The Madhya Pradesh High Court has ruled that the disputed Bhojshala complex in Dhar district is a temple dedicated to goddess Saraswati, quashed a 2003 Archaeological Survey of India order that restricted Hindu worship while permitting Muslim prayer, and directed the government to consider returning the goddess Saraswati's pratima from the London Museum and allotting suitable land to the Muslim community for mosque construction.

In the meantime viewers, we're shifting our focus to Madhya Pradesh. The Madhya Pradesh High Court today has ruled that the disputed Bhshala complex in Dal district is a temple dedicated to goddess Sarasuti. The court has also stated that the Muslim community may approach the state government for separate land in the district to construct a mosque. The indoor bench observed that there was evidence of a Sanskrit teaching center and a Saraswati temple at the site. The court has stated that the religious character of the structure indicated that it was originally a temple. Let's in fact take a look at an excerpt from the judgment copy itself. I have it open on my screens if you can project it to our viewers. This is what the Madhya Pradesh High Court's indoor bench to judge bench has observed. First up, its observation.
The disputed area of B Shala and Kamal Mhola Mosque is held to be a protected monument under 1958 act with effect from 18th March 1904. The religious character of the disputed area of the Bchala complex and Kamill Mala mosque is held to be a B shala with a temple of goddess Vag Dvi or goddess Saraswati. That is the second observation. Observation number three, the impunched order dated 7th April 2003 passed by the director of the archaeological survey of India to the extent restricting rights of Hindus to worship within the Bchala complex in the property in question at land number 604 and also permitting the prayer by the Muslim community are quashed.
Observation number four, the government of India and the archaeological survey of India will take a decision for the purpose of administration and management of the affairs of the Bchala temple and Sanskrit learning within the property in question at land number 604 situated at Thar district and the ASI will continue to have overall administration and management of the property in accordance with provisions of the 1958 act.
Observation number five, the ASI shall have full supervisory control over the preservation, conservation and regulation of religious access.
Observation number six, so far the relief claimed by the petitioners to bring back the pratima of goddess Sarasuti from London Museum UK and reestablish the same within the Bchala complex. uh have already made number of representations to the government of India and the government of India may consider their representations to bring back the pratima of goddess Sarasuti from the London museum and reestablish the same within the complex. Observation number seven. In order to secure the rights, religious rights in particular of the Muslim community and to ensure complete justice between the parties in the case. If the respondent number eight submits an application for allotment of a suitable land within the Dhar district for the construction of a mosque or a place for prayer, the state government may consider the said application in accordance with law for allotment of a suitable and permanent part of land in Dhar district to the Muslim community which may be represented.

This is at page number 241.
Another important direction by the Madhya Pradesh High Court as it is directed to I mean High Court has directed the government of India and archaeological survey of India to take decision regarding administration and management of the Bhojala temple and Sanskrit learning center. The court has observed that every government has constitutional obligation and the court has used the word constitutional obligation to preserve the ancient monuments, temples, sanctum, sanctorum, dities of spiritual importance. Again 24 240 page number this is what the court has observed on again on page number 240 the high court has observed that continuity of Hindu worship at the bhal bh shala site was never been extinguished over time. The high court said historical literature archaeological references indicate existence of sarasuti temple at this particular place dhar in the state of Madhya Pradesh. So these are the important observation we have the this judgment copy 242 pages judgment of the Madha Pradesh High Court as important historical judgment by the Madha Pradesh High Court. Absolutely.
