm waiting to see that proof because otherwise there are certain things that ring true. Well, >> do you have any >> that goes I would like to recant that because I don't have proof that he did it. But I do have proof that I'm being framed. Yes.
>> You have to understand, Miss Pine, there are two things. Either he vandalized his own property, which I find is unreasonable because he would have to live with all this filth that's in his bed. He had to I'm speaking with you.
I'm speaking I would have to find that he took a knife to his own sofa and destroyed the cushions to his own sofa.
And quite frankly, I don't know this gentleman well, but he does not appear to be psychotic. Now, I don't say that he may not be a trutht teller all the time, but he doesn't appear to be psychotic. So, no person who's not psychotic does this themselves. So either some stranger in the night came in and vandalized his property or you your boyfriend and or your brother. Who did you say that you called your brother to come?
>> I called my father.
>> Your father to come?
>> Yes. And my father called my brother and he came.
>> Just a second.
>> Yes.
>> I knew I heard brother in here. Did your brother come?
>> My brother.
>> Okay. Called at least brother. I don't know if father came too. So I have to find if it was total stranger, the plaintiff or you, boyfriend, father, brother, friend, whatever it was. So all I'm asking you to do is, do you have any other proof other than the nonsense that you gave me?
>> The two cats.
>> Court come to order. All eyes.
>> Have a seat, everyone.
>> Kevin approaches judge Judy.
>> Case 2170, Jali versus Carter Nepomino.
Thank you. You're welcome.
>> Oh my goodness.
>> Judy turns to Katie.
>> Calderon.
>> Hello.
>> What's your first name?
>> Amante.
>> Amante.
>> Yeah.
>> Good. It's much easier than your last name for me to pronounce. Mr. Julio, this roughly is what the case is about.
You and Miss Calderon were in a relationship for a period of time. You decided to take an apartment. You were both on the lease. So far, correct.
>> Correct. your arrangement with Miss Calderon, which seems to be consistent in both your complaint and your answer, is that you had a much better paying job. She was going to provide the food and some other stuff for the house, and you were going to be covering the rent when you lived together, which you did.
>> Correct.
>> There came a time when Armonte, who was a friend of yours, came to live with you. According to you, he was going to help out with the rent.
>> Correct. He came, he lived with you, he helped out with the rent for maybe a period of time, and then he helped himself to your girlfriend.
>> Correct.
>> Now they're a couple. When you were no longer a couple with Miss Calderon, she stayed in the apartment for a period of time, but then they both left.
>> Correct. And you're suing both of them for rent and for the return of two cats that they took when they left. You claim the cats are yours.
>> That's good.
>> That's what the case is about. And some cat expenses in the event that I let them keep the cat. Cats. Two cats. So, when did you and Miss Calderon sign a lease together?
>> We signed the lease together at the end of July with the landlord present.
>> July of 2022. July of 2021. Correct.
>> And it was for a year.
>> Correct.
>> And you had a job working for whom, sir?
>> I worked for a company called Steris.
>> What do they do?
>> They provide medical equipment to hospitals all over the world.
>> How long have you been working for them?
>> I going to have eight years under my belt this year.
>> And when you moved into the apartment in July of 2021, what kind of work was Miss Calderon doing >> at the time? She was working at an I want to say an animal uh hotel.
>> It was a pet daycare boarding facility.
>> Okay. Were you an hourly employee?
>> I was an hourly employee.
>> And I am correct that when you moved in in July, your arrangement was that you were going to pay the rent.
>> That was >> the arrangement.
>> Correct.
>> When did Arante come to live with you?
>> About August to >> That's correct.
He just >> Judy glares at Katie. Amante was going to be our third roommate.
>> You mean one, two, three?
>> Correct.
>> Well, you're not roommates really. You and the defendant, Miss Calderon, were not roommates. You shared a room.
>> We shared a room and >> and Arante was going to live where?
>> In another room.
>> And what was your arrangement with Arante with regard to paying rent?
>> We would split the rent three ways.
>> Is that correct?
>> Yes.
>> And how much was your share of the rent?
I want to say approximately 9 27.
>> How long did you live there?
>> I was there when they signed the lease.
I watched it all happen when they signed the lease. I came in, they signed everything.
>> Well, you didn't sign the lease.
>> I did not.
>> But you were there from the beginning.
Yes.
>> And it was your agreement with the plaintiff that you would pay a third of the rent.
>> Yes.
>> Great. We asked the land too. So, hey, try not to hold each other's hands.
Let's do the coochie coochie someplace else.
>> So, you agreed with the plaintiff that despite the fact that you were not on the lease, you were going to assume the responsibility of a third of the rent, $927.
>> Yes.
>> So, you moved in July, August, September, October, November, December, January, February, March. You left in April.
>> Yeah.
>> So you were there for 9 months?
>> Yes.
>> Did you pay rent for the nine months?
>> Yes, ma'am.
>> Is that correct?
>> He paid rent for about the 7 and 1/2 months.
>> Okay. And then you left.
>> Yes.
>> Why did you leave?
>> I decided to leave because he decided to go to another place he was offered. So >> what do you mean he decided to go to another place?
>> Um got a place from his grandparents in another city. So, I couldn't hold down the rent with her. So, I decided to leave to save money and go back to my parents house.
>> Now, Mr. Jal, you see, you don't make up a story like that like he just told me.
A lot of that has the ring of truth to it. Where are you living now?
>> My grandparents house in an in-law unit.
>> So, when did you tell them that you were going to a different place?
>> In March.
>> When did you leave?
>> I left in July. Did you let him know that you were staying until the end of the lease?
>> I >> I what >> I >> I what >> I discussed with them that I would be leaving, but I would stick around to help them find either a different location or even suggesting that we all went back to our respected families just to, you know, call it.
>> Mr. Jal, this isn't working for you. I have to tell you something, sir. This case is not working for you at all. And it's only because Mr. Romante is very direct with me that you're suing them for $10,000. Where does that come from in your mind? Your agreement with her was you were going to pay the rent.
Never out of pocket. Your agreement was you were going to pay the rent. He paid his rent when he was there. He paid his one-third. You then told them you were leaving. That's a whole different story than what you wrote in your complaint, Mr. Julio. Do you understand?
>> Correct.
>> It's a whole different story. So at best Arante would owe you for 3 months rent if they just left. But you told them that you were leaving. Now when did you find out that they were a couple?
>> I found out at the end of April.
>> Were you all living together?
>> Yes.
>> So you just had two months left to the lease. So he was paying you. He paid you in March. You had May, June. You signed the lease in July. So it was over at the end of June. June 30th.
>> It would been over at the end of July, your honor. Well, she doesn't owe you any money for rent. At most, he owes you two months rent. Tell me why you left.
>> Uh, my job doesn't pay that well, so I decided to go back to my parents house.
>> When you took this apartment, this expensive apartment that was almost $3,000 a month rent. Had you had a discussion with Arante about moving in with you before?
>> Yes.
