While Nicole maintains to this day that her story is the truth and that her accusations claim she lived through 10 years of hell, other family members assert that the accusations were false and that there were psychological evaluations, audio recordings, and other elements that directly challenged her credibility and that were not considered in this trial. [00:04:11]This case has really divided public opinion in Argentina, because many people initially believed everything your niece said, right? And now they're trying to reverse what happened. I have also spoken with your brother about it from Argentina and the truth is that it is a dangerous case. How have you experienced it as a family?

[00:04:38]Uh, ugh, I don't know how to explain it. The truth is that it is something painful for both my brother and all the members of the family.

[00:04:48]People, well, obviously they're divided; those who know us, many people support us. Obviously they know who we are, but many people obviously haven't listened to us in any way to explain that some things weren't like that, and many people who knew gave us their support because they knew what we were like as a family and they knew my brother. Basically, it devastated us.

[00:05:22]Of course, of course, because how old was your niece when she reported this alleged incident? Well, let's see, legally speaking, we can't say "alleged" because this brother is supposedly convicted, therefore, we can't say "alleged" legally speaking if he has reached an unjust conviction or not regarding the case. But I'm still going to use the term "alleged" because obviously today we're giving a platform to your version, specifically his. When did they think, when would these alleged abuses have started?

[00:05:57]Look, she supposedly, precisely, supposedly, all this started when she was between 14, almost 15 years old, when she made the complaint, right? She corroborated the complaint using her older brother, but she contradicted herself on several occasions.

[00:06:17]First she said five, then she said 10, then she said 13. Uh, obviously in the Gessel chamber examinations, uh, it was said that, I mean, it came out that she was a fabulist.

[00:06:35]And well, in the medical studies it turned out that the girl is a virgin, they did n't find any trace, no trace of any kind, no genetics, no hair, nothing, I don't know, nothing that could say that the girl had been abused, she had no signs of having been abused, or mistreated, neither in the past nor recently up to that moment, right?

[00:07:07]Yes. We, as production staff, received a portion of that program, of that expertise, and indeed it appears, but it says absolutely nothing. These are scientific analyses that were not carried out. Therefore, this expert opinion was not considered in the trial.

Moreover, they took certain things for granted, I mean, the trial prosecutor, who was the one who directly accused him of things that hadn't even happened, that he had penetrated her, sorry, the word, anally. That said, when the girl, I mean, was, I mean, the records say so, I mean, the police, the doctors say so, and even the psychologists, I mean, let's see, uh, they took it for granted that no, she wasn't an abused girl, she didn't fit the profile of an abused girl.

Electricity so that she could n't escape, so that she appears giving a version on television, I mean, a supposed neighbor.

[00:08:30]Nobody knows the one who was on TV. My brother owned a warehouse, that is, he had an accident many years ago, which disabled him in some physical ways.

[00:08:42]So he set up, let's say, a family business in the house, which was a warehouse, a lot of people went to buy things, people were coming in and out of the house all the time because it's a warehouse, right? I mean, let's see.

[00:08:59]Well, and they had gone on vacation for a while, they had gone to the coast for a month, uh, and my brother, let's see, bars, he had bars, I don't know where they had the bars, on the windows, for security reasons, basically. Let's see, clearly. Let's see, and then I don't know what the fence is about, for example, it came out that it said they were putting up an electric fence. That 's a lie, basically because there was never an electric fence. If there was anything going on at any point, it was because my brother, for example, when he went on vacation, did leave the house closed, the warehouse closed, but we all live on the same block, so we could see each other's houses. So, what electric fence was he talking about? No, there wasn't any of that, was there? Aside from that, when you say it was a family business, as we say here in Chile, it was a real family business, because he would bring the vegetables, he would travel at night to get them, his wife also worked there, his son also worked there, and you see, it really was that, it was a family business. What happens that day when all this explodes?

[00:10:23]The specialists in this type of crime call it devilation. Your brother told us that in an audio recording that I want us to listen to, a relatively short audio recording. What does he say?

[00:10:35]To the audience, my name is Pablo Luciano Rina, the famous callus of the house of horrors in Monterande.

[00:10:42]The father was sentenced to 20 years.

[00:10:45]My situation began in 2018 with my daughter Nicole Rut Salaberry.

[00:10:51]At that time I was 14 years old, I had identified her. That her maternal grandmother had introduced her to a male, Cristian Sebastián Pacheco, a 35-year-old man, a relationship that he, as a father, did not allow.

[00:11:06]I am a merchant, I had a business in the town of Esteban Echeverría Monterande, where I worked, I had a butcher shop, I worked together with my wife and my children, a family micro-enterprise.

