In criminal cases involving road rage incidents, individuals claiming self-defense must demonstrate that their actions were proportionate to an imminent threat; however, when a suspect shoots a victim immediately upon exiting a vehicle without clear evidence of an immediate physical attack, courts may determine that the use of deadly force was not justified, leading to murder convictions rather than self-defense claims.

As Soon As He Got Out | Skyler Burley InterrogationAdded:
Till the offense.
What were your exact words, bro?
Oh, you almost killed both of us.
On the night of August 13th, 2024, police were called to the parking lot of a United Dairy Farmers store on Clime Road in Columbus, Ohio. [music] When officers arrived, they found 17-year-old Gage Lane [music] Anderson lying on the ground with a gunshot wound. He had been in the city working with his father, saving money for a car.
Within minutes, he [music] was transported to the hospital where he was pronounced dead. Investigators quickly determined that the shooting was not random.
According to police and prosecutors, [music] the encounter stemmed from a road rage incident between two people who did not know each other.
Witnesses described a man getting out of a vehicle and opening fire before leaving [music] the scene.
A helicopter tracked that vehicle within minutes, leading officers to a stop about a mile away where [music] 30-year-old Skyler Burley was taken into custody the same night.
What happened in those moments on Clime [music] Road would become the central question of the investigation.
Detectives needed to understand how a traffic dispute [music] escalated into a fatal shooting and whether the explanation given by the suspect [music] matched the evidence collected at the scene. This is the interrogation of Skyler Burley.
Skyler? Yes, sir. Detective Stevens, Columbus Police. I'm sorry to put my hands on you. No, that's okay. That's all right.
So, is there somewhere that she could please excuse us and stuff?
>> Oh, yeah, yeah, yeah. We're all taking photos in the office. I appreciate it.
Yeah, this is fine.
You can see it from well somewhat. Yeah.
You all right?
>> [snorts] >> I'll try.
How did you get burned?
I'm not sure how she got Look at you, good.
>> Oh, man.
Dying. To relieve it? Yes.
Sir, you obviously speak English. Yes, sir. You don't need a translator. What's high school I graduated.
Um Lenny.
All right.
Do you have a GED?
I don't. I was close.
You read and write? Yes, sir.
Do you not have a hearing problem? No, sir. Okay, good.
You wear glasses or contacts? I supposed to but I don't. Okay.
I supposed to have hearing aids too but I don't.
Okay, so well you and I have no problems conversing. I mean I don't sign language or anything. Okay, I don't need braille, right?
>> No, sir. All right, good.
You consumed alcohol in the last 12 to 24 hours? No. Okay.
Have you consumed any drugs including marijuana in the last 12 to 24?
Yes, sir. I did. Okay. How much was that? It's no big deal. I just need to know. Um To be honest with depression I smoke a lot. Okay. So I can't really give you a >> How long ago?
How long ago in the >> Like how long ago? Like Was that this evening, this afternoon or Here is the evening. Evening?
Okay.
Joint? Bowl? Joint. Okay.
Okay.
After this, is it possible to use the restroom? Mhm. Mhm. Okay, cool. Well, I got to pee real bad.
In fact in fact we'll go ahead and do that now.
Okay.
They've already there took the swab of your hands, right?
>> Yes, sir. Okay. All right. All right.
We'll go ahead and let you do that now.
Do I need to hand cuff him? No, no, no.
You going to run and lock the door? You got it.
They was treating you all right. Yeah, I know. I know, bro. I'll be right here.
Yes, I got you.
Lord. Um have you been in this situation before? Have you been arrested before?
Uh a long time ago.
And how old are you now? 30. 30.
Juvenile arrest or adult arrest?
It was I want to say the beginning of my adult Okay. All right. By 18. All right. Have you ever had anybody read you your rights before?
Uh yeah, the first time.
>> Okay. All right.
You're in custody. You're not free to go. Okay? So, in that sense I can't make you say anything, right?
Yes, sir. So, that I I got to give you the the legal option. All right? So, I'll read this statement to you and then there's going to be a statement I want you to read. I'll ask you if you agree with it. Okay?
