So, since that last data center video, a lot of stuff has happened. Birmingham is now trapped in a legal war over this nebious AI data center project. And there are multiple lawsuits flying around at the same time. So, I want to untangle this entire mess for you. So, first, residents in Oxmore Valley along with the Greater Birmingham Humane Society have sued the city of Birmingham and Nexus over this proposed 300 megawatt AI factory. They are saying that the city pushed this project through without proper zoning approvals and that the old region's property lost its grandfathered rights once the building was demolished and that the city basically changed the rules Midgame to help Nebus move forward.
Residents are worried about this non-stop industrial noise, the massive power usage, the environmental concerns, falling property values, traffic, light pollution, and the impact on neighborhoods and animals. Remember the greater Birmingham Humane Humane Society is right across the street as well as the Red Mountain Park. So now the Humane Society is directly involved because they're saying that this the hypers scale AI cooling systems and the electrical infrastructure can create this constant low frequency noise that animals are far more sensitive to than humans. So here's where it gets wild.
Back in March, Birmingham's zoning board denied one of the major power infrastructure requests tied to the project and then approved a different one. Then afterwards, the city attorney issued a memo basically saying, "Actually, Nebius didn't even need those that those approvals." Anyway, the residents lost it because people had shown up. They packed overflow rooms.
They spoke publicly. They participated in the zoning process. And then afterwards, they were told, "Well, the process didn't even matter." So now Nebius is also suing and appealing zoning decisions tied to substations and switching stations needed to power this giant thing.
which means that the residents are suing to stop the project and Nebius is fighting to keep the project alive. And Birmingham is stuck in the middle trying to rewrite its own zoning laws in real time because apparently nobody had rules for this billiondoll AI factory showing up in our neighborhoods.
And now there's also allegations that one of the women involved in the lawsuit, the Oxmore Valley lawsuit, is being harassed by the Birmingham police after filing suit. So whether you support this project or not, this should concern everyone because this is bigger than one building. This is about who gets heard when giant corporations arrive. Can the cities rewrite rules after public opposition? And what happens when AI infrastructure moves faster than democracy and zoning laws can keep up?
