This analysis masterfully translates complex constitutional standards into a clear, practical demonstration of how legal precedents govern real-world police encounters. It provides a sharp, evidence-based look at the "totality of circumstances" that effectively demystifies the legal threshold for DUI arrests.

She Had Court THIS MORNING... But This Happened.Added:
A lot of people just called 911 saying your driving was going to kill somebody and now you've been involved in a major car accident. My thing is why has nobody taken me serious right now? They are.
They taking you seriously. They about to seriously take your ass to jail.
Multiple people called 911 on you. This should be an interesting and wild ride.
Let's get right to it. On December 2nd, 2023, Officer Seymour responded to a multi-vehicle [music] collision in Georgia. The driver, Ms. Rittenberry, had been reported to 911 for reckless driving [music] seconds before impact. She was arrested for DUI, less safe, reckless driving, and a seatbelt violation. A presumptive field drug test returned positive for cocaine.
I don't know about it. Yeah, I don't know about that either. Let me see your driver's license.
Why are you asking Let me see your driver's license, please.
Because because a lot of people just called 911 saying your driving was going to kill somebody and now you've been involved in a major car accident. I need to see your driver's license right now.
I need to see your driver's license right now.
I don't have a driver's license but I can give you my information cuz the last time the police took my ID. I don't know why. Why would the police officer take your ID last time? I don't know.
What's your first name? I got that.
Right, I need to go to the hospital and you being rude.
>> What's your first name, please?
I need to change clothes. I'm full of pee.
Head itch that head itching, ain't it?
Y'all okay?
Rittenberry? Yes.
All right.
What's your date of birth? 303 28 Why are you smacking yourself in the side of the head?
It don't matter so like you just put it up on me like I just did something wrong. Yeah cuz cuz multiple people called 911 saying your driving was going to kill somebody.
March 28th, what year?
March 28th of what year, please? 98 All right, thank you.
Why are you smacking yourself?
This officer hasn't been to many cookouts, ladies and gentlemen. Uh sir, this is something that black women do when they either get a fresh perm or when they're wearing a wig. Usually when your head is itching this much, it means your shit's dirty. Somebody snatched this wig off this bitch's head, give it a good washing, and hand it back to her, please.
10-4, let me get your date of birth for you.
What's your badge number? 2259, I'm Officer Sanders.
No, that's that's not happening right now.
Um is he rude or is he doing his job and you pissed off because you know he about to get to the bottom of your [ __ ] Last name is Rittenberry. 228898 I'm not I'm not getting away with anything. I'm asking why you're smacking yourself in the side of the head.
Yes, but why did people call 911 and say you were driving recklessly?
Yes, they did.
Okay.
How are you injured?
They sure did.
Yes, she does. She has a temp tag. And they gave the exact temp tag.
Um what are your injuries?
My back hurt. Okay.
>> Everything is sore on me right now. I'm pissing. All my clothes is wet. I'm pissing.
I was out of shock. I hit my head on these things. Uh why do you keep smacking your head? That's what I'm asking.
>> Cuz my hair itch. This is a wig. You worried about all the wrong [ __ ] Well, ma'am, I'm responding to a car accident. I'm asking why somebody's smacking themselves in the side of the head.
Okay.
Yeah, he's trying to find who's at fault. I think you getting super defensive because it's you.
Poor dude, he don't know what's going on. Why you keep smacking your head? I wonder is he genuinely concerned?
>> [laughter] >> I was asking why you got called in as reckless driver.
No, that's not true.
All right, can you stop interfering?
Uh if y'all need to medically evaluate her, feel free. Go ahead.
364, what's your 20?
Oh my god, this is a hot ghetto mess. You got twig baby hair ponytail here and bonnet Bonquisha out in public taking up for an allegedly drunk driver with a bad, dirty, dusty, itchy wig and a bad attitude. Oh my lord Jesus, man. See, y'all don't understand the type of comments I'm going to have to delete.
