>> Well, I have a scenario with my wife and maybe you can respect my wife's wishes.
Okay. So, she was uh she was assaulted by a a man, right? And she was and that person was put in prison. So, she saw this she saw somebody that was a man going into her uh locker room and she's threatened now by man. She's got PTSD from that. You as a doctor would certainly understand PTSD.
>> What is that man claiming?
>> So she saw a man to >> Yeah.
>> So she saw a man. So she didn't see so but trans women aren't men. So she she didn't see >> Did she see a trans woman in the bathroom?
>> Yeah, that's what we're talking about.
>> Yeah. A bearded man that was wearing a dress that called himself a a trans woman. So, how did how did she know that this person wasn't a sis woman with a medical condition that causes more masculine characteristics?
>> Um, because when that person undressed, uh, she saw his member.
>> So, I'm a little bit skeptical that this happened uh to to this person. Was this in a bathroom or were this in a locker room? 24-hour gym and she was taking a shower after her workout and the person came in wearing a dress claiming to be in the trans community and had free access to that space and was getting undressed in front of my daughter and her and uh it traumatized her.
>> Okay. So, did did this person assault anybody? Did this person touch anybody?
>> Yes.
>> Or is it did this person just go in the bathroom?
>> Trans. Yeah, she she uh that person uh broke uh the the person's uh privacy barrier and was entering into a space that they don't long legally belong.
>> So just mere exposure to an organ is not uh is not assault.
>> Oh, so we could walk around in public without getting arrested. That's weird.
I don't think that's true.
>> No. So in a lock and in a closed locker room space where people are dressing and undressing that is the place where that is known to happen. Um that would not be assault. You can have the choice to not walk into those particular spaces if you don't want to be exposed to people who are undressed.
>> Okay. So, if I'm a man and I'm not trans, I could just walk into a woman's uh locker room and get dressed in front of her in a 24-hour fitness and not get arrested.
>> I don't think there should be I don't think there should be public changing rooms where people can see anybody uh like that. Uh unless >> I agree. I agree.
>> Like I think it should be there should be doors to the floor, walls to the floor.
But in this particular scenario, um there's something that's happening in your argument where you are saying that that this person has PTSD uh from an assault and therefore seeing any type of anatomy that is different to what is expected of sis people uh is triggering of that PTSD and should not be allowed. And so the question is what to what extent of discomfort >> like who gets to decide what level of discomfort for them >> gets to ban other people and also with people with overlapping characteristics where do they get to go? So by what criteria are we >> Yeah. So by what criteria would you be allowed to use the women's space and which ones would you be allowed not allowed to use the women's space? Well, we we would do what what we do when it comes to uh gender versus a social construct, which could be subjective.
So, we would use biology. So, large and small gametes, we would go by that what your birth certificate says.
>> So, do we test your gameamtes when you go to the bathroom? [laughter] >> Well, again, you would you would be designated that at birth just like you were. That's why you changed it.
>> But I didn't but none of us know knows our gametes at birth. And so there's an interesting contradiction or at least conflict in your argument that you want to exclude people from a bathroom based on assumptions made about them. But then you want the definition to be solidified on uh innate characteristics of gamet production which don't always male and female.
>> Yeah. Those don't always.
>> Yeah. But are you are you're a doctor?
Are you claiming there's no distinction between male and female?
>> Yeah, I'm claiming that that it is a multiffactorial distinction. And so there it's very difficult to narrow everything down to one particular criterion that includes you as a woman or excludes you as one.
So no matter what biological characteristic you go to to try to include somebody as a woman or exclude someone, you're going to have many exceptions within that. So uh and even cis people are going to be excluded based on that. So uh I think you have to take things multiffactorially instead of relying on one piece of anatomy or one uh one biological characteristic.
>> So I got a question for you. So how so can anybody designate themselves as anything then under your criteria?
>> Yes. Well for their [laughter] gender.
For their gender. Yes.
>> For their gender. Yes. So then if if if it can be anything then by your own logic it's nothing.
>> No no no. So judge >> Yeah. You just you just gave a ridiculous f facious argument.
>> If if you could define if you could define I'm having a conversation with just a oneonone.
>> You're going to you're going to you're going to respect my guest too.
>> I have no respect. Somebody that just makes up [ __ ] and applies any definition they want to [laughter] gender. That's insane.
>> I didn't I didn't I didn't apply any definition. You just said it could be anything.
>> So, >> no, I said you could you could self-identify as anything.
>> Yeah, you could be anything, which means there's no definition.
>> See, that's what that means.
>> Judge, >> let me give an example. If I say that the sun could be a balloon or anything, then you can't define the sun ever.
>> Judge Judge, uh, there's a bodybuilder, I don't know if you can look up on Instagram, but there's a bodybuilder named AJ Hullbrook, and who that is.
>> You know who that is?
>> Yeah, you guys use that all the time to debate.
>> Okay. Well, I I wanted to use somebody other than Buck Angel uh because I I I I've heard that I I think I've heard that Buck Angel's a bit problematic or something, but uh AJ Hullbrook uh is is uh female to male. Would you So, you're saying that you would prefer AJ Hullbrook to be in the women's restroom with your wife and daughter? Well, here's my here's my point as to why I brought that situation up because it is a real situation. Even though the people in the think I made that up, I didn't.
My wife was actually assaulted by a male. So, let me explain. Hold on. Let me just land my Let me You want a discussion? Let's have a polite discussion. Let me finish what I'm going to say. The reason why it's a problem is because there are women designated spaces. There just are. So, by your criteria, because you admitted that anybody could designate self-d designate themselves as a man or a woman, this opens up a big can of worms where any uh P3DO person could claim that they're a part of your community and you could not stop them.
>> No, but here's the issue with that.
Here's a big issue with that argument is because those activities like those actions if you go into those spaces and commit essay or if you do something inappropriate that is already illegal.
That is already something that they are not supposed to do. But there's there's no bathroom attendance. There's no locker room attendance. People can just people can who want to do those things can just go in and and do it anyway. So blocking out trans people blocking out trans people does not prevent those things from happening.
>> It just discriminates against trans people. So if so why can't So why can't a trans person walk into a space, use it, and then leave >> here? Because here's the reason. Because me, let's say I'm not trans. I've never been trans, but I let's say I've got an I've never been caught and put on a list that would require me to designate myself under child essay. Right. So, we're talking I could using your argument, I could walk in Well, can I finish what I'm saying?
>> No. No.
>> I could walk into a space like that, expose myself, and you couldn't stop me.
trans. Why do you think that men need to pose as trans people in order to get into those spaces?
>> Because you've given them access. You've literally given them access with your facious argument.
>> They already have access. They already have the ability to do it without going through. I'm looking any bearded man can walk into a bathroom and claim they're trans and you couldn't stop.
>> They don't have to. That's my point.
They don't have to do that list from Google.
>> Well, there's some that are passing, but there's now now used to you as you used to have a criteria back in the day.
>> Judge, judge, I'm looking at a list right now from Google. That's recent arrests where a man was arrested for being in a woman's restroom. Uh, 3 hours ago, Gwinet man followed a woman into a restroom. Uh, May 23rd, a 27year-old Onita, Alabama man was arrested for following a woman into a restroom. Man repeatedly enters one uh women's restrooms. They don't need to pose as a trans person in order to get into the restroom. They just >> All he could have gotten out of the crime. All he had to do is say is he's a trans woman. No, he doesn't. No, they don't.
>> He could have he could have gotten out of the crime. He just needed to claim he >> going into any place to do crime. You're going to get arrested.
>> Well, wait a second. Just sitting there and exposing yourself to children is a crime. But under your criteria, an adult adult judge, the reason why the reason why I call >> would be no problem. No, judge. The reason why I don't believe your example is because so many people use a scripted example like that to make the exact point that you're making. And so I'm kind of calling [ __ ] that this actually happened because most of the time trans people, like people who are actually trans and who are going into a women's space to use the space and then leave, aren't going in there to out themselves as trans. They're going in there to maybe use the changing room, use a stall in the bathroom, and not make a scene out of it. So, if somebody walked in in that example that you're giving, I don't necessarily believe that that is a trans person. Not saying it couldn't be, but it's very, very unlikely to be because who's more likely to be assaulted in that situation. it's actually a trans person who goes into that bathroom and doesn't pass or gets outed, they are much more likely to have violence against them. So, I doubt I doubt that that was a trans person that did that.