>> Okay, Mr. Jul, I'm reading your complaint because something wasn't registering right with me. You say you moved into the apartment together in August of 2021. Then you go through a whole bunch of stuff about a cat and then another adopted cat. You said in October we adopted a second cat. Around this same time, a third roommate moved in to shoulder some of the Well, that's not true. He moved in right at the beginning.
>> And that was >> that was what?
>> That was uh >> a mistake. That was a mistake.
>> Okay. But Aronte acknowledges that he agreed right at the beginning. He volunteered the fact that he was there at the lease signing because it was agreed at the lease signing that he was going to pay a third of the rent. So sir, you owe him rent. As long as you show me that you've paid the rent, you moved out in July.
>> Yes.
>> And you paid your rent through July or were you evicted?
>> No, I paid my rent in July.
>> Through July?
>> Yes. Okay. 1854. Armante, you owe him $1,854.
That's for two months rent. Got it. I'm not subtracting anything because you stole his girlfriend.
>> Caption coming up.
>> What were you requesting when you filed your small claims case?
>> Either the return of both cats or $5,000.
>> That's not happening for you, Mr. Jal.
>> And later today, >> there were restrictions put on the space. No, >> you have to pay attention.
>> Okay, >> sir, because what I'm suggesting is really in your favor.
>> Oh, okay. Let me Okay.
>> A courthouse. The Judy Justice logo appears in the courtroom. Kamar, Katie, and Damonte.
>> Kamar Jalil claims his former roommates Katie Calderon and Amante Nepoeno are wrongfully keeping his cats and owe him rent money. Now, let's deal with the issue with the cats. She doesn't owe you any rent. That was not your agreement with her. You moved out in July, August, September, October, November, December.
5 months ago. She's had both cats, right? She says they're her cats. When did you first file a small claims case?
>> September of 2022.
>> What were you requesting when you filed your small claims case? Be careful. I was requesting either the return of both cats or $5,000 which was the accumulated expense of not just the cats but also the expenses of our dogs as well. So any animal expenses for >> okay >> the time that's not happening for you Mr. Julia when the cats were either registered or went to the vet whose name is on the sheet as owner >> I believe it was Miss Colar. Is that correct?
>> That's correct.
>> And she owns the cats and she's had them for the last five months. I suggest that you go and adopt two more if you want some more cats. Do you understand?
>> Yes.
>> You were living together as a couple.
However, your friend Arante has to pay you for the couple of months rent that he didn't because he says, not you. He volunteered that that was your agreement from the very beginning. So, he owes you $1,854.
We're finished. Thank you very much.
>> This court is a journ. I think he's just kind of butth hurt that I moved on.
>> At least now I can put everything behind me and say that I did try.
>> I didn't think it would escalate this far.
>> All you can do in a situation like this is just you learn from it and you move on.
>> The heart wants what the heart wants.
>> This is what it is. It's life. Judy, >> I find fascinating Sarah that people will write and or be assisted in writing a complaint and an answer, but they read it over. This man is an intelligent man.
He has a serious job for eight years.
First of all, he was suing for $10,000.
Come up with that money. $5,000 for the cat's expense is ridiculous. But his complaint had really nothing. Even the timeline >> as your clerk, I know that is a pet peeve of yours when >> I don't understand it. You know, if you're going to tell a lie, >> at least tell a consistent lie.
>> Correct.
>> I think the right thing happened. I think the defendant friend admitted himself that he owed the rent and that was great even though he probably should have just >> had not said I was there when the lease was signed. This was always our agreement. I was going to be the third.
>> He was honest which we always appreciate and so I think the right >> I think he needs to like you say put a period move on >> move on anyway all all happy and they look happy they couldn't keep their hands off each other. Case number 2172 Foster Gartner versus Menzel. All parties, please come forward.
>> Jamar Foster and Shan Garner are suing record producer Livven Manzel for event costs after Livven cancelled their Halloween party.
>> Who's Mr. Garner?
>> Mr. Foster.
>> Right here.
>> Are you going to be speaking? You're standing in the speaking spot.
>> Yes, ma'am.
>> Okay, great. According to what I read, the defendant rents a music studio. Is that correct?
>> I rent a facility in which I own a music studio. You rent in someone else's building.
>> Yes.
>> And you're recording people. During the course of your business, you decided to enter into an agreement with the defendant to use that recording studio which she rents from that space which she rents from a landlord.
>> May I correct you please, your honor?
>> Yes.
>> Um, she actually it's a facility that has multiple units in it. She runs a studio and then there's other event space inside of that same facility.
>> Okay. Give me an idea of how large the space is.
>> I believe we were quoted something like 5800 square ft.
>> And so you have a music studio and around it is other open space.
>> Yes.
>> You decided to go into some sort of a business with her. You wanted to run events.
>> Yes, ma'am.
>> Social events. nothing to do with the music studio.
>> Absolutely not.
>> Is that correct?
>> Yes.
>> And according to you, you gave her $6,000.
>> Yes, ma'am.
>> Sort of front money to start using that space.
>> Yes, ma'am.
>> Subsequent to giving her the money according to you, there were restrictions put on the space on the number of people you could have, the kind of parties you could have, etc. >> No, absolutely. I apologize.
>> Well, you have to pay attention.
>> Okay, >> sir. Because what I'm suggesting is really in your favor.
>> Oh, okay. Let me Okay.
>> So, is really in your favor. So, you have to think.
>> Okay.
>> Subsequent to giving her that means after giving her the money, restrictions were put on the kinds of events and the number of people you could have in the space. Is that true or not true?
>> That is absolutely true.
>> No, that's not.
>> Just I'll get to you in a second.
>> Okay.
>> And you want your $6,000 back?
>> Yes, ma'am. And >> that's what it's about. The defendant does not deny that you gave her $6,000.
And then I'm going to hear what her defense is. So I want you to tell me when for the first time did you have a discussion with the defendant about going into this business venture where you would front the money and whatever events you would have there you would reap the benefit the financial benefit from that. When did you have that discussion with her?
>> Okay. So, we met living at the end of uh August of 2022.
We actually signed the agreement pretty fast. We signed the contract agreement on September 1st.
>> May I see the agreement?
>> Yes, ma'am.
>> There was no agreement signed, so I don't know how it could be signed.
>> She keeps arguing that.
>> Just a second. Could you be quiet?
>> Yes, ma'am.
>> Jamar hands the document to Kevin, who brings it to Judy. She reviews it.
So in your hand, >> what's >> that's the studio that she runs.
>> Sarah, you have to you have to sort of explain it because I don't see signatures. You know, I'm used to looking at contracts where people sign things, but I know you can sign things by docuign. Your signature isn't on here.
>> Yes, ma'am.
>> And >> that looks like a signature from a docu sign or some sort of online.
>> Okay. Is that you?
>> This was a proposal that I did. I do not even own yet as a DBA. Just a second.
It's getting better. Don't say anything.
This is your proposal. Now, I'm going to read it.
>> Okay.
>> And your masterpiece management.
