D'Amelio family scandal, Prickly Pear Coffee vs. influencer + Patagonia vs. Pattie Gonia clarified

So, the first story that I have for you guys today, we haven't spoken about the Dilio family in so long, but they are in the headlines after Dumo posted a blind item about the family feud this weekend. So yesterday, Duma posted a blind item that read, quote, "Sources allege that Tik Tok and Broadway star Charlie Dilio discovered millions of dollars had been transferred out of accounts that were established during the years her career was managed by her parents." Insiders claim the transfers allegedly occurred over an extended period and involved funds that were intended for Charlie's savings.

[00:01:38]According to sources, Charlie became aware of the situation after her parents were allegedly supposed to be removed from certain accounts. The matter is now reportedly in the hands of attorneys.

[00:01:47]Sources further alleged the dispute has caused a major rift within the family with Charlie's sister Dixie Dilio reportedly siding with their parents.

[00:01:55]Okay, so obviously grain of salt with Dumo as always, but it's not totally shocking to hear something like this about the Demilios considering it's pretty obvious that there's a major rift or a major fracture in the family and there has been for over a year. The first signs that Charlie had possibly gone no contact or low contact with her family were last year when she didn't attend Dixie's birthday party. And since then, she's been very publicly distant from her family. She did her Broadway stint and I don't think they went to any of her shows after October 2024, including her closing night. It's like one of those facts, those like pop culture internet facts that are just like seeped into my brain and they come to the forefront when I have a story like this and I'm like, how do I know that? I don't know, but I do. Oh, and also she unfollowed her parents on Instagram. So, Charlie's father, Mark, wrote this on the Dwis post. No one called me for an interview. Okay. Well, Dumo does not call for interviews. Mark, no one called me for an interview. This is not true. We love Charlie, but she is being manipulated and I have the receipts. Over the last six years, we have remained silent and never addressed gossip, but the time has come to set the record straight. I fear framing this as like receipts, gossip, saying Charlie's being manipulated publicly on this post.

[00:03:11]Like, none of that is good vibes for me.

[00:03:15]All of that is giving red flags. Your daughter going no contact with you, only speaking to you through lawyers, which he later confirms, like that's not gossip. That's not something to like bring the receipts over. Okay. So, then he was asked if he's heard from her in the comments, and he said absolutely not. She's always had a team in place.

[00:03:34]Lawyers, business manager, manager, agent. We purposely set it up that way.

[00:03:38]Not sure if you know anything about our family, but we were doing fine before Tik Tok. Again, just like a weirdly kind of slimy response. Just because you were doing fine financially before Tik Tok blew up your entire life doesn't mean that after Tik Tok blew up your entire life and you moved to LA and your lifestyle inflated by like 100% that you wouldn't have needed more money. And I'm not saying that they took her money. I'm not saying that this blind item is true.

[00:04:06]Obviously, grain of salt like I said, but I don't really think that necessarily proves anything. So he then went on TikTok live and it was very long, but essentially he confirmed that Charlie isn't speaking to her family right now and says he always set out to protect her. And like the initial example that he gives of this of him protecting Charlie is that he would protect her from like creepy predators in her DMs and emails, which like I hope so. I hope as her father you were the one monitoring your teenage daughter's accounts when she became the most famous girl on the internet at 15 years old.

[00:04:42]Like I hope she did not have just complete unfettered access to her DMs where I am sure there were lots of creepy men. In the live he goes on to say that she's being manipulated by the people around her implying her business manager. And he alleged that this person views her as a cash cow. All I want to do is I'm going to protect my name and protect when people talk [ __ ] about me and it's not happening. So, and everybody knows who they are and I and I have I have the receipts. She she hasn't reached out to me in some time. She's mad at me for something. I gave my daughters everything everything they they I thought they wanted and needed.

[00:05:15]And now you got a bunch of team around around them that think they know what's best for Charlie. And I dude, I have all the receipts. The problem is what am I gonna do? What am I going to do if I if if if I if I sue someone? What's that going to do? Drag my drag my family into a lawsuit. These emails I sent I sent one to her business manager. He didn't respond back. Maybe I'll post that one later. We should look into everybody associated with Charlie. These dumb [ __ ] don't understand that I can use AI and search 330,000 emails and I have everything. So you want to come after us? What What did our business manager Ronar say? Mark, you give yourself too much credit. that we took money and put it offshore. I don't even I wouldn't even know how to do that. I wouldn't even know. Like, come on, dude. We got our own money. Going through this process was never about money. It was always just about having this crazy awesome experience with my family. And as far as stealing money, if anything, I'm owed money. I wouldn't put everybody on on blast, but it's it's just not it's not accurate.

