It's like performing surgery on yourself in the desert with a scalpel. If you mess up, you can't call the doctor for help. This is the legal version of you broke it, you bought it. Hector's response, I still don't understand. The judge's frustration is palpable. Is Hector actually this confused or is he playing the system?
>> All right, let's say you needed surgery and you're in the middle of the wilderness. You need surgery and you tell me and you tell the doctor, "Guess what? I'm performing this surgery on my own. I don't need you. I'm walking out of the hospital. I'm going to go in the desert. Now, maybe the doctor would try to uh stop you and do other things. But if you go in that desert by yourself, don't tell the doctor where you are. You take a scalpel out in the desert by yourself. You don't get to call the doctor and say, "Hey, I'm in the middle of desert performing surgery. Um, you know, I'm doing I'm going to be my own anesthesiologist. I'm doing all of this.
How do you do this?" Cuz they're not going to tell you. It's the same thing here. You're saying that you do not want to be represented by an attorney. You want to represent yourself. So that motion, that uh indictment, I'm not to tell you anything about what that indictment is. The state is not to tell you, oh, this is what this indictment means. This is the range of punishment. Those are things that you're supposed to do. Do you understand?
>> I still don't understand.
>> All right. So, just have a seat. This is what's going to end up happening.
You're going to have an attorney. That attorney is going to come over to the court right now. You're going to speak to that attorney. After you speak to that attorney, uh, we're going to go forward. Miss Ferguson, can you call manage to sign counsel and let them know that we need an attorney over here and that attorney will talk to you. That attorney will tell you what that indictment means. That attorney will tell you the range of punishment. Do you understand? I still don't understand.
>> All right. Well, I don't know how I can further make you understand.

Hector just invoked the Sixth Amendment, the right to know the charges against you. But here's the catch. He already has the indictment. The judge even confirmed it. You've been given a copy.
Hector's argument, the court failed in its duty. The judge's response, the indictment is the nature and cause. This is the legal version of a student demanding the teacher explain a test after they've already been given the study guide. Is Hector actually being denied his rights or is he just misunderstanding the process?
>> Asked the court to divulge the nature and cause of the accusation upon the authority of the sixth amendment and that this court has failed in its duty to inform you of the nature and cause of this action.
