[00:00:04]It's called >> Thank you, Your Honor. We're here in the state of Ohio versus Nathaniel Jackson case number 25 CR1652.

[00:00:12]The defendant is present with counsel Paul Meyer. We were last here on April 10th, 2026 where the defendant pled guilty to count one of the indictment, failure to comply, a felony of the third degree, and we are here today for sentencing.

[00:00:29]>> All right, Mr. Meyer.

[00:00:31]>> Your Honor, that is correct. I think the court is also aware of the fact that Mr. Jackson has been sentenced by the Cuyahoga County Common Pleas Court for a period of incarceration with ODRC on a similar charge. So, uh we're uh ready to uh proceed with sentencing.

[00:00:51]>> All right, go ahead.

[00:00:52]>> Well, Your Honor, uh I would like the court to fashion a sentence uh which includes a minimal uh amount of time. I think Mr. Jackson has been relatively cooperative in this matter.

[00:01:04]Uh he's already got a lifetime um suspension of his operator's license, so uh I know the court would uh also impose that uh overlapping suspension, and then uh I believe any sentence the court imposes is by law going to be consecutive. So, uh we understand that. Thank you.

[00:01:27]>> All right, Mr. Jackson, what do you want to tell me before I impose sentence?

[00:01:31]>> Um I just want to let you know that I am better than my worst moments. Um I'm not like trying to go to prison for a longer time. Like I was hoping like for like a suspended sentence if possible.

[00:01:44]Um but I'm owning up, taking responsibility for my actions, [clears throat] and just ask for your mercy.

[00:01:52]>> So, what was the thought process here when you were at this >> I wasn't here.

[00:01:57]>> behind the wheel in this uh Willoughby case.

[00:02:00]>> I honestly wasn't thinking. I was scared at the time.

[00:02:04]I was really just scared and trying to get away at that moment.

[00:02:10]>> All >> Well, the the problem is the getaway.

[00:02:15]What what time of What What time of day was this? Do you remember?

[00:02:18]>> It was night time.

[00:02:19]Well, evening.

[00:02:21]>> Okay.

[00:02:22]People around in the in the uh shopping center?

[00:02:28]>> They've said that, but not not Yeah.

[00:02:31]>> Right.

[00:02:32]So, >> [cough and clears throat] >> you you essentially turned a misdemeanor theft case into a felony three fleeing a loot. So, what Why did you decide to run?

[00:02:48]>> I was scared. I was on probation in Cuyahoga County.

[00:02:50]So, I was scared that, you know, I was going to get arrested and they were going to violate my probation and stuff like that. And uh I just knew that I was doing something wrong. So, I was trying not to I was trying to evade the law and not try to get in trouble at that time.

[00:03:08]>> Well, you've been sentenced out of uh Cuyahoga over a year for a failure to comply, right?

[00:03:15]>> Yes.

[00:03:16]>> Right.

[00:03:17]And what was that What was that failure to comply all about? What did you do?

[00:03:23]>> Um we actually got They they They said that they tried to conduct a uh traffic stop.

[00:03:29]And I basically I didn't see them, but I pulled over a little bit further down and they came like about 5 or 10 minutes later and they addressed me about the situation and we handled it right then and there. I went to jail, bonded out, and then >> Okay. You've also got some attempts in your past, right? Attempt failure failure to comply?

[00:03:50]>> Yeah.

[00:03:51]>> Okay. Why do you keep doing the same thing over and over again?

[00:03:56]>> Honestly, I just I'll be scared to stop for the police like but now I'm just >> Well, why? Why?

[00:04:05]>> I most of the time I'll be on probation or it'd be something going on in my life to where I just don't eat.

[00:04:13]Cuz I like jail is like the right thing at the right time at that time.

[00:04:16]>> Well, it's usually never the right thing at the right time, right?

[00:04:19]>> it isn't but now it's like now I know not to do that.

[00:04:25]I can't drive anymore.

[00:04:26]>> Well, it did this this situation you went you went over a median one point went a little airborne and and then nearly struck some uh pedestrians.

[00:04:44]>> I understand.

[00:04:45]>> It's There's people targets of busy stores.

[00:04:49]People in and out of that place all the time.

[00:04:52]And and you nearly hit some people.

[00:04:56]So your your past demonstrates you don't have a lot of concern for this kind of stuff cuz you've got Is it Miss Gold? Is it Is it two attempted failure to complies in the past?

[00:05:08]>> Yes, Your Honor. One in 2023 and one in 2025.

[00:05:13]>> Okay.

[00:05:14]And then we got the the the Cuyahoga and we have this one. Go ahead.

[00:05:18]>> The one from 2025 was actually in 2023.

[00:05:22]>> Okay.

[00:05:23]>> It was It was the same one. It was a duplicate charge and I was supposed to get charged for it and when I got out of prison he um William McGinty he mis-sentenced me at the time I'm I'm guessing.

[00:05:34]And when I got sentenced to prison he was supposed to put that in there and he didn't. So when I got out he just gave me probation for it but it was from 2023.

[00:05:42]>> Okay. Well So on the first attempted failure to comply, you went to prison?

[00:05:52]>> Yeah.

[00:05:53]>> Was that McGinty, also?

[00:05:55]>> Yeah.

[00:05:55]>> Okay.

[00:06:00]And then you got the minimum on the Cuyahoga one, the 12-month, right?

[00:06:04]>> For this here?

[00:06:05]>> No. In when you were downtown.

[00:06:08]>> Yeah, downtown when you know.

[00:06:10]>> Okay.

[00:06:11]You're going to Lorraine in a couple weeks for a sentencing on a uh theft, right?