Before we ask any questions, you must understand your rights. You have the right to remain silent. Anything you say can be used against you in court. You have the right to talk to a lawyer for advice before we ask you any questions.
If you are unable to pay a lawyer, a lawyer will be appointed to you prior to any questioning if you so desire.
If you wish to answer questions now without a lawyer present, you have the right to stop answering at any time.
Okay. You also [clears throat] have the right to stop answering at any time until you talk to a lawyer. Okay? Okay.
Says, I have been read the statement of my rights as written above and I understand my rights. Is that a true statement?
>> Yes, sir. Okay.
Um the important part of that is we can I'm going to and you can stop at answering at any time. All right? You All right. So, if I can have you sign right there, that's just saying that I read you your rights and you understand them.
Frank or signature. Oh, you can do signature.
That's fine. Okay.
All right, man.
And we got All right.
We watched this stuff happen tonight.
We've got a lot of people said this happened, that happened. We're still collecting all that information. Yes, sir. They're telling me their side of the story.
I need to get Skywar's side of the story. Yes, sir. All right. So, this this is your opportunity to tell me what happened and why.
When When did this When did this start?
Uh I can't give you a time.
I I I have no idea. Is it still light out? Yeah. Okay. Yes, sir. Like I said, um I'm going um towards the gas station.
I just bought some um Taco Bell for my daughter. Okay. Um going towards the gas station, the gentleman cussed me out.
We end up going to the same spot.
Um I hop out. Dude in the passenger side [ __ ] um [ __ ] like I say disrespected me.
So >> you How do you mean?
Like like saying he's going to hit me.
So I um I got the car and I talked to the driver.
And I tell the driver like um that I don't basically tell him I want no problems. Basically letting him know that it wasn't cool. He almost hurt both of us.
Dude get offended that's in the passenger side.
Um he jumps out at me.
He starts swinging.
So, the first thing I'm like first thing I did was I did shoot him. Okay.
But it was I was terrified for myself and I was defending myself.
Do you remember how how many times you shot? Once. Once. Do you know where he was struck? I do not. Okay. Um That's good. I I appreciate your honesty in that.
>> I ain't going to lie to you, man.
>> Okay.
Where where did he You're coming out of Taco Bell where at? Where I don't know that area real well. We You want that.
Um This Where was Are you Taco Bell where where you guys almost had a collision? Well, Is it Georgetown? I would say Taco Bell on Harrisburg Pike.
But we had we almost had a collision on um you know Franklin Heights exit? Yeah.
>> The school? Yeah. You was right past that.
>> The right. Yeah. Okay. Then we was saying If you were going towards the UDF, so you're going south? I'm going Yes, sir. Okay. And he was coming from where? He's I want to say he was turning out from that parking lot. From the school parking lot? Yes, sir. Okay.
So we both was going >> So there was a there was a school parking lot there's also some other parking lots there.
>> parking lot. It's it's two schools over there. You got Franklin Park and you got the one that used to be like the CVS they made into like a county academy school. Oh okay. Okay. Charter school.
Yeah, that's what I think it is. Okay.
So so he's pulling out of that. Yeah.
Okay.
And he pulls out in front of you were you in front of him at that point?
I was coming up he was Okay. So I had to basically like >> So you're going south he's coming out this way? Boom. Okay.
>> It was without hitting me. So say like this to me. Put your hand back. Put your hand back. Yeah, that's me stopping the car basically. Okay. And he pulled out you said Because the way the way the way straight is you going that way. You have a lane that's like straight. You go straight and then that emergency is three. But you also have another lane that's like considered a turning lane. The one in the middle? Yeah. Okay.
All right. So, you're in the turning lane or you >> I'm in straight lane. Okay.
All right.
And when you pull into the UDF I was actually going to get something to drink. Okay. For my daughter. Okay.
>> Cuz I got her some three tacos. I didn't get anything.
All right.
And you pull into the UDF after him?
Or before him? After him. It was after.
Okay.
What what does he actually say to you?
What did you say to him first? What made him respond to you with words?
I I was I wasn't even talking to him.