>> It's still illegal. Assault is still wait. I'm in a place that allows me to get naked as a woman. I'm a transw woman. Where am I breaking the law?
>> Because being exposed, exposing a body in a place where bodies are exposed is not in itself a crime. That is not the problem.
>> Well, when does it become a crime?
>> When the assault happens.
>> Well, the assault happens the second that a male steps into a female space where people get naked. That's the crime. And you just gave me an example of it.
>> That is not that is not Let's >> Do you think that that is legally what is in place in in places?
>> Yeah. Yeah. You're not supposed to judge. What's What's preventing you right now from doing that as a cisgender man?
>> Well, now that the laws allow trans trans women to walk into any question, nothing.
>> Answer my question. You've allowed it.

>> I just did. You're It's legal now. I can legally do that.
>> It's not legal. You You as a cisgender man cannot walk into a a woman's >> prove I'm a sis. If I say I'm a woman off and hang I say I'm a woman. Prove I'm not. Prove I'm not.

Like I don't know what crime what crime have I according to you. I could do that. If I'm a if I claim I'm a trans woman I could do that. There's a you're you're ignoring you're ignoring the distinction between an act a sexual act uh versus just changing in a changing room. Those are completely different acts.

You are in saying that you are suggesting that trans women are inherently men and I am my position is that trans women are not men and so allowing a trans women to exist in a space with women is not a problem.
>> Well, here's what I do know. Aside from any space that you can occupy now that I could just claim that I'm a woman, here's what I do know. Uh if what you think and believe is natural, why is it that you need science to offiscate all of the uh consequences of your actions?

Whereas in you're altering your biology to be something different than it isn't.
