Flirty Drunk Driver Gets Shut Down By No-Nonsense CopAdded:
your agenda.
>> Your hand.
>> Thank you. 39. You're getting placed under arrest for DUI.
>> Put it on you.
>> Throughout my career, I made dozens upon dozens of DUI arrests and they're never fun. And they're all unique in their own way. But there's one thing that occurs many times throughout those DUI arrests where a female attempts to flirt her way out of the DUI arrest and it never ends well. This is one of those.
>> I'm sorry. Did I do something?
>> Okay. What's that?
>> Did I do something wrong?
>> No. Somebody called us. Are you >> Hi. This is my house.
>> Oh, >> I was just coming to get her.
>> Gotcha. Gotcha.
>> I didn't know where you guys were. I went to the house over there.
>> The driveway's full.
>> I'm sorry.
>> Gotcha. We got called in reference to a well-being check.
>> Do you need me to get out?
>> She was coming.
>> No, it's raining. It's raining outside.
Do you have an uh ID with you?
>> So, this appears that it was a DUI that was called in by a person who knows her.
And we get those calls all the time.
Sometimes it's just a person who sees a person weaving. You get the car, you conduct a stop, and then it just begins from there. But a lot of those calls come in from concerned citizens and sometimes people that know the person driving, leaving an event, and they're concerned about what's going to happen to them.
>> Who called on a on a check?
>> Uh, that's my business. Okay.
>> Personal business, I guess.
>> Um, if you want to give me a couple minutes, I'm going to finish up with her and then she can head on over to your house. All right.
>> Okay. Well, >> that way.
>> Yeah, it's right here. Just park in the driveway. We're going to leave the door unlocked. Okay. So, I'm going to move my car up just a little bit. Okay.
>> No, no. Stay in your car. Put the car in park.
>> Okay. Yeah, it's in park.
>> It's in park.
>> Yeah.
>> All right.
Okay. Have you been drinking today?
>> Uh, I had two glasses of wine.
>> Two glasses of wine?
>> Yeah. That we went to?
>> Yeah.
>> How long ago was that?
>> Probably about >> Why are we drinking? Why are we drinking behind the wheel? I had a glass at the party. Do >> you mind if I hold on to the keys?
>> Yeah, I have like two boxes at home.
That's all. And I went to >> Yeah, but go to their house.
>> You're admitting to drinking alcohol and driving >> after. Listen, it took a while.
>> Two glasses of wine, a woman her size in 30 minutes. It's a lot of booze.
>> Like I didn't do it like right before I drove.
>> Right. But you have a I I'm getting indicators that you're you're impaired right now. You have a slured speech. You don't get slur speeds from one drink or two drinks, you know.
>> I did.
>> You admitted to drinking and so >> Okay. So, am I going to jail? I'm just going to their house right there.
>> Well, I'm going to conduct an investigation. Okay.
>> I can leave the car here.
>> Okay.
>> If you want me to.
>> Okay.
>> Don't I >> Okay, listen. Relax. Just take a deep breath. All right. So, give me a couple minutes. I'm going to talk to this deputy right here. Okay. Can you turn off your car for me?
And she just admitted just now that she is she has been drinking. She has a slur speech. You could slightly smell alcohol coming through. So if you want to talk to her, I'll stand by or if you got anything. Whatever you want to do, just let me know.
>> All right. I appreciate it. You should be good. I'm going to hold you guys up.
>> Okay. Appreciate it.
>> So what's going on?
>> Um I was at a birthday party, my daughter's friend, and her mom was like, "Hey, just come over to my house after So, I went over there to the wrong street and I was knocking on the door and then I was like, I don't think this is just her house. So, we went we were going that way and I guess that's her house right there. Y >> and that's what we're doing. I did have some wine before we left. Like, I'm not denying that. It wasn't something crazy.
You know, we >> How many of How many How >> I had three glasses of glasses.
>> So, it went from two to three. That's something the officers will definitely note.
>> Like I don't They're right there. Yeah.
>> Like I don't want to Please don't take >> Okay. Just wait right here for me. Okay.
>> Do you want to roll up your window or >> No, I'm saying I'll give you the key though. We can at least turn.
>> Yeah. Yeah. Yeah. Um >> you just uh hit the power button for me.
>> Here. I'll just >> not working the the battery.