That's That's where um I'm like I'm keeping it real like confused why he got so like I would say like I feel like he was already agitated.
And I feel like by me telling driver like you almost basically messed both of us he took it offense.
What were your exact words but Oh, you almost killed both of us. Did you guys almost hit each other or anything like that?
>> Yeah.
Okay. Anything. You almost killed [clears throat] both of us.
>> Yeah.
Okay.
And the driver responded how?
He looked over to dude.
He He instantly looks over to dude and then that's when dude just I wish I could show the way it was. Okay. [clears throat] But it's only us and they probably try to put me like I'm trying to attack y'all type stuff and I ain't [clears throat] trying to go through that. All right.
Um after this happens, what happened?
I You shot. After I I get in the car the base fee. I leave the scene to I I was about to call you guys. But by the time I get to the place to call you guys it was already like 30 20 cars pulling up.
Okay.
And you went in you went into that house? Yeah, go into the house? Yeah. Is that your address? No. I think I think I was there. Until my face get fixed.
Okay, who whose house was that that you pulled into? Uh that was the mother of my child's sister. Okay.
And That's why I was dropping the food off there. Okay. And once you got there what did you do?
Once I got there I basically walked back and forth with the helicopter start to circle.
And then I got into um her sister's car heading back up there.
And that's when she calls me the mother of my child calls me and say it's like so many cars there.
So I take upon myself and go back.
I go back um so many police officers like 20 30 ARs.
>> All right. All right. I'mma keep it real. I know I don't scare I know I I know how it is. Yeah.
>> Yeah.
I ran. I I actually ran then I'm on the phone with the mother of my child. She was like you're not doing about size nation first.
So I came back.
So, once I came back, they they made it like I was um like dangerous.
I would say, hm? I understand their point because I did run.
>> don't know anything. All we know is a man dressed like you shot a man and ran from you. We had no idea why. No, I don't We don't know what you're thinking. We don't know. I Nah, I totally understand. Like >> I don't I don't blame you guys for what I did, but you feel me?
>> good. But yeah, so I basically come back.
Um They slammed me on the ground.
>> When When did you get into the white car?
Or the gold the gold car? Yeah.
Uh I'd say I parked the black one. You go in the house.
No, I didn't go in the house. Okay.
>> My The mother of my child was in the house with the food. I just I walked from the porch, walked back, walked from the porch, walked back, and I seen the helicopter. And that's when I got to I got in the gold car, was about to go back.
And that's when they told That's when she was on the phone like, "They're here." How long were How long were you there before Before they told Before you tried to get away? And the How long How long from the time you parked that black car to the time police started chasing you and you noticed a helicopter at the top of you?
Well, I didn't try to get away.
But I'd say by the time I parked the the black car Mhm. and got into the gold one, it was like a minute. They was pulling up.
Okay. Like, if you even say a minute, like, soon as soon as I parked the black car, I walked to the porch, walked back, seen the helicopter, and then I get in the gold car, about to go back, and that's when I see I see um I see cops, but it was only one at the time.
But she And that's when I was on the I called her. She said that's when it was a lot of them. Mhm. So, I circled back around.
I circled back around. That's when they surprised me with all they had. They told me they'd shoot me.
So, your intention was to surrender to them when you seen >> I Man, I seen I'm not going to lie. I seen AR pistols.
I get it. Yeah, they all had them. They had scopes and they We're we're we're well-funded police department.
>> Yeah. I get it. You well compact. Okay.
And and you get taken into custody there.
Yes.
>> Okay.
Couple questions.
What happened to the clothes that you had on when this incident occurred? Cuz it looks like from the UDF video, it looks like you have something long sleeve on.
Did you have a hoodie on?
Um I did have a black one. Okay. Where's that at?
I don't >> When did you take it off?
Like Oh, man.
I want to say in the car.
Okay. So, that hoodie's going to still be in the black car or the white car? If I'm not mistaken, it should be the should be the black one. Should be the black one.
All right.
The big question.
What happened to the firearm? Where's it at?
The firearm is uh Is it in my bag?
Mhm.
It's not in the bag? No.