>> Yes, ma'am.
>> Okay. Well, so this is sort of easy. You prepared this proposal. Speak.
>> Yes. After >> just a second. You prepared this proposal.
>> Yes, ma'am.
>> And as a result of this proposal, you received and deposited $6,000.
>> Yes.
>> Yes. Well, then you have a binding contract. Okay. So that's what I'm telling you. You have a binding contract and there is nothing in this contract that limits the kinds of events or the number of people or anything else with regard to this space. All it says is business activities, event planning and event rentals. Nothing else. And this is your proposal. So the terms of it are construed if there's any material question since you prepared the agreement which became a contract once you accepted their $6,000.
I view the terms of the agreement most harshly against you because you prepared the document and it says this agreement cannot be amended without the written consent of all parties.
>> Yes.
>> Yes. So you signed the agreement, you got the money and then at some point according to them and according to you, you made certain limitations on the kinds of events, the numbers of people etc. >> That is >> now that now that happened according to you because you do not own that space.
You rent that space and there was a problem with the first party that they threw.
>> Correction.
>> Come on. We're not talking about Gone with the Wind here. We're not talking about a six volume masterpiece. We're talking about a yes or a no.
>> Caption coming up.
>> Based upon this proposal, they gave you $6,000 which you deposited into your bank account. That means a contract was created. That's the agreement. I'm telling you, that's the law.
>> A courthouse. The Judy Justice logo appears in the courtroom. Jamar, Shawn, and Livven. Jamar Foster and Shaun Garner claim record producer Livven Manzel broke their agreement by cancelling their event. Livven is counter suing for the costs of a recording session.
>> Okay. There was a party that got out of hand.
>> Yes, ma'am.
>> Okay. And after that party that got out of hand, too many people or whatever it was, your landlord complained.
>> Yes.
>> Okay. And it was after that that you told your two partners that the >> we are not partners.
>> Yeah. According to this you are.
>> We didn't finalize the agreement.
>> This is a finalized agreement. Madam, I just said to you, I want you to pay attention. This is your proposal. Based upon this proposal, they gave you $6,000 which you deposited into your bank account. That means a contract was created. But that's the agreement. I'm telling you, that's the law.
>> You prepared the proposal. You signed it. They said, "Okay." And they fulfilled their part of the agreement by giving you $6,000, which you accepted.
Got it.
Got it. And you can't, according to the agreement that you prepared, modify this agreement any other way than a written contract signed by both parties. You can't change the rules. Did you know that this was rented space?
>> We didn't have all of the details about the place. Well, see, next time you should know what you're dealing with, whether she's the owner or whether she's not the owner, whether she's a renter, whether she has the ability to rent out to subleasase for events. I mean, all these things before you give somebody $6,000. You should know that. Okay. And you had one event at the space.
>> No, we actually didn't get an opportunity to throw any events at the space at all. the event that you were speaking of. She had partnered with another group of promoters and individuals to throw that party. So we >> So you didn't have any >> thing to do with that? What was it? A Halloween party or something? It was a Halloween party, but that wasn't with you.
>> No, that wasn't.
>> Is that correct?
>> He was a part of the event.
>> Is that correct that it was with other people?
>> Yes, it was correct. It was with other people. They were just associated with the event. They worked at the event. And >> I don't care whether they worked at the event. You received money from other people for an event.
>> Yes, ma'am.
>> Well, that let's be clear. And after that event, you imposed additional restrictions on the use of the space.
>> Just a hold on a second.
>> They knew about the >> Hold on. They can't tell me what they knew. This is your contract.
>> They called a firef.
>> Uh my landlord contacted me that the neighbors were complaining people were parking on their lawns 90 minutes into the party, but it was not their party.
somebody else paid you for it. The next party they wanted to throw involved minors and I told them absolutely not.
>> Yes, ma'am.
>> I just made it clear what types of events would be approved. Well, you can't do that. I'm just telling you you can't do that.
>> Ma'am, I'm I'm not allowed to throw events that have out drugs for children.
>> You have to understand something. You can do whatever you want as long as you put it in a contract. You prepared the contract. This contract is silent as to any restrictions on the space for events. So, you have to give them their $6,000 back because they didn't have an event. They got nothing of value for their $6,000.
>> Correction. They were managing an artist whenever I met them that they were responsible for paying. So, I'm counter suing them for $1,000.
>> Just a second.
>> Okay.
>> $6,000 they get back.
>> Okay.
>> Easy. That's a contract case. Now, you have a counter claim and your counter claim is for $1,000 because $50 because because you say they owe you that for a rental that they did for an artist that they manage.
>> I provided my services as a recording artist and a music producer for their artist. I provided them with two exclusive beats, which >> Well, show me the contract with them.
>> I have >> Just show me the contract with them.
>> There's no contract.
>> Judgment for the plaintiff in the amount of $6,000. Counter claim dismissed.
We're done. Thank you very much.
>> Supported the jury.
>> I was just trying to have a proposal, not a finalized agreement.
>> Well, I appreciate us getting some type of justice out of the situation.
>> They came in wanting to do multiple things. I'm excited for my small business.
>> We tried as much as we could to help out and make sure that we increase the revenue streams inside of that business.
>> They're actually going to be hosting hookas with children at your event in your space. I'm not comfortable with that. to ever associate us with any type of drug use or abuse, especially involving children. That was just in an inaccurate claim.
>> I think it's better just to part ways.
>> Move over to bigger and better things.
Sarah, >> I was going to tell you I had the invitation per se for the event for Halloween that they had put together.
So, they put a lot of time and effort into planning the party. It seemed very legitimate. There was notes about security. There was notes about no alcohol. Food and drink will be provided. So, I could tell that they had put in a lot of effort to hosting this event. And although it wasn't a malicious breach on the defendant's part, I understand she hosted a party that had nothing to do with the plaintiffs that she got into a little bit of hot water. So, to be cautious, she was letting them know, hey, I can't host these types of events with a lot of people. It makes the street too crowded.
Whatever the reason. However, I disagree with you because I would have given them the full 10,000 that they were asking because although not a malicious breach and I understand her >> guessing in your house, madam, she wasn't burglarizing your house. She was bitten by your pitbull. That's what the case is about.
>> Told she was told not to go into my house >> if I believe you. Now, I'm going to look at your video.
>> Oh my god.
>> Footage of Mila stepping through a door then backing out onto a porch.
>> So hard. She even said it was her fault.
>> It wasn't her fault. It was your fault.
You had the dangerous animal.
>> How was it my fault?
Don't ask me. Don't ask me any questions, madam.
>> And now the conclusion.
Mila Basin is suing her former employer, Sarah Adams, for lost wages and pain and suffering after being bit by Sarah's pitbull.
>> Okay. My issue actually is in addition to everything else. Why would a seemingly smart woman have a dog that she would have to warn people about to come to her front door? Why? I say to myself, why? I don't understand that.
And when I was preparing for this case today, looking at the complaint and looking at the answer, I I can do a little multitasking. I was reading the newspaper.
