FURIOUS Judge Has HAD ENOUGH and Prepares SANCTIONS for Trump DOJ?!?!Ajouté :
Well, it just got a lot worse for the US Attorney's Office in the Northern District of Illinois, the office that brought the prosecution against the Broad View 6 protesters peacefully protesting who got caught up in the Operation Midway Blitz being led by ICE and others uh in Chicago. Their case has not only been dismissed for prosecutorial misconduct, including inside of the grand jury room. And wait till you hear what Judge Perry had to say about that. But she's equally raised the spectre of vindictive prosecution.
Right? The very same doctrine that just got used by a federal judge in Tennessee to dismiss all charges against um Garcia has also been raised by the judge as has sanctions. And it's so bad that the the um US attorney for the Northern District of Illinois, Mr. Bros. He doesn't know whether he's coming or going. At one point, he comes to court completely falls on his knees and begs for forgiveness to have the indictment dismissed because of the acknowledged prosecutorial misconduct, which included trying to pull a fast one over the judge by redacting aspects of the grand jury transcript that the prosecutor didn't want the judge to see. Uh but in addition, while he was in court, he couldn't help himself and he started to attack the defendants who were now be about to be dismissed again because the judge said a version of well I'm not going to let you know protesters influence a the jury in the jury pool.
He said, "Well, judge, that's what this case is about. It's about a mob that got around a car." She said, "Wait a wait a minute. Now you're undercutting your mayulpa about the prosecutorial misconduct. What happened? Why did it happen? And where did that prosecutor go who's been accused of it? And a new motion just filed in the last few hours by the um by the Broadview 6, I guess, now down to Broadview 4, who filed a motion to have the government preserve all of their text messages, records, and files for a future motion for sanctions.

Let's get down to what this Department of Justice seems to be all about. Or as Judge Perry said in one of her observations in court yesterday, uh I can't give the Department of Justice the presumption of regularity anymore because everything they do is irregular.
Uh the Broad View Six got down to four before trial. Trial was just a week away. included a social media influencer who was running for Congress not successfully, but anyway, she has first amendment rights regardless. Cat Abu Gazelia, her campaign manager, Andre Martin, Michael Nesbbit, who is a wardsman in Chicago, elected official, uh Brian Straw, who's a village trustee, and others that were protesting. They surrounded a car. Okay, car backed out at 2 miles an hour, and that was the end of it. and they got indicted for misdemeanors. But the problem is in the grand jury, the U person that was handling the case, the prosecutor who was a seasoned 20-year prosecutor, she did a couple of rookie mistakes. Let's just say violated the constitutional order, let's say. For instance, in talking about her evidence, according to the now unredacted transcript, she vouched for the credibility or the weight of the evidence. You never can do that. You can't bolster a witness by saying, "Well, you got to believe this police officer. Look at him. He's in a uniform." You can't bolster the credibility of a witness. The witness's credibility is determined by the jury.
And you can't vouch for the evidence.
You can't say, "Well, trust me, ladies and gentlemen, I'm a career prosecutor.
That evidence, that's really good evidence. It's way it's this is beyond normal evidence. I wouldn't bring a case if I didn't have evidence like that.
Can't say that. Certainly not in the grand jury. And you certainly can't say it in the closing statement either. And she must have known, the prosecutor must have known that this was a problem because u uh uh and her name is Sher Meckllinburgg because um she redacted the transcript when she sent it into the judge and to the other side after they asked for it because they suspected there was some wrongdoing. And of course, everything she did wrong was redacted.
always a telltale sign. She also apparently spoke to grand jurors outside the presence of the rest of the grand jury room. You can't have one-on- ones, conversation, exparte conversations with grand jurors. And you can't eliminate the ones that you think are against you from session to session. So, she was pruning and gardening the grand jury to get it down just to the group of people who would who would vote to indict.