That's going to be a thing. A witness seen the firearm in your hand when you were coming out of the black car.
Witness seen the firearm in my hand like I was in the black car? Yeah. When was this?
2:30 tonight.
That gun That gun should be in that gray bag.
And along should be some some weed. [clears throat] Right.
Was that in it?
The weed was, yeah.
I ran. I hope.
Where's the tags on the black car?
The tags? Should be on them.
They off?
They're in that house on the in the front.
On the in the downstairs bedroom.
Come on.
That's what That's what's reported to me back here. I haven't been to the scene yet. We got an entire team out there right now.
No, the tags should be on the car. You know, we got I had a sergeant go out there and describe the car to me. Right, and give me a VIN. There's no tags on that car.
Hm.
No tags at all.
Hm. How long have you had the car?
Uh I'm just curious. Did it have metal plates or is it like a temp tag in the window we just missed? No, it should be metal. Metal plates, okay.
Uh your gray bag, what is it? Is it Is it one of the one pockets or is it like It's like It should be three. Three pockets on Should be three different ones. Okay.
But that's the one that you had when you got arrested, the one we have right now.
Today?
Okay, then.
The swing The swing bag.
>> Yeah.
We'll double-check what's not likely to miss mistakes. What kind of gun was it?
Uh a Sig Sauer 9.
Semi-automatic?
No.
Revolver?
You said semi-automatic? No, it's not automatic. All right, it's got a slide.
Yeah. Okay. It's semi-automatic.
What makes it a Sig?
Ruger?
P X 90. Yeah.
No.
I was going to say they got it in 9mm.
Yeah, it's Is it back there over there?
You want me to What's that right there? Go ahead.
Where did you go?
Where is No.
Your actions when the police came up on you before they actually laid hands on you.
And it This is after you ran or whatever it was.
You made a statement, "I don't care. Go ahead and shoot me. Shoot me. I don't care. It's over." What did you mean by that?
Why did you say that?
>> [sighs] >> To be honest with you, man, depression, man.
Not Not I'm sorry to call you man, but depression, man. I lost my daughter, sister.
I um I tried to do right for them and everything's How did you lose My daughter with a seizure.
My She was only one.
My sister, drugs.
Heroin.
I'm sorry to hear that, brother.
I appreciate it, man.
But um Was that here in Columbus?
For the last few months, um, I've been trying to build myself to be the the male for my kid.
Who told you this?
She said it.
Okay. I got a promotion coming in.
And I was Where you working at?
Valvoline.
Which one? Rona's Road.
Uh, one off of 256?
Uh, like 15 minutes from the hospital.
On Broad? Yes, sir. Okay. Okay. You know where Myers is at?
Yeah. Right across from Myers.
Okay.
What else?
One other question we're going to ask you, and it's not which everybody's right to say why I don't know.
Why do you carry a gun?
Especially when you have the depression.
You want You want honesty, but full and throttle. That's what I want.
Let me Let me put this way. That's what I expect, and that's what I demand.
Well, that's That's all the way I would rather give it, but to keep it real, like my brother, my sister's boyfriend, um, Shyanne.
That's what made me initially get it from the beginning cuz of that, um, protection and, um, watching the news, and you see people constantly bars, driving past bars, clubs, killing people, um, shooting people.
So, by me having a daughter and a girlfriend, I'm the only male that they have. Her mom's gone.
So, I try to be the protection of the family.
To be real with you, yeah.
I just try to protect them.
But she they safe.
I'm cool.
Don't worry about I'm just saying if you want to play games, you can never get that right now up here.
Was anybody with you?
Uh Yeah.
Who's that?
The um mother of my child.
What her name is?
Aneda. Aneda?
She had nothing to do with it.
Cooper?
Yes, sir.
Was she driving the black car?
No, that was me.
Were those the only people in the car?
Cuz on the video it looks like you got out the kind of looks like you got out the passenger side uh driver side rear.
Oh, no. I was in the driver seat. You're the driver seat, okay.
And she was in the front passenger?
Okay.
No kids in the car?
I said no, I'm sorry.
Okay.
The gun's not in your backpack. There's a magazine in your backpack but no gun.
