Citizens have the right to record police in public spaces under the First Amendment, and officers must have reasonable suspicion to detain individuals beyond a traffic stop; repeated stops focused on one residence after complaints may constitute retaliatory policing under 42 U.S. Code Section 1983, while officers can order drivers out of vehicles during lawful traffic stops per Pennsylvania v. Mims (1977) for safety reasons.

>> Hey, you can't be up on my car like that.
All right. What?
>> You can't be leaning up on my car. Don't touch my car. I didn't touch your car.
>> Yes, you did. We have it on camera. No, I didn't. All right.

>> is Corporal Board.
I asked you to step out of the vehicle.
For what?
>> [clears throat] >> Cuz I want to talk to you. So, step out of the vehicle.
>> You can talk to me from right here, sir.
>> of the vehicle. I don't need to step out of the vehicle. Call your sergeant.
>> [clears throat] >> I'm the one that's in charge right now.
So, step out of the >> boss.
I've done nothing wrong. You have his license and everything else. We have reasonable suspicion to stop >> my license. We cleared you. We ran everything. It's good to go. I haven't heard anything back yet.
Okay.
You can talk to me plain as day from right here. I put my phones right here.
>> April 2020, [music] Sheridan.
A routine traffic stop quickly turns confrontational when a driver refuses to exit his vehicle without understanding the legal basis for the order.
The stop [music] escalates into arguments about Supreme Court rulings, constitutional rights, >> [music] >> and police authority, while a canine unit is later brought in to search for evidence that may not exist.
The question becomes, was this lawful procedure or an unnecessary escalation?
Because I don't need to step out of the vehicle, sir. You guys need to do your job and know that I know what your job is as well as mine.
>> know what my job is.
>> Okay. You have no idea what my job >> I do have no I do have not have any reason to be pulled out of my vehicle.
>> the Supreme Court said that whenever a traffic stop is made, an officer can ask you to step out of the vehicle, you step out of the vehicle.
>> What have I done? What am I being cited with?
>> It doesn't matter.
At this point you're being detained. I asked you to step out of the vehicle.
>> For what?
>> going to search your vehicle. I just want to talk to you away from the vehicle.
>> talk to me from right here. Why can't you step out of the vehicle? Because do I need to step out of the vehicle?
>> There's court law that says that there's nothing wrong with me asking you to step out of the vehicle. The court has said that it's fine. What what is what code is what is that? Uh I don't have to give that to you. You can look it up later on your own time.
>> Okay. Do you know it? Do you know it? I know the law.
>> And him.
Everybody pays me. Okay. And guess what?
So [clears throat] technically, I also pay taxes as well, so I also pay my own paycheck.
>> Okay. That's fabulous.
>> So that means nothing to me.
>> Okay.
All this stuff you're saying is >> You need me to get out of my vehicle so you can talk to me when you're talking to me right here making that makes no sense to me.
>> to step out of the back of the vehicle so I can speak with you.
I can speak with you right here.
>> also told me that you have a knife on your person. Do you want it?
It's a fishing knife.
Do you want it? A knife can cut me as well as anything else can cut me.
>> And it's not going to cut you. No, I don't want your knife. I don't want you to remove it because I don't want to put a weapon into your hand.
>> I don't either.
>> Even though you have one on you right now.
>> No, I don't.
>> After telling me you have one. That doesn't mean that it's still on me.
Can you please call your sergeant?
I'm not calling a sergeant. I don't need a sergeant here.
Have we got a return yet on him? Is he good to go?
Is valid? Everything's valid?
Okay, so who is the person that I don't know.
>> So you're telling me that a person was inside your vehicle, you didn't know who they were? Yes, sir.
You don't think this kind of odd?
I don't let random people ride in in my personal car.
Am I Am do is my stuff clear? I I mean It really doesn't matter because the thing is is that >> It is suspicious whenever we pull behind a car >> Have you been drinking, sir? Why do you have to keep keep clearing your throat?
