In criminal court bond hearings, judges determine pre-trial release conditions based on the severity of charges, including bail amounts, GPS electronic monitoring, reporting requirements, and restrictions on contacting victims or possessing weapons. The court finds probable cause for charges and sets bail conditions that vary by offense type, with more serious charges like domestic violence or drug possession carrying additional restrictions such as curfews, random drug testing, and mandatory distance from victims.

And then additionally, you've been charged with driving while license suspended or revoked. And then I have I'm going to have a question for um everyone here in the courtroom. I see on our docket an additional count of violation of probation from Oyola County, but I don't have anything regarding that in our paperwork. Is that um a mistake on the docket or is there really an additional VOP charge out of Oyola County?
He does have uh your honor uh Deborah Bowens, he's it does show on his DOC document that he does have a uh county probation and it lists Davenport. It doesn't indicate the county.
Something's actually missing from this DOT.
Yes, sir.

>> Yes, please.
>> I provisionally appoint the public defender's office to represent you and I have reviewed the arrest reports and the citation and I do find probable cause for those charges. At this time, hold on. At this time regarding the violation of probation from Oyola County, the court is not in a position to find probable cause, but I will give the state um 24 hours to see if they can establish probable cause on that count.

>> Um I know um you usually don't do um bail for violations of probation. Um, but I'm in vocational class, right? Like they go together because for unpaid court fees or whatever, is it is it possible I get bail on the VOP so I can still go to vocational classes?
you unfortunately because you on the pulp violation of probations you will not be able to get at this time you will not be able to get bail but I have reviewed the arrest reports and the citations on the charges other than the oyola v the alleged uh oyola vop probable cause after reviewing the arrest reports and citations for all of those charges your bond status is no bond on the pulk VOP charges but as to the driving while license suspended or revoked I am going to require are um pre-trial release with bail's condition of pre-trial release. >> All right. And for the um the court date for this, can it um just to ask, can it be a little closer than the 20th November days we're giving out? Can I get like the doing like something close?
>> It's somebody else's docket, so I can't really alter somebody else's docket.
Okay.
>> All right. I appreciate you.
>> We can certainly talk to your attorney and see if they can file a motion to move it up. Okay, thank you.

>> There's no reason why he should be.
>> All right. So, Mr. McLean, I wasn't here yesterday, so you probably feel like this is deja vu since apparently you were here yesterday. So, I think they brought you over by accident because apparently they um did an instant warrant on these charges. So, sorry that your book got brought over for no reason. Okay.
>> Yes, ma'am.
Deborra Goen's from PD's office. Uh, actually, he's here today on add-ons and it was an offense that happened, allegedly happened in the detention center. So, I was here yesterday and he did come through in the standard >> warrant was issued. Hang on.
>> Okay.
>> I don't have any of that paperwork. So, if there's new charges, that's news to me. It was not provided in the folder.
>> And pre-trial release doesn't have it.
Does clerk's office have that?
All we have is it's on he's here for a VOP that was misered yesterday.
>> Okay. And does the state attorney's office know anything about new charges?
I >> I do have an affidavit for the two resisting charges.
>> Okay. Well, if that's what he's >> we don't have that. So, pre-trial doesn't have it. The clerk doesn't have it. And the court doesn't have it. So, was he booked in on those?
Yeah, approach.
>> Yeah, I'm I'm asking if he's already been booked in on them.

>> All right, we need that first.
I'm >> too >> between what happened yesterday and and I'm not sure why they're add labeled add-on because they would not be add-on to anything. The only time I usually >> Marcus >> Mlan >> I'm checking him now to see if he's >> like the only char we have >> Tyler Mlan right >> and this is from the arrest report that I'm looking at is from yesterday >> at 1520 and that's titled as the VOP >> 1520 two days ago.
>> Okay. And then this is >> violations.
>> I was asleep.
>> Hold on one second sir. I'm not asking you any questions right now. trying to figure out if you have new charges. This is the VOP affidavit that I see. Is it beyond this one?
>> That's that's what I received. But it talks about the I think I pulled up the right one.
>> It talks about a new law violation from May 11th.
So >> that's the one that's in the folder. So that's not new.
>> Sure. And Deborah goes for Mr. Mlan's benefit. It it is it's an add-on and apparently there for the warrantless VOPs. Maybe there were two charges that they didn't include yesterday. That's could be the best that we could do, but it would all be under the VOP.
>> Are you saying there's not new law charges that it's just the VOP?
>> Yes, ma'am. Well, >> okay. All right. Yeah.
>> Yeah.
>> I thought you said there were new charges.
>> I thought that there was, but that there there are not. There are not. Mr. MLAN that we went down that rabbit trail.
>> That's right.
>> All right. Thank you. So, apparently he was brought over an error and they were addressed and there are >> All right. Moving on.

