In criminal trials, confessions made during periods of psychosis or severe mental illness may not be reliable evidence, as individuals in such states may lack the capacity to understand the consequences of their statements or may be influenced by delusions, making it essential for courts to carefully evaluate the mental state of confessors when determining the admissibility and weight of such evidence.

Delphi: ALL of Rick Allen's confessions laid bare! 👀Added:
Good morning everyone. My name is Michelle. I hope you're doing well.
Welcome to another video. It is a Sunday morning, the 24th of May. Finally, we're getting our heat wave. It's just gone 8 a.m. and it's a little bit warm here in the UK. Anyway, we're going to talk Deli case. I did a live stream yesterday evening, my time, going through some of what was said on Court TV. It's Vinnie Palolan investigates.
He had Erica Morson on who is a private investigator. I'm not getting into the drama of it. In fact, we're not even going to talk about what Eric has said in that program in this video because what I want to talk about is the confessions that Rick Allen made while he was in Westville. And they became a major part of the state of Indiana's case against Richard Allen at his trial.
And the reason why I'm bringing this up again is not because of this episode of Vinnie Investigates where they did talk a little bit about the confessions. It's actually a video that I made a couple of days ago now on Nancy Guthrie that has inspired this video because in that video on Nancy Guthrie, I briefly mentioned the Deli case and an interesting conversation in my comments came from that. So it was quite serendipitous, just a coincidence that that very same day Vinnie did the Deli case and talked about the confessions. So yeah, I'm going to talk about it.
>> It's time for you guys to start being journalists.
>> Before an angry Andrew Baldwin left the courthouse, 13 News overheard him speaking to Richard Allen's wife, saying, "It ain't over. The world's watching. The world sees what's going on. Heat. Heat.
All right. So, this was the conversation.
The only reason why I mentioned the Deli case in this Nancy Guthrie video is because a lot of people are questioning why after 10 and some days there are still no answers in the Nancy Guthrie case. And it was an ex Puma County Sheriff who you know said sometimes it takes a long time to get an arrest. The comment I made was about the Deli case.
It took 5 years for them to get an arrest. Libby and Abby were murdered on February 13th, 2017, and Richard Allen wasn't arrested until October of 2022, more than 5 years later. However, they had Rallan's name because he called in a tip on February 16th, just 3 days after the murders. His tip was that he was there on the trails that afternoon. He saw the public appeal and he called in to say what he saw. They cleared the tip, put it in a drawer and then five years later, I would argue when they wanted a pati, they unearthed this tip and it all went downhill from there for Richard Allen. So, at the trial in 2024, the state of Indiana made a huge deal about the 60 plus confessions. Yeah, normally if someone confesses, well, you got to believe them. But false confessions are very common for all sorts of reasons. Coercion being a main one, just being so beaten down, being forced to confess. That's the main one.
However, mental illness can also cause people to confess to things that they didn't do. And I argue that Rick Allen was psychotic at the time when he made those 60 plus confessions because he didn't confess when he wasn't psychotic while he was in his psychotic period between April of 2023 and June of 2023.
That's when he made the 60 plus confessions. When he came out of the psychosis, then he stopped confessing.
All right? It's correlation doesn't mean causation, but you've got to accept that that's pretty pretty dodgy. And if somebody is in a state of psychosis, well, surely whatever they say shouldn't be admissible in court. But what the state of Indiana argued was that Rick Allen wasn't psychotic. That he made those confessions freely and rationally.
So, the comments section, somebody said, "Sorry, are you saying you don't believe Richard is guilty of murdering those two girls?" And then someone else said, "He's definitely guilty. There's just no real forensic evidence against him.
Someone helped him in my opinion. I just don't see how someone who confessed 60 times is innocent. He doesn't have an alibi. He was there when they were killed." Well, was he there, though? Was he there though? Because there's no evidence that he was there. Somebody says according to investigation, 70 people in the general area. There was loads of people in that area that day.
So just because you were there on the trails that afternoon doesn't mean to say that you murdered the girls.
Confessions after physical and/or psychological torture are not credible.
Judge Gull erroneously disallowed the sketches. defendants, gun expert, and other suspects into evidence while allowing an illegal search and false confessions into evidence. Just look at the history of promotions and the criminal enterprise comes to light.
Absolutely.
Absolutely. I said he also confessed to killing all of his family, including grandchildren that didn't exist, cheating on his wife with a cigarette, and starting World War II. All confessions were made when he was psychotic, when he was so ill, his medical notes said he was gravely disabled. The jury and the public have been sadly misled. During the trial, criminality Theresa put this together.