28, all right.
Papa 6479518 Okay, did Okay, did somebody hit her or did she hit somebody? Did she call someone to hit her? Let me quick pause in this [ __ ] so I can see what's going on.
Hey, did you see anything happen?
Um I was sitting in my car. I just heard Okay. All right.
Did y'all actually see anything happen in person? Yeah, we was just talking.
All right, can you can you just tell me what you saw? Okay, me and her was talking because um my card was declined and she said, "Hey, hey, I pay for your stuff."
>> And you y'all were here at 8:20?
>> Right here and then I said, "Thank you."
and I was giving her my number cuz she looking for apartment. Did this [ __ ] just say cuz my card was declined? And um For her? Yeah. Okay.
They hit her so hard it blew her over Okay.
Was she making a turn or going straight, do you know? She was going She was going straight. Okay. And where was the other vehicle coming from?
The same way. So they were both going straight? Okay.
Yeah, they were going straight.
Okay.
Y'all, I'm just trying to figure out cuz I'm not trying to be bad to her but multiple people right before the accident No, I know. I I know. I'm just letting you all know but multiple people right before the crash happened called 911 and said she was driving recklessly and going to kill somebody. And then boom, an accident happened so I'm obviously led to believe that she caused it. If I was a police officer and I was trying to talk to somebody and get situational information and collecting evidence and [ __ ] was on the phone, that [ __ ] would piss me off. Everybody walking around on the damn phone talking to somebody. You need to be worried about your card declining.
The only person you should be on the phone with is the bank. She talking about what, baby? What he going to do?
All right, looks like she just smashed into somebody and then she's called in as reckless driver. Um I haven't checked the other vehicle that was there over there. I haven't even spoke to them.
I don't know if signal one or 1096 yet.
She's literally been there the entire time just smacking the side of her face.
And I asked her why she smacked her face and she's asking for my name, badge number, calling me a city officer [snorts] or anything. That and the other.
So I haven't made too much of a decision on that yet.
He don't understand, y'all.
Okay.
What happened?
Previous Previous to this light, she she was just kind of swerving down the road. Yeah.
I told my wife I I said I don't think that girl is conscious. Like something's wrong with her.
And as we started down the hill here, she Like right about here?
Yeah, just I mean after immediately after the light. Like she stalled, like didn't go with everybody else. And then as she started to go, she wandered into the lane, out of the lane, and then she wandered into our lane and she never she was like half lane Yeah. all the way down and then it we were stopping at the red light, cars were and she didn't even slow down. She came into our thing and just kaboom and then just went shooting into the Okay. Four independent sources established reasonable suspicion under the Fourth Amendment. Pre-crash 911 calls, eyewitness accounts of swerving, collision physics consistent with rear-end impact, and a prior inhalant DUI 2 weeks earlier. 2 weeks earlier? Oh man, hell no, guilty. Send this [ __ ] to jail. We ain't even got If y'all want to finish the video? No, we going to finish it anyway. Hold on. Under Illinois versus Gates, those facts evaluated together satisfy the constitutional threshold without a single statement from the subject. OCGA section 406391 requires only that a driver be impaired to the extent it is less safe to drive.
No specific substance or back is required. A witness stated on camera he believed the driver was not conscious before impact. That observation alone satisfies the factual predicate for a less safe charge. The officer identified physiological indicators of CNS inhalant impairment, a DRE level observation. The prior arrest cannot prove the current offense, but under the totality standard, a pattern of identical conduct is permissible context for reasonable suspicion. That distinction is critical.
The investigation was defensible. An arrest on prior history alone would not be. Officers observed the subject concealing an item in her clothing received from bystanders. Under Chimel versus California, a lawful arrest authorizes a full warrantless search of the person. The concealment does not independently establish probable cause, but reinforces the totality already developed and is relevant to officer safety.
