In criminal court proceedings, initial appearances serve as the first formal court hearing where defendants are informed of their constitutional rights (presumption of innocence, right to remain silent, right to an attorney), assigned public defenders, and given conditions of release such as bail amounts, no-contact orders, and court dates. The court considers factors including the nature of charges, prior criminal history, failure to appear records, and pre-trial services assessments when determining release conditions. Defendants may be released to pre-trial services with specific conditions or held on cash bonds, with the court balancing public safety against individual liberty interests.

So, I don't really know how I should go about that or what's going to happen, but I just want you guys to know that.
>> Okay. You absolutely have a right to be heard, ma'am. It will be up to the Puma County Attorney's Office to determine whether or not they want to press charges. At this point in time, they are pressing charges. And given what I've read from the interim complaint as well as what I have from pre-rol services, Mr. Castillo, like I said, I am going to hold you on that $1,000 bond. I am not ordering no contact.

Appoint Douglas Taylor to represent you.
Set court for May 12th in front of Judge Pascara at 100 p.m. And with that, ma'am, you're excused.
>> Your honor, just to clarify, the May 19th is the Tucson City Court and May 12th the Justice Court. Okay. Thank you.

>> Um, yes.
>> Okay. Then I'll release you, sir, on your promise to go to court. You're going to have court on June 9th at 9:00 a.m. I am ordering, sir, no contact with the alleged victim and do not go to her or his whoever's it is uh place of work or residence. This is effectively a order of protection. All right, sir. So, if you violate it, that could be new charges. All right, sir.
>> Okay. Thank you, sir.
>> You're accused.
>> Is it possible I could say something?
Who who's the other victim for?
>> Okay. Thanks. Oh, thank you. Okay.
>> Uh Y, he has something he would like to share with you. Okay.
>> Yes, sir.
>> Um she told the officer last night over the phone that she did live there, which in fact she does not.
So, I've ordered you not to go to her residence or workplace. I don't know where she lives. If she doesn't if she is not living there, then you can go there. You just can't go to where she's residing.
>> Okay, cool. All right, sir.
>> Your name please.
>> Gas, I am seeing you, sir.
>> Hello.
>> Hi, sir. I am seeing you on charges from Green Valley Justice Court. These are charges of criminal trespass of a failure to appear on criminal trespass charges. Sir, >> give me one second. Sir, >> pre-trial services has reported that there's a history of failing to appear.
Green Valley has asked me to impose a $100 cash bond. I'm going to comply with that request. One other pack sponsor.
I'm going to appoint Janet Alt Schiller to represent you. set port for May 14th at 8:30 a.m. in Green Valley Justice Court and order you so that if you do postpond, you may not go back to the incident location where you're alleged to have trespassed. Understood, sir?
>> Yes. But um sir, um I was on pre-trial over there in Green Valley and they they said that um all my cases were dismissed. I I received a letter the other day and I have it in my wallet.
They said my cases were dismissed.
>> That is not the information that I have. from >> asked I'm sorry I asked our um from pre-trial he said I had no more cases pending >> I'm not sure I don't so if you're discussing felony cases that could be true sir um pre-trial wouldn't have been supervising you for a green valley misdemeanor case >> they released me to go to uh court in Green Valley that that's where I was released from from jail here and the last time and I was put on pre-trial >> clarissa do you know anything about um what Mr. Ogos is saying.
>> But did they say that case was >> Hold on.
>> Sorry.
>> Um, let me look into that, your honor.
Um, we wouldn't have spoken to him anyways because he's someone that we didn't release. He's just here for misdemeanors and just for history of FTA. So, we wouldn't have spoken to him, not from our office today anyways, unless he spoke to someone prior.
Um, but let me >> I've got very little information on a Green Valley case.
>> Yes. Let me um double let me double check to see the status on >> to keep talking, sir. We're going to look into what you're saying.
>> Sorry.
>> I don't have access to Paul Art right now.
Give it give pre one second.
Um, is it disregarding to see if the case is still um pending or if he's or if it if it was dismissed?
>> I'm just not sure how he talked to Art about a Green Valley Justice Court case.