Seriously, that's where we're going with this? I have not been drinking.
Okay.
I'm Questions I'm allowed to ask you to wrestle you up. You want to try to wrestle me up by asking me questions? We can both do that.
>> this isn't the first time I've dealt with you. You're not bothering me. This is pretty common for you. So Why don't you look at me, sir?
I don't have a passenger.
>> have dealt with you several times. You had a passenger that ran out of the vehicle and you're telling me Regardless of who you're looking over there talking to me.
>> Why does it matter where I look?
>> Because you respect a man you look at him in the eyes.
Okay.
Okay. So what does that mean?
Well, I don't understand who you're talking to if you're looking at somebody else.
>> just said you're the only person in the vehicle. So is there somebody else in the vehicle?
>> No, sir. Do you see anybody else in the vehicle?
>> who Who is in the vehicle with you? I don't know. You don't You don't >> me the same questions over and over looking for different answers?
>> to answer the question. I answered the question.
>> You're telling me you have no idea who that person was?
>> answered the question. You have no idea who that person was?
>> No, sir. Okay.
Jesse, like always, it's always been a pleasure speaking with you.
>> Thank you.
Look around all you want to, sir, on the outside of the vehicle.
Look at the look here. I rolled my damn window back up.
Hey, Jesse, you're getting a citation for a no insurance. What's your current address? Um it should be on file. It's 5901 Coffee and Avenue, lot number 97. Thank you, sir.
Also, sir, with your willingness, you can I can check the glove box or something.
I don't know because I don't trust you officers and me reaching around to look for my insurance, you know.
Hey Jesse.
Sir.
Do you have a gun or anything in that in that glove box? No, sir. Okay. Do you think you have some insurance in that glove box?
>> Very possible, okay. I have a center console and a glove box. Like I said, it's my mother's vehicle. Okay. So, I can check there. Sure, go ahead.
I know it's insured because all of our vehicles are insured through Progressive here at Wyoming Financial Insurance.
>> right now.
So, Jesse, this is very simple. We're going to write you a citation >> Go ahead and write the citation, sir, and I'll just I'll just deal with it in court. I ain't I don't need to worry about looking for it. We'll deal with it that way and waste more of our money, huh? Okay, Jesse. Let's do it that way.
So, please understand that if you do in fact have insurance, if you contact the insurance company and ask them to send you a piece of paper, they will If you in fact have insurance right now, they'll >> I do. My mother does. Okay, they'll send you a document saying that at this time of day during the traffic stop, you in fact had >> Yep. had insurance through whatever company. When you have that, >> have it. I understand how this works, sir.
All the way. Okay, well then I'll stop explaining to you.
>> Thank you.
I'm going to pause it real quick. I only got 13 minutes left.
What's your dog's name?
You don't know your dog's name? It's not my dog.
Oh, this is the lady she's ran her dog on my Can you keep your dog's nails off my vehicle, please?
She's done this once before.
At the courthouse on camera.
On recording. So, I'll just add it up on you guys.
Oh, the dog's got to go to the restroom.
Let's go ahead and show that.
>> [clears throat] >> So, Jesse, you said before that you didn't know the name of the passenger that was with you. You know where did you pick them up at?
So, I'm not answering any more questions.
What is your officer's name?
Corporal Rogers. Corporal Rogers. Okay.
It's different than what I was told. It was uh and you guys don't have a sergeant on duty. Under Pennsylvania [music] V. Mims, 1977, officers generally have the authority to order a driver out of a vehicle during a lawful [music] traffic stop for safety reasons.
However, prolonged detention or expanding the stop into a criminal [music] investigation without reasonable suspicion can raise potential Fourth Amendment concerns.
The citizen remains [music] verbally resistant, but mostly compliant with physical commands.
The officer correctly cites removal authority, but communication and escalation [music] management appear weak.
Legal grading: Officer conduct, [music] C+. Citizen conduct, B. She can circle the car 10 times, the dog's not going to hit on anything because we don't have anything.