This is a really, really good resource.
This is all Theresa's work. She put in a spreadsheet all the dates and a summary of each confession, who the witness was, and then what was going on at the same time. And I think when you see it in black and white, it becomes obvious that something major was going down.
Remember, at the time he started confessing in April of 2023, he had been in Westill Correctional Facility in solitary confinement for 5 months. At the beginning of April of 2023, this is what he looked like. He lost a third of his body weight. His defense team was so concerned about him that they took a photo of him and they put in a motion to get him moved from Westville. And it took Judge Gull two whole months to have a hearing during that June 2023 safekeeping hearing. The defense were accused of being liars by Nick Mccleand, the prosecutor.
They weren't lying. The photo says everything.
This was filed on the 5th of April, 2023, and this was at the beginning of his psychotic episode. Let's go through these confessions, shall we? So, what Theresa has done is put everything down with a date, a summary of what the confession was, and then some context around it. So, in November of 2022, this is when he'd been in Westville for less than a month, he told Dr. Waller, his psychologist, that he felt like a burden, wasn't sure who he can speak to about his case. So, this is when Dr. Waller, who was the deli fan girl, was befriending Rick Allen. And then, according to witness Harshman, who was a cop, he told Kathy, "I love you." He's crying. Sounds distraught. Tells Kathy, "I don't want you to worry about me. I'm sorry." While crying and saying, "I effed up. If anything happens, I'll see you in the next life and take care of the family." So they're saying because he said I effed up that in itself is a confession and this is back in November of 2022. But things get really concerning the end of March and by the beginning of April he is in full-blown psychosis. So March 21st 2023 he tells Dr. Wala that has accepted God into his heart to the warden Gallipo and Galipo had put the date on that it was March of 2023 but it wasn't it was April Rick had said he used to work at CVS and he disposed of a box cutter used to kill the girls in a dumpster but this is the one that was erroneously dated. I'm ready to officially confess to killing Abby and Libby. So Harshman brought this into evidence at the trial, but this was a conversation with his mother. 4223 Allan initially sounds upbeat and positive, asks his mother if she's going to church that day, then cries and asks his mother, "Did Kathy tell you I told her that I have accepted the Lord Jesus Christ as my savior? I've got a family that will always love me no matter what.
and I know we're all going to be back together eventually. He also says, "I didn't accept God into my life until March 21st, 2023." And then the phone call to Kathy, which is controversial because they only played at the trial, that phone call. And it was the two phone calls that he he made in addition to this that gives you the context that he realizes that he's losing grip of reality. But the jury didn't get that.
And he said, "Honey, I did it. I killed Abby and Libby." And Vinnie Palitan played part of that phone call.
>> Yeah.
>> Are you there?
>> Are you there?
>> Yes, babe. Yeah, babe.
>> What's going on?
>> I just wanted to apologize to you.
>> What's going on, >> what?
>> I killed Abby. I killed Abby and Libby.
>> No, you didn't.
Yes, I did.
>> No, you didn't, Darren.
>> Yes, I did.
>> Don't say you did.
>> No, you didn't.
>> No, you didn't, dear. You're not feeling well. There's something wrong. They've messed up your meds or something there.
>> No, I evidently did it.
>> No, you didn't.
>> Messed up his meds.
>> Say that.
>> They Excuse me. I've got a cough. They messed up his meds, says Kathy. There's a whole lot more going on that Kathy wasn't aware of at this time.
>> Because maybe I did it.
>> No, you didn't.
>> Maybe I did it. So, he doesn't know.
Maybe I did it.
>> I think I do.
>> I think I did it. I think I did it.
Is that a confession? Do you think?
Okay. It's at this time defense photo that we've seen. Defense requested a modification to safekeeping order and he was put on suicide watch. Throughout April, things get really bad. Crying and screaming, he then says, "I think coming to prison cured my depression and anxiety. Helped him find Bible God. Do you want my Bible?"
45 2023. Slipped enveloped the door.
said he wanted to confess to killing Abby and Libby and apologize to families. So that's the confession that he wrote to Gallipo. Gallipo said that that came in March. Actually, it came in April while he was psychotic.
It's my contention that Gallipo purposefully misdated that confession because in March he wasn't psychotic, but they knew in April that he was 45 2023. I killed Abby and Libby while becoming tearful. He made sure they were dead because he didn't want them to suffer. Intentions were sexual in nature. Thought the girls were 18 or 19, but could have been as young as 11.