I don't see anything else that he might be dealing with? I see Mr. Ogos had some felony cases, but they appear to be quite old or at least a few years old. So, he's not on release for those. So, I'm just not sure what Mr. Ogos is discussing with regards to talking to Art um from pre-trial services if he's only being seen on this Green Valley case.
>> Okay. looked like it could have >> go ahead.
>> It looked like it he could have spoke to him um regarding his case that was where he had an arrest in back in April of this year.
Um that would be my only um that's just what I can see from our records. Um he did have a an arrest in of April 11th of this year. So that could possibly what he's um speaking of regarding the Green Valley case.
Give me one second for Oas.
>> That case was um the arrest in back in April. It was a felony for criminal trespassing. Um that was dismissed.
>> So that that could be the confusion.
This sir, the criminal trespass case I'm seeing you on from Green Valley is from January 13th to 26. That case, it appears, was not dismissed. All right.
Given the confusion, sir, I understand.
I will release you on your promise to go to court. You're going to have court, sir, May 14th. So, in 3 days at 8:30 a.m. in Green Valley Justice Court. All right, sir.
>> Don't go to that court date, sir. There will be a warrant for your arrest again.
>> Okay.
>> All right, sir. With that, then you're excused, sir.
>> Thanks, Clissa.
>> You're welcome.
Your name please sir.
>> Fighter.
>> Fighter. I am seeing you on charge from Tucson City Court.
>> Sir, these are relevant.
>> One second, sir. One second, sir.
The charges, sir, that I'm seeing you on right now is one charge of domestic violence disorderly conduct occurring, it looks like, occurring from November of 2025.
Give me one second, sir.
Sir, if I order no contact with the alleged victim of this case.
>> Yes, sir. However, this was a vicious act of harassment, and I'd like to request the charges be dismissed so I can leave the town to Las Vegas.
>> So, I can't dismiss charges, sir, based on your request. The state either ask for a dismissal or you get to uh fight this. You get to have your day in court, sir, where you get to prove, if you want to try that, um well, where the state had to prove that you are guilty of these charges, not prove your innocence.
Um, if you want to file some kind of an a protection order against the alleged victim for harassment, you can do that.
But that's not what we're doing today, sir.
My question, sir, is will you agree not to have contact with her?
>> Absolutely.
>> Will you agree not to go to her residence or workplace?
>> Yes, sir. All right.
>> I will set court then, sir, on June 2nd at 1:30 p.m. in front of Judge Millian, and I will release you, sir, on those promises.
What time you honor?
>> 1:30 p.m.
>> Thank you. Enter, >> please. If not guilt on your behalf, sir. And with that, you're excused, sir.
your name, please.
Go Martinez.
>> Oh, thank you. I was going to say that's right. Okay.
>> Yeah, of course.
>> Give me one second, sir. I did not anticipate seeing you. So, let me take a look at the file real quick.
All right, Mr. Martinez, I'm seeing you on charges, sir, of disorderly conduct, domestic violence offenses, aggravated assault, domestic violence, disorderly conduct, contributing to the delinquency of a minor, threat, and intimidation, and more disorderly conduct charges.
Sir, these are all out of Tucson City Court.
And I understand that there is a victim on the line. Would that individual please announce their presence and let the court know what they want the court to know?
>> Martinez.
>> Ruby Martinez.
>> Um Ruby Martinez. Thank you, ma'am. Did you want to be heard, ma'am?
>> Yes.
>> Okay. Go ahead, ma'am.
Um uh I'm his daughter.
>> Okay.
>> Uh >> um uh the incident that happened. Um well, I just want to um know what's going to happen with him.
>> Okay. You just want to know how like >> are you asking to have >> Yeah. Then how much time he's going to get?
>> So right now, ma'am, >> I'm sorry.
>> Fine. So, right now, ma'am, I'm just going to go over his charges with him, which I've done, and I'm going to set conditions of release. Are you asking to have no contact with him, ma'am?
>> I want contact.
>> You want contact, ma'am? Um, are you asking do you want me to impose bond?
You have a right to be heard as to whether or not I impose bond, ma'am, >> or release him.
Um, is there a possible chance to release him?
>> So, I get to make that decision right now. Ma'am, I have to tell you and Mr. Martinez that given the failure to appears and the new charges, I'm not inclined to release him on these charges.