[00:06:12]>> And then he said that he only communicates with Charlie through her lawyer. Quote, "We're destroyed, man.

[00:06:16]We're freaking devastated. We want Charlie back. We love her." Okay.

[00:06:20]Obviously, this is like so sad. I mean, I do believe that Charlie has cut them off for a reason. One of the weirdest things about all of these OG Tik Tok families, like the Demilios, like Addison Ray's family, is that the parents really wanted to be involved like in their content and in their careers from a fame perspective rather than like a parental or like guardian perspective. Like, we saw these parents get so obsessed with being famous themselves. Like, they all launched their own accounts. They would do their own paid appearances, all their own sponsorships. They moved their families to LA like six months into TikTok blowing up. I feel like it was red flag central. These were thirsty parents. And we saw a lot of that on the Dilio show, too. Like Charlie and Dixie were not doing well when we watched them on that show. And there definitely were moments where Heidi and um I was going to say Heidi and Spence or Heidi and Mark were supportive of the girls. But I would say it was still shocking to see how little control they took over those moments to ensure that their daughters felt protected and safe mentally and emotionally. There was definitely an air of like put your head down and deal with this for the sake of the family brand.

[00:07:33]But it's clear that Charlie still feels like to an extent I assume that they didn't show up for her in a way that they should have to protect her mentally, physically, emotionally, while she became literally the most famous person in the world overnight at the age of 15. And I understand that is not normal waters to be navigating. Okay, I also understand that Heidi and Mark and like everybody involved, the whole family would have had no idea how to go about this. It's an incredibly specific situation. But it seems despite that, she clearly feels like they made a big mistake or some big mistakes and she's having a hard time forgiving them. All right, the next story that I have for you guys today is there is some coffee shop drama with a Nashville coffee shop and an influencer. So, a Tik Tok creator named Katie Wood is going viral after calling out a popular Nashville cafe, Prickly Pair Coffee, for essentially ripping off consumers with the size and price of their refresher drinks. So, for context, Prickly Pair Coffee Co. is a Nashville based coffee business founded by Anakah Ballas. The company has grown from a mobile coffee cart to multiple locations around Nashville. I think they have four. So Katie made a video a few days ago sharing that their refresher drinks, which have two types of drinks in one split cup. They were selling them for $12 and they basically contain as much liquid as a single Starbucks venty refresher which costs around $6.

[00:08:52]>> If you live in Nashville and you know what prickly pear coffee is, I'm going to do a little experiment real quick just so you can be pissed off with me.

[00:08:58]Okay. They have these thing called split cups. Okay. I usually get a refresher from them. It's like give or take five or six bucks for a refresher. The split cup is supposed to be two full drinks.

[00:09:07]She goes to ring it up. It's so you could try two different flavors. She goes to ring it up and it's like $12 and some change. And I go, "Wait, is that for one drink?" And she's like, "Yeah, cuz it's two drinks." I was like, "Oh, it's two full drinks." And she was like, "Yeah." I was like, "Okay, I'll try it."

[00:09:19]Like I'm making a video anyway. I was like, "Whatever. I'll try it." I was like, "I'm going to do something when I get home after I drink them. I'm going to put it in a venty Starbucks cup cuz this is what I usually get like my refreshers. This cup is $6. If I get a venty refresher, it's usually about $6 and some odd change, right? This was $12. This is not full all the way with water cuz there's no ice in this. They put ice in it when they give you refresher. Venti Starbucks cup $6 and some change when I get refresher. Look at this.

[00:09:48]Add ice to that. That's just as much as you get in a split cup thing for half of the price. I'm never going to prickly pair again. I'm so irritated about it.

[00:09:58]>> Katie has over 300,000 followers and this video got over 2.7 million views.

[00:10:03]So, Prickly Pear commented on Katie's video writing, "It's $10 because we have to make two separate drinks. If it was 12, you likely added a different milk, extra shot, etc. It's also the same amount that you would get in a venti if not less." So, Katie shared that after her video and after they commented this, the cafe blocked her. And then she made this follow-up video.