This is today.
A 7-year-old Louisiana girl was mauled to death by a neighbor's pitbull after it ran into her family yard. The name of the person is here was that child was laying outside her East Baton Rouge Parish home Friday when the dog barreled onto the property and viciously attacked her. Family member tried to stop the dog by hitting it with a walking cane, but the animal couldn't be deterred. first graders suffered multiple bites to her face and severe skull damage. She died.
The dog was euthanized. The dog's owner told the officers he wasn't home during the attack and regularly lets the dog roam the neighborhood. He was charged Saturday with homicide.
>> Yeah.
>> Perfect.
Perfect. I would go right from charge to execution. And I also have proof that another lady down the street was bitten by >> Just I'm going to get to you. I'm not finished. I'm not finished. I don't understand. I have others. I have others cuz it looks like you look like dogsitting mom killed by pitbulls.
North Carolina woman was mauled to death by two pitbulls. She was dogsitting for after the mother warned her to stop watching the animals. According to reports, that's all. husband came home, found her in the backyard being eaten by two pit bulls that she was watching for her son. I don't understand. I have more, but I won't bore you with more.
So, I don't understand why intelligent people have a dog that they know is capable of killing somebody, of just turning and killing somebody. I don't understand it. I think, you know, insurance companies can can legally discriminate against people who have pit bulls by saying, "We're not going to ensure you."
>> And there's a reason for that.
>> But your honor, I told her before she left not to go in my house.
>> My dog was not outside. My dog was in my car >> protesting my look. I want you to look at the video again. And unless your daughter is a and can't follow your instructions, she did not say to her, "Wait outside." She saw Just a second. She saw her. She was in charge of your home that day. She permitted her to come in and put the drink down. She did that.
>> She You want to watch the video again or do you acknowledge? So you acknowledge it. So I don't care what you said to her. When she got there, the circumstances were such that your daughter, who was taller than you are, was very happy to have her come in instead of saying, "You're not allowed to come into my house cuz we have this vicious dog."
>> It's not vicious.
>> Which have Oh, yes. A dog that a dog that bites somebody that's coming in.
>> She was protecting my children in my home.
>> Just a second. I understand what you're saying. And I'm saying to you that she came in with your daughter within inches from her and your daughter when she opened the door, didn't you see the dog?
>> No, I didn't realize.
>> What? You didn't realize?
>> No. It happened so fast. When I entered the door, I then realized. So, I came back to rush >> to stop Mila, but she already got bit.
It was too late. So, it is my fault, >> right? It's not your fault.
>> I love that. It's too bad that you can't teach that to your mother.
>> It's really too bad you can't teach your mother to say it's my fault. I have a dog that can be vicious. And so far the dog has not been vicious to my children.
I hope for your sake and your brother's sake that one day the dog doesn't get annoyed with one of your brothers. I just hope. I mean, this lady was about your size, the one that was killed by the two pitbulls. An older lady.
So, I'm hoping your mother chooses to have that instead of double locks taking care of her children. Great. But then she has to pay the consequences.
>> Caption coming up.
>> I mean, I have tell you, I'm old. I'm very old. I'm probably the oldest person that you know. I have never read one article where a Shih Tzu killed a person. That's why I have Shih Tzus. You have Chihuahua. I've never heard about a Chihuahua killing a person ever.
a courthouse. The Judy Justice logo appears in the courtroom. Mila, Sarah Adams, and April.
>> Mila Basin claims her former employer, Sarah Adams, owes for injuries after being bit by Sarah's dog. Sarah says Ma accepted a $300 settlement from the incident.
>> Now, may I see the note that you had from a previous neighbor?
>> Yeah. So, this is a text message from Sarah to me stating that the neighbor I could read.
>> Okay.
>> Nobody can state to you.
>> Judy reviews a document.
>> Okay. What was the name of the other woman that got bit by your dog?
>> Your honor, it was my neighbor. And >> just a second. I asked you for a name.
Did she get bitten anywhere around this time?
>> No.
>> What year?
>> It was 2020. And it was a dog fight that me and her were both trying to break up.
>> Just Just a second. It was 2020.
>> 2021. Excuse me.
>> Okay.
>> She is my neighbor.
>> Just a just a sec. So, a year before.
When? In 2021? Give me a month.
>> I don't remember.
>> Summer, fall, winter, spring, >> fall. So, you're talking about September or October?
>> Somewhere around there. Yes.
>> Was she treated for the dog bite?
>> No, your honor. It was not >> The answer is no. She was not treated for a dog bite. Not seen by anybody.
Correct. Okay. Can I see photographs of the dog bite, please? And >> I also have the first initial appearance that I went to the hospital.
>> Mila hands photos to Kevin, who brings them to Judy. She reviews images of skin contusions and puncture wounds.
>> Now you can step back up. I have another question for you.
>> Judy turns to April.
>> Now you were there. I heard you say from inside, "Oh, I'm sorry. I'm so sorry. Is that right?
>> Yes.
>> Yeah. At least twice. Now, after this happened, what did the plaintiff do?
>> Yeah.
>> After this happened, just you and your two younger brothers were home. What did the plaintiff do? She was sitting outside on the porch.
>> We came and gave her some towels.
>> Who's we?
>> My brother.
>> So, you got some towels. I saw she asked you for some towels.
>> Mhm.
>> And then we tried to give her some band-aids.
>> Put the paper down. and you were annoying me.
>> Um, she said, "Just let me come in." So, I put away the dog.
>> She said what?
>> Just let me come in. So, I put away the dog and I put her She was in my mom's bathroom and we were fighting band-aids and rinsing it off.
>> And then I didn't ask you a question.
>> Now, she's in your mother's bathroom.
She's trying to clean it up. And you put the dogs where?
>> We have kennels for them. Cages >> and kennels.
>> Mhm.
>> Okay. You have kennels for them that you put them in at what time of day or when anybody is coming over. When do you use the kennels?
>> Uh we use them when we leave or about to leave or if somebody's coming over that they have a met.
>> Okay. Now you knew that the plaintiff was coming over. Your mother had told you the plaintiff was coming over.
>> Yes.
>> Okay. And did your mother tell you in that phone conversation would ordinarily ask because I know I live with people your age and a little bit older.
When is McDonald's going to be here?
When is it going to be here? Did you ask your mother that question?
>> No.
>> Did she give you any indication about how long it would take?
>> No.
>> How did you know when plaintiff arrived?
>> The car pulled up.
>> So you were looking outside for the car?
>> Yes.
>> Great. And when you were you looking outside for the car, you knew the food had arrived.
>> Yeah.
>> You went outside?
>> Yes. I closed the door right behind me.
>> Of course. You closed the door behind you. You went and got the food. There was extra food. She was clearly following you. And you clearly saw that she was following you into the house.
>> No.
>> Well, by the time you got to the front door, you want to see it again? You turned around. You saw that she was there behind you.
>> That's when when I went in the house.
That's >> No, no, no, no, no. Right before. Right before. Play it again, Sam.