But you have a right to be heard still, ma'am. I want to make sure I want to honor your right to be heard, though.
So, tell me what you're asking for, ma'am.
Um ju basically just um how how long um how long is going to be um sentence?
>> All right. So what I'm going to do, ma'am, is this. I'm not going to order no contact with you. What's your name?
>> Ruby.
Yes.
All right, Mr. Martinez, I am going to hold you on a $1,000 cash or secured bond. Set port.
for May 19th at 1:45 p.m. in front of Judge Maldonado.
Appoint the city PD's officer to represent you. Enter please if not guilty on your behalf. I'm going to order you not have contact with any other victims outside of Miss Martinez.
I don't know if there are other victims, sir. Um, but I have Miss Martinez's request to have contact with you. So, I will allow you to have contact with your daughter, but not with the other alleged victims in these cases, sir.
I'm going to enter, please, of not guilty on your behalf on all these cases, sir. And with that, you're excused.
>> Am I able to talk to him?

>> Yes, please. Um, we are asking for release to pre-trial services. Your honor, Mr. Aldred just informed me that he has stage four cancer and that he needs medicine that he's not receiving at the jail. There is also indication on the pre-trial services report that he needs mental health and substance abuse assessment which would be easier for him to get outside of the jail than here.
He's also a lifelong resident of Tucson.
So he's not a flight risk owner and he has an address that was verified thanks to his ID. And I just would like to mention as well that uh he is currently not a violent offense based on pre-trial services and he has no prior failure to appear in the past two years.
>> Thank you.
>> I've been in chemotherapy all the time.
I got I'm about to die and I'd rather not die in jail.
So, yeah. I mean, Eugenie, if I release him, he's going to go back to DOC. Um, he does have a parole hold. Um, >> so wait, when is that up? I thought it was over with. No. Tell me when >> it says you're still on parole right now, sir. That's what that's what D is saying.
>> Oh, I shouldn't be over with any day.
>> Well, sir, notwithstanding that given the factors that Mr. Moer laid out, I do find his recommendation is accurate. I'm going to set a $30,000 cash or secured bond. Set >> set court on >> at 1:30 p.m. and appoint the PD's office to represent you, sir. Um, you'll have an attorney come out and speak to you within the week.
That court on May 21st is unlikely to go. So, please talk to your attorney with regards to what to expect in the next 10 days.
>> $30,000. to your honor. Is it possible to um have you add a condition that he get his access to chemotherapy or his treatment while he's in here?
>> Because I need I go to chemotherapy every 21 days.
>> The jail is going to have to organize that, Eugenie. I can't order the jail to do things for medical reasons.
>> Perfect. That's okay. Thank you.
Your name please. Your name please.
Ma'am.
>> Amanda Wilce Wilson. I am on charges of possession of a dangerous drug, possession of drug paraphernalia. I understand that Eugenie has discussed the steps program with you and you're interested in that, ma'am.
>> Yes, your honor. I want to release you, ma'am, to the supervision of pre-trial services, set a steps screening on May 18th at 9:00 a.m., a preliminary hearing on June 25th at 1:30 p.m. and appoint the public defendants officer to represent you. Ma'am, here's the most important thing. If you don't go to that step screening on May 18th in front of the Superior Court, you will not be eligible for the program and this will just be treated as a class 4 felony.
Okay, ma'am.
>> Understood. Thank you. All right, ma'am.
You're excused.
>> Thank you.
We're going to return to the beginning.
>> Your name please. Sir Brooks, sir, are on charges of possession of narcotic drug and possession of drug paraphernalia. Sir, the state's asking for me to impose a $500 bond. Um, Mr. Moer, I'm inclined. I understand your your request. I'm inclined to release him to pre-trial services. Did you want to make further argument, sir?
>> No, I was actually uh borderline about that request. So, I I don't have any problem with the courts.
>> Mr. Brooks, a little concerned that you might not show up to this step screening. I'm imploring you to do that, sir. I understand that Eugenie discussed that with you. Is that correct?
>> Yes.
>> All right. So sir, I'm going to set a step screening for May 18th at 9:00 a.m.
You need to go to that, sir, if you want to be eligible for this diversion style program.