>> This is just my luck. Oh, >> okay. Just wait right here for me.
>> I was wondering why the officers kind of traded off one officer who made the stop to the other officer. And I see it's two different departments. You have the Marian County Sheriff was the second officer that arrived and the initial was I think it was Okala PD. There are jurisdictions that cross over in the United States that's very very common.
In fact, it could be from one street to the next. And sometimes you'd end up having things that you would end up doing together. A stop that starts on one side goes to the other side. I'm not sure that that's what happened here, but it's definitely two jurisdictions. I looked at the cars and it's two jurisdictions. That's why they switched.
>> All right. Would you be would you be willing to cuz this conclude I'm going to do a criminal investigation now.
Would you be willing to do some um field sobriety exercises?
>> Yeah.
>> Okay.
>> Oh my god.
>> I can smell the >> Yeah, I >> alcohol coming off your breath and your eyes are bloodshot.
>> Um Oh my god. Sensory thing. I hate being rained on. I'm like literally creeping.
>> I'm the same way. All right.
>> Okay.
>> All right. So, I'm I'm going to check your eyes. Stand with your feet together. All right. Hold on.
We'll stand over here. Feel better.
Stand with your feet together like this.
>> Huh?
>> I'm sorry.
>> Uh, stand with your feet together and your hands down at your side. Okay.
>> She flirt tested him. He shut it completely down. I call it flirt and divert. So they flirt, divert you away from what you're supposed to focus on.
This happens commonly in policing. So the flirt test is something that I've seen many, many times of policing. Not only done to me, but observed.
>> Keep your head still and follow the tip of the pen your eyes. Okay? Do not move your head. Okay?
>> This is really good. I've explained HGM many times, but I'm actually seeing anagmas here. So let's look at this.
It's the involuntary jerking of the eye when you follow a stimulus. It's a six-point test. smooth pursuit, 45° max deviation. And you'll see the jerking on this person's eyes. It's very rare that you can kind of see it on a body cam this clearly.
>> Sorry, I'm so wor.
>> Oh my god. M stand in the same position.
Okay. And then just follow the tip of the pen. Don't move your head. Okay.
Did I fail? No.
>> Okay.
I promise you I didn't like >> overdo it. I think it's a scorn.
>> And her BAC could be still going up depending on how recently she just drank.
>> It's okay. I'm fine.
>> It's fine. I'm good. After all this is done though, I kind of want to know your name if that's okay.
Oh my god, I'm literally drunk. I told you I don't like being drunk, right?
This is literally the my literally worst nightmare and action.
Like I have medication. I have not taken it, but I do have medications for my anxiety. I feel bad for you having to be out here, too.
>> Yeah, I'm supposed to be out here at 6 and they diverted me to this. So, >> well, at least you have a rain, guys.
>> Got to come prepared.
>> Hey, you never know when you're going to be cold.
>> That's right. Keep right there. I'm going to show you how to do it. Okay.
>> One, two, three.
>> All right. So, and then maintain this position. Do not work. Don't start walking until told to do so. Okay.
Sorry. My fault. You may begin the exercise.
>> One.
>> Okay. When I tell you to begin, I want to see you raise either leg approximately 6 in off the ground like so. Parallel with the ground.
>> Can I do it like this?
>> No, you got to do like this.
>> Okay.
>> Like this. Parallel to the ground. Keep both legs straight. And look at look at your raised foot. Okay.
>> So, just like this. I'm looking at my raised foot about 6 in off the ground like that.
>> Okay.
>> Do I have to have a time or just >> So, I'm going to when I tell you to start, you're going to count out loud all the way to 30. Just same thing. Keep your balance. 6 in off the ground. Okay.
>> Okay. This is horrible.
>> All right.
>> Come in. All right. You ready?
>> Yeah.
>> Two.
>> All right. You may start.
I can't do it.
>> Okay, >> I mean I can't I can't Okay, >> I think I did like 20 seconds. Let me just talk about the field sobriety test because I noticed a lot of people in the comments from other countries talk about America still using what they call these archaic field tests. And I get reason why people say that. Whenever you're in a wet space with all of these divots in the road and it's raining and there are holes and all kinds of things, it makes it difficult to perform those tests even for a person who is sober. So likely that could get challenged and I know that defense attorneys look for these kinds of things and the officer likely would have had a difficult time finding a location to make the person more stable to perform the test. Am I going to jail?
