Taylor Swift's Trademark Showdown

[00:00:00]Protecting your business brand is important and it's not very complicated.

[00:00:04]It involves a filing with the US Patent and Trademark Office located down the road here in Washington DC. And the law rewards people who turn square corners and file applications for a trademark.

[00:00:18]Uh when people do that, when businesses do that, they can get rewarded. If they don't follow the rules, then they can end up with a big headache. Just ask Taylor Swift. There was a really interesting lawsuit that's been filed in federal court in California that I have right here. Filed uh by an individual by the name of Maren Flag. She had previously trademarked Confessions of a Showgirl, which is essentially a word mark. It was granted several years ago.

[00:00:46]Taylor Swift, years later, filed an application for a word mark for Life of a Showgirl. Late last year, that was denied by the Trademark Office on the basis that there was a clear similarity uh that could result in consumer confusion. Even though that was denied, she went ahead and she released the album Life of a Showgirl.

[00:01:10]Fast forward to today, we have a lawsuit in federal court in California by Maren Flag asserting trademark infringement and unfair competition. And there is an injunction hearing that's going to be coming up in court at the end of this month, which will be a very important inflection point in the case. Um in that instance, the plaintiff will be able to argue that there should be an injunction that stops Taylor Swift from being able to pursue this. We'll see what happens in court, but in the meantime, there's really interesting business lesson to be derived. Following the rules and turning square corners is not complicated and frankly, it's really not even that expensive. And doing so is something that every business should consider and pursue when appropriate. But by not following the rules and then nevertheless just jumping ahead, it could really lead to a huge can of worms. It'll be interesting to see what happens in this case. Obviously, Taylor Swift has unlimited resources. She can fight this, but she has a serious uphill battle because she did not file for registration. These often are resolved in what's known as first-in-time, first-in-right situations. So, we will keep you posted on this really interesting case, and Taylor Swift is about to find out whether or not she's going to be able to continue singing this tune.