Okay, hold on. Shout out to this channel for actually breaking that down. The link to the original video is in the description if you want to go give them a shout out, subscribe, or anything like that.
Careful, thank you. Any 10-65?
I hate two people, a thief and a drunk driver. You human degenerate piece of garbage. You inconsiderate bastard. You put everybody else's life that's on the road with you in danger. All you have to do is either not drive or get an Uber or Lyft. I have no sympathy for this dirty wig itchy head ass [ __ ] I don't care who it offends. And yes, before you ask, I would say the exact same thing if it was a white woman.
Um, are you able to tell me what happened with the car collision?
Can you tell me what happened with the accident?
All right. So, I'm just trying to figure out cuz the the truck over there, they got hit and the damage on your vehicle is from you hitting them.
Cuz they're Were they Yeah, but but but look at look at the back of that truck.
That that truck has been hit.
And then the the ve- I'm just trying to figure out cuz the damage on your vehicle's in the front of your vehicle.
Y'all keep in mind this stupid [ __ ] just had a DUI, according to them, 2 weeks ago.
But the damage on their vehicle's in the back and yours is in the front and you're both driving the same way. How would they hit you if they were in front of you?
And they were they were in front of you.
That's I I haven't talked to them. They haven't told me anything, but But just looking at the back of their truck, you rear-ended them.
Y'all know it's coming, right? Y'all know it's coming.
I I wasn't saying you know them.
Right.
Okay.
Okay.
Okay.
No, I'm just saying that vehicle has rear end damage.
Okay.
Okay.
Okay, that's not how this works.
That's not how this works.
Okay.
Uh, you need to shut the [ __ ] up cuz they finna take her ass to jail where she belongs.
Huh?
All right. So, so what happened?
Did y'all Man, is y'all This is not real. Let me Is this real? I'mma have to verify and make sure this ain't some AI made up [ __ ] She drunk driving, hit a car, DUI 2 weeks ago, supposed to be in court today. Ain't no way in the hell. Like just tell me your side of the story.
That's just what I'm trying to figure out.
Okay, is there damage to the inside of your car at all? Did it intrude?
Okay.
Gotcha. Gotcha.
Okay.
Well, he's got rear end damage. You got front end damage.
Nobody was turning.
So, how did I Yeah.
15 months 21152 last ticket on her wrist.
Yeah. Yeah.
Um What is this white girl right here doing, y'all? I know what she doing. She taking up for sister girl right here because the oppressive white police is taking up for the other white couple.
So, we black people, we got to stick together. Ma'am, what is your long back ass over here doing? Get the hell out of this situation, please.
>> [laughter] [clears throat] >> Hey, can you get away from that person?
Huh?
No, I Oh, no.
Hey, ma'am, come here.
Come over here.
Right here?
Oh, yeah. Yeah.
All right. Can you Can you come over here, please?
Are you okay?
No, she ain't okay. She drunk. You taking up for a drunk [ __ ] You done put yourself in the middle of something that you shouldn't even be in the middle of. See, I don't just take up for black people because they black. And I know some black people hate that. I'm at the age where I know [ __ ] comes in all shapes, colors, and sizes. I'm not just jumping on your side cuz you black. Oh, [ __ ] you black. I'm coming to your aid cuz everybody else is in the wrong. No.
I need to assess the situation. Black people Black people can be in the wrong.
Even if the other person is white. I know that's a foreign concept.
I wondered the other chick come to her senses like, "Damn, I think this [ __ ] is [ __ ] up. Let me get myself away from here."
I'm Never mind.
I'mma explain to All right. I know you don't know her and I understand you're trying to I understand, but let me just tell you what happened, okay? So, she's got front end damage on her car. She get There's rear end damage on the truck over there.
She just called in as a reckless driver and she's previously been arrested in this one before driving while high on glue.
Oh my god, y'all. High on glue?
Well, I I can't I can't explain it why I can't I can't read what's on the driver's table. Let me read it again that way I take the blood test.