Ridiculous. What's Sher Meckllinburgg doing now? You're never going to believe it. She was picked to be counsel to the Senate Judiciary Committee, which is controlled by one vote by the Republicans. And guess who's the ranking Democrat? Yep. Dick Durban of Chicago of Illinois is the senator from Illinois.
He's on there. I think it's going to be an awkward first meeting between Miss Meckllinburgg and Mr. Durban. Don't you?
And I don't think she's long for that job, if you know what I mean. She did things that were so bad that even the junior who'd only been a prosecutor for like weeks on the case. His name is uh Matthew Skea. He even told the judge in in confessing because he's still in the office and Meckllinburgg is in Washington. He said, "Yeah, I thought it was kind of strange some of the things that she was saying." Um, however, I'm new here myself and it didn't bring it didn't um it didn't come to a head until we started looking at dismissing the charges internally. Enter Mr. Bros, the Northern District of Illinois prosecutor. But he he got himself all wrapped around his axle because he goes in there acknowledging to the judge that this is one of the worst things he's ever seen in his life of prosecutorial misconduct. apologizes, says he's going to dismiss right there and does the indictment, and then he starts defending the indictment, which gets Judge Perry sort of pissed off. Here's what, let me give you some uh some clips and quips from there. This is what Judge Let me start with Judge Perry. Judge Perry says from the transcript, "There are significantly bigger problems than misinstructions to the grand jurors."
Because I guess that was a topic.
I will say that I was incredibly shocked by the redactions that were made. I have read hundreds, if not thousands of grand jury transcripts involving prosecutors who are the most junior of prosecutors to several US attorneys who have appeared before the grand jury. I have never seen the types of prosecutorial behavior before a grand jury that I saw in these transcripts. I do believe deeply in the presumption of regularity and that most government attorneys are doing the best they can. that trust has been broken. I think there's also a potential here separate and apart from the merits on how this case ends up proceeding on sanctions for prosecutorial misconduct and potentially for ethical violations including cander to the court. That is a not so subtle signal that people like Meckllinburgg and anybody else may be referred by the judge to the uh the courts of Illinois that supervise the bar there about their bar licenses. Right. Once again, people going out of their way to do the bidding for the Donald Trump administration and risking their law licenses as a result.
Here are uh let me play backtoback clips. Here are here's a quick little press conference of lawyers and others for the Broadview 6 about what just transpired. Play it. It should shame every single American that we have a Department of Justice that hides behind the grand jury in in selling these indictments, saying it's terrible conduct for anybody, much less a federal prosecutor. There's going to be repercussions for them. Probably not from in this DOJ, but uh hopefully uh the bar association or someone else uh the Illinois bar will take care of it.
>> And here's US Attorney Bros. But saying, quote, "I will tell your honor that as upset as you are and have been, I too had not seen conduct like that, and it upset me, which is why we did dismiss that indictment."
>> Now, we'll continue to follow what happens right here, but as I've said before, just to take the plane up 5,000 ft and look back down. This is a intellectually dishonest um ethically exhausted and bankrupt and um challenged Department of Justice that has been cut. you know, 5,000 8,000 people left and they were not replaced or they were not replaced with competent people and they have that's why you have, you know, two week old prosecutors, you know, running around sitting idly by while there's prosecutorial misconduct or Lindseay Hallan who's only been a prosecutor for minutes in the Eastern District of Virginia violating the fifth and sixth amendment rights of people. this prosecutor uh violating the fifth and sixth amendment rights of people in the grand jury. What is it with this administration? It's because the tone is set for the top. They are given permission to be weasels in court, to be slippery little eels to violate their primary ethical rules about cander to the tribunal, cander to the opponent.
They are officers of the court. I am an officer of the court. They've sworn to uphold the constitution and abide by the rules of professional conduct of the place where they are regulated of the federal bar for instance in Illinois.
And yet they throw it all away. They throw it on the scrap pile of you know, I don't know, keeping their jobs, bootlicking Donald Trump, or because their bosses are also ethically challenged.