[00:11:20]The situation of my daughter Nicole along with my son, well, they had night out, they went out while that was seen hidden with this male, which created a lot of conflict within the family because I did not allow it, I could not allow it as a father.

[00:11:35]Uh, this whole situation culminated in the year 2019, on February 6th.

[00:11:45]That day I had the supermarket; the day before I had gone to the wholesalers, to the central restocking markets, which many of us know here in Argentina operate at night for the big merchants, buying vegetables, meat, all those things.

[00:12:02]Upon my return the next day, February 6th, I arrived at 11 am. My dad, a client and neighbor, was there.

[00:12:11]I unloaded the truck; it was a normal workday.

[00:12:14]At 11:30 in the morning I sent my daughter to the house of one of her maternal grandmothers, who is on my mother Bemba's side.

[00:12:19]We all live on the same block. Uh, my mother-in-law also lives on the corner, my mom lives in between, and I live on a corner before the supermarkets in front of a technical plaza.

[00:12:30]Uh, a normal day, nothing to worry about.

[00:12:33]I worked in my butcher shop section, my wife was at the till, my children were restocking the merchandise on the shelf, my dad was inside, I had a caretaker, Gustavo Ojeda, who was the one who looked after the house for me. This usually happens before the market closes; it starts before the market closes. By then, when I had returned, my son had gone to get his hair cut. He arrives around 11:40 in the morning, scared, looking for his sister. I was looking for where he was.

[00:13:02]The whole family group was present inside the store working and he left again without any problem. When the market closes, our daughter leaves, she disappears.

[00:13:17]My wife and I didn't know anything about it.

[00:13:19]We went to rest because we were exhausted from working all night.

[00:13:24]When I woke up at 5:15 in the afternoon, 4 hours had already passed, I called my daughter and she was not inside my house. My younger children, I don't know, tell us what he had done to his sister. He had locked the bedroom door, and he leaves, he goes to the house of his maternal grandmother, Ana Semmira Centurión, who had introduced the male.

[00:13:46]Uh, already informed by my younger children, Kiara Brisa Rut and Jan Rut, who was present at all times along with her sister. The whole group was present. They tell a very strange story. We went outside and my wife was asking me to please go and pick up her daughter from her grandmother's house.

[00:14:05]Uh, this grandmother, well, she has a history that always scared my wife and me because they are people of ill repute. We had few relationships.

[00:14:14]Uh, we took care of, well, I took care of working, of raising my family, right? Each one has his own family.

[00:14:21]Uh, the thing is, I went outside, I spoke with my neighbor who was at the door, who was the landlord, and he told me if he saw my daughter. He told me that she got on the motorcycle leaving her maternal grandmother's house, got on her brother's motorcycle and headed towards the avenue, and without knowing where we were, because we didn't know where my daughter was, we didn't know anything about all this.

[00:14:42]And I told my wife that I was going out to get soda, while my dad, who also has the house next door, was looking for Nicole. My neighbor was there, we were, almost all the neighbors were coming out because it was strange. He went into my mother-in-law's house and that's what caught the neighbors' attention. I get into my truck and when I get out of my truck, 200 meters away the police stop me and accuse me of having stolen a damn gun, right? And well, I had gotten sick because I was the owner. I am stopped by his brother, whose name was Cristian Omar Pacheco, who is the brother of Cristian Sebastián Pacheco. They are all old friends of my mother-in-law.

[00:15:28]And then they take me to the police station, the official one, they take me directly there.

[00:15:34]That's the first audio. He's answering us now because he's watching the program and he says, uh, before going on vacation, he says, I'm going to ask about the cable issues, sorry. He says, "Before going on vacation, Nicole, Diego, and Leonel were the ones who put electrical wires in the window and door. Who can testify to that?" It is Diego, who is the nephew who can attest and testify to what they put and what Leonel declared in the trial. That's why they had cable. They put it there for security reasons, right? So that it does n't start.

[00:16:10]Clear. Sure, because, well, we, well, like everywhere here, right? For example, I don't know, I also had one at one point and then I took it down because, well, you become aware of the kids, this and that, but of course, it's like they're on top of the wall, there's like a dividing wall and someone had broken into her house at one point through the back where they had put up that fence, but it said danger, electric fence, but in reality it didn't have electricity, it was, I mean, it didn't have it, the sign just said that, you know? And that was for many, many years.

[00:16:49]Well, but whether they exist or not is not absolutely a security issue.

[00:16:54]Now, of course, for the sake of security, what did you know about this relationship with this person who is 30 years older, or at least 20 years older, something like that, eh, about her? How old was she? I was 14, something like that.

