GRAVE Charges Against ICE Should Have Trump SCAREDAdded:
Hi everyone, Harry here to talk about another charge. The second charge by local Minneapolis authorities against ICE agents for their conduct, allegedly unlawful conduct during the whole operation ICE surge in Minnesota. Okay, Mary Morardi brought this one. She's the DA in Minneapolis. She is the person who presumably would bring charges against uh the killers of Renee Good and Alex Prey that is still being investigated under the impediment of non-ooperation from the feds. There was a previous assault charge already brought against an ICE agent in St. Paul for basically being a hot dog and passing a motorist and waving his uh rifle at that motorist.
Point one, just as happened in that other case, we have the now common scenario. Every time we've been able to verify, it's another instance where after the episode, ICE claims some grandiose conflict with the victims who they say were coming after them, etc. And you have the ICE agent, Christian Castro, who first said that there was this huge threeinut scrum when they were going after him with a shovel and only then did he open fire. That uh was completely trashed when the New York Times got a hold of video that showed the whole thing was 12 seconds. Uh at that point, the Trump administration actually had to withdraw the charges that they had levied against the victims in this in this case, the person who was shot. And um a rare instance of basically acknowledging this guy had lied. So that's point one is the scenario is the ICE agent does the shooting and then does a false story of saying he was under threat. Point two is that the uh Henipin County District Attorney was able to put this case together without the cooperation of the feds. The same kind of scenario she's confronted with in the other killings.
So you had the feds uh basically saying we won't tell you anything. So what happened? There was an initial interview that a state agent uh attended with the partner of the agent who was accused of firing the shot. And that uh interview explained what had happened and contradicted things that the uh now defendant Christian Castro had said. So they took that and then statements from the four victims in the case who are four people who live together. One of them was driving home and the agents saw a license plate that they thought belonged actually not to him uh as it turns out but someone else who was there illegally. A crazy chase ensues. There's a 911 call and the um main victim who gets shot in the leg makes it to his house stumbles giving them time to catch up goes into the house and the whole thing as I say lasts 12 seconds. A shot is fired, lodges in the wall but also goes into his leg. The uh charges in state court are five. One for assault of each of the four people who were living in that house, the guy that the agents were chasing and then a um friend of his and their two uh partners. All four of them lived together. Those are all felony assault charges under Minnesota law. And then the fifth is for the falsely reporting of the crime, the lies that the guy told. It was only because of this initial interview and then the um foraging through hospital records that Henipin County was able to determine who the defendant is, that it was this guy, Christian Castro. The feds basically gave them no information, no cooperation. and they were able to put it together on their own. But that has real implications for the eventual um really um imposing effort to try to make cases against the shooters of Freddy and Good, but they have enough they think to bring this case. Notwithstanding, ICE officials said the prosecution is unlawful and nothing more than a political stunt. We can be sure that just as in the other case, you're going to have Castro try to remove his case to federal court and then the whole argument will be over whether his actions basically this is this is for federal immunity purposes were necessary uh law enforcement necessary and reasonable law enforcement or was he just uh really you know lost his um cool and did things that he was not authorized to do. That's going to be the legal issue that governs whether he gets immunity in federal court. And it's also going to be more or less very close to the issue that he would try to plead in any any jury trial back in Minneapolis and say, "I was acting justifiably in self-defense under Minnesota law." It's the same kind of thing. Was he in fact doing his necessary law enforcement work? And here he starts in a pretty big hole cuz he lied about everything.
Doesn't mean uh technically he he can't be found to have been doing what he was supposed to do, but that he lied so flagrantly about it is not going to uh help him very much before a factfinder.
One final point I want to note. The other assault charge that was brought in St. Paul, it's against an identified uh agent. There is an arrest warrant pending for that agent, but he has yet to be picked up on the warrant. So, that case has gone nowhere, and the the ICE agent is in some fashion a fugitive on the run. But it's another indication of not simply a kind of latitude by the feds, but really um potential active efforts to just keep Minnesota from going forward. Even in cases such as this one where they know the ICE agent has lied, there's at least a strong argument that the ICE agent wasn't doing his official duties as he were supposed to do. And that should open the whole um case for state prosecution. But you can see ICE is dead set against this. And um the Mary Morardi and bringing the the charge says look his federal badge doesn't make him immune from state charges for this criminal conduct in Minnesota. But this case is obviously going to also be a whole broader showdown and tugof-war between state authorities and federal authorities from whom the state can expect basically zero cooperation even if uh they the feds are basically aware that this guy was a liar and possibly acting out outside of his responsibilities. Indeed, they didn't.
It took several weeks for the feds even to look at the video that the Times had produced that showed this guy was lying.
Then they did act. But in no way are they even lifting a finger to help uh Minnesota. And I think you could well see them in court uh trying to help Castro, the ICE agent, and keep this case from proceeding to judgment.