>> Footage of April carrying food while approaching the house.
>> She's now out of the car.
You're calling your brothers.
>> Turn around. You look at her and smile.
Say nothing. She walks in.
>> So you say nothing to her.
>> Got it.
Don't say don't come in here. Don't come in. Just leave it outside. You're both smiling. Smiling.
>> You want to see it again? No. You were both smiling when you walked and play it again, Sam.
>> Footage of Mila approaching April from behind.
April turns to her.
Got it.
>> Okay. Thank you.
>> Got it.
>> Got it.
>> Yeah. I very good, >> Miss Bazine. If quite frankly, the only thing that's distressing to me about your complaint is that you're only suing her for $3500. That was >> that's the only thing that is, you know, as far as I'm concerned, you could have just as easily been really seriously injured. And to me, people who keep will keep an aggressive dog that's an aggressive dog at home for whatever reason, especially a breed that has been determined to be a potentially dangerous breed of animal, deserves any consequences. This guy, this 20-year-old idiot, is going to jail. If I was sentencing him, he would go to jail for a very long time. As an example, maybe you have to set examples for people who allow innocent people to get killed because they like a particular breed of dog. I mean, I have tell you, I'm old. I'm very old. I'm probably the oldest person that you know. I have never read one article where a Shih Tzu killed a person.
>> That's why I have Shih Tzus. I've never heard I've heard them oh they my finger maybe you know they ripped my stockings they ate the furniture leg but I've never read >> a piece you have chihuahua you have chihuahua I've never heard about a chihuahua killing a person ever.
So if you're dumb enough to have a dog you have to accept the consequences.
This guy is going to accept the consequences for his stupidity for letting his pitbull roam around by going to jail. And you don't accept the consequences by paying the exact amount that she's requesting, which is $3,500.
Your counter claim is stupid and it's dismissed. And I'm done with your honor.
We had an agreement that she signed.
>> Done with you.
>> We had an agreement that she signed.
>> Caption coming up.
>> I was very high on narcotics and coming under the influence of coming out of the hospital. I do not remember signing this. And if it was, it was for her to make me feel better because of what happened.
>> I'm sorry, Miss Basin. That's not going to fly with me.
>> A courthouse. The Judy Justice logo appears in the courtroom. Mila, Sarah Adams, and April.
>> Defendant Sarah Adams is accusing her former employee, Mila Basin, of harassments after her dog bit Mila. Mila claims she did not agree to Sarah's $300 settlement.
>> We had an agreement that she signed. She signed the agreement for $300 and we were done.
>> Okay. I'd like to see that if she >> On top of that, the next day she came back into my house to meet the dog that bit her.
>> I don't care. What do I care about that? Why would you bring >> bit? She she she picked at it. I have all this evidence that she picked at it and that's what it turned into because she didn't take care of it.
>> I have to tell you, I don't care whether she took care of it or whether it got infected. If I got bitten by somebody's vicious dog, I don't care whether it got infected or not. That's a traumatic event.
>> Reut just a second. But if you signed a release to her, >> that's a different story.
>> No, I didn't.
>> She signed that paper.
>> Don't. Sarah Adams hands a document to Kevin who brings it to Judy. She reviews it.
>> Why did you sign this? This is clear.
First would Kevin.
>> Can I see it please? And what is the date on?
>> Well, it says this agreement settles a dog bite that happened on 718.
>> This was signed in October November.
>> If you shout out again >> because I was missing all my money. I was not getting paid. I needed something from her. I >> What do you I don't understand what you mean. You weren't getting here.
>> When's Is there a date on this?
>> And I do have other things that she signed. If you need to verify the signature, >> I was very high on narcotics and coming under the influence of coming out of the hospital. I do not remember signing this.
>> And if it was, it was for her to make me feel better because of what happened.
>> I'm sorry, Miss Basin. That's not going to fly with me.
>> That's not going to fly with me. If you accepted the $300, >> pay careful attention to what I'm saying before you answer. If you and the defendant in any action can at any time, even without a lawyer, if neither of you have a lawyer, I'm speaking can settle a claim if they wish to settle a claim before getting the courts involved. That can happen and that should happen in many instances. I'm not quite sure this one, but it certainly should happen more often than not. You settled for less than you were entitled to. You settled for $300. Did she give you $300? No, your honor.
>> May I see that document, please?
>> She did not.
>> Okay, let's see whether she did a car battery.
>> No, no, no, no, no, no, no, no. Let's not get ahead of ourselves.
>> I agree to give Mila $300. Did she give it to you? No.
>> Show me that you gave it to her. And when I gave her cash, it's on camera at work. I handed her at work with my boss there. My boss, you can call him right now.
Listen to me. I'm not calling your boss.
That's your problem to prove it.
>> I also helped her when her car broke down. I paid for a battery. I paid for lift for her. The dog bit me. Shh.
>> I don't care. All I want to see is proof that you handed her gave her cash 300.
>> I don't have proof cuz I gave her cash.
And >> Well, that's a problem for you. Did she give you cash?
>> Your honor, no help me out with a car battery and that she loaded.
>> Just a sec. It doesn't say that you gave her $300. Your honor, she's lying. It says I agreed to give her >> She's lying. I handed her $300 and made and had her sign that at work.
>> We did it at work. She's lying.
>> Well, then then I'm going to give this to you. She says you didn't give her the $300. You have no proof that you gave her the $300.
>> You have no proof?
>> I don't. I don't. We don't have any proof. $3,500. Judgment for the plaintiff. We're done.
>> This court is a journ.
>> I feel like if it would have been a Shih Tzu that bit her and did that damage, I feel like the judge would have favored would have gone in my favor.
>> And I knew I would get justice coming here for Pit Bulls. She takes care of the community. I'm so glad that happened that way.
>> I had a lot of evidence and the reason why her bite turned into what it looks like now is because she didn't take care of it. She picked at it.
>> I was happy to bring the kids food. I'm that type of person >> because I have documentation of her picking at it. She went to the hospital four different occasions. It's >> pretty traumatizing.
>> I know she was fine cuz I have text messages that prove that she was fine.
>> All of a sudden, the dog just got me, >> that it was her fault. She knew better than to go in the house.
>> Right when I walked in, the dog lynched and grabbed my leg.
>> I walked in and then I realized there was a voice behind me. I I went back and saw that Milo was back and she got bit by that time. So, I went to go help her.
>> Locked its jaw. The her tooth went really far down deep. Me and the baby girl both had to hit the dog to get him off of me.
>> I picked up the dog and I put her in her kennel.
>> Very terrifying. I still have PTSD and even watching that video was shocking.
>> She was constantly complaining about the dog bite to myself, my boss, slandering me every chance that she got.
>> Absolutely ridiculous.
>> And I said, Mila, look, this needs to be settled once and for all.
>> Bullied me and put me in a position, cornered me, and made me do what she wanted to do. She was my boss, so whatever she said, I had to do.
>> What do you want? She said, give me $300 and I'll sign something saying we're done. So that's what I did.