>> Okay. We're going to have a preliminary hearing on June 25th at 1:30. That court date is highly unlikely to go. So please stay in touch with your attorney at the legal defender's office with regards to to what to expect uh within the next few weeks. But specifically, sir, um make sure you go to that May 18th 14 at 9:00 a.m. in in superior court. All right.
>> Okay.
relationship to pre-trial services and wish you good luck, sir.
>> Your name, please. Ma'am.
>> Maria Gabriella Cordova.
>> All right. Miss Cordova, I'm seeing you on charges of aggravated domestic violence. Ma'am, the state's asking that I release you to preach all services, but I want to make sure, ma'am, that um if I do release you, you'll have I can order you to have no contact with a victim and not go to their residence or workplace, and you'll agree to that, will you, ma'am?
>> Yes.
>> Thank you, honor.
>> I'm going to order you released to pre-trial services. You'll have court on June 1st at 1:30 p.m. You are ordered to have no contact with the alle victim, not to go to their residence or workplace, ma'am, and not to consume any alcohol or illegal drugs while you're on pre-trial release. Understood?
Yes. Yes, your honor. All right, ma'am.
>> I'm going to point the PD officer represent you. And with that, ma'am, you're excused.
>> Thank you.
>> Yeah. Yeah. Oh, always.
>> Your name please. Sway front school cargo river.
>> All right. Mr. Cargo Rivera, I'm seeing your interpretive aggravated driving under the influence.
Josh, I don't have a um a request from you on this case, unfortunately.
>> Yeah. Um the pre-trial services I I figured out with the the other one and this one, the pre-trial services report came a little bit late, so I sent this about 20 minutes ago. Um, I'm asking for $15,000 uh based on upon the inherent nature of the offense. He does have prior felony convictions. He has a misdemeanor record. He is pending that DUI in city court. NCA score of five, FDA score of four. Uh, he could not stay in one lane.
Uh, he did a U-turn, couldn't stay in the lane after that. He had a 0.290 BAC on his PBT and he was pending extreme DUI in city court. So that's over 0.2 on that pending one. And uh that was that's a very recent case. Uh I'm asking that uh if he is released, he does not drive without a valid license, not consuming alcohol, not possessing a fire.
>> All right. Um my inclination was a $10,000 bond for reasons that Mr. Moer already stated.
Did you want to be heard before I imposed conditions of release though?
>> Yes, your honor.
I still would like to request a chance on pre-trial services. Your honor, he um has no prior to fail no prior failure to appear in the past two years and is currently nonviolent. He hasn't addressed a full-time job that he will be losing and he's willing to comply with not driving um and go to the court etc and find a way to go there without using his car.
>> Yes, sir.
>> I'm not going to release you, sir, uh to pre-trial services given all the things that Mr. Moer already stated. I'm going to impose a $10,000 cash or secured bond set court for June 1st at for May 21st at 1:30 p.m. Appoint the PD's office to represent you and order that if you are released, sir, you are to consume no alcohol or illegal substances.
>> Your honor, I am on doing behavioral health. Um, I self admitted to Paul Verde. I know I made a mistake. Um, so sir, >> I'm saying um everything you say sir can be used against you. I'm not inclined to change my conditions, sir. Your attorney can certainly advocate for a release at a future hearing. In fact, that hearing could be soon if they provided the court with information with regards to what you would be doing when you are released. But as of today, sir, I'm going to hold you on a $10,000 cash or secured bond.
And with that, sir, you're excused.
Thank you, your honor.
>> Your name, please, sir.
>> Demetrius Lopez.
>> Lopez on charges of possession of a drug asking that I release you to pre-trial services. That was my inclination. Um, and sir, I understand that you also are interested in the steps program.
>> Yes, please.
>> All right. I'm going to f the step screening for May 18th, 9:00 a.m.
Appoint the PD's office set a preliminary hearing for June 25th at 1:30 p.m. Third, if you do not go to that May 18th hearing, so in seven days, um, you will not be eligible for the steps program and this will simply be treated as a class 4 felony. Understood, sir?
>> Yes.
>> All right. I'm going release you to pre-trial services. As I indicated, make sure you stay in touch with pre-trial services and your attorney so you can know what to expect with these court cases. All right, sir.
>> Thank you so much, your honor.
>> You're excused.
