>> Right. Here's my concern. My concern is that we have this legal proceeding and I don't believe that you're and I and you if you are determined to be in incompetent we can't go forward on any of these proceedings and you wouldn't get the counseling that you're that you're requesting.

The issues that you raise in presenting your case are as I said disjointed. They're irrelevant to the matter at hand.
They're they're born of what I understand you believe to to to be necessary and required, but they have no basis in law under the >> Yeah, they're stupid. Also rude, crude, and socially inappropriate.

In this case, I'm comfortable with just a 12-month deferred sentence and then um a fine.
>> Um But I I still I mean I I don't know.

I you know, talked to him about his military service, his mental health treatment history, his understanding of the law, his research process as a source of the statement that he gave earlier and based on all of those obviously understanding that I do not represent Mr. Schultz I would personally have a good faith doubt that would meet the requirements of the competency statute.
I again I'm not a mental health professional. I can't diagnose Mr. Schultz or anything like that.
>> Does he have something on his head or is that like the picture is very small on my monitor or is that just some artifact of the lighting in the the video?
>> But I do think that it's worth investigating.
It's that's the record that I can make for your honor and I can give more details if you would.
>> And so so Mr. Schultz um We have this competency diversion program but it it has to be some sort of stipulated agreement. Um And you you get services through the VA?
>> Yes I do. Um mental I dental all nine yards. I'm scheduled up in Denver to get >> It looks like he's got a blue plastic yarmulke on. I'm not saying he does.
I'm just saying that's what it looks like from my monitor.
>> My teeth extracted.

>> I've all all there's getting out.
>> I remember with my I went my grandmother had all of her teeth removed and then had you know back then it was dentures um and I took her out to dinner and she complimented she had sole fish so and she complimented the chef and said I have no teeth and I could eat this and he bought our whole dinner.
>> Yeah they're getting they're getting me a permanent permanent bridge too.
>> Yeah they nice things now.
>> Yeah they they do real nice things for you for veterans. And so I'm going to get them.
It's just a matter of time to get in it, you know?
>> So, but let me let me ask you this. Are you receiving regular mental health treatment?
>> Um at present, no.
Um I found an online place here while I was waiting that does uh diagnostics for autistics for for for neurodivergence.
>> Right.
>> Um >> [clears throat] >> I'm going to probably try to contact them. And like I said, uh I've got >> Oh, good lord. That's why Zach said that.
He really He really did come out with the neurodivergent thing.
>> Somebody up in up in Janesville where I was at the Restoration Village, her name is Bailey Chenault that will testify for me in court that I am neurodivergent.
>> I believe you are. I have no doubt that you are and I know that that condition comes off in um >> I have no doubt about your about your neurodivergence.

And so, the whole the whole reason why they have this competency diversion program is because normally if I read you a competency advisement, then you would have to cooperate with um a doctor from the state hospital interviewing you and then making a determination of competency [clears throat] and that can take a long >> months, yeah. Yeah.
>> And and I don't know how much faster this process is.
>> I I can I can only get this done as soon as possible.
>> But so, they're they're trying to reduce the demand for those statewide competency um evals. They're They're wanting to support participants in achieving stability. Um and so, they'd probably help hook you up with your VA benefits and get you um >> Yeah, I I just need to like I said, I got got the extraction coming up.
I just got to recontact with the VA to get everything back down here.
>> Yeah, yeah. So, they can help you with that.

>> They can help you with >> Yeah, and it's it's just a matter of time, you know, time and resource.
>> And there and you know, it's a low-level offense.

>> Um and so, I think that this would be great for um for diversion, but there has to be a stipulated referral um before I send this to the program and I don't I don't know I don't know what that referral looks like. And then we have to file the order appointing wraparound care coordinator.