[00:17:08]Uh, between 14, almost 15.

[00:17:11]This one, and this man, well, uh, I didn't know anything until that moment. I didn't know anything until that moment when all this mess broke out. Basically, I didn't know anything. I knew my brother argued with her a lot.

[00:17:25]Uh, I saw her as a normal girl who went dancing, who, you know, went out with her brothers, her cousins, uh, she was always with us, who were the family, the, you know, with the uncles, uh, basically she declared, of course, there she is with her friends at the bowling alley, the complainant, this, the brother, this, well, there are other photos that also, well, we haven't shown them because we don't want to.

[00:17:54]There she is in a group, uh, that went on a kind of church trip with a church that she said she didn't go out with anyone or that she didn't deal with people. She said she always claimed she didn't have social media, and I have photos of her on social media that she said she never had anything on, and I don't know if that's the little material you have, but I have photos of her, lots of photos of her going out to clubs, with groups of friends, and many things. So, yes, indeed, if he knew if she could go out. Now, the figure of the maternal grandmother is crucial in this story. Apparently, from everything I've read, I get the impression that she has something to do with this story and with what's being done against your brother, because it seems like something very elaborate for his age, and apparently she's the one behind it. What do you know about that?

[00:19:07]From your niece's maternal grandmother.

[00:19:13]Well, yes, because, look, supposedly this started when this whole situation began, which supposedly had already started a month before they went to the coast, right? They went on vacation to the coast, they were there for a month, I mean, supposedly she tells her maternal grandmother about it and supposedly, because I always say supposedly because here everything, I mean, for me it's nothing real, huh?

[00:19:42]And she grabbed it, told her grandmother, and the grandmother said, look, if your granddaughter tells you as a father or grandfather that she is being abused by her father, you're not going to do anything about it, are you?

[00:19:57]Clear.

[00:19:59]Uh, you do it immediately. So, she expected them to go on vacation, right? They went on vacation when they came, of course, they were looking, waiting for the moment to make the perfect plan, you know what I mean? Because that's how I see it, you understand? She was there at the time, when she came back, it was right away, they were already with the Pachecos, I know the Pachecos, I live near them, I live close by and I met them through this because although I live close by, I had never had any contact with them and well, they are all police officers, commissioners, well, they have those things of instilling things in the minors, right? How to do certain things to get rid of, say, the parents or certain things because they have kept properties.

[00:20:58]Ah, they are healthy, they are good people.

[00:21:03]Yes, but there are quite a few.

[00:21:05]Yes. And well, and also, uh, there are drug-related things in the background, uh, they've paid with drugs.

[00:21:13]Uh, well, and the case was also framed with drugs because of my brother.

[00:21:18]My nephew says so in one of the audios, he tells it and I have proof of it.

[00:21:23]Hero, they arrest your brother that day and the ordeal begins for all of you.

[00:21:30]How did the arrest go? According to what your brother says, the arrest happened this way. They arrested me at 5:30 in the afternoon, maybe a little later, on board my truck, 200 meters from my house, arrested for allegedly robbing at gunpoint, and they took me to the DDI. In that place I meet Soria, the father-in-law of my sister-in-law Yamila Salaverry. They wanted to have a procedural record signed.

[00:21:58]I am a man who has an education, I read and I read well, I read quickly and there were false words that made me hounded when I ran a red light, they even went so far as to sign me. Well, they beat me up there for not signing the document, a document in the minutes that they wanted me to sign at all costs.

[00:22:22]And well, that's where it's unbalanced. There was a disagreement there between the inmates I had housed inside a cell, there were 15 of them that day, on February 6, 2019, they asked that I be taken out, they housed me in a mailbox. There I received threats that because I messed with the commissioner's brother, they were going to kill me, they were going to kill my family. And well, then the days that passed began to show that my sister, well, my sister started to be followed and scared, some police officers tried to stab her.

[00:22:53]Natalia, I am being taken to testify on the date of February 8th, while inside the judicial town of Monterande, of the UFI 3 of Monterrenda.

[00:23:03]The court would be for questioning.

[00:23:07]Uh, they leave me inside a cell. I was with another inmate, one of the security guards came in and hit me on the head with something hard, like an iron knuckle duster. He had something in his hand that I didn't see because, well, just then an inmate said to me, "Be careful, because when I turn around they'll hit me." And then, well, I lost my mind, I lost everything. I finished the Evaperón in the hospital.

[00:23:31]When they recovered the Eva Perón, uh, well, the police were photographing me, telling me I was going to be famous, and that's when they started accusing me of being a rapist because supposedly later they told me I had raped my son, then they changed the charge to that I had raped my daughter, they started putting that case against me.