Is the gun in the house or did it fall out while you were running? We're going to search the house. Um We're going to search the house. If you can tell me where the gun's at in the house, we don't have to tear the damn thing up. Um I'm going to be honest with you.
I don't know if they took it in there or they did not. I could have dropped it outside.
But it was in my bag. Okay. But you can if you get a search warrant, you feel me? Yeah. I wouldn't want you to tear the house up. Well, we got to look everywhere. There's possibly a gun them drawers, cabinets, food.
>> Is there some way I can Bathrooms. At least call them and see if they pick it up.
Who At the house? Who was Who was at that house?
Who was at it?
It was the mother of my child, my daughter.
>> Okay.
She was with you.
Yeah. Okay.
Who else was at that in that house? It was her sister.
Um I don't know who else there.
But you know her sister was there. Yeah.
Okay. Her sister's watching my daughter.
Okay. And her nephew, I don't know yet who he is.
Describe Describe your girl's house.
What does it look like?
We're in a hotel right now.
Hm? We're in a hotel right now.
So the The house that you The house that you drove to, describe that house.
The house I drove to? Mhm.
Oh, you said it was your girlfriend's sister. Yeah. Okay, baby mama's sister.
Okay. Describe that house. What color is it?
That's going to be the hard one, I'll be honest. Do you know the actual address?
I don't. Okay.
>> That's That's But you can You can drive to drive to it.
Uh to be honest, I would just turn the corner until I seen her car.
Okay.
I I've been there. That's my second time being to that house.
Okay.
So if I would tell you, it's white.
All I know is her car in the driveway.
Okay.
>> So that's how I even All right.
How'd you get the keys to that car?
I get the keys to the car? Yeah, that's all I seen.
The keys were? Yeah, they were sitting on the balcony.
Well, on the table.
On the On the porch? Yeah.
It was next to a cigarette.
So I'm thinking that she could have probably came back with my daughter.
Cuz when I pulled up, they were just walking in. And I kissed my daughter. I was like, "Come here." I told her come here. I kissed her and I told her I love her.
Okay, so they were just walking up to the house when you pulled in, too. Yeah.
And then this this happened and she just had her cigarettes and and keys down there.
No, when I when I when we pulled up, they was like I I want to say they was from outside going in. Mhm.
Because >> Okay. You don't know if they just pulled up, but they were outside when >> No, I don't know if they just pulled up.
That was just my assuming. My assumption. All right. And then they seen you and she just put her cigarettes and keys down there. Yeah. And I um she was like, "What's going on? What's going on?" And that's when I kissed my daughter. And I was like, "I love you.
Daddy love you."
And that's when she was like, "What's going on? What's going on? What's going on?" And that's when the girl I was like, "Skylar, you need to call him. You need to call him.
Turn yourself in."
I said, "I am."
So, when I was heading back when they was in the gold car heading back up there, um she said to come back.
>> car?
Why I couldn't take the black car? Why couldn't you take the black car back up there?
Stupid.
I'm being honest, stupid.
Makes sense to you?
Part 7 do part 7 don't.
The guy that jumped out of the car at you, did he say anything?
I might have missed that.
Uh yeah. Well, when he jumped out of the car, he did when he was in the car.
Okay.
>> He did.
That's when he threatened me.
Threatened what? He threatened you how?
That's when he said he'll kill me.
And then dude opened up the door. Skyler opened up the door. They're arguing.
And then next thing you know, I Skyler like this and then dude ran out the car and attacked him. And then after that I heard gunshots.
And when he grabbed your arm, was that your gun arm that he had?
He He grabbed it.
We see that on the video.
He >> Your Your gun was out.
It was in my hand.
Right.
And the shot was He didn't reach for your body.
The shot was as soon as he got out of the car.
He Am I able to see this?
Eventually, yeah.
Well, I mean I'm in I I expect you to be honest with you and I'm going to be honest with you.
>> No.
Trust me. I would I could have lied about the whole shooting Mr. like that, you feel me? It wouldn't have made much wouldn't have made much difference cuz we got the video. We have the There are other witnesses with cam with cell phones. They're still collecting all the cell phones.
