The driver, Ms. Rittenberry, had been reported to 911 for reckless driving [music] seconds before impact. She was arrested for DUI, less safe, reckless driving, and a seatbelt violation. A presumptive field drug test returned positive for cocaine.

That observation alone satisfies the factual predicate for a less safe charge. The officer identified physiological indicators of CNS inhalant impairment, a DRE level observation. The prior arrest cannot prove the current offense, but under the totality standard, a pattern of identical conduct is permissible context for reasonable suspicion. That distinction is critical.