[00:10:25]>> I posted my video being like, "Hey, this is insane because I'm getting about 16 to 20 ounces of liquid for $12, and it has no caffeine in it, and you don't have to make it. It's a pre-made mixture that they just pour into the cup and add either water or lemonade." And they commented this response, and they said, "It's $10." No, it's not, babe. It's not $10. It was 12 plus. Um, if it was 12, you likely add a different milk, extra shot, etc. Hey, did you watch my video because I ordered a refresher. That's not coffee. I didn't add anything. It's just juice. That is also the same amount you would get in Aventi if not less because they would add ice. You also added ice. That's a crazy thing to say.

[00:11:06]Second of all, there were people that commented. They were like, if you went to Starbucks and you got to Grande's, you would get you it would be $12, too.

[00:11:13]And I to that I want to say something so true, bestie. If I went to Starbucks and I got their grande, which is 16 ounces, I would pay about $12 for two of them.

[00:11:25]Prickly pears drinks are there. They say in their own comments 12 ounces. So I'm already getting less liquid. And the two 16oz drinks I would get from Starbucks, they would have caffeine in them.

[00:11:36]>> Then Anakah from Prickly Pear made a response video where she went through the itemization of their pricing. video going around talking about how we are scamming people with the price of our split cups. And I wanted to just explain on the back end about the pricing of these cups and also why I responded the way that I did. The first part of this is I am not mad. Everyone has a right to their opinion. Um I there is no hate towards the girl who made this video. I blocked her because honestly my own was a lot of hate comments and it has already been honestly like some of the hardest. Like the last 6 weeks have just been brutal in business and personal and so I I apologize if that was perceived as rude or immature. It may have been all those things. I was not in a place to be able to receive these hate comments and let it roll off my back.

[00:12:26]She has been unblocked uh because I am no longer on our TikTok. Someone else has taken that over. Next and the most important part as far as the price breakdown. Uh the split cups are two 12 oz drinks. So I never want to come across as wine to our customers and say fulls size drinks. They are two 12 oz drinks. In total that is 24 oz of whatever drink you choose. They were designed to be half matcha half coffee.

[00:12:50]That's how we post about them. That's how we advertise them. And so what you decide to put on either side is totally up to you. But the goal and intention is that they would be half matcha half coffee. That's what the pricing is based off of. These cups are $118 each, including two straws. So, this makes it over a dollar more than our large 24 ouncez ice cups.

[00:13:07]>> This did not go over well. Let me read you some of the top comments. So, this comment has 47,000 likes and it says, "By your logic, Neapolitan ice cream should be triple the price because it's three flavors." This comment has 14,000 likes and it says, "If you're giving people half of two drinks, the drinks should be priced as one drink." This comment has 65,000 likes and it says, "Nah, it's the attitude you have, not the pricing." And then there's a lot of people in the comments saying that for like split refresher drinks like this, the kind of going price is around $7.

[00:13:40]The main sentiment here is that Prickly Pear should have just doubled down on their pricing. You know, like you're a small business, you're entitled to charge whatever you want, and it's up to the consumer if they actually want to pay for that. But a lot of people feel like this would have gone down better for Anakah and her brand if she came on TikTok and instead of kind of getting defensive and trying to get too in the weeds of like defending why she charges this and whatever, if she just said, "Look, we're like a small business. This is what we have to charge and this is our pricing and just like stand firm on it." I don't know if that would have gone over well, but that is what a lot of the feedback says [laughter] because I understand from her perspective feeling very defensive in the sense that like she's being accused of like being greedy, of ripping people off. Like those are big accusations. I know why she wanted to defend her pricing or give an itemized I guess explanation to her pricing, but a lot of people feel like maybe she should have just been like this is the price and like unapologetic about it. Anyways, because this didn't go over well, Anakah made another video in response.

[00:14:42]>> We have reached [clears throat] out to Katie and apologized and um refunded her drinks and she acknowledged that and and said thank you for that. I did not respond well. I got defensive and I completely own that. I haven't been on the TikTok, but I've been hearing that there are good suggestions as well. And so, we've taken those suggestions um just as far as advertising goes and writing in the description like, "Hey, this is priced for a coffee and a matcha." And um our team as people are ordering are will probably recommend that to you as well. This is priced for that. It really is just so sad to see people capitalizing on that and capitalizing on hurting a small business on um directly coming after me for my mental health. Uh you know, as a womanowned business, I would expect that we would encourage each other. At the end of the day, I hate that the prices have to be what they are as well. I posted a video on this actually recently about how hard it was for me to raise prices, but that we had to if we wanted to keep the doors open. And now the final piece of this, and I do believe it is the final piece, is Katie has made one final video saying she's going to stop talking about this and she actually kind of like pretends that she's going to address Anakah's final video and then she's like, "Actually, can you go watch this playlist of mine?" So, she's trying to drive traffic to her other videos.

