While freedom of speech exists, social media platforms are not immune to legal consequences; Ghana's Electronic Communication Act 2008 (Section 76) criminalizes knowingly sending false or misleading communications via electronic services that could prejudice life-saving services or endanger safety, with penalties including fines up to 3,000 penalty units or imprisonment for up to 5 years, as demonstrated by recent arrests of TikTokers for defamatory remarks about public officials.

>> [music] >> What's up, ladies and gentlemen? Welcome to another episode of What They Happen.
Now, you know what they happen. We're giving you stories of what's happening on social media, what people are talking about. If you're new to this platform, welcome. Make sure you like, you subscribe, you follow 3 Xtra across all platforms, especially YouTube, and all our social media platforms as well. Now, today, I see see see, those that are on TikTok, TikTokers, please come. Or those that are on any live social media streaming platforms, come come.
Why why I can't say it's all of you, though, but some of you, why do you do this? Why?
Why would you intentionally put a camera in front of you, record yourself defaming somebody, record yourself passing comments that you know it is not true?
False about another person. And most of the times, it's not even about oh, your colleague or anything. That one is worse. But, you would choose somebody that has more power than you.
And you would diss the person. But, oh.
This is the news that I have seen on social media. I say make I can share plus you guys. Make you see. So, the Cyber Vetting and Enforcement Team has arrested 49-year-old Rita Akosua also known as Mama One on TikTok.
Yes, at Drabing in the Ashanti Region over alleged offensive and derogatory remarks directed at President John Dramani Mahama and First Lady Lordina Mahama. She is currently being transported to Accra as at the story in the morning. she was being transported to Accra to assist in investigation. And I watched the video that people are claiming she did and that caused the arrest. Entirely, the things that she did say about the president and the first lady, very bad.
Very bad. I ask myself, how? Why? What will force somebody to do this?
What at all will cause somebody to to go this mile? To We cannot Unless we cannot play the the video for you guys to watch it. Because if we do, we are supporting it.
But Charlie, it's very bad. Not long ago, another TikToker was also arrested, Camilla Alhassan, and she was even jailed for 1 year for also threatening in a threatening social media post targeting President Mahama and the first lady.
Uh, that is one. Another one, Ghana police posted in May in May that a suspect was also arrested over threats against president in viral video. And then the person's name is called Akosua Seywaa Minat.
That was in May. Then 5 days ago, another one, arrest 1 year due. Then today, today, today, another arrest.
Still comments, still social media. See, free speech is there.
There is freedom of speech. You can say anything, anyhow, anywhere.
Nobody will do you anything. But as to whether you will get freedom after the speech will be dependent on what you said in your speech. So, be careful. Because in Ghana, it's in the law. It's not as if it's not there. It is in the law. It is There is something called electronic communication act.
It was passed in 2008.
And then in the act, there is a 17 76 clause be there. Let me read it. It says, "A person who by means of electronic communication services knowingly, intentionally, knowingly sends a communication which is false, that is one, or misleading two and is likely to prejudice the efficiency of life saving services or to endanger the safety of any person, that is four, ship, aircraft or vessel, commits an offense and is liable on summary conviction to a fine not more than 3,000 penalty units or to a term of imprisonment for not more than 5 years or both.
So, like the Camidoh Alhasan story, she went in for one one year. She's going in for one year. But if they use this one against you, if they find out that whatever that you've been posting is false and it is set to harm somebody, you can go in for 5 years. So, why do it? Why? If you don't do that TikTok live to say what you have to say, what will happen?
Mhm? What will happen?
If you keep it in your head, what will happen? There is another one. There is a defense So, this is in case you you you post you mistakenly post this thing because criminal law in Ghana is is a big thing. It's a big thing, you understand? So, Ghana repealed its criminal libel a long time ago. Let me read this one to you.
Online defamation and abusive speeches can still lead to police arrest and criminal charges under specific technology law. So, that is the electronic communication act that I read to you, Act 76, Act 775.
Mhm? So, that one they can use it against you if you were on TikTok, if you were on Instagram, if you were on Facebook live, YouTube live and you are passing they will get you comments, defamation.
If you are passing false, you are spewing falsehood about somebody's brand, you can [clears throat] be used They can be used against you in the law court. Now, in case you defame somebody, eh? In case you defame somebody, you can use these three points to defend yourself. Justification, that is one.
Proving that the statement you published is completely true.
So, while you are on the live, whatever that you are saying, if you know you have evidence backing it, say it. They take you to court, you have justification of saying it. Fair comment, showing that the statement was your honest opinion or critique made on a matter of public interest based on facts. Don't forget that. You can have your opinion. Opinion is like a commodity.
You can have your opinion, but it should be based on facts.
And then the third one is privilege, that you can argue that the statement was made in an official capacity, such as in a courtroom or parliament or those kind of you understand. But if you do not fall under any of these three defense, you are going inside. So, that's the news that is trending on social media right now. 49-year-old woman arrested arrested for passing derogatory comments about the president. So, an update that I am getting on the Mama One story is that she went to court today as I said.
They transported her because of her comments from Ashanti region to Accra.
She's been to court and she's been granted a 50,000 Ghana cedis bail with two sureties. This is the video.
Kantanka TV Gold Coast Media. Thank you so much for recording this one.
So, guys, watch it.
>> and I would die for my party. God is my witness.
Thank you.
>> Aha, so now you see.
Advise yourself. Advise yourself.
