He's no longer in office; he's a former president, a former senator, he doesn't have the prerogative of being tried in a special court, he doesn't take that prerogative with him. That's why Lula was prosecuted and tried in the first instance. In 2018, the Supreme Federal Court (STF) settled this understanding in Lula's case. The Supreme Court (STF) said: "Everything's fine.
Lula has no prerogative in the STF. Lula is a former president and a former president in the first instance. What did the STF do in the case of President Bolsonaro? The STF said the following: "No, no, no, now change that." And the former president is on the Supreme Court and brought President Bolsonaro's case to the Supreme Court, saying that the former president now has the prerogative of being called into the oven.

In criminal review cases, the Supreme Federal Court (STF) judges the case in plenary session, which requires an extended quorum; everyone votes. Nunes Marques, Fux, and André Mendonça will have to convince a few more ministers for this criminal review, which is currently with Nunes Marques, to annul the process that convicted President Bolsonaro. And if that happens, it will cancel out all the others in a chain reaction. Now, do you know what Nunes Marques could do to show that he is a judge with a capital J? So, my friends, this became very clear to me, because now, just recently, Nunes Marques understood that these proceedings from January 8th should not be in the Supreme Court.
So, obviously, as the rapporteur for the criminal review, he will follow the same understanding. What remains to be seen, then, is whether he will have the courage to issue a ruling now granting the injunction and suspending the effects of the conviction, or whether he will work to convince more ministers besides Fux and André Mendonça so that his argument prevails and the criminal review is granted.
