In actual fact, he arrived the way powerful men always do in this country with an audience with a convoy in obvious cases and with the quiet understanding that the system bends for people like him. I'm talking about none other than Joe Ferrari Sibon.
My people, Joe Ferrari did not shuffle into the Delmas court, magistrate court, like a man that was burdened by a lot of serious criminal allegations. No, he arrived like a man who already knew that this day would go the way he wanted it to go, which is he would sleep at home in his bed.
I'm sorry to say this, but he was right.
By Thursday afternoon, my peoples and his three co-acused Mimi Daniel Masella Filimon Makayam Caesar and Bafana Oasan all walked out of the Dalmas magistrate court with 70,000 rand bail each. Mhm.
The September postponement, not July, August, September postponment in their calendars is the best thing to ever happen because so much can be done in two months before they go back to court. Point is, we received these news today and in actual fact, the state did not oppose the bail. The god of yesterday told Haiti the journalist from CA is still the god of today. He wasn't wrong was he?

Let's be honest. So now I want you to take I want to take you back from the complications that came with this particular case all the way to today. So you actually have a picture of what is currently going on in this particular case. So much has gone wrong, but at the same time, we are hopeful that so much can go right. So, let's be clear about what this case is actually involving, right? Because the numbers matter, my people, and they have a way of getting lost in all the theater that we keep seeing. So between 2022 and 2025, prosecutors have apparently alleged that these four men apparently happened to have run a systemic protection racket and this was against a mining businessman in the Enangala district.
Okay, so not a once- off shakeddown is what we're talking about now. No, it was a consistent thing. In actual fact, that's what makes their money.
But anyway, it became a sustained operation. It became a business. It became a genuine normal thing for them to do. And apparently, they did this for over 3 years, right? Well, it's highly possible that they probably did it for more than 3 years, but according to the person who is an applicant of this particular case, it was going on for 3 years. And apparently, allegedly, they were expecting upwards of 2.2 2 million rand in so-called protection fees. Mhm. And this was from a man who reportedly had no safe exit.
Yes. So now we have two counts of money laundering, right? And they obviously both of them sit alongside a case a charge of extortion. Money laundering two counts. Extortion one count. All of them are huge my people. They are huge.
So the point I'm trying to make here is the fact that this is actually obviously not a bar fight. This is not a domestic dispute. This is an organized economic predation. The kind of hallow issues, the kind that hallows our communities.
It silences business people and it keeps the entire sectors hostage to some form of strong men with fleets and foundations and Facebook followings.
They are completely different from us.

In short, what I'm trying to say Yeah.