Those who didn't have a cell phone had eyes. They seen it.
They heard it.
We're going to find cameras that's going to follow you. We're going to go back out probably tomorrow.
We'll find the cameras that's going to follow you from where you said you started all this.
the Denver store all the way to the UDF, and when you pull out of the UDF, we know basically what direction you went. We'll start following cameras there.
We'll start following ring cameras.
And then I just hope that nothing contradicts what you said. No, no. Cuz that's not going to look good. Oh, I know. You know you good, I think.
Some of these witnesses heard the words.
It's cold.
Like I said, he told.
Mhm.
I was thinking the same thing.
>> [laughter] [snorts] >> Reviewing your baby stuff.
Good baby good dog, year old.
No. Do you know somebody named Cedric?
Cedric? How many years worth?
Maybe once.
I don't think what I mean yeah, I mean I probably know.
I don't know I don't know. I don't get names confused.
I know Cedric, I know I know the dude with black hair and my eyes work cuz first name ain't Cedric.
So and and that's going to tell us the same thing you said?
Say again? And that is going to tell us the same thing you told us? Yes, sir.
All right.
Well, I'm good if you're good, Grim.
Yeah.
Can I see you now?
>> Yeah, he's going to I should Yeah.
I got to say this.
Are you still You wouldn't want somebody to come back and call you a liar. And as long as you're being honest then you got no worries. Yes, sir.
Um how long would I stay here?
I don't know yet. We're going to We're going to work a search warrant.
Um we're going to take the car, do a search warrant on that.
We're collecting all the video. We're going to put it all together. Then the rest of six members of my homicide team are going to get together, come up with what did you learn, what did you learn, what did he tell me, what did they tell you, come up from there.
All right?
Yes, sir. All right, bro.
Is it something If you need anything, don't open the door. I'm not going to do that. Okay. Okay. That freaks him out.
Am I able to They're going to come out in the yard and do call somebody?
They're Or I got to wait? Yeah, yeah, you'll eventually be able to call somebody.
All right.
I wonder if I'm still a suspect or what I'm waiting for.
Uh am I able to still get a lawyer though?
Or that's that's after I talk to Grim?
Okay. Yeah, you can a lawyer anytime you want. Cool.
Thanks. If they try to take you in back here and they want to talk to you, just tell them Okay. Okay.
Big guy, real quick, man. What is uh the code on your phone so we don't have to leave it on there and break the code?
Thanks. They put it on my phone.
>> Mhm.
Um >> [clears throat] >> I got to personally your phone. What's that?
>> Do you have to show me your phone real quick?
No.
I know.
Oh, you can't show me the numbers on yours?
The numbers on your keypad on your phone.
It's 1 2 3 4 5 6 7 8 9 0. No, I was trying to see if I could show you how Oh. Oh. Yeah.
You trying to unlock my phone? Mhm.
Did you?
I got some pictures in there.
You might take this looking. Okay.
All right.
All right, we'll get back with you, sir.
Yes, sir.
Last but not least, man, we got a search warrant for your DNA.
Does that make sense to you?
My DNA? What am I going to do with What are you going to do?
All we do is swab the inside of your mouth, put them on Q-tips, dry Q-tips, and then we send them We hold them.
We got a judge to sign a search warrant allowing us to it.
Allowing us to do it and ordering you and ordering you to allow us to do it.
And this is just to like just make sure I'm me?
Well, let's say we recover some kind of evidence that we need to Like let's say we find a gun when you say, "Hey, that's his gun." If you If you had a gun, your DNA would be on that gun, and we could compare the two things.
You know how that works? Or if we have to put you in the car, we could swab the car and just to just to tie things up everything, all right?
So, all we need you to do is just open your mouth.
Am I able to also talk to a lawyer, please? Oh, yeah. Yeah.
>> Okay.
Yeah, when you get down to the county One side and the other side.
So, I'm under arrest?
What's that line? You said I'm under arrest. Yes.
Yeah, you're you're not free to go. No, no, I can't go until I talk to my lawyer.
So, this face No.
Oh.
Then he processed decide.