You'd think a good dog would only have to circle it one time.
Maybe you can calibrate your dog.
When will my uh citation be ready?
Okay. How long does it take to write a citation? Because it doesn't normally take 10 minutes to write one citation.
He has my ID. That's all he needs to write a citation. So, here I'll explain this to you. I have a little packet for you, too. Thank you.
This is a citation for your failure to maintain liability insurance. Set your court date out. Court date out for the 4th of May, 8:30 in the morning. Okay. I understand what no insurance tickets are. This one's for your broken windshield. Okay. One 10. Appreciate it.
>> Same date. Let me grab that packet for you.
And yet, they did not take a picture or nothing of my broken window for their evidence.
These are the people we have working for us.
The no insurance is must appear. So make sure you Appreciate it. Yep. Now I'm free to go. You gave me my ID and all that. We're good to go.
>> all your information.
Oh yeah. Hi. Hi. Um I'll take a a cup of water if you have one.
You want a cup of water? What what brings you out here today? Cuz this is a critical care critical facility here and you're video taping secure environment here.
Right.
Uh is that something I'm allowed to do?
You can video tape and stuff like that, but realize this is restricted access here.
January 2024, Tucson, Arizona.
A First Amendment Auditor arrives at the Arizona Department of [music] Public Safety to record publicly accessible areas and test government [music] transparency.
Within minutes, officers begin questioning his presence, [music] citing concerns about sensitive information and security operations. What follows becomes [music] a tense debate over public photography, accountability, and the limits of police authority [music] on public property. And there's sensitive information back there, sensitive vehicles, and so forth. I'll get you some water if you want to come in. Uh I'll wait right here if you don't mind. Okay.
So again, please stay away from the edge of the building here.
Um is that a lawful order? Well, I'm telling you that you know it's suspicious when someone comes up and they're masked up, they're video taping our building, people start getting concerns. We don't know who we're dealing with out here. Sure. So you know we've got a lot of people that work here. Oh yeah. That's why I'm here.
>> law enforcement >> I'm here because of all the people that work here. Okay. What why is that?
Uh excuse me one second. I got Just hanging out.
>> off of a cold and I cough a lot.
So I'm not contagious so Okay.
So what is >> Well, what is your concern with people that are working here?
No concern. I'm just here because it's my right to be here. Okay, yeah, you can be here, but realize, you know, there's governmental operations going on here, and people are coming and going, and they're trying to do business. Sure. And if you're going to film with that, we start wondering what's going on. Sure.
So.
You got a problem?
Certainly not.
Oh, okay. I'm just wondering why you're trying to come behind me.
Why not?
I don't know. It's your right to do so.
Just like you.
You say you have a right to be on this property. Right.
He has a right to go wherever he wants to out here. Right, right, right, but but that's it's it's a different story when he's trying to intimidate me. You see the difference? That's intimidation.

I'm responsible for this building here, so I'm going to be out here and making sure everything's okay. Everything's fine. I'm just recording. All I'm All I'm doing is recording, taking pictures.
That's it.
>> Okay, that's fine. So.
You can record all you want and stuff like that, but when you start interfering with our governmental operations >> not interfering.
>> Again, you see the signs that say no trespassing out here.
>> I haven't trespassed behind those signs.
Okay.
I don't know what to tell you. Well, you can tell me that I'm doing nothing wrong and walk away.
Well, as long as you're interfering with our work here, people are concerned. We have people that are non law enforcement that work in this building that are not cops, that don't carry guns to protect themselves.
>> Do they work for the public?
>> They work for the public.
>> Okay, so that their their rights are the same exact as yours. Right. Which is a perfect servant.
Right. Right. Right. Right.
I agree with you.
They're public servants as well. They serve our public.
>> Sure.
What's your name?
What's your name and badge number, sir?
I'm not at liberty to say.
Oh, you're busy now, huh?
Well, it's kind of like, you know, we asked you your name and you just sit there and go, "I don't have to give you anything." I don't. I I I don't I'm not I don't work for the government.