[00:06:16]>> Yeah.

[00:06:17]>> And we got some Summit stuff you got to take care of, right?

[00:06:21]>> Yeah.

[00:06:22]>> All right. You got to get your [ __ ] together. I mean, this is this is ridiculous.

[00:06:26]>> I understand, Your Honor. I have court on Friday, actually, for another case that I'm trying to clear up.

[00:06:31]>> Summit?

[00:06:32]>> Um uh I believe so. I think it's Summit. I'm sorry, they they run together. I'd be confused.

[00:06:40]But um it's from prison. I'm in prison now, so whatever from there.

[00:06:45]>> All right.

[00:06:46]Well, you got to figure out what you want to do after you get out of prison, cuz this this stuff ain't working out too well so far.

[00:06:53]>> I actually was working when I got and then I have a my son, he was born February 11th, so I haven't got to see him yet, either. But I was actually working when I got arrested.

[00:07:04]I just was doing dumb stuff.

[00:07:06]>> Well, that's true. Can't argue with that.

[00:07:09]Anything else you want to say?

[00:07:11]>> Your Honor, I just ask that you give me the minimum if if any prison time at all.

[00:07:16]>> Well, there has to be prison time.

[00:07:18]That's the nature of the offense. When you pick up these failure to comply, it just compounds. So, it it has to be a prison sentence, and it has to be consecutive.

[00:07:28]So, that's where you're at. That's kind of the activity you engaged in.

[00:07:35]>> I understand.

[00:07:36]>> All right. Ms. Cole.

[00:07:38]>> Thank you, Your Honor. In this case, as you as you have already said, that the defendant essentially took what would have otherwise been a misdemeanor theft and escalated it to a failure to comply. This offense happened at approximately 6:30 in the evening on October 27th, 2025, so a few days before Halloween. And at that time the parking lot where the Spirit of Halloween store was located was busy with pedestrians from Spirit of Halloween, from Target, from several other stores. And the defendant with no regard to the safety of any of the other pedestrians or people located in those cars, um, took off with disregard to those people, driving across the median, driving through a pedestrian crosswalk. Um, parents had to pull their kids closer to them. There were individuals who the police talked to who were afraid that the defendant's car was going to strike them. Um, and the defendant took these actions with no regard for their safety.

[00:08:36]The defendant has previously been convicted of what shows on the Cuyahoga docket two attempted failure to complies, one in 2023 and one in 2025, as well as a recent conviction for failure to comply F3 that he was sentenced to in Cuyahoga County. The state does not believe that these actions warrant a minimal prison sentence. The state is asking for prison consecutive to what the defendant is serving in his Cuyahoga case.

[00:09:05]>> And that is a consecutive by statute, correct?

[00:09:08]>> Yes, Your Honor.

[00:09:10]>> All right, I reviewed the um the um pre-sentence report that was done out of Lorraine as well as a portion of the report relating to this offense.

[00:09:29]And uh reviewed the judgment entry from Cuyahoga County from your recent sentence. I considered all the provisions in 29 292912 and 292913.

[00:09:42]So, as I said, Mr. Jackson, this is a Usually these failure to complies are on streets that lead to highways and 90 miles an hour and the police stop chasing, but this was I think this was more dangerous because now we're not talking about cars, we're talking about people walking out of stores across parking lots at 6:30 at at night 4 days prior to Halloween, so it's busy.

[00:10:13]And that place is always busy. That shopping center is always busy, especially around that particular area.

[00:10:18]So, you pose a real danger to people who are just out minding their own business because you're and these two other women are you know, doing what you do and that's, you know, stealing from different stores. That's you're all over the place doing this stuff.

[00:10:35]So, >> [clears throat] >> on the uh on this charge count one, the failure to comply, I'm going to sentence you to 24 months in prison.

[00:10:44]And that by statute, that uh sentence is consecutive to your Coyote County case, which is a 12-month sentence.

[00:10:55]I'm also going to impose the costs and your driver's license is suspended for your lifetime. That's a mandatory suspension under the code.

[00:11:05]Uh when you get out, you will be on post-release control for a year, up to 3 years with conditions. If you violate the conditions, the parole authority could send you back to prison for up to 9 months for each violation, up to 1/2 of my sentence. If that violation is a new felony, you could get an additional consecutive prison sentence for the violation, the maximum of which is the greater of 12 months or the time left under post-release control. The charges are dismissed.

[00:11:35]>> Your Honor.

[00:11:35]>> Yeah.

[00:11:36]>> Am I able to get the time served for since December? When I got arrested December 16th from Lake County.

[00:11:42]>> Well, I I I I do not believe so. I don't know Miss Gold's position on this, but you're held on several other cases.

[00:11:51]So, I don't know if uh if you believe there is any credit for for time served.

[00:11:58]>> Your Honor, I don't believe there is because at that time he was also being held and getting credit for uh >> Okay. If you are we'll we'll take a look. If you're if you were not being held on anything else, then I'll give you credit. We'll go back and give you credit for whatever time you served.

[00:12:11]But, if you're being held on something else, then there is no credit.

[00:12:15]>> So, can I get like a judicial or something?

[00:12:17]>> Well, you you got you got you got to clear up a whole bunch of things before you can even think about that.

[00:12:25]So, anything else, Miss Gold?

[00:12:27]>> No, Your Honor. Thank you.

[00:12:32]>> two years of time a year >> two years consecutive to the time that was imposed by Cuyahoga County.

[00:12:41]>> Well, now you got 12 24 months from from here.

[00:12:44]>> So, I don't get out till 2019.

[00:12:50]>> Yeah, I would say that's correct.