>> Mr. Rivera.
>> Your honor, if I may mention, Mr. Rivera, who is next, did not hear the initial uh briefing for the felony hearing. He joined us.
>> Thank you very much. I appreciate the information. Mr. Rivera, this is the time set for your initial appearance.
We're going to go over your charges as well as your conditions of release.
Before we do that, know that you are presumed innocent. You have the right to remain silent. Anything you say can be used against you. You have the right to an attorney. I'm going to be appointing an attorney for you, sir, on both these cases. is your city court case and your felony case. The felony case, sir, is charges of possession of a dangerous drug, possession of a narcotic drug, and possession of paraphernalia. The city court, sir, is for charges of driving under the influence.
The state's asking that I release you to the supervision of pre-trial services instead of steps screening hearing. I understand from Eugenie that that's you're interested in the steps program, sir.
>> Steps program. Yes, sir.
>> Okay. Let me set a step screening then for May 18th at 9:00 a.m. A preliminary hearing for June 25th at 1:30 p.m. Um, Eugene, I've forgotten to ask you, but I'm assuming you're waving time for these.
>> Yes, sir.
>> Thank you. Uh, I'm going to release you to pre-trial services, sir, and appoint the legal defender's office to represent you on the felony matters, sir. So, most importantly right now, sir, you got to go to this court date on May 18th if you want to be considered for for the screening for the steps program. um and stay in touch with pre-trial services as well as your attorney to know what to expect with regards to your case. All right, this is court case, sir. I'm also going to release you. I'm going to appoint the city PD's office to represent you on the misdemeanor driving under the influence charge. You're going to have court June 12th at 1:45 p.m. in front of Judge Vera. That court date will go. Understood, sir.
I'm going to order that you not consume any any alcohol or illegal drugs while you're on release for these charges. All right, sir.
>> All right, sir. With that, then let me enter please if not guilty on your city court cases. And with that, sir, you're excused.
The other one is Huh?
>> That's kind of Of course, >> your name please, sir.
>> Did you say Ruben Manuel?
>> Yeah.
>> Thank you, sir. Sir, this is the time for initial appearance on felony charges.
I am going to discuss those charges and conditions of release. Before I do that, you are presumed innocent. You have the right to remain silent. Anything you say can be used against you. You have the right to an attorney, sir.
I'm going to appoint, sir.
I'm going to appoint, sir, the Pimac County Public Defenders Office to represent you. The state's asking, sir, that I release you to to pre-trial services um on these charges of aggravated shoplifting.
That was my inclination, sir, to release you.
>> Your honor, if I can uh just address that one second. Uh I I got the pre-trial services report on him. He does have a lot of out of uh county warrants and three pending justice court cases. And so my updated request was to for like a $50 bond so he could get some or or a minimal bond so he could get some time credit in there. That >> is Are you saying that he's I don't see a probational. Do you see one, Josh?
>> No, of warrants out of Coochis County.
>> Oh, he's being held on warrant right now.
>> Yeah, that's what it shows if I looked at that right. Yeah.
Are you being held in your facility on warrants?
>> Oh, you know, you know what? Uh, your honor, I I misread that. That is completely wrong on my record. Your honor, pre-trial service is what I'm going to ask for. Um, he is on probation right now.
>> Yeah. I mean, Mr. Manuel, I'm I'm inclined to release you given the kind of dimminimous nature of the allegations here. Um, I mean, you don't want to pick up new charges while you're on felony probation. Um, I'm going to order, sir, that you are released to pre-trial services. I'm going to order, sir, that you contact your probation officer within 24 hours of your release from the jail.
I'm going to order, sir, that you not go back to the location where you're alleged to have committed a shoplifting.
Set court, sir, for June 1st at 10:00 a.m. in Aaho Justice Court. Sir, that court date is incredibly highly unlikely to go. That does not mean this case is going away. It just means that uh you likely will not have a preliminary hearing on June 1st. You're going to have to be in touch with pre-trial services as well as your attorney to know when you should be expected to come to superior court. Okay, sir.
>> Okay.
>> All right, sir. Um, I think that does it then, Mr. Emanuel.
Good luck. Okay, sir.
>> Thank you.
>> Thank you.
>> Thanks, everybody.