All right, Mr. Reese, you're charged with domestic violence assault. Would you like for me to appoint the public defenders office to represent you?
>> Yes, ma'am.
>> I provisionally appoint the public defenders office to represent you in this case. I have reviewed the arrest report. Is there anything any is there anything anyone in the courtroom wants to tell me?
>> All right. Then I have a question regarding probable cause. I certainly understand the threat that was made, but um what I what the arrest report is not very clear on is um the remaining provisions and requirements for assault regarding the couple um the threat.
The threat's clearly there, but coupled with an apparent ability to carry out the threat and doing some act which creates a wellfounded fear in such other person that such violence is emanated the whole back portion of the statute.
Um, I do not see any probable cause for in the arrest affidavit, unless someone can point out where.
I'm not saying that the that probable cause could not be established. I'm saying that as the in the manner in which the arrest report is written, I cannot find probable cause currently.

The woman is an amazing woman, your honor. She has enabled me to work for the Lake Wills Care Center for two year for almost two years now. A year and 6 months. She has driven me on the path. God has driven me on the path to a proper life.
And um we just after we both come from bad situations and after nearly 2 years of fighting, we had a moment where we were scared if we all fought for not.
Our transportation was gone and we had support, but I I I'm afraid it wouldn't be enough. I was a bastard that day your honor to be quite blunt.
I know it doesn't excuse anything on her behalf, but I just want her to come home. I love her to pieces. She is a excellent member of society. She me and her both have clean records. We both have wonderful lives ahead of us.
We I've spent every penny I had after my car was total to get us back on our feet. And the officers were kind enough that day to allow us to finish the transaction before she was taken away so I could be here to take her on it. I'm here because of God and Steve and more importantly her.
I speak for her character. I am not afraid of her and in no way, shape or form did she mean what she didn't. And I would hate for her to have a record for this. I would hate I have no intention. I I understand it's not up to me. I understand it's up to the state about charges in Florida. I've done a little bit of research, but the internet can only tell you so much. So, I will say this directly to the state.
Please excuse her.
I just want my life back. My life is I went to work today. It was hollow. The victory that we have, the the the new car, everything finally under our name.
It was hollow without her.
>> And you understand that I'm only here regarding probable cause and if she should be released and if so, what the condition should be?
>> I understand. I was just I just wanted all this to be on record as well as well as my statement.
>> Yes.

>> Okay. And are you in fear?
>> No.
>> Okay. Uh, if she is released, would you would you be comfortable with a no violent contact? It just means that she can't in any way, shape, or form um be violent in any way.
>> I I'm willing to agree to whatever it takes to get her home because I love her and I want her home.
>> All right. And I understand that pre-trial services is recommending straight pre-trial release.
There would be no objection.

