78% TAX on Family Cash Gift?! ITAT Mumbai Verdict Shocks India

[00:00:00]What if I told you a man paid 14 lakhs of his credit card bill in cash and declared only 6.3 lakh income and still escaped most of the tax demand. This actually happened in Mumbai. Mr. Mehta had a 28 lakhs credit card bill, but the declared income was just 6.3 lakh. The income tax department flagged it, issued a notice under section 69A and called the cash unexplained money. The tax demanded was nearly 11 lakhs at 78%.

[00:00:30]Their logic was simple. Cash was more than double his declared income, but Mehta said the money came from family gifts. 3 lakh from wife, 8 lakh from father, and 4.5 lakh from mother. At first, he gave the affidavit, but the tax officers rejected them because affidavits alone mean nothing in tax cases. Then, he went to ITAT in Mumbai.

[00:00:54]This time he showed bank statements, UPI records, and income proofs. Wife had professional income under section 44ADA.

[00:01:10]Mothers and fathers gifts were partially accepted because you cannot give beyond your real earning capacity. The final result, 9.25 lakh escaped the tax and the rest 4.75 lakh was still taxed at 78%. The main lesson here is family gifts are not automatically tax free.