>> I I still have one more.
>> I still have one more extra.
>> I mean, I really did only have three glasses of wine. Yeah, I did drink and then I I I left kind of immediately after, so I did >> have it right then. Have mercy, please.
>> Jesus Christ, please.
It's like I get They only have me.
There's nobody else. Their dad works 24/7 and he's everything.
Um, >> my god, this is literally the worst thing.
>> After touching your nose, immediately bring your hand back down to your side.
Okay, so it's going to >> bring it back down to your side.
>> All right.
>> Sorry. There you go.
>> All right. Do you understand all the instructions?
>> Yeah.
>> Flirt test again. He passed with flying colors. He just ignores it. The flirt and divert almost never works. Don't try it.
>> Chin dimples.
>> Thank you.
>> Why was she pulled over? Why are we calling?
>> Cuz baby daddy called.
>> And then I can smell the smell of alcohol in a >> breath. Call the police on her.
>> Yeah, I had a few glasses and you know I did. But >> why can he can just make the call anytime?
>> Well, I had they smelled alcohol.
>> Plus he was supposed to call apparently and uh what happened was that she she apparently didn't call him or something and then OPD ended up stepping out with her and then >> we s like a tad reader or something. I I know I don't know how they located her.
I just showed up as OPD was already here. So, I'm not there.
>> Say what it look like.
>> It's bizarre that like people can just call the police, you know what I mean?
Just like anyone.
>> It's really interesting when you see people try to defend people who are being investigated for driving under the influence of alcohol or whatever intoxicant. They don't realize. And I've worked with officers who have lost family members. And people think that flirting or doing whatever or talking about the other person who called the police is going to change that. but the person they're talking to may have lost a family member and has seen people the destruction that these accidents can cause. It's better to just be professional and go by what's happening with the officer as opposed to trying to weasle your way out of it and try to minimize the fact because it's incredibly serious.
>> Okay. Do you understand the instructions that I gave you?
>> Yep.
>> Just keep your head tilted back the whole time. Okay.
>> This is horrible.
>> I know. Let's try and get through this.
>> Getting in my Okay, we're going to do it. All right.
>> All right. So, go ahead and tilt your head back. Close your eyes.
>> All right. Hold on. Not to tell you to start.
>> Oh.
>> All right. Left.
All right.
Right.
You got to bring it back down to your side.
>> Oh, okay.
>> Yep. Tilt your head back a little bit more. There you go.
>> This is the worst thing I've ever been through.
>> And then left.
>> All right. I'm going to have to turn around for me. So, right now you're getting placed on arrest for DUI.
>> Oh my god.
>> I'm going to have you walk over to the back of my car.
>> Just going to have you stand right here.
>> You don't have anything else on you, do you?
>> Be really bad, though.
>> Okay, I'm cool. We're going to have to wait till we get to the jail. All right, I'm going to do this for you.
>> I'm going to I'm going to put my Okay, calm down. Calm down. Calm down. Calm down.
>> What did I do wrong? Like I did.
>> So So I'll explain to you. Go ahead.
Have a seat in the back of the car.
>> So you were stopped because you were driving and you had three drinks of wine that you admitted to me. Correct.
>> Okay. So that's why I did the DUI exercises. You displayed you have bloodshot eyes, the smell of alcohol in your lip, your breath, and then you also displayed multiple signs to me that you were impaired. Okay.
>> So, right now you're being >> So, that's why >> So, right now you're being placed under arrest for D.
>> You do all my um exercises if you already knew you were going to place.
>> No, I did not know I was going to place you under arrest. Just because you have the smell of alcohol in your breath does not mean that you're DUI. I still have to run through the exercises and prove the fact that you are on you're either impaired or not.
>> Oh my god, he is.
>> That's all correct. And then he also has to get evidentary tests down at the jail, which is going to be blood or breath. Another interesting thing is that you'll see that a lot of times you'll see things go around on social media about what to say to the police, what not to say to the police. It always amazes me that people always try to find a way to circumvent getting around the police doing their job as opposed to maybe giving the same advice about not getting behind the wheel and driving.
Maybe that >> just give me one second, man. I'm on the phone. Sergeant, >> please just let me say >> just give me one second.