Mr. Battles, you're charged with battery by strangulation, possession of fentanyl, robbery by sudden snatching, possession of drug paraphernalia, resisting or obstructing an officer without violence, possession of methamphetamine, and then I have a question on the last charge. Um, when I look at the arrest report, it says it's a battery at M1, but when I look at the docket, it says it's battery with a prior conviction. My understanding is it's charged as just an M1 battery. Is that correct?
>> I'm not asking you. I'm asking you.
>> I ain't none of that [ __ ] >> All right. No passing, >> Mr. Mr. Battles. No cursing. We're in court.
>> Oh, sorry. Oh, >> hang on.
>> That's not You got the right person.
>> I'm looking at it says battery prior conviction.
>> Hang on a second. The one I'm looking at only has battery touched M1.
So, >> are you your honor, are you talking about the um >> I'm talking about the arrest report that's in the court file. And Mr. Battles, you need to stop talking, please, because it's it's amplifying over here and we're trying to uh sort this out for you. So, just hang tight a minute. May >> approach. You may, but I have no way of knowing which is all right. This is what was sent out.
So, it appears to be a difference because this is so y'all need to tell me which is the which is the updated one.
And Deborra Bowens, your honor, if I may, I'm from the public defenders office. With regards to the the affidavit that I have, it says battery prior conviction.
>> Miss Goen, just so you know, there's there's two. We've established there's two affidavits.
>> So, they >> So, I'm trying to figure out which one is the updated one.
>> Okay.
>> There's clearly two different Right.
>> Yeah. So, if someone needs to help us figure out which is the last the most updated one, when I look at the one in the court file that was provided, it was signed on May 21st.
How about the one you have, Miss Bernett?
>> Uh May 21st at 2:36.
>> This is tell me a time, right?
Do you have the ability to print anything out?
>> Printer is broken. I don't think it's printed in.
>> All right. So, tell you what we're going to do. Um, it looks like that is the only difference in the charges, sir.
So, what I'm going to do is um well, let me go step by step. Would you like for me to appoint public defenders office to represent you?
>> Central, you're muted.
Central's muted.
Would you like for me to appoint the public defenders office to represent you?
>> Yes, ma'am. Regional council, everything, please.
>> All right. I'm going to appoint the public defenders office to represent you in this case provisionally. I have reviewed the arrest report. I do find probable cause for all of the charges with the exception of um I do find probable cause for battery.
I'm going to give the nothing in the court file. Hold on one second.
Apparently now pre-trial services has found it. So let me review that. Do we know if that's the update which one came first?
>> I haven't heard that answer yet. Judge, either way we can stipulate to a to a battery. We're just going to put on record that the one of the affidavit does say that he has a previous battery conviction on 426 2017 and case number 53 2017 CF 232. So we would just ask that you keep that in mind when you set the bond, but we'll stipulate to the battery.
>> All right. Are you wanting 24 hours to be able to establish the program?
>> No, your honor.
All right. Okay. So, um the state is stipulating that you're charged with just the battery on that one charge and all the other charges that I previously stated. I did go ahead and appoint public defenders office. I have reviewed the arrest report. I do find probable cause for all the charges and for um battery because that is the affidavit that I have. And the state is not asking for 24 hours to establish probable cause as to the charge of battery with prior conviction. So in this case, I'm going to require pre-trial release with bail's condition of pre-trial release. Mr. Bail said $6,000 on the battery by strangulation, $5,000 on the fentanyl charge, $5,000 on the um battery charge, $7,000 on the robbery charge, and $1,000 on each of these additional charges. Once you are released, you need to report immediately to pre-trial release services office in person in Lakeland at 9:30 East Parker Street. Thereafter, you must report by phone. three times a week on Mondays, Wednesdays, and Fridays. You may >> should be done. Should be done before I say something. You good? I got you.
>> I got not to say nothing. [ __ ] that.
>> And then you need to hold on one second.
You may not use, possess, or carry any firearms, guns, weapons, ammunition, or knives. You're prohibited from having any contact with the victims in this case.
>> All right. You You can voluntarily absent yourself, but I'm still reading it. You are prohibited from having any contact. You charging me with charges.
Tighten up.
>> You need to stop talking and stop disrespecting the court right now.
>> Disrespect.
>> I understand you're not having your best day, but you don't want to have a worse day.
Do you understand me?
>> You may not use, possess, or carry any firearms, guns, weapons, ammunition, or knives. Additionally, you are prohibited from having any contact with the victims. You may not contact the victims directly or indirectly. You may not contact the victims in any manner whatsoever. You must stay at least 500 ft away from the victims, their residences, vehicles, places of employment, and schools at all times.
You also must submit to random your analysis that you're required to pay for. Now, Mr. battles. What I hear from you is that you don't agree with the charges and that you think you've got some defenses and that is why I appointed an attorney to help you with that. You can talk to your attorney about that and they can bring forward any motions that you want them to bring forward in this case. Okay.
All right. What's happening to the TV?
>> I have no idea. Just it's back on.
>> All right. Thank you, sir. Good luck to you.
>> What are you? Moving on. Elijah Bell.
Yes, Miss Ho.
>> Uh, I was just listening to the court.
Thank you.
>> Okay.
>> Moving on to Elijah Bell.
Sir, you're charged with fleeing attempting to elude law enforcement officer with lights or science active as well as four counts of grand theft of a motor vehicle as well as conspiracy to commit burglary of a conveyance, petty theft, conspiracy to commit grand theft, 10 counts of burglary of an unoccupied conveyance, resisting an officer without violence, and three counts of attempted burglary of a conveyance. Would you like for me to appoint the public defender to represent you?
>> Says no.
>> I provisionally appoint the public defender's office to represent you in this case. I have reviewed the arrest warrant and the complaint affidavit and I do find probable cause for all the charges. In this case, I'm going to require pre-trial release with bails condition of pre-trial release and GPS electron GPS electronic monitoring as conditions of pre-trial release. You may not be released until the GPS electronic monitor is affixed to your person. And they do find probable cause for all of the counts.
>> Judge, yes, >> I have four extra charges.
>> Hold on. Apparently, there are four extra charges other than the ones that were provided to the court. So, what else do you have?
>> I have four counts of wor.
>> I don't have four counts of wor. So, let's see what pre-trial services has.
It says four extra counts of lar.
We have the affidavit on here. It should have all of the charges on it.
>> Well, this is the one I'm thinking. Can you just go back to our file before doing all that real quick? If you go back to what's in there.
>> Okay, hold on one second. Let me do it.
Were those add-on charges?
>> I saw one and I don't remember if it was this case where several charges were scratched out by the presumably state attorney's office, but maybe that's not this case.
>> S22 file.
>> There's not an amended warrant in the jail file. And I don't see another affidavit unless somebody else has another affidavit with those.
>> I have a amended warrant right there.
>> Okay, great.
pull it over because I have it too.
All right. So, apparently there's an amended warrant that was not provided to the court. So, let me look at that.
There's basically it's the same thing with four additional charges.
I see. So, um, the petty theft instead of one count, it jumped up to five counts.
>> All right.
So, the I guess that instead of one count of petty theft in addition to all those other charges, the it is now five.
So, that's the situation. All right.
Would you like for me to appoint public defender's office to represent you?
>> Yes. No. I provisionally appoint public defender's office to represent you. I have reviewed the the arrest warrant and the amended arrest warrant and the complaint affidavit.
