There are two types of people in the world...Added:
One example that I like to talk about is uh people's attitudes toward chiropractors.
Um now there there really are if you were to do a vin diagram there really are two kinds of people in the world. Uh there are people who think that chiropractors are quacks and there are people who are currently going to a chiropractor.
There's really not any in between on this. And so if you're doing void dire on a case in which your client has gone to a chiropractor for treatment uh for an injury and you're trying to convince the jury either through questions where you're eliciting responses from favorable jurors or asking rhetorical questions uh or emphasizing how the judge is going to instruct you in some way. making some effort uh to persuade those folks. The people who think that chiropractors are quacks are going to have a little thought bubble over their head, if you could see it that's just going to be saying, "No, still a quack."
and the people who are good for you. If you've done that, if you've tried to elicit information from people on the panel who are good for you, not only have you not persuaded anyone else on the panel, you've exposed your good jurors to make it easier for the other side to strike those jurors.
So, it really is at total cross purposes of what you would want to do.