>> I just want to stay here, please.
>> Okay, just calm down.
>> Okay, >> I can switch your cuffs to the front.
Just calm down.
>> The wine in there is hers. It's I didn't even drink it.
>> Okay. Do you have anything else that you need out of it >> that you're going to need with with you?
>> No. Do I >> So, your vehicle's getting towed, right?
Yeah, your vehicle's getting towed. He's Your boyfriend's coming to pick.
>> So I I can't because officer witnessed you behind the wheel, the vehicle on and you also gave all the impair your your all the identifiers that you're impaired. So you said it's in your wallet.
>> You said it's in your wallet.
>> I know there's some strings you can pull. My my my cousin is charging. He knows.
>> Name drop. And he didn't bite. This officer is really professional. Very matterof fact and about his business.
>> Where is your ID? Where's your wallet?
>> In my wallet. In my purse.
>> In your purse. Where's your purse at in the car?
>> It's in my my purse. It's It's in the front.
>> Okay. Give me one second.
>> I have to piss so bad. Like I'm about I mean, can I just like squat? No. Like I got to pee. This happens so frequently when if you watch my videos or if you watch other videos when people are drinking and they have to pee and they're in the back of police car and the officer has to do all this work, they end up peeing in the car very, very frequently. I mean, you can't just let them go to the bathroom because you're releasing them and you can't watch a female go to the bathroom. So, it's really challenging. But in Las Vegas, I remember when we would get to jail, they peed in the car. There were inmates that were custodial inmates or trustees and they would clean out the seats if it was urine. And that may have changed and in your jurisdiction. I'd like to actually know. chime in in the in the comment section in your jurisdiction. If someone pees inside the back of a police car, who's responsible for cleaning it?
Especially if it's the officer. I've never ever heard of that.
>> If it's not in there, then I left it at the previous place.
>> I'll just need all your information and everything.
>> Well, I can give it to you like my social or whatever.
>> Okay, just give me one second. I'm going to sit up front and you can give me all the information. Do you want me to put the cuffs in the front?
>> I don't I honestly don't care. I just want to go home. I didn't like honestly >> most major departments don't allow cuffing people up front unless they have a medical challenge. I noticed that a lot of times in some of the southern police departments they let them cuff them up front. It's definitely not as safe as cuffing a person behind their back. I think it's very kind of him to do that especially if his policy allows it. If you have a jurisdiction that does not allow it or does allow it, I'd love to hear this kind of stuff about how it is across the country, especially if it's regional about cuffing in the front.
>> I have as much as normal people do and I was going straight here. So, >> look, look, I I'm going to be straight with you. It's raining. It's Okay, hold on, hold on, hold on, hold on. I I'm talking to you.
>> You're driving on terrible conditions right now. Anything could happen. Just because you have three drinks of wine does not mean anything. I'll put the cups in the front. So, turn around for me. Face me.
>> So, let me tell you something about that HGN test. So, in order to get certified, you have to be certified in HGN. You have to have people come in and drink and they monitor the person who drinks over that period of time. Everyone's body is different, but I can tell you for smaller people and females, a lot of times booze hits them a lot faster. So, don't go off what other people do. It's just a bad practice to get behind the wheel.
>> Like, I'm going to be >> I can't let you I can't let you spot anywhere.
>> I can't.
>> So, I can be in your >> I cannot just try and hold it until we get there. I'm trying to be as quick as I possibly can. Okay.
>> I don't want to be in your car.
>> I I I know you don't.
But it's going to happen. I have to like >> I I know. I'm I'm trying my best. I'm trying my best.
>> You have no idea. Like I'm about to pee in your car.
>> You want me to pee in your car?
>> I do not want you to pee in my car. I'm trying to be as quick as I possibly can.
Give me one second. Okay.
>> So, we saw the DUI arrest. The officer was incredibly professional throughout.
We saw the flirt and divert tactic which failed miserably. I hope that she gets the help that she needs and makes better choices in the future. and the people who were giving her the advice and trying to push the blame onto the person that called, that's just completely wrong. The police are doing their job.
If a person's concerned about a person, cuz the person that called is likely concerned about her and other people on the road. Make better choices. If you like this kind of content, like the video, subscribe to the channel, and click on the video that's on your screen for more content just like