>> I don't know. Some people are different.
>> Sarah and Judy.
>> So I just wanted to point out a distinction in the articles that you brought in. I know you've been hearing these pitull cases for decades and so I understand your outrage every time you see one. But the distinction in the news articles that you brought in today as examples as well as this case. There's a couple key differences. One, the main one being in the newspaper articles, the dogs were outside outside the home, outside the control. And in this case, the defendant wanted to make it especially known that the dog never left her home. However, from a legal standpoint, it's a more egregious charge if you allow your dangerous animal out and about in society without any sort of warning. However, just because it's inside your home doesn't absolve you from that responsibility. The plaintiff was still an inviteee into the home.
Like you had said, the daughter had every opportunity from the street all the way up the sidewalk all the way onto the porch and even into the screen door that you can see on the video opened up.
Never once said, "Oh, just wait outside." Even with my own dogs, >> put the put the >> or put or leave the food on the on the porch. Even with my own dogs, golden retrievers, sometimes I never know if they're going to be over excited. I say, "Just hang on one second out here. Let me make sure they're good." And I make sure they're happy, whatever. And then I say, "Come on in." So, she had every opportunity to do that and she didn't.
So, like you had mentioned to her, it's not like the plaintiff was a trespasser or trying to steal or trying to harm her children. And you're still responsible for your dangerous animals even if they're inside your home.
>> Yeah.
>> So, just think that's a word to the wise that it's not just when they're outside your control that you can be held liable.
>> I thought it was awesome.
Heat. Heat.
Heat. Heat.
Heat. Heat.
Heat. Heat.
Heat. Heat.
Oh no.
Oh, now yeah.
Time.
Oh, are suing their neighbor Scott Ellum for the because of a baby macaw bird.
>> Court come to order. All rise.
>> Judge Judy enters.
>> Have a seat, please.
>> Kevin approaches.
>> Hello, judge.
>> Hello, Kevin.
>> Case 2194. Frankini Nunes versus Ellen.
>> Thank you.
>> You're welcome.
>> Miss Nunes.
>> Yes.
>> Your husband?
>> Yes, ma'am.
>> You and Mr. Alam.
>> Ellen.
>> Alum are neighbors.
>> Yes, ma'am.
>> And you have backyards that are joined, separated only by a fence.
>> Yes, ma'am. Excuse me.
>> What kind of fence?
>> It looks plastic. I'm not sure.
>> Picture of the fence.
>> Scott hands a document to Kevin.
>> And you each have, as it would happen, dogs, the same breed.
>> No, ma'am.
>> What do you have?
>> I have a Shetland sheep dog and a Dutch shepherd, ma'am.
>> And what do you have?
>> I have shepherd mixes.
>> How many dogs?
>> Two, your honor.
>> And you have two?
>> Yes, ma'am.
>> This is what the case is about. This is the fence. It's not a chainlink fence.
It's either a wooden or a plastic fence.
And you can see that underneath this fence there's a board here where I assume there's a hole because the dogs dig holes to get to each other. Is that fair statement?
>> Yes, your honor.
>> Fair statement.
>> Yes, ma'am.
>> Okay, good. Case is about an incident that occurred. You've been neighbors for a while and you have had this dog digging also for a while. Also, correct?
>> Yes. Yes, ma'am. The defense.
>> Okay. This incident happened on the 16th of December, 2022. Why don't you tell me what happened?
>> I got up that morning to let my dogs out.
>> Both.
>> One dog. Okay. So, the day started out me and my husband woke up. My husband had to go get a tire fixed. So, we took my smallest dog, my Shetland sheep dog, with him. I remained home with my two children.
>> Slowly.
>> Okay. Sorry.
>> How old are your kids?
>> They are six and seven, ma'am.
>> Okay.
>> I remained home with my children because they were ill and I had an appointment with them later on that day. My husband went to go fix the tire at 8:00 a.m. I got up in the morning to let my dog out.
I let >> Sorry.
>> Got up in the morning to let your dog out.
>> Yes.
>> The shepherd mix?
>> Yes, ma'am.
>> Okay.
>> I let her out and then she came back in and I was cleaning and my two children were in my master suite with my macaw Penelope.
>> Okay. That's what the case about. This case about a macaw the cost of a macaw.
Yes.
>> Which is a bird.
>> Yes, ma'am.
>> Go ahead.
>> My kids were in the master suite. I opened the door. I'm out there cleaning.
I let my dog out of my >> and the door came back.
>> Sliding door. She came back. Well, then she stayed by the door. Now, none of my windows have curtains so I can >> just a second. So then, but she stayed by the door, but she was inside.
>> She came back inside. I shut the door. I then, this was 20 minutes went by. She's by the door. She's crying. I told her we would play later. I assumed she had to go to the restroom again. And I let her out again. She stood on the step, but she didn't go further than that. And she was just kind of staring out. from the left side of the house is where the defendant's dog Bella charged in my home. And then when I tried to grab her, >> when you say his dog, Bella >> Yes.
>> came into the site and ran into the house, that doesn't somehow if the dog Bella came out and your dog was on the step, it would seem to me would stop on the step at first to sniff, play with your dog if your dog is sitting outside.
I mean, I have dogs. would go over to that dog first, not run into your house.
>> You would think that, ma'am, but she's been in our house three times before this because I had to return her to the defendant on three separate occasions.
>> And >> and she didn't do that that day. When she came in the backyard on the three other instances, I remember the very first time someone from that household came to my door and I knew the dog was in my backyard, but I didn't open my door. I left her back there. I figured they'd come. They did. And I said, "Hold on a second." I put my kids, I put my Shely in the room with my bird, and I shut the door. Are we talking about the same date? December.
>> We're talking about other days that I brought.
>> Okay, let's not go on tributaries.
>> Yes, ma'am.
>> What's your dog's name?
>> Lucy.
>> Lucy. So, the dog just went straight into your house. And what did Lucy do?
>> Lucy charged after her and tried to attack her.
>> Okay. So, the dog has been in your house before. Have there been incidents with the two dogs?
>> No, ma'am. The defendant's dog is submissive to my dogs. So, the only time I brought the dog in my home was when I shut all the doors to all my bedrooms.
Someone from the defendant's home came.
I opened up the front door, brought her in, and she went straight out because there was nowhere else for her to go.
>> Okay. So, it's your dog that is the Lucy is the more aggressive dog.
>> Lucy's never been aggressive with her. I believe that Lucy was aggressive with her that day because of the way she came in the house.
>> When you say Lucy was aggressive. What did she do?
>> She started growling at her and she started >> in the house.
>> Yes.
>> Now they're in the house. Put a period there. We have the two dogs in your house.
>> Yes.
>> And they are growling at each other. So that's not a happy picture cuz they're big dogs.
>> Yes.
>> Now let's get to the bird. You purchased a macaw.
>> Yes, ma'am.
>> You have photograph of what they look like?
>> Yes.
>> When did you purchase the macaw?