[00:16:00]All right. And the last story that I have for you guys today, I'm going to cover the Patagonia versus Patagonia lawsuit again. So last week I covered it and there is a lot of discourse right now about how this lawsuit is being misrepresented. So I thought it was right to talk about that.

[00:16:17]I hesitate to and I really debated if this was the right story to cover because as I mentioned on Thursday, this is a very bad time in history for a giant corporation to be suing a drag queen. Like the LGBTQ communities, the drag community, they are under such attack right now. And I want to protect those communities. Like I don't want anything that I say to be able to be used as like ammo for people to be hateful. Classic. I'm on the last story and Pumpkin starts growling at me because she wants up. If you guys are watching, Pumpkin's on my lap now. I hope you guys can see her behind my laptop. So, just know I thought about this a lot, but the reason that I chose to discuss this is because the other side of the lawsuit looks at the protection of creatives and artists, and that is also so important in this time.

[00:17:03]So, I feel like I did not give enough information on Thursday when I covered this about the true, I guess, reality behind the lawsuit. You know, I said was trademark infringement. I didn't really explain specifically what they meant by that in the lawsuit. And there's a lot of people online who are saying, you know, like Patagonia, they don't own the name. That's like a region. There's a lot more to this. It's not just the name. There's actually a lot of issues with like the parody logo and things like that. So, let's get into it. To catch you up real quick, Patagonia is suing drag queen and climate activist Patty Gonia for $1 for trademark infringement. Patty made a video last week calling on fans to help her get Patagonia to drop the lawsuit and said that Patagonia is trying to permanently take away her name and threaten her with more than $1 million in legal fees. The lawsuit accuses Patty of breaching an agreement they reached in 2022 that quote restricted Patty Gonia from selling branded products or using designs that were substantially similar to the company's logo per NBC. So this agreement happened when Patty was going to collaborate with Hydro Flask. So quote in February 2022 when Hydro Flask was discussing a collaboration with Patty, Hydro Flask asked Patagonia to ensure the company did not object to the proposed collaboration. The parties met and discussed restrictions around the use of Patigonia to avoid confusion about the source of products or advocacy connected to Patigonia. Patty confirmed in understanding that she must refrain from selling Patagonia branded products or using fonts or designs that copy or are substantially similar to Patagonia's logos according to the suit. That is from NBC as well. So now there are photos throughout the lawsuit of Patty wearing the copycat logo including at an award ceremony for Out Magazine. So this would be where they were both saying that they've been trying to come to some agreement for years. Okay, so that was something that Patty said and that's also something that Patagonia was saying. But this all came to a head when Patty filed a trademark to use her name for quote apparel, marketing, and events. Now, Patty claimed that she only trademarked her name to ensure she never loses the right to use it as that recently just happened to another drag queen, and I forget which drag queen it was, and all the articles that I was reading about this didn't reference which drag queen it was, but Annabelle told me about it on Thursday when we were talking about the initial story.

[00:19:23]So, I'm sorry, Annabelle. That is disappointing. I know for you to hear.

[00:19:26]Okay. So, I still stand by what I said on Thursday. This is a very bad time in history to be filing this lawsuit, but I understand that brands also have to protect their trademarks, otherwise they do risk losing them. So, trademark attorney Josh Gerbin told journalist Minavon Burke of the situation that US companies have a quote obligation under US law to police their trademarks.

[00:19:48]quote, "If they were just to allow Patonia to use this name in an unfettered way, they would actually potentially lose rights around the name." So the next person that came around that wanted to do something, they would point to Patigonia and say, "You're letting her sell shirts and you're letting her do all this stuff."

[00:20:02]And the business of trademarking is so important in the creative industry. So I understand why there's this kind of growing concern online from people talking about this lawsuit specifically and saying like two truths can exist here. this can be a very bad time for this lawsuit to be filed against her and like we don't want her to lose her organization.

[00:20:22]We want her to be able to continue her advocacy. We don't want her to have to pay over a million dollars in legal fees. Like all of those things can be true while also it can be true that it's important to protect the arts and to protect creatives and original content in this time.