And it says there's nothing in my system. I'm still going to jail, correct? Like when am I taking Okay, when am I taking a blood test? It'll be now.
How am I How am I do a blood test?
But either way it go, I'm going to jail.
Yes, you are going to Okay.
I'm refusing If I'm still going to jail, I don't have nothing in my system. Okay, what's the charges?
Um, so he is charging you for the seatbelt violation and then DUI with a less safe action under the statute that covers inhalants, okay?
So, that's what we're investigating. So, I just need you to stand aside for just a minute.
Yeah, get your punk ass out the way. You see how she was looking like, oh damn, I'm coming to the defense of a stupid [ __ ] Come over here, please.
No, no, no, you guys are good.
Ma'am.
Miss Writtenberry.
Miss Writtenberry.
Come over here, please.
Can y'all go ahead and put Miss Writtenberry's ass in handcuffs?
She's She's She keeps looking for Okay. No, this is What what what Oh, this is I was asking him what they said.
So, what they said is they were driving down, they saw her swerving and they were up in here. Yeah. As they came up to this light, she didn't slow down, the light turned out for traffic, the light changed, and she ran the stop light.
Okay. And so, witness confirmed all of that. Okay. And I told him he didn't really got a call minutes before this.
Yeah, um, she got arrested at 8:00 for DUI, blew So, that's what I I'm trying to see Yeah, she's she's definitely exhibiting you know, signs, but I don't think she's going to do anything.
You good if I go grab them case card and we can get out of here? Hang on, please.
Okay.
Um, hey.
You all right? I'm not all right, no. I need to go to the hospital. I'm peeing, I'm wet, my back hurt, I'm hurting. I need to go to the hospital. Y'all making it worse cuz y'all trying to make it seem like I fought. Y'all making It is.
Well, I've asked you your side of the story several times.
No, you just you just you can't tell me anything.
Yeah, but you can't tell me anything.
Okay, so tell me your side of the story.
Yeah, you said what? I asked you to tell me your side of the story. I said you just said that's what I thought. Yeah, cuz you're not telling me cuz I've asked you several times and you're just babbling on.
Can you please tell me your side of the story?
You don't want to tell him, why don't you tell me?
Get your punk ass off the phone and let me hear your side of the story. This ought to be entertaining. You you will don't y'all were just whispering about me, but anyway, like I was trying to say like I was trying to tell him Soon as I got hit, I pulled out. I'm I need another female officer over here, please, Central.
Don't get out the car, stay stay where you at, stay where you at, stay where you at. I get out, come out She's She's having stuff up there, bro.
Oh.
Um She's just Yeah, not saying anything.
I'm not sure she'll tell me her side of the story, she can't. Said she blacked out.
Um They're obviously saying she flies up behind them, swerving and they see it and they try and get out of the way and then she just hits them. She on drugs? I think she is. She's definitely not going to be field graded like that, but I'm comfortable with it besides that. Her last DUI charge was for inhalants and she is taking this pair of leggings that these people gave her, random witnesses, and she shoved it into her bra and she keeps finicking with the bra and she asked them several times, where is that bag at?
So, I'm pretty sure she's shoving whatever she did have in her bra.
Looks like she's high. At minute 20, the subject invoked her right to counsel.
Under Edwards versus Arizona, custodial interrogation must cease upon that invocation. However, under Pennsylvania versus Muniz, field sobriety exercises produce physical evidence, not testimony. They are not interrogation within the meaning of Miranda. Post invocation requests for sobriety testing were constitutionally permissible. The subject declined all field sobriety exercises. Under O.C.G.A.
Section 4055, operating on Georgia highways constitutes deemed consent to chemical testing upon a lawful DUI arrest.
Refusal is admissible at trial as evidence of consciousness of guilt under South Dakota versus Neville and carries mandatory license suspension. Refusal supplements probable cause. It does not defeat it. The field test returned a presumptive positive for cocaine.