>> I purchased her with payments over time.
I completed the purchase at the end of September. September 30th.
>> This is the macaw.
>> Yes, ma'am. That's my >> a parrot.
>> Yes, ma'am.
>> In December. How old was she?
>> She was going to be eight months.
>> And how much did you pay for her? I paid $4,3208 for Penelopey.
>> Okay. Could I see the bill?
>> Absolutely, ma'am.
>> Her birth certificate along all of the >> pretty bird.
>> Thank you, ma'am.
>> Patricia weeps.
>> Caption coming up.
>> She bolted in my master suite where my kids were.
>> Lucy.
>> No, Bella.
>> Bella.
>> Bella did. And I went in there like I heard my kids screaming, "Bella is killing Penelopey."
>> And later today, >> is there something wrong with your mind?
>> No.
>> Did you just say to me, "Am I crazy? Did he say he owed back child support?"
>> Yes.
>> To her?
>> Yes.
>> A courthouse. The Judy Justice logo appears in the courtroom. Patriceia, Giovani, and Scott. Patricia Frankini claims her neighbor Scott Ellip owes for the cost of a baby macaw bird killed by Scott's dog.
>> Tell me what got you interested in the macaw.
>> Earlier this year, full disclosure, ma'am, I had a ended up in the hospital very sick for two weeks and I was going through a lot and I started volunteering at the bird store down by my home and I really liked the Hans McCall because my grandma had one when she was younger.
>> Slowly.
>> Yes, ma'am. And so I spent a lot of time bonding with the birds there and my husband and I thought it would be good and therapeutic for me given what I had been going through.
>> Okay. Now the two dogs are in your house sort of fighting with each other.
>> They did not fight, ma'am. I did not.
>> Growling growling at each other. And tell me what happened with Bella and the Macau.
>> I tried to calm Lucy down and my master door was open. Everything was happening so fast. I know I'm describing it slowly, but it was quick. She bolted in my master suite where my kids were.
>> Lucy.
>> No, Bella.
>> Bella.
>> Bella did. I heard my kids screaming, "Bella is killing Penelopey." And >> that's the bird.
>> Yes. And I tried to get to Bella. I couldn't. My dog was standing in between us. And while I was with the two dogs, then my son thought, "Oh, I'm going to go get her." And that's when he got Bella kind of snapped at him and she scratched him. And so then I couldn't get her. I I couldn't. She literally was like chewing her up in her, like dropping her and like biting her again, you know. And it wasn't until my Dutch Shepherd bit her on the nose that she finally let her go and I swooped and I grabbed her. I booked it to my pantry in my kitchen with my kids and Lucy stayed in front of the door and I have a door on it and I just stayed in there and I called my husband and I was screaming on the phone. He got home maybe I don't know how long. It probably really only was like 5 or 10 minutes but it felt like forever. She was like, "And where was during this time?"
>> Bella was around the pantry with the bird in her mouth. And then I took the bird from Bella and then I put her to the cage and then Lucy just stayed by by the parrot and then I opened the door and talked to the kids.
>> Um, they were all hysterical and I was trying to understand what she was doing.
>> Where was Bella?
>> Bella was in the kitchen with a parrot.
>> And how did Bella get back to the defendant?
>> I walked her over.
>> How did you do that? kind of like how a mother pup grabs in front of the band by the neck. I grabbed her by the neck and I walked her over.
>> Okay. Your dog killed their bird in their house. And >> your honor, the hole that allowed Bella to get in to their backyard, it's primarily dug by their dog over the course of many, many months.
>> And >> I continued to repair my side of the fence. Their dog continued to dig the hole, destroyed wood that I had put there. The dog got through. And that story, it's sad, but that's not the story that he gave to my wife when he came pounding on my door.
>> Well, you can't tell me what he said to your wife, sir.
>> Okay, that's fair, your honor. I can tell you what he said to me. I called him.
>> You can tell me what he said to you >> instantly.
>> Just you have to understand, he wasn't home when your dog got into the house.
He came home at the end of the episode.
Do you understand that? I understand that.
>> Okay. Understanding that, you can tell me your version of what he said to you.
>> What they both said to me. I've had conversations with the both of them since this has happened.
>> Okay.
>> The story has changed two or three times. First, it was she was doing something in the backyard and Bella just came charging in and basically knocked her out of the way, got inside. The first story was I assumed the entire time that he was home because when he was talking to me over the phone, >> I don't care what you assumed. He wasn't home when it started. Your problem, sir, is first of all, you were aware of the hole. I don't care who dug it. You were aware of it. And it's not the first time that the dog has gone onto their property. Has their dog got onto your property?
>> No, because I fixed my side of it. I take care.
>> So, the answer is The answer is no.
>> Correct. Who do you live in your house with?
>> My wife and my children.
>> How old are your children?
>> I have a one-year-old. I have a seven-year-old.
>> Let us say it's their fault that the hole existed that allowed your dog to get out, but you were aware of it because it had happened before that they had to bring your dog back. That a fair statement?
>> That's fair. Yes.
>> Okay. Let us assume that it was your dog that was responsible for the hole and their dog, despite the fact that yours was a better digger. You know, having dogs and having a fence, they both dig at the same place. They may not have fixed their side, but they both dig at the same place trying to get to each other. Whose fault do you think it would be if their dog created the major part of the hole, got into your yard, and bit your one-year-old? Whose fault would that be?
>> I think it would be equally our faults >> really.
>> Absolutely. Yeah. For for digging, for not taking care of your property.
Absolutely.
>> Really? I actually find that answer sort of bizarre.
>> I would take responsibility if my child got hurt due to something that I didn't take care of. Absolutely, I would.
>> Well, you may feel guilty about it, but you would certainly want them to pay all of your child's medical bills.
>> No, I would not. Well, then you're a better person than the law is, sir, because your dog was outside of your control, clearly because it got into their house. It was something that you were aware was a possibility, no matter who dug the hole. So, you were aware because it had happened before and your dog caused damage. and the damage your dog caused. And I'm putting the emotional distress these two young children and the plaintiff seeing your dog kill this bird that they had been paying off so much per month for a very long time. Putting aside that, they paid $4,300 for this property that your dog destroyed. And that's your fault. You're responsible for that. So if because of this problem and your dog has a problem and their dog has not come onto your property, but your dog comes onto their property, then you have to say, you know what, I'm not letting my dog go out unsupervised because it has created trouble in the past. May have been their fault because they didn't fill in the hole as quickly or as carefully as you did, but you knew that that happened and you're responsible for the damage. It would be no different than if the dog ran inside and as she was trying to get the dog, the dog bit her and she had to have surgery and she had to have a plastic surgeon deal with reconstruction. Who do you think would be responsible for that? That would be you. And just because it's a poor little bird that happened to be the victim of this doesn't make you any less responsible. Judgment for the plaintiff in the amount of $4,300. We're finished.
>> Court is ajourned.
>> Outside the courtroom, Patricia then Scott. I feel like it was justice for Penelopey.