[00:23:53]And well, from there I was transferred to the prison unit. In the prison unit where I was detained, a few days later, I contacted my family and there, well, my wife was there, my wife, my son and Nicole attended to me. I asked him why they had reported me and were extorting me, asking me for money, the truck, cash, that I give them all my things. And well, they filed a complaint against me, without denying it, without... I suppose it must be to get rid of the father because they just wanted to mess around. In other words, my son wanted to mess around in my house, they wanted to do what they wanted, and he told me that if I didn't give them what they asked for, they would keep lying until I got 35 years in prison or died in prison. And the truth is, a situation like this is difficult for me because, well, it's something that's a punishment from one's own children.

[00:24:47]And well, that's where the terrible situation began. Um, my wife got into a fight with her, she got into a fight with her sister because they overheard this conversation.

[00:24:56]Everyone was there, we were all there, uh, I have the audio recordings, they're recorded there. My son, as my son Leonel recounts, they were asking me for money, my daughter was asking me for it, uh, and when I said no, well, the accusations started. They went to the press, uh, they actively went to all the media outlets to accuse me of things I did n't do, things I didn't commit.

[00:25:19]And my children... The whole family group was present inside the house and they accused me of rape while I was with my wife, I mean, if that were the case, we were two adults and they accused me. They focused on the prosecution's accusation, and as a man they took away my rights, they didn't investigate me, they didn't allow me to testify.

[00:25:39]Uh, I hired a lawyer because I'm not from the legal field, and the lawyer, well, she ended up betraying me; she didn't want to talk to me. Uh, I had provided him with the evidence, audio. I already had it by March 28, 2019.

[00:25:51]My son had opened up, he had confessed the whole situation. He told me that they had been planning it for some time, that his sister had told him at the coastal party on vacation, that she had spoken with her uncle, they went to a villa, they bought Honduga and they paid someone near a prosecutor's office, a certain certain person, who supposedly had the authority to arrange it within the prosecutor's office to frame me, to fabricate the crime of gender violence and convict me. And well, they did this to me, he started to confess, he filed the complaint, they made a fake modified video, my son told me that he handed it over. He was the one who reported me, it was my son Leonel, not my daughter, but my son Leonel.

[00:26:29]And then they changed the cover sheet, they put my daughter on it and well, that's where the whole legal process began that has taken away all my rights. They didn't allow me to testify, they did n't allow me to provide evidence, they built the case on their own grounds alone. There's nothing for me. The lawyer I hired told me that, well, nothing, this is something that many people risk when you're accused of gender-related issues, that the lawyer can be bought off, and today here in Argentina most lawyers are politically indoctrinated, they maintain their political position based on their money and status, and it doesn't matter if they have to destroy a human being's life. I gave my lawyer the evidence, I gave her everything, she already knew everything and yet she betrayed me. I went to a trial, they took me to a public people's trial, which I didn't want. They took me to the hearing, I was with my lawyer, I asked, uh, the judge's secretary attended to me, I told him, "Please, I want my official defense attorney because I don't know the lawyer, I hired her, but she never came to see me in jail. That is, she doesn't accept my evidence, she doesn't accept anything." And well, from there they told me that there was a supposed law here in Argentina. The court itself lied to me, as did the prosecutor Marcela Dimundo, along with a lawyer, saying there was a supposed law that prohibited me from choosing because I was accused of gender-based violence, thus depriving me of my right to choose. I had no choice and I am not a legal person; I am educated, but I am not someone who is instructed in the law every day.

[00:27:58]And they told me that if I hadn't signed, three judges would arrest me and give me double the year's sentence. We started arguing, I wanted to speak to the judge and unfortunately, well, after the hearing I ended up receiving a threat from the lawyer. My dad was called and told that the judge was angry with me for exceeding the defense that if I didn't shut my mouth he was going to give me 15 more years in addition to the 20 that were on the cover sheet, simply because of the cover sheet and there is no content.

[00:28:30]Hey, but what your brother is saying is really intense, because they set up the whole procedure and the whole process first for their son. I mean, I'm not going to go into detail about what's happening to you, but yes, indeed, the son is the one who puts all this together in the first place.

[00:28:50]He was involved in drug-related matters.

[00:28:52]How was it?

[00:28:53]Yes. Um, look, from what I understand, the boys were manipulated, right?

[00:29:02]Uh, the guys, there was also a drug thing there, and I don't know those people, I'm unaware of them, right? I have n't had any dealings with them.