Presumptive colorimetric tests are screening tools subject to false positives. The officer's own statement that the result showed an unidentified mixture underscores its evidentiary limits. Under Melendez-Diaz versus Massachusetts, only certified laboratory analysis is admissible to prove drug identity at trial. This result alone cannot sustain a conviction.
Yeah, oh yeah.
And she keeps smacking herself on the side of the head over and over again.
That ain't got nothing to do with the drugs, man.
And I was right here. And you didn't see who hit you?
Huh? You didn't see who hit you?
>> I definitely I she Y'all just told me who hit me. I didn't know who hit me. I just I thought they kept going. I didn't know who hit me.
I don't I still don't know who hit me.
Um I still don't know who hit me.
Are are you willing to do any field sobriety exercises or anything like that, make sure you're safe to drive?
Just make sure you're safe to drive.
Or or is it just me they got to I haven't spoke to them, but right now you seem to be the vehicle that is causing the collision, so that's why I'm asking if you would like to do field field sobriety exercises.
Yes, you caused the collision. You annoying as hell and your wig is matted and dusty than a son of a [ __ ] Yeah.
A what?
No, we actually have witnesses.
The ones that were over here, they said they didn't actually see the collision.
She said the witness is gone.
>> [laughter] >> This is amazing. Y'all remember the chick with the sprout blonde ponytail that was taking up for her? She was like, bye, [ __ ] you on your own.
Miss Writtenberry, would you like to do field sobriety exercises?
No, I don't smell it. I'm not worried about liquor.
Not worried about weed.
Yeah.
Physiological indicators of impairment by central nervous system inhalants.
Sorry, by central nervous system uh So, there's inhalants. That's what I'm That's what I'm worried about.
Inhalants. What do you mean? Yes, an inhalant is glue, aerosol.
Huh? You must just read my background. I I am concerned about your background, yes.
Yeah, and the fact that people were calling 911 about your driving.
He kind of messed up, y'all. He was saying physiological evidence. He should have just left it there. He shouldn't have said nothing about no inhalants, right? But he got to ask dad to the right. I just don't know if that'll hold up in court because they just said you can't use a past arrest as probable cause for this. Come on now, y'all got to be on it.
Yeah, two weeks ago is pretty soon.
No, but also because of what's going on now.
Okay.
Now, what he should do while he's on body camera is say, that's not the reason I want to do a field sobriety test. You appear impaired to me. It has nothing to do with the charges from two weeks ago.
Um Do you want to do any field sobriety exercises?
The paramedics are here with you right now?
Okay, do you want to do the field sobriety exercises?
Yeah.
Miss Writtenberry.
Would you like to conduct a field exercise or field sobriety exercise?
Right here by Arden.
>> Yeah, yeah, I'm I'm touching too.
He said he's the lieutenant. You talking to the HNIC.
White people, if you don't know what that means, Google it.
Y'all know what I'm about to do.
You just asked me your side of the >> [laughter] >> All right now, it's driving under the influence drugs and reckless driving.
Yeah.
Cocaine.
Okay, so the one from 2 weeks ago got dismissed, but this one she played guilty to. Yeah, well it's cocaine mixed with something. I don't know if you knew you had cocaine. Yeah.
Okay, it comes back cocaine, but it's definitely got something else in it.
All right, so there's cocaine in it.
>> I hope she had insurance and I hope it covered those other people's car damage.
I hate people riding around under the influence of anything and I doubly hate people riding around under the influence of anything with no damn insurance. If I got to pay it, you got to pay it too, damn it. Ladies and gentlemen of the Supreme Court jury, let me know what you thought about the state of that lady's wig. Should her head had have been itching that damn bad? Should she just throw that matted ass wig away and start over brand new? How stupid do you think the other chick was for taking up for this broad not realizing that she was in the wrong? Let me hear it down in the comments. All right, man, that's all I got. Till the next video, peace out.
