Citizens have the legal right to record police and other individuals in public spaces, including sidewalks, as long as they do not enter private property; this First Amendment protection means that business owners cannot legally stop people from recording on public sidewalks, even if they are uncomfortable with the recording, and law enforcement cannot compel individuals to identify themselves or stop recording in public areas.

Hey guys, >> what are you all doing?
>> I can't hear.
>> What are you doing? What are we doing?
>> Yes.
>> Like, do you need to know all that?
>> Just because you're recording us.
>> We just recording a video we was sent down here.
>> Oh, for what? What is it for? Can I ask?
If I if I can't, it's okay.
>> I don't know if we're allowed to say uh >> just because you're on our like >> we're on your property.
>> Yeah.
>> And where do you want us to go to?
>> Um if you just don't mind >> standing over there like in the line.
>> No, no, no. Don't stand in the line.
>> Wait, what?
>> No, don't stand in the line for sure.
That's That's different. I was just wondering. It's okay if you can't stay.
>> Oh, you don't want us to come. We can record like closer. We can't stand here.
Can we stand?
>> This is probably fine. Just don't come any closer if that's >> Yeah, we wasn't going to go like dinner on you guys property. We was actually about to leave here in a few hours.
>> I think we're going to be here for a few hours.
We can at least say we can at least say we just really just getting like the u like the customers when they come in like like the license plates. What we was really kind of concerned is is this where the workers park right here?
>> Yes, sir.
>> Okay.
>> So, these are all your license plates right here.
>> Yeah.
>> Yeah. We're going to >> Why do you need our license plates?
>> Now, that part I don't think we can say.
>> All right. Yeah, we just got to document, get some license plates and stuff.
>> But we was sent down here by our boss.
>> Where do you guys were? You can't say.
>> Yeah, he said wait till the end.
>> I just don't want to get in trouble. I don't know how much I actually can say.
I didn't even expect anyone to say anything to us cuz we wasn't on the property.
>> Okay, that's I mean, you're not on you're not technically you're not like on our property. So, I guess they can't tell us why they're recording.
>> Oh, >> I did tell you while we was recording.
How you doing, sir?
>> Good, bro. What's up, big dog?
>> I put a little Vaseline on my hand. I let her know that uh we was just sent out here to record. We wasn't really speaking to anyone.
>> Bro, what are they recording?
>> They're recording our license plates.
So, >> not yours specifically, but like >> the customer.
>> Yeah. Yeah, the customer >> or what?
>> Yeah, they can't say weird thing.
>> That's just the part that we can say.
And we was just trying to concern like is this the these four right here?
>> These four are our employees.
>> Yeah, we about to go. Right. That's where we actually about to go right now.
>> Go get those first or >> I mean that's what we >> I just need Why do you need our license plates?
>> We're not allowed to.
>> I can call him. You do you want to speak with them?
>> Speak with who?
>> Our boss.
>> Our boss.
>> Cuz I'm not I didn't read the He gave us some uh contracts to sign, but I didn't even I didn't read >> talk to your boss >> here. Do you want to give him a call real quick?
>> I I don't know if he's up this early.
>> Here. Let me just call my boss and I can get this figured out.
>> Do what?
>> Well, hold on real quick. just cuz she said she really didn't want us here. If you would speak with them and just let them know what you >> want you here, >> huh?
>> Our boss didn't want you here.
>> I thought I thought just the vibe I was getting. I didn't think >> I just It's It's concerning that you want to record our customers license plates and you're not >> If you can just tell him that and tell him how you guys feel about that.
>> I don't know if he's awake. What time?
>> Just Just give him a call and just >> Bro, you're going to get me fired, dude.
>> We're fine.
>> I don't want to get fired, y'all.
>> If you speak to him, I >> I'll call I'll call him real quick.
Let's see if >> I appreciate you coming out as well, man.
>> No, bro. I'm just going to check you out. I'll still do >> I hope he's up.
>> Yeah, me too. I can't give you it because you might run off with it. It's an expensive phone.
>> Yeah, it's >> Yeah, I don't think >> I was going to warm up today, bro.
>> Yeah, I'mma hang up. I'mma hang up before I actually wake him up.
>> Okay.
>> Yeah. He's He's going to be so mad.
>> Well, you're good, bro.
>> Give me one sec.
>> I can't really make out that red car right there. Could you could you read me off their license plate real quick?
>> No, I can't.
>> Huh?
>> No, I >> Can you get that?
She's on the phone, bro.
I don't know.
Is that is that the workers cars too >> over there?
>> The four.
>> Uh couldn't tell you, man. I don't know who I mean. I know these are cars.
>> If you can do me a Here. Do you have like a pen or piece of paper on you or your cell phone? I was just saying if you can like write down these four right here.
>> No, I can't. I'm sorry.
>> I give you 20 bucks.
>> No, I can't. I'm sorry. I don't know. I just what you're doing it for. I'm sorry. I can't do it.
>> Even if I give you 20 bucks.
>> I'm sorry.
>> What?
>> No, bro.
>> Just for your trouble. Just for your trouble, sir.
>> This is so you're not pouring. It's okay, man.
>> You don't have the $20, man. Give them 50.
>> Hey, we give you 50, man.
>> They didn't say we can't come on the property. Go over there.
It must be the vibration.
>> I know.
All right. Now, Kansas City look like law enforcement has arrived.
without doing that little confrontational. I want an autograph. I want >> Hey, sit across the street in the auto.