[00:29:13]And I know that, like I said, they're brothers, I mean, they're police officers, and they're like brothers, they're a gang.

[00:29:23]which they basically call the Smurfs.

[00:29:27]Uh, and well, and among them, I mean, let's see, uh, they put together, let's say, to get rid of people, even though the kids wanted freedom, a certain freedom, that my brother allowed some things, there were things he didn't, no, no, and so it's like they use the kids, but there are also adults involved in this, you know? Clear.

[00:29:52]So, sometimes, when you say to the boys, you might think, "Okay, look, I don't understand, there are things I can't answer because I don't know them. For example, he tells me, 'He talks about people I don't know, you know what I mean?'

[00:30:11]No, no, don't worry about that.

[00:30:12]But look, there's something interesting he says, and your brother says, ' My son confessed, my son clearly said that all of this had been set up.'"

[00:30:25]It had been a lie, hadn't it? Yes of course.

[00:30:28]My nephew, about two weeks later, maybe a month later, looked for me and said, "Auntie, I want to talk to you." I didn't want to distance myself from my family, from my dad and my mom, because my mom had suffered a violent attack.

[00:30:41]My dad had been shot at. Well, we had been through a lot in a very short time. They had set our truck on fire. There had been, I mean, a terrible chase involving journalists, a lot of things, police officers who weren't really police officers because they were supposed to be protecting us, but because they were police officers who wanted to hurt us, they wanted to hurt us as a family. I mean, they were working for this guy Pacheco, right?

[00:31:13]All of this was basically part of that gang.

[00:31:20]And well, how does this happen? My nephew calls me, asks me to meet him in a plaza, and shows me how he had made the video. He shows it to me, and I just stare. I mean, I went over, I mean, obviously I did n't want to go over because I was scared, not because... Look, I know who he was with, but it was because he kept saying to me, "Auntie, I want to talk to you." Because he found out the forensic tests had come back negative. Supposedly, he said he felt bad because he believed his sister, that he'd been used, and that by the time he realized it, it was all over. He thought they were just going to arrest him and that's it, and that it would only be a couple of hours. And when he showed me how Nicole supposedly made the video, I was stunned and I said, "Well, Leonel, if that's the case, I'll take you to the police station myself, and you can recant and explain everything." "Nobody wanted to take our complaint." Well, it took a year and a half for them to finally take his complaint. A year and a half, right? Because nobody wanted to take it.

[00:32:43]Yes, go on, go on, sorry. Uh, well, uh, a year and a half passed before they could finally take his complaint, basically.

[00:32:54]And what's more, when he sat down at the trial, which was the trial, where my brother had no defense at all, it was a farce, basically, for me it was a farce because, well, now I'll explain that to you, but he, my nephew, said everything in detail until the prosecutor, uh, the prosecutor, let's say, on the other side, uh, was threatening, threatening my sister-in-law at that moment. At that moment, she was threatening to take the children away from her and she wasn't siding with the girl, let's say, with Nicole, uh, that she was going to take the children away, that, I mean, look, that she was going to take the two youngest ones away because my brother has four children, that she was going to to take the two minors out, or that they were going to lock her up too.

[00:33:47]Uh, uh, Leonel told everything, he said it was a lie. He had fabricated the case, he said, he named everyone, everyone by name.

[00:34:00]And his statement wasn't taken into account. My sister-in-law got the lawyer too.

[00:34:07]Uh, it happens that she, according to her, I don't understand from her words, she, uh, when they made her sign a paper they made up, uh, it says, "You reported this."

[00:34:22]Yes, but she explained that it was supposedly out of fear because they had told her they were going to take the two youngest children away. She said, "Yes, I signed that." "There's nothing more to say," he told her. I mean, in the case they had stated, they had stated that my brother beat her, that she suffered physical abuse, violence, well, all kinds of abuse. They accused my brother of breaking bricks with his bare hands, of being a monstrous person, of intimidating the kids with different acts, right? Like locking them up and stuff like that, I mean, excuse me, Natalia, but when they arrested him, they were trying to find anything to justify a sentence like this, anything, but your nephew, your nephew said what you just said and he recorded it, and here we have it so we can all hear it from the person who started this whole process. And what did he end up saying? Let's listen, please, because it's extremely important and this wasn't considered in the trial. Listen. I was going to do something. I never thought you were going to end up in jail.

[00:35:34]Then Nicole told me that the She took her to the cemetery, where her friend lived, and I don't know what else. I didn't even know the guy's house or Pacha's. So I took her there, I left her there. I went back to the workshop. From there, the workshop took me to talk to a guy named Ojito Elías at the police station, and I told the police the whole situation.