>> When a homeowner doesn't take care of their property and someone lets another dog in their house, they shouldn't be blaming other people for that.
>> It was extremely difficult to hear my kids screaming like that and do nothing to calm them down.
>> The judge's ruling is the judge's rule.
>> I hope that he never gets another pet again.
>> I don't think there's going to ever be a relationship, which is totally fine by me. Sarah and Judy.
>> One of the most interesting things about that case is I don't think that the defendant's dog, Bella, was a quote unquote aggressive dog. But I didn't get a hint that the other dog was even aggressive. Even by the fact that the husband was able to walk her back by the scruff of the neck, if that was an aggressive dog, they would just turn right around and give you a nice little snap. So, that says to me that although the dog didn't obviously do it on purpose, what are you going to do? But you're responsible as a defendant. You let your dog out. It's a act that's happened more than once. You were on notice.
>> Dog is out of your control. You're responsible. That's the bottom line.
>> Case 2202, Young versus Buchanan. All parties, please come forward.
>> Essie Young is suing her granddaughter's father, Keith Buchanan, for an unpaid loan she gave him for a car.
>> Judy.
>> Miss Young, the defendant is married to your daughter?
>> No.
>> He is the father of your grandchild.
>> Yes. Do he and your daughter live together?
>> No.
>> Where does your daughter live?
>> In Maple Shade.
>> Were they ever married?
>> No.
>> They have one child?
>> Yes.
>> Who's 12?
>> Yes.
>> Did you live together with Miss Young's daughter?
>> Well, at one point she lived with me in Maple Shade.
>> How long ago?
>> This was 2011.
>> You mean when your daughter was a baby?
>> Yes.
>> How long have you had custody of your granddaughter? 11 years. My daughter never stayed with him.
>> I don't know that. He says she did.
>> Yeah, but she did.
>> Caption coming up.
>> So, she got that money that he owed her for child support for taking care of his daughter and he wrote that off of the loan. Is that what you're telling me?
>> Yes.
>> Oh my god.
A courthouse. The Judy Justice logo appears in the courtroom. Essie and Keith.
>> Essie Young claims her granddaughter's father, Keith Buchanan, refuses to pay back a loan she gave him for a car.
>> This is a very simple case cuz I don't have to get into the history of why you have custody of your granddaughter.
>> Yes.
>> Mr. Buchanan, according to you, asked you for a loan to buy a car.
>> Yes. When was that?
>> Before he got it. He was calling every day.
>> Did you maintain a relationship with him?
>> Yes and no.
>> Would he visit his daughter?
>> No.
>> Ever?
>> Once in a blue moon.
>> Okay.
>> I usually have to take my granddaughter to see him.
>> Okay. It was sort of odd to me. If he was never married to your daughter, so they didn't have a formalized relationship. They don't live together now. Why would you loan him? I know that you did. Why would you loan him money?
>> Except you're a very nice person.
>> My granddaughter asked me to. She said, "Grandma, would you please help my dad?"
I told her, "I really don't want to."
And she said, "Could you please do it for me?"
>> Oh, different story.
>> Yes. And then I said, "Okay."
>> Okay. So, you discussed with your daughter during one of these visits that you needed money to buy a car.
>> No, never did.
>> You never did?
>> No.
>> Who is this person? That's my wife.
>> Does she work?
>> Yes.
>> Do you work?
>> Yes.
>> Well, why would you ask your daughter's grandmother who takes care of her who's always taking care of her? You don't.
Neither does her mother. Why would you not ask your wife's family? You both work, take out a loan. Why would you go to her and ask her for money?
>> But it was a situation that happened and I lost my previous car. I contacted Essie. I talked to Essie.
>> No, I'm asking you why you would ask her. What would prompt you to call her?
Doesn't she have parents?
>> Yes, she do. I did that and at the time they couldn't help.
>> So, you went to her parents first?
>> I went to I went to her family first.
They said they sorry they can't help at the time. So, Mrs. Young was the last my last resource which I didn't want to use, but at the time I had to use it cuz I had no other choice. I had to hurry up and get a vehicle.
>> Well, why don't you take out a loan?
>> Actually, I couldn't.
>> What do you mean you couldn't?
>> Cuz my credit is not all all that great.
I try to take out loans. I try to go.
>> Does your wife have a car?
>> Yes, she has a car.
>> Okay. Why don't you use her car?
>> She work I work I work an hour and a half away from home and she worked too and we worked around the same time.
>> How much money did you borrow from her?
>> 2,000.
>> How much did you give back?
>> 912.
>> 912. Show me.
>> Keith hands documents to Kevin who brings them to Judy.
>> On page four, May 5th, 2022, she got $912 >> from what? from my taxes. And we agreed on once I filed my taxes, she would get I would give her $2,000 for my taxes.
She got $912 from them, that same taxes, because I owed backup child support. So, she got on top of my regular payment for child support plus $912.
>> What is that? Something wrong with your mind?
>> No.
>> Did you just say to me, am I crazy? Did he say he owed back child support?
>> Yes. And so she got that money that he owed her for child support for taking care of his daughter and he wrote that off of the loan. Is that what you're telling me?
>> Yes.
>> Oh my god.
That's the dumbest thing I ever heard.
Well, never. I should take that back.
It's the dumbest thing I've heard today.
>> Sarah nods. If you owed her back child support, how much did you owe her? I >> only owed her $900 >> in back child support.
>> Yes.
>> Okay.
>> Then I pull you for >> Just a second. Just a second. You owed her that money in addition to owing her that money. You owed her $2,000. Do you understand that? So you owed her $900 plus $2,000.
Are you not following me? Am I getting something wrong here?
>> I'm with you. Are you following that?
That's either a yes or a no.
>> No, I'm not.
>> Okay. Well, I'm going to repeat it again. What you said was they took money out of your taxes for back child support. $900. So that means you paid her $900 of the $2,000. That's what your argument is.
>> Yes.
>> Am I getting that?
>> Yes.
>> You already owed her the $900.
>> I I had no awareness that I owed her $900. When I found out that $900 got tooken out the taxes, I had no tax coming back. I as actually I was like, "Look, you got $900. You going to have to give me time." And that's when it went south. Oh, >> you got $900 that I owed you anyway.
Now, now I need more time. Oh my god.
How is your granddaughter in school? She do okay?
>> Yes, she's she does okay.
>> Yes.
>> Okay.
Either his math skills or his moral skills are somehow lacking. It's tomorrow.
>> Judgment for the plaintiff in the amount of $2,000. We're finished. Thank you very much.
>> This court is adjourned.
>> Outside the courtroom, Essie then Keith.
>> I thank the judge seen right through him.
>> He was going to be miserable. So, I just let him be miserable.
>> No one thinks like that.
>> As long as she go by her life or go by my life, leave my family alone.
>> I just think he was hustling me.
>> Only contact me when he got something to do with my daughter. That's it.
>> I don't want anything to do with him either.
>> Sarah and Judy. So, initially I may have been a little lost.
