Wanting a Big WeddingAdded:
Plaintiff Moren Brand says after she and the defendant met two years ago, they became fast friends and did everything together. Meen says the defendant and her witness are married, but they tell everyone they're engaged because they wanted the defendant's parents to pay for a big wedding. Marine suing her former friend for an unpaid loan.
Defendant Jennifer Quigley admits borrowing money from Marine, but insists she's repaid her for a portion of the loan. Jennifer's counters suing Marine for harassment because since loaning Jennifer the money, Marine has repeatedly called and emailed Jennifer, threatening to divulge personal information about Jennifer to her family.
>> Start with you.
>> Okay. Your honor, I met Jen in ' 05. She and I met through a mutual friend. We um became fast friends, best friends, I thought. Um, we did everything together. In October of '06, Jen came to me with her so-called fiance.
>> Why do you say so call?
>> Because she's actually married to him, and she has been since August, but she's not telling anybody because she feels that that she deserves a big wedding from her parents. I guess >> your honor, that's personal and private.
We chose to do that for re for personal reasons including his children's benefit.
>> All right, move on.
>> Because they were married when they met.
>> What the other issue?
>> Um they asked me for $1,500 in October.
I said I could give $500.
Jen said um that would help. So we met.
I met her and Derek at the gas station.
I gave them the $500.
Derek gave me a high five, thanked me, told me I owed him one or he owed me one, and that he uh they would pay me back in January after the holidays were over.
>> Let me hear from her, and then I'll get back to you.
>> First of all, your honor, I have paid her $200 of this $500 loan. I paid it to her in March of this year.
>> You said I was for something else.
>> She's claiming that that $200 I gave her was to go towards a debt she feels I owe her from October. When was there when did you agree to repay her?
>> I agreed to repay her as soon as humanly possible. I was not working at the time.
I was not working until a month ago. And I did pay her the $200 in March. She's not putting this forward with this loan.
>> Right. And in two weeks, you were going to pay me the >> And the 300 should have come. You're saying once you got a job, >> right?
>> Your husband didn't have a job.
>> He's had a job all along. I was not working until this >> Derek.
>> All right. You tell me about this.
>> Um I I have had a job the whole time. We uh we are married. She has Moren or Bo was one of the few that knew the difference only because for my children's sake and everything else, we were trying to make it an easier transition for them throughout.
>> And you wanted a big wedding.
>> Everyone yet?
>> No.
>> All right. We won't let anybody >> Yeah. I figure it's I figure it's all kinds of quiet now. I figure it's all we keep it in the back right here.
>> A big wedding. That's all they want. A big wedding. Your honor, that has nothing to do with it. That's the first line of it. That's not what I'm getting at.
>> How was your wedding character?
>> My wedding. I'm not married yet. I'm getting married this.
>> Okay. Yours going to be big.
>> No, not really. It's in the back.
>> You quit hating on her cuz she wanted one.
>> This is my first wedding.
>> That's all you keep. She wanted a big wedding.
>> One either. You're not going to have one either.
>> But >> I already had a big one. Your honor.
>> Sir, what do you what else you want?
>> The way the way that this actually broke down is when she loaned Jen the money, Marine even said to her that, you know, we loan money expecting not to get it back. And that's kind of how I took it and that's why I gave her a high five.
>> You took it as she as she could. Not as in she couldn't or that you wouldn't, but that cuz Jen had even offered to sign a promisary note.
>> She did, your honor. I Please be quiet. Please be quiet.
>> She had offered to sign a promisary note. She told her no. Don't worry about it.
>> Have you paid the woman or not?
>> I have not paid 200 of the five. We're now we're at a point where we can start paying. You owe 300. Yes, sir. Correct.
>> And you say you paid her back 200.
>> 200 of that in March. Yes. She's claiming that you say you didn't receive the 200.
>> I did receive 200 in April, your honor.
>> But in October of '05, Jen and I went to a Halloween party. That's when she lost her job apparently, and she could not afford her costume or the room, the hotel room. We got a hotel. Are you saying the 200 they repaid you was for something that happened in October of '05 >> 2 years ago?
>> Correct.
>> Okay. So why did you turn around and loan them more over a year later? No.
>> Because now she's married and I thought she'd be responsible.
>> She hadn't been responsible in a year.
>> But now she's married. She's got Derek.
>> In fact, it's been two years. If they just gave you the money, your witness want to speak.
>> Really?
>> State your name.
>> My name's Troy Olman. I'm fiance to Moren. Uh really about the only thing I know about this is in April, Jen had called and left Moren a voice message stating that she had $200. They would meet and in two weeks she would pay the balance of the loan off.
>> You heard her say that >> on voice message.
>> All right. Have a seat, ma'am. Mhm.
>> He said that he heard her say, >> "I have $200 for you and I'll pay you the rest, the other 300 >> later, right?"
>> For the loan, that had nothing to do with Halloween and she knows that.
>> Ma'am, if she said, "Here's 200 I have for you and I'll pay you the rest." The rest means the other 300.
>> Right.
>> Right. If she said, "I'll pay you the other 300 later," then you interpreted that as part of that 500. You're talking about that 500 that's in question. I'll grant you $300 on that the amount they agree they owe because your husband has contradicted what you're saying.
>> But I have the bills, your honor, from the house. I know you have the bills, but that has nothing to do with this $500. Can we get to the bank fees we're suing her for >> on? She does owe me 300 on the 500.
>> Get all your receipts together and then I'll look at them. Your counter claim for $1,000 is for what?
>> My counter claim is for harassment since the loan. Since that loan, she has repeatedly emailed me, which I do have the emails. She has threatened to share personal information >> to share it with my family knowing that that would cause massive defamation of my charact.
>> I see that that uh email.
>> I also have an email here, your honor.
What does yours say, ma'am?
>> Just how I asked Jen to pay me so we wouldn't have to get to this point.
>> I want the money for your costume, half the room, the items we got at Walmart.
Where did she threaten you on here?
>> Actually, your honor, she doesn't have threats in the emails. All of the threats were via voicemail. He did actually hand me this.
>> I'm sorry. I am sorry. I apologize.
>> Your honor, >> the the voicemails were continuous. Most of them >> yourself. I believe now that you did include these previous loans in '05.
Since you lied about this, your claim is dismiss. I'll give you all you asking for cuz she lying. 600 >> $620 for the plane. Just don't bring him to testify for you no more. He want to mess you up in the first place. I did not