But now I wanted to talk about the wig where everything actually went wrong.
Okay. So before we get to today's anti- climax, we need to talk about last week because last week is a very important time of this particular case. Okay. So this is because last week was when I think everything was literally just masked out. This the mosque just slipped and we saw everything for what it was. Apparently the bail hearing was originally scheduled at Gua Fontain magistrate court which we all know. The state prosecutor, his name was advocate.
He is the one that was supposed to appear for this particular case. But guess what? He didn't go. And you know for sure we heard so many stories about what could have potentially happened to Unaba, right? But point is I think he didn't go. Not because he was maybe lazy, not because he forgot, but because according to the NPA when they told us he had received death threats.
I'm so happy that he's not dead. He's alive and he saved his life in comparison to saving a job that would not be saved if you're dead.
But the point is those death threats, my people, was serious enough to send him into hiding. Send him into hiding.
Hear me. Send him into hiding. I want you to actually think about this slowly.
We have a state prosecutor in a major extortion case that actually went into hiding because he feared for his life. a prosecute feared for his life. South Africans, this man is supposed to protect us and take those and put them in jail. And unfortunately, he too is afraid and would rather choose his family and his life over South Africans in inverted commas. We are in deep trouble. Although I must say I would have also probably done the same thing. It so happened that the magistrates apparently unaware or unmoved by this context actually struck the matter of the role. We all saw them celebrating saying, "Oh my goodness, we are going home." As though that matter would not be reenrolled. It made no sense. Anyway, the lady magistrate then decided above that I will also issue a warrant of arrest for the prosecutor to come here. What we heard from the NPA that apparently the acts that were done by this particular magistrate were actually unheard of. was the first in the entire new age of democracy that such a thing actually happens without no explanation whatsoever. What there was so other so many other remedies that the lady could have chosen but decided to choose the worst of them all was what she paid or maybe she'd continue to be paid for the rest of her life.
It will never change the fact that the accused walked free. Their supporters celebrated in the corridors of justice, my people. And what followed was an institutional scramble. It so happened that the N&P and and I'm sorry, the NPA actually challenged the striking off of this particular case. They complained about the magistrate's conduct. They told us about it. Well, but let me just say this magistrate's conduct came way later. Everyone was fixated and focused on the prosecutor and never the magistrate until just recently when things actually changed. We spoke about the magistrate's cont contact contact conduct and they the NPA that is urgently decided let us make sure we reenroll this case to make sure there is some form of justice being done. We must be seen to be making sure people in South Africa see that courts are above anyone. And they tried Sham because h what happened today may not have made it better but at least it makes it make sense.
And they were not about to take that chance. My people this time they said we are going to Delmas. Yeah. We are going to a venue that is chosen specifically because this was actually deemed a safer place.
Yep. The NPA is saying Delmas is a safer place. Let that land. Think about it properly.
I'm still saying I don't want to say we're on our own, but gosh, criminals seem to be having a field day right now.
Point is, the South African justice system, my my people, relocated a high-profile criminal case because the original venue was considered too dangerous for the state to function in.
Do you understand what that means? We have quietly normalized the idea that certain accused persons carry I really think it's sad that we have quietly normalized the idea that certain accused persons actually carry with them an atmosphere of threat so thick that courts themselves actually need to move.
And this is exactly what this man Joe actually kind of slightly showed us.
Enough about that one. Let's talk about the bail that broke people.
So back to today, back to 70,000 rand each.
South Africans actually were watching this unfold on all social media platforms, even on YouTube. I was watching this proceedings on SABC and I was just so shocked at what I saw because I just could not understand how we got here. Over 53,000 views on ENCA.
The journalist um Hades post was actually on fire on eggs, my people. And hundreds of comments were there and most of them just had a lot to do with versions of the same exhaustion when it comes to our justice system. There were a lot of furious questions such as what was any of this for? Uh 70k that's nothing to these men. If you if a man makes 18 million rand as revenue a month, what more is 70,000 rand? It's like asking them to pay one rand me. That is how deep this whole situation became. It also ended up making us think a lot about the fairness of justice when you have no money.
Others were talking about how there are so many ordinary people who sit in remind in in in remand detention because they literally can't afford bail for 5,000 rand and here is a person who affords bail for a million rand and you gave him 70,000 rand. They threatened the prosecutor is what other people are actually saying and others even made sure they mentioned that they are out on bail and it does not make sense. But I want to say to you, it does not make sense from an emotional perspective, but may potentially make sense from a legal perspective. Don't kill me.
It doesn't make sense. But maybe that's rather the point. This is the moment in the story where South Africans actually realize that the justice system of South Africa is actually two-tiered. It it doesn't just peek through the curtains.
No, it walks to the center of the stage.
It takes a bow and actually dares you to say something about what actually happens because the well-connected man with a taxi empire and the community foundation and the Bible sound bites actually gets bail and the state doesn't even fight.
Hey, the man who can't confirm a fixed address sits and waits because he just does not have an address to confirm what the system my people according to me and how I see it. I don't think I would get to a point of saying the system is broken. The system is not broken. A broken system fails accidentally.
This system is performing exactly as designed. It is performing exactly as designed. But the problem is it is for certain categories of people.
The questions nobody is asking loudly enough are the questions I just want to quickly talk about just now. This is something we should not forget. This case is a case with a victim in it.
Okay? It took a lot for the man who reported it to actually gain the strength to even report it, let alone investigators take it and take initiative. Particularly because of the person we're talking about being Joe Ferrari. Okay. His name is Dr. Thomasani.
My people, Mr. Dr. Nulli is a businessman. He is a man who allegedly had to pay over two million rand over three years to stay safe just because he is a businessman in a mine that is said to have people around it force you to pay for protection fee.
2 million rand in three years is a lot of money.
Think about him. Think about how he is sitting at his home. Not just him with his family, his kids, and they're just watching television. And he is all of them are just now watching the man he actually accused walk free.
Conditions attached. September is circled on the calendar. But that feels very far away. Not just for me, but for him too. for his family, his safety, his life that I owe, the prosecutors, every single thing about this case that could go wrong could definitely go wrong in the short space of time that has been given to it. If I were to ask a very serious and important question, I don't know if you would be able to assist me.
Who is protecting him now? Really, who is protecting him right now? Who is protecting the witnesses who may have to testify in September? Let's just assume that this case survives that long. Let's just assume that the NPA actually holds its nerve. Let's just assume that the next prosecutor doesn't also receive an envelope of threads through the post.
Let's just hope everything goes well in a normal realistic heavenly world.
And who is investigating the death threats against advocate and Because in the noise of bail hearings and procedural gymnastics, that crime, my people, the intimidation of a state prosecutor in an active case seems to have been filed under the no Tedworth concern and promptly forgotten because it doesn't look like we're even talking about it anymore. Yeah, we did talk about it when it had to do with him being suspended. But now, funny thing is Farad had a lot to say and he spoke about his god. Okay, he spoke about how good his god is. When told had that the god of yesterday is still the same god of today, he was performing for multiple audiences simultaneously. Let me tell you that for his supporters it was some form of faith. I believe in God and I didn't do anything. I'm innocent and you know I have lived my life to the best of my ability and I have assisted my community to the best of my ability. But only he and God knows for others observers like me and you. It was defiance for me. for the state. I believe it was a spectacle of saying it may have been something closer to a provocation. You think you got me, but you did not get me as yet.
We still have a long way to go in this case and you don't know me allegedly.
But let's be honest about this whole situation. I know it makes us angry, but he is not wrong to feel confident. He isn't wrong to feel confident. The script here, my people, is very, very familiar. Something we've seen before in South Africa many times. In actual fact, you arrest a person. The arrests actually generate headlines. Then bail hearings generate outrage. And then September arrives quietly. Witnesses now think twice because this man clearly can get away with anything. Cases now are being postponed. They drag on and we don't even understand why they are dragging on. And powerful men with patient lawyers and long memories outlast the news cycle. They know for sure there'll be another story about someone else who is hotter than them. And we will focus on the story of the ones that are coming sooner than they are later.
What happens when nothing happens?
What do we do if it so happens that nothing happens?
Sadly, South Africa once again I'll say has seen this film before.
Now what needs to happen according to you the case resumes on the 1st of September 2026 and this is between now May, June, July, August, 3 months in actual fact. Between now and then, there are several things that must happen if this is to mean anything at all. Not just to the man who is accused of all these things, but also to South Africans who are watching at their homes and getting updates every now and then.
There is a threat and the threat against Advocate and Daba according to me is something that must be treated as a priority when it comes to criminal investigations. I understand we want to see this guy going down, but we must understand how this guy got to daba.