Selfish coward all of his life. wanted to go back and change his actions. He's a sex addict. He molested his sister.
There's no evidence that he molested his sister. All this is 45 2023.
Experimented with male and female children when he was a kid. Thought this was where his problem started. He was an alcoholic twice since 2011. Expressed remorse for the killings. Wanted to give his Bible to the family of Abby and Libby. Was sleeping with a Bible. Asked to speak with the chaplain. This is all 45 2023.
And then we've got some strange stuff going on on the 6th, 46 2023 and 47 2023.
God, I'm so glad no one gave up on me after I killed Abby and Libby. I, Richard Matthew Allen, killed Abby and Libby by myself. No one helped me. I'm not crazy. I'm just acting crazy. Dear Lord, forgive me for molesting Abby, Libby, and Chris. You don't know who Chris is. No one called Chris there at the time. Dear God, forgive me for molesting Abby, Libby, Kevin, and Chris.
So, there was no Kevin or Chris there. I want to confess. I know a lot more.
Okay, so we're still 47. He said he confessed and uh Waller told him not in his best interest cuz it could go to the media. Wanted to ensure he didn't sign anything. So this is Ma 48 2023. Allan is piercing in his cell and saying, "I'm ready to confess. I swear to God I killed Abby and Libby."
Followed by, "Fuck you." And then Ron, I don't know who Ron is, but tropy lady. [ __ ] you. Attempted to drink toilet water, tried to eat a bottle of hot sauce, and urinated on his mat. Then we go to 49. I killed Abby and Libby as he was flushing paper down the toilet.
He stated that the funniest joke is how he killed them. Then he shouted f words at his shadow. I got what I deserved for what I did and I hope I burn in hell for what I did. I'm sorry for what I did for killing them. I don't care. Kill me while he was crying.
Still 49. I'm sorry I killed those kids lying on floor mumbling.
Okay. Still 49.
I only killed them to give my family more time to live. I only killed them to give my family more time to live.
Did he actually mean he was confessing to give his family more time to live?
You can't tell me my wife is dead. I'm sorry I killed those kids. I was afraid they would save my wife.
So, is he actually saying that he was afraid that they would kill his wife?
410. Cursing while singing God Bless America. Masturbating in front of door.
Singing Mamas Don't Let Your Babies Grow Up to Be Cowboys. Lick the window of the door and said, "Kathy, I did it. I'm guilty. Run, Kathy, run. I did it." My name is Richard Matthew Allen of the National Guard, singing God Bless America. Running into the door while bracing for impact. Kathy, Kathy, Kathy, while running into the door. Running in place, singing God Bless America. I want to go camping. You, me, Roger, Marvin.
Don't know who those guys are. Still 410. Chris is my best friend. While stuffing paper into the toilet, naked but not responding to his name, doing things to his genitals. Urinating outside his toilet. Preoccupied with religion. Legal papers on floor. 410.
Thinks this is a psychological game meant to tear him down. Well, he got that right. He totally got that right.
Then 412 and 413.
Banging on door, clapping naked, touching genitals, rolling on ground, lying naked in cell with feces on him, feces by his mouth, guards dragged him to the showers, determined he was suffering from psychosis.
Dr. Wrightwood called about bizarre symptoms, diagnosed psychosis, contacts Dr. Hayes and Dr. Bernard so they get the docs involved.
So remember, he's been chatting about confessing now for nearly two weeks whilst doing all sorts of bizarre stuff.
4:13 rolling on the ground. What more have I got to do? I swear I never cheated on the cigarette. God, I was eating a pizza. Ran in place naked. I will never again smoke in my life. God, I'm sorry I wasted your time. I'll never smoke. I'll never cheat on my wife again. I'm a Libra. Okay, cool. Okay, still 4:13. Walla, she is told that he was possibly experiencing an emotional breakdown. I think that's little to no sleep since April the 4th. Okay, so 4:14. This is when he was involuntary medicated with Hald. At the same time, those docs saying at the trial that he wasn't psychotic. So why are they giving him how doll then? Okay. 417 having nightmares. More people died due to his selfishness. Wants to tell the truth and go back and make things right. Singing, marching and crying. Stated he had done vulgar things and and that's not who he is. Banging head on door asking for someone to read his Bible to him. Then he says I killed Abby and Libby. So this is 418. Still presenting a psychotic though. 420. asked for his Bible and thank God for watching him. Asked to talk to Warden, wanted to confess that he's guilty. Says he confessed to Warden, says it two times. Requested a shower and a Bible. Drank toilet water.