Sir, what's your name?
Fernandez, what's your badge number?
Fernandez, do you have a badge number I can have?
>> need it.
I do [clears throat] need it.
>> No.
Your video tape shows what his badge number is.
>> No.
Shows what all our badge numbers are. It shows who we look like.
>> Sure. You don't show what you look like at all.
>> have to. Okay, that's fine. We don't have to either. I know. You can go put a mask on. I That's not going to bother me at all. That's fine.
What I'm going to tell you right now is don't interfere with anybody coming from this building.
>> only one that's interfering here is you.
I'm not interfering with anything.
You're interfering from my photography I'm trying to take.
I'm standing in a parking lot that I'm authorized to be in talking to you.
You're talking to me. You're coming up here and video taping me. Right. I have every right to. Yeah, that's fine. And I have every right to stand here. Oh, of course. And I don't mind it.
>> And I don't mind it either. Okay. Then we both we both finally agree on something.
>> Absolutely. So, what I'm telling you is don't interfere with vehicles coming and going.
>> You don't have to give me directives.
You don't have to give me directives.
I'm not listening to them. You're not listening to them. Okay.
>> No, you don't you don't have to tell me what I know.

It's your job to answer my questions.
Would anybody like to answer a question I have?
What is your question? I would like to know where I can get a complaint form. A complaint form? You can go online.
Arizona dps.gov. Uh can you can you get me one here? Cuz I don't go I don't have online. We do online. You have you have a cell phone. We do online.
>> Right, but I don't have a printer and all that and all that good stuff. You don't have to print. You do everything online.
>> It's a PDF? Yeah, it's all everything is online. azdps.gov.
Uh I would rather fill it out and and uh make a co- come in here and make a copy and get a co- uh receipt that I turned it in and all that good stuff. Our recommendations are that you do it online. That's how we do everything now. Okay. So.
All right.
>> All right. Uh that's your recommendation, but can I get a complaint form? You can get that online.
You don't have any here available?
I'd have to look.
Okay. I'll wait here while you look.
Walk of shame.
Look at this guy taking pictures of my bike.
You like that bike?
I'll sell it to you if you want it.
Huh?
I'll sell it to you.
Um it's on the Tima County GPS property right now.
Uh it could be if you want it.
Everything's for sale. I'll sell you my camera in my hand if you want to buy that, too.
Well, I paid 2,000 for it.
But um I'll probably make a little profit on it for you.
I'll sell it to you for four.
Anyone else, a grand. Under the First Amendment, recording [music] government buildings and public officials from publicly accessible areas [music] is generally protected activity.
Law enforcement may approach and ask questions, but absent reasonable [music] suspicion of a crime, citizens are typically not required to identify themselves or stop recording.
The officers [music] appear focused on security concerns and operational awareness, while the auditor intentionally tests constitutional boundaries and [music] accountability procedures.
Legal grading, officer conduct, B minus.
>> [music] >> Citizen conduct, B.
That wasn't long, guys, for them to come out, run away.
Some pansies they are.
Look at this guy sitting in his car looking at me waiting for the gate to open. Hurry, hurry, hurry, go, go. Oh, he pulled his camera out.
>> [laughter] >> Oh gosh.
Clowns.
Yes, it is going to be a good day.
We'll see about that.
Wait a little longer, guys.
I think it's going inside.
See if they got that complaint form I'm ask- asking about.
>> [snorts] >> Hello, can I help you?
Yes, I need to come in and get a complaint form. Okay, the complaint forms are not a physical paper anymore.
You're going to have to do it online. Uh that's not true, ma'am. By law, you have to give me a complaint form.
I will let you speak to the the captain again or one of the troopers, but I do not have physical copies of complaint forms. They're all online now.
>> Okay, so what you're saying is you can't go online and print it?
>> You can. No, you can go online and print it, right?
>> No, you need to go online and you can create and I don't I don't have access to online printer or none of that. There's a public library, so you can always do that.