>> Okay. Hell yeah.
>> I'll come back. You got to make a long walk.
He not going to walk.
>> He is not going to approach >> where he's parked at.
It wasn't too much where he could either though.
>> I give him that.
>> There's a lot of people here.
All right. So, it looks like there's another officer.
Hey, look at this. They giving their information.
Maybe not across the across the yard.
Get out of the action. Get out of the I'm going be looking for it.
What time is it? It's 9:00.
>> Appreciate you.
15:47.
I'm pulling his body camera. We in for Smith.
>> We in for Smith and it's 9:00.
Number >> 242 >> 2492 pulling >> in Arkansas. I dealt with Arkansas before and uh it was not hard or difficult pulling their body cam footage. So uh we definitely pulling this. We on Rogers.
Hello. So, who called?
>> Um, it's about these people over here filming. Uh, they're like wanting all of our license plates that are coming through.
They're wanting everyone's license plates.
>> Like, yeah, they're like filming everyone's license plates. And then we asked them to like not do that cuz it's our customers. And they were like, um, we can't. And they were like, well, like, why are you doing it? And they were like, we can't tell you or we're fired. Like, I guess they're like hired by somebody to come do this.
>> Uh, what it sounds like is they are we have a lot of these first amendment auditors that are like trying to get a rise out of police. So, it sounds like it's some of these people that are trying to get a rise out of police and so legally they can record anything they want. As long as they're not recording inside of a private area as as long as public goes, they can record all they want.
>> Okay.
>> Um there's nothing we can do about that as long as they're not on your property.
When I throw on the sidewalk right now, they're recording me to see how my reaction is.
>> Yeah. So if they get on y'all's property >> and you want them gone or you want them banned, >> I can ban them.
>> Oh, okay.
>> But because they're actually on the sidewalk, there's >> you can't do anything.
>> Even if they're trying to keep trying to get license plates and stuff.
>> Yeah, it doesn't.
>> Oh, okay.
>> It doesn't matter. Unfortunately, that's one of the little loopholes in the in the law that I can't even like force them to identify themselves.
>> Oh, really? Unless um they step foot on your property or unless you want a ban.
Okay. Yeah. So, I mean it's an annoyance, but there's really nothing I can do about that as far as as far as that goes cuz like right now I'm recording, you know? So, like there's nothing we can do as far as that goes.
Now, if they start harassing your customers or if they start harassing you, um then we can't. But just with them just standing there recording, >> can't do anything. can't do anything.
>> Okay.
>> What if it causes business to slow down because people don't want to be reported? Still can't do anything.
>> Can't do anything.
>> Really?
>> Yep. Not because they're not cuz they're not on your property. They're on the sidewalk right now.
>> Now, if they start getting on y'all's grass, take pictures of it and let me know.
>> And uh call us back and we'll we'll take care of it then.
>> All right.
Can I get a contact number for somebody?
Uh >> here all day. Yeah. you around.
>> This is our boss.
>> Is he aware? Is she?
>> Yes. He's the one that called.
>> All right. But yeah, that sounds like that's what they're trying to do cuz like right now they're recording me. So they're just trying to get a rise out of y'all and trying to get a rise out of us. So they >> So they're just trying to get a rise out of y'all and trying to get a rise out of us.
>> So they told them that uh >> there ain't nothing we can do with them over there. I'm sorry.
>> Yeah, they told them that if they told them who they worked for, who they were that they'd get fired from their jobs.
>> That's what the reporter said.
>> And that could be true. They they may be employed by somebody and this is what they're paid to do. So >> yeah, as long as they're not actually on the property, >> and that's this is what they typically do is they typically just sell >> this happening a lot. I guess >> it happens all over.
>> Yeah. They just they they're more target than usually the public.
>> But >> they just know like coming on like someone's property.
>> Yeah. That's why >> they don't they're not here to to bother you though. are just here to record and it normally irritates people because they don't like being recorded but >> most people don't know that you know people can record in the public place.
There's no expectation of privacy when you're in public.
>> Okay.
>> So, >> okay. Well, thank you for coming out.
>> No problem.
>> Of course. All right. Take care.
Hey, I watch y'all every day, bro.
>> Oh, yeah.
>> This got to be a calling from God. I got you.
>> I don't want to take a picture with y'all, man. I swear to God. That's what's up, man. How force How force officers do.
>> Okay.
>> Well, from what we saw, we got >> Hey, you should you should turn your camera around cuz that's going to be a blurry picture. Do it now. do a selfie now with us behind the sun.
>> It's going to be a clear picture.
>> Appreciate y'all.
>> Yeah, man. What's your name?
>> Michael Whitfield.
>> My name's Alex.
>> Tag me. Tag me when y'all do the video.
>> We got you, bro.
>> That's what's up.
man. He's so happy.
>> I'm just as happy, y'all. Like, this is dope.
>> Kansas City. That's probably going to wrap things up here at the Seven Brew.
Police did pull up. Uh, they chose not to respond. Nothing is wrong with that.
But we are pulling body cam footage just to see how they actually handled the situation. But for now, salute to for Smith. I think they did at least educate them. That's all I can say on what I saw. So, salute to them. But if y'all love the content, we are on the road. We are moving south. Uh, hit that subscribe button, smash that like button, and most definitely leave a comment. Till next time, Ken City. Peace.