420. 422. I killed those girls, so I have to kill myself. I killed Abby and Libby. My wife wasn't involved. I want to confess. 423. And then 425.
Wanted to visit his wife and move from Westville. thinks that his behavior is due to not getting his Prozac and Cerakquil. Dr. Martin 425 recognized doctor at visit understood he was at prison although asked for warden his wife some chocolate and taco bell 426 grandpa molested him there's no evidence that his grandpa molested him so who knows 426 I'll take some KFC can I talk can you listen I killed Abby and Libby question mark 428 naked in bed said he wanted a shower 428 he's selfish and not taking care of himself self killed two girls from deli with a box cutter. He stole it and left it in a CVS trash. Wanted to write a confession. 429 Talked about wanting to rape Abby and Libby, but got scared, panicked, and killed them instead. Can I confess to the warden and Dr. Waller? I'm already dead while pacing and muttering. Told guard he was being stabbed on something about World War II. Okay, cool. Now we're into May. So, water on floor. I will kill everybody going to start World War II. Says he feces because he's insane because he doesn't have water.
So, was he drinking toilet water because they were trying to intentionally dehydrate him? Who knows? I killed Abby and Libby. Don't want to die. Wanted to kill himself by jumping off his sink.
Should let others into his cell to kill him. Killed his old family and his best friend. Well, he didn't know, did he?
because his family are still alive and whoever his best friend is. I assume he's also still alive. Wouldn't kill himself. He's too much of a coward. Ask for a drug test. Does he ask for a drug test? Because he realizes they are drugging him. 53 2023 on the 13th. Went to mom's. Not lunch. Got beer. Drank three. Bundled up. Went to the bridge.
53. Lied in weight. Saw the girls.
Wanted to rape them. did something with the gun, saw a van, got scared, killed the girls, and put branches on them.
Okay, so that's the major confession.
That's the one that they really focused on at the trial because Nick McClean said this is details only the killer would know. But remember, he'd been given his discovery by this point. So, he knew that Abby and Libby had branches on them. He would have seen the crime scene photos.
and the van. Well, the van couldn't have come at the same time that the girls were being murdered. We've talked about this so many times. The prosecution lied about the time that the van passed by.
We know this because of surveillance video. It wasn't presented at the trial.
53 bullet fell out at some point. left avoiding the trail. Went to his car and carried on with his life. Ate feces because he feared telling the truth.
Wouldn't kill himself. He's too much of a coward. But if he dies, tell his wife that he loves her. Didn't want to miss Easter. So I think he's already missed Easter by this point. Felt things were missing from his property bag probably. So Easter was on April 9th.
Went from constant watch to every 15 minutes. Eating meals for the most part.
No psychosis. This is according to Dr. Martin 59.
Planned his last meal and how to snap his neck. Wanted to help others and wanted a job in the prison. Just want to sign my confession. I would be better off dead. And then 510. This is from Harshman apparently to Kathy. Think I've lost my mind. To which his wife responded, we've all lost our minds at this point. I need to tell you something anyway. said to his wife while she responded, "Are you sure you want to talk to me over the phone?" "I think I need to I need you to know that I did this." "What? There's no way." Catherine responded, "You are not well, so you don't need to say something you didn't do." Alan says, "I have to tell you that I did it. I may have to spend the rest of my life here." So Kathy's crying and he says, "I don't understand. I just got to know everybody is still going to love me. Confess the crimes again. It's okay, honey. I did it. I did it, baby. And then I killed Abby and Libby. And then asking his wife if she was going to love him and she said, "I love you." 510 Upset he couldn't contact his wife. 510 wanted to call his wife back with her in the room. Tells Kathy I killed Abby and Libby. Kathy said, "Stop saying that.
Mentioned the electric chair and that he might have to spend the rest of his life in prison." 510. Kathy doesn't believe me. I didn't do everything I said I did, but I did kill Abby and Libby. Okay.
511. Wants closure and wants to apologize to families. How do I prove I'm insane? 517 asked his mother if his wife Kathy told her that he did it. And she said, "We're not going to discuss this." Later told his mother, "I'm just worried you guys aren't going to love me because I said I did it." Alan's mother told he wasn't in a good place. We'll always love you no matter what. Then confessed to crime again. Alan's mom said, "Rick, don't talk about this. I think you're messing with you. I know you didn't have it in you to do something like that. Mom, why would I tell you I did it if I didn't?" 518.
