In criminal justice systems, failing to complete court-ordered rehabilitation programs can result in losing the opportunity for sentence reduction and facing additional prison time, as demonstrated when a defendant was terminated from a jail treatment program for minor violations and subsequently convicted of multiple felonies with extended jail sentences.

Defendant Blows His Second Chance Over Something Ridiculous!Added:
Motion to terminate the intervention plan.
Violation is that November 11th, you were discharged from the jail treatment program. You understand that charge?
Yes, sir.
Okay.
So, why were you discharged from the jail treatment program?
Cuz I got into an argument with another >> An argument with Who?
With another inmate Drew.
>> About what?
About every time I would do something, touch the TV, talk to somebody, he kept saying I was too loud. He kept saying >> Where were you watching TV in the jail treatment program?
Because we have we have free time. We are allowed to watch the TV in there.
Right.
And so, this is what How many times did this happen?
Multiple times he kept telling I'll turn it down, it was still too loud for him.
Whenever somebody else would have it at the same volume, it was perfectly fine.
He kept saying things and doing like disrespectful things under his breath.
Sit Sit down.
Please speak louder. I can't hear you.
He kept saying disrespectful things under his breath and stuff. Like what?
Like you're disrespectful ass little kid. [ __ ] Like just things like that.
And I started getting tired of it. Who was this person? This other dude named Drew. I don't I don't know any his name other than that.
So, you got an argument and what happened?
He just kept kind of like I felt like he >> happened with the people who run the jail treatment program? With the people?
They gave me two strikes for that.
Okay.
Two strikes, what does that mean?
So, in the JTP program, you get three strikes.
And they kick you out if you get three.
They gave me two for the argument. And then what happened?
I had forgotten my homework in my room after I already completed it and I turned it in 1 minute late and they said that I I wasn't taking the program seriously because I forgot my homework and they kicked me out for that. What No, what He just said that he got an argument twice, got two strikes, forgot his homework and got kicked out. Is that what happened?
Yes, Your Honor. It was also my understanding that he was disruptive in group in general.
Is that true?
They perceived me to [clears throat] be disruptive, but I was the main person participating and answering the questions that she was asking, so I don't see how I was disrupting the group.
Okay.
Why are they out to get you?
I don't know. I don't So, they say you're disruptive in group, you say you're not, you say you got in two arguments outside in your free time during a break and forgot your homework and they just booted your ass out for that. Why are they out to get you?
I don't know, sir. You don't know.
Did we subpoena witnesses here to see who is out to get him? In case we're going to have a hearing on to see who's out to get him.
No, Your Honor.
How are we going to uncover this great mystery to determine who's out to get Devon?
I guess we're not. Shall remain a mystery. How many days has he been in jail now? From around October 1st, he was sentenced to 180 days.
Okay. With 126 and 127 days of credit.
So, you've used up all those days just about and you got nowhere.
How long are you going to How long are you going to continue to screw around?
Sir, I was trying to take that program seriously, so >> No, you weren't.
If you were, they wouldn't have kicked you out of it. You ever been in trouble before?
Yes, sir. When?
Multiple times when I was a juvenile.
>> Okay.
What happened when you were in juvenile court?
They put me in the JDC.
What? They put me in the JDC.
What's a JDC? Juvenile Detention Center.
Why did they do that? Cuz I was I was out there committing crimes.
Oh, for God's sake.
Now you're an adult, you got this case, felony receiving stolen property, a trespass, a felony breaking and entering, a falsification, and I put you on intervention, right?
Yes, sir.
>> To avoid a felony conviction. Boy, what a mistake I made.
Ms. Novotney?
Your Honor, at this time my client would like to admit to the violations. Court will and he understands that I will see maybe terminal in Mr. Nof?
State's in agreement with that termination here. I will see your Honor this is I'm as you stated he does have a lengthy history of juvenile court.
Um in addition he failed to complete the jail treatment program as ordered by this court.
Okay.
So is there any reason that you want to continue to be a chronic pain in the ass? No, sir, no. What what what what do you think this is?
You spent how many years over here screwing around? Four or five years in juvenile court, and you learn nothing.
You didn't wise up sitting over there in the detention center, did you?
The answer is no, because you came out and became an adult and did the same stupid [ __ ] you were doing when you were a juvenile. Do you What do you think this is? A game?
No, sir.
Okay. So So what do I do? Foolish me. You obviously have mental health issues and drug issues, and it doesn't matter to you. You're going to do whatever the hell you want. I try along with your lawyer to devise a plan for you to complete so you'll stop doing all this stupid [ __ ] But you managed to get yourself kicked out, and I don't believe you that it was for arguing with Drew somebody twice over a TV over a TV. You got What you have other things to be more concerned about than the goddamn TV station. Yes, sir. Okay.
You but you don't seem to care about that stuff.
And so you just spent 180 days in jail.
You you've been over here for 6 months now?
Yes, sir.
>> Okay. You enjoy it over there? No, sir.
>> Then why then why don't you do something about it?
Well, sir, I was thinking about how that was going to affect me at the time. I was just thinking about the here and now. I wasn't thinking about it. Well, you better stop thinking about the here and now all the time because the here and now has been 7 years of this nonsense. And you're only 18 Are you 18 or 19? 18. 18. 18. And thinking about the here and now puts you right here right now for the last 6 months.
Okay. On each I'm terminating the intervention plan on both cases. So, you're now stand convicted of those [clears throat] offenses. Your Honor, if I may What?
>> Um the exact credit for 816 is 174 days, and for 818 175 days. Okay. Thank you.
On 818 you now stand convicted of felony 5 theft, felony 5 breaking and entering 816.
You are now convicted of a felony 4 receiving stolen property. So, on each case you're going to spend an additional 45 days in jail, Lake County jail. The last 30 you're going to complete the jail treatment program. Then you're going to go to NEOCAP and complete that, follow the recommendations, get a mental health evaluation, and follow the recommendations, minimum of 6 months of sober living after that. No drugs or alcohol with screens. Utilize one doctor, one dentist, and one pharmacy.
Take your medications as prescribed.
Sign releases. Four AA meetings a week and a sponsor. Full employment. Pay the cost of supervision fees. Does that sound familiar?
Yes, sir.
>> It's exactly what I told you on October 1st. Only now you're convicted. So, you go over there and you do whatever you want to do. You can either complete it or not complete it. It's completely up to you. If you don't complete it, you'll be back here again and you'll go to prison for 24 months on 818 and and 18 months on 816. Do you understand that?
Yes, sir. Cuz if you don't complete it, they'll file another motion and we'll be back here again.
And if I find that you violated, that's what we're going to do next time.
Because I'll for sure know that you really don't give a crap about what's going on here.
And you can show us that how much smarter you are than all of us. Mr. Novotny, anything else? No, your honor. Mr. Novotny, anything else?
>> No, your honor.