Bang said on wall. I killed Abby and Libby. No evidence of psychosis. No evidence of psychosis. Coherent. Eating normal. Everything fine. Wait till we see Waller's notes, though. 65 2023 talks about losing his mind and ends the call, but you know that I done it right.
611 tells his wife I did it. I feel like I'm already in hell. 618, why are you doing this? Do you know God? Do you know why I'm here? I killed Abby and Libby. I want to apologize.
Do I make you mad? Did I tell you about my wife? I killed Abby and Libby. wants to go to heaven. Wants to talk to wife.
See his family. Afraid of dying. Doesn't feel well. Feels like his head will quit. Afraid something will happen to him before he can say goodbye. Didn't want to die. He's confused. Doesn't know what is rational anymore. Not sure if he is going to heaven. Meanwhile, says in his medical notes, "No evidence of psychosis. Stopped how doll injections.
Video shows Rick in a catatonic state.
Then we don't know when these were, but says he molested Dawn. Just wanted to die. Said he wasn't racist. How can I go home? Am I in jail? Am I already dead?
How do I prove that I'm sane? Please help me. Please, God, help me. Lost his virginity to a babysitter when he was 11. Don't know whether that's true.
Lives in medieval times. Girls screamed while he committed the crime. Well, nobody heard any screams. After smearing faces on his face, he said he won't be doing that again. He's eating a Bible.
He's pulling his fingers in his rectum and rolling his feces. Put a spark into his genitals, drank toilet water, defecated in his hands and smeared it on his body. Refused to eat meals in March.
Killed his own family, including his grandkids, which he didn't have.
Molested his sister. No evidence of that. Didn't believe someone turned him in. No one did. Kill me and saved my family. Touched his daughter. She claims he never did. Getting an erection in his sleep. All over this old bearclaw. If I [ __ ] those girls, I [ __ ] them. If I killed those girls, I killed them.
Intentions were sexual. Thought girls were 18 or 19, but could have been as young as 11. Molested his sister. No evidence of that. I experimented with male and female children. Well, we don't know whether that's true or not. And then once at war bash, apparently. So, this is well after the psychotic period, but we don't know what was going on. We have no context about what was going on at this time. I'm sorry for what I did.
I'm sorry for killing those girls. He was awake and crying while talking to himself, curled up in a fetal position.
So Theresa put, "Not to self, Galipo was fired. Note to self, Fishery was fired.
Note to self, Waller was no longer allowed to work in Westville. Jeremy Broady, another guard." So all these people who gave the evidence no longer at Westville. Interesting coincidence, isn't it?
But during the times that Allan was doing all these really incriminating confessions and his doctor was saying that he wasn't psychotic, Dr. Waller's notes actually say something different.
Dr. Waller's notes wrote he's poor critical deteriorating suicide ideiation delusions states death will bring him relief insomnia hopelessness okay 412 notes more critical selfharming takes a running starting cell crashing his head and face into a concrete wall emergency hell shot given 414 grave disability consuming and covering himself in feces 414 to determine if involuntary meds are needed, if Rick should transfer to a DLC facility with mental health facilities such as WA Bash, but no, they couldn't do that. Dr. Wall will testify that they did start involuntary meds, which they did. So 420, Dr. Waller's notes, disjointed thoughts still going downhill as conversation related to competency to stand trial. 423. Suicide companions are replaced by DOC guards, so he gets tased. Dr. Waller's notes say disorganized thinking accelerated. So this is around the same time that Dr. Martin says there's no evidence of psychosis.
518 vegetative state of depression. 522 is having a psychotic reaction to stress. Mortasing Dr. Waller's note saying depression peaked. physiological symptoms presenting, trembling, stuttering, knees buckling, eyes bulging, and then by July when he stopped confessing some signs of restoration.
Dr. Waller testifies he's back to proclaiming innocence, but states, "I've already been sentenced." Guys, to me, whether someone is guilty or not, in my opinion, you cannot believe things that people say whilst they're in the middle of a psychotic episode. But you do you.
And let me know your thoughts in the comments. I'll see you in the next video. Bye, guys.
Oh, go to see.
Oh, yeah. There is. Oh, go there.
Stay. Ella, get it. Cassie, get it.
No, I'm not playing it.
He's not playing it today. Okay.
Good boy, Noodle.
