[00:00:01]Pliff Judy Stasil says the defendant and her husband are her landlords. And Judy thought they were good people until she discovered the defendant's husband was in jail for embezzlement and grand theft. Judy is suing her landlords for emotional distress and harassment.

[00:00:19]Defendants Clarence Tate and his wife Donna say Judy and her husband are habitual liars and Judy's nothing but a prostitute. Clarence and Donna are counter suing for defamation.

[00:00:32]>> Uh, your honor, March 23rd of last year, when my husband and I decided to move into the apartment complex that the Tates own, little did we know what we were getting into. Uh, at the time when we moved in, Donna portrayed herself as a good, loving Christian woman with even a kinder, loving Christian husband. What she failed to tell us was that her husband was incarcerated. And I found out myself when I accessed the court records, he was incarcerated for several counts of embezzlement.

[00:01:02]Um, he didn't get out of uh jail until, I believe it was late June of last year.

[00:01:08]>> Yes. Because had we known what he was in jail for and we would never have moved there. He's also been charged in the past, your honor, with forced oral culation on his own spouse.

[00:02:49]>> Um, I went out my apartment door one day to take my dog out to go to the bathroom. Mr. Tate was in the spa area uh cleaning it and my dog happened to run in there. So, I ran in there to get it the dog. And he started yelling and screaming at me, you know, all kinds of profanity.

I witnessed this behavior from her several times and have also confronted her about it. Your honor, she is a known prostitute. [00:07:04]>> It was it was empty. She took it upon themselves to go into the unit and remove furniture that belonged to that particular unit, the TV set, the couch, the dressers, whatever. So, we had to call the police to advise the police that they did this. They came out. We have a police report.

[00:08:45]>> Say it. woman proceeded to badmouth and talk to about the owner of the property stating that he was a something and something and landlord who was quick to complain and to do repairs.

[music] Janie claims she never had any problems with the defendants until the day they abruptly moved out and one of the defendants assaulted her and she has the video to prove it. Janie [music] suing for property damage.

[00:12:22]Defendants Leah and Estrosa and her girlfriend Eileen Morales admit they never had any problems with Janie. But on the day they decided to move out, Janie tried to provoke a fight and they were forced to call the police. [music] They're counter suing for stolen property.

[00:12:37]>> Start with you, >> sir. As a young woman, I struggled through life. I um went to school and I went full-time and I had a child, so I try to make a better family for myself.

[00:12:48]So, I figured I gave these two young ladies a chance. Um they seem to be a very nice family. They had a child. So, I figured, you know, I'll go ahead.

[00:13:01]>> Did they do that or were they >> They they worked full-time and they went to school full time. So they reminded me a little bit about myself. So I said, "You know what? I'm going to give these girls a chance. They're like the perfect family.

[00:13:23]>> It turned on uh July 26th. And so prior to that, everything was fine. Everything was fine. There was no problems.

[00:13:37]>> Ladies, first of all, your honor, Eileen and I have been together for 4 years. We have a son together. We go to school full-time. We work full-time and we also coach. Um, normally we don't tell people we're a couple because we like them to get to know us as individuals first cuz we feel there's a lot of discrimination in the world and we would just like it if we weren't judged based on who it is that we love. So everything was good, your honor. Um, we like she said, we had no problems in the beginning, you know.

[00:14:04]Uh, everything was fine up until the time that she wanted to do a walk through because we had did a lot to the house as fixing it up.

[00:14:10]>> What month is this?

[00:14:11]>> This is in about April in 2010.

[00:14:14]Let me get back to her then, then I'll allow you all to respond. Ma'am, >> before the lease, they had asked if they can do some improvements. I said, "You're allowed to do the you're allowed to do the improvements. I'm going to put it on the lease, but as soon as your lease is over, you you are not to remove any of the improvements." I did a walk through. The house looked very nice and there was like, "Oh, yeah. We love it here. We have our privacy. Our kid can run around the yard. The property is actually on three lots, so it's a big yard." And they were happy. And they even told me that they wanted to stay another 6 months if it was okay.

[00:14:45]>> I said, "Sure." And maybe after the 6 months, I can probably try to sell you the home.

[00:14:49]>> You know, and it stayed like that. On [clears throat] uh July 26, I get a call from my sister stating that there's a U-Haul at the property. Um I go out there and when I arrive, they are shocked that I'm there. And I asked, I said, "Are you all moving out?" And they said, "Uh yes, we had a family emergency." I said, "Well, y'all should have had the courtesy to call me and let me know y'all are moving out. It takes five minutes."

[00:15:18]>> And they said they had to attend a family emergency.

[00:15:32]>> There was family emergencies. It was like that where my brother was in the hospital. It caused us to change up our living arrangements because after that day we need or her family needed somebody to stay there with her brother because it was um kind of like a behavioral >> needed both of you to stay there.

[00:15:51]>> Because I couldn't afford to to stay at the place by myself.

[00:15:54]>> Okay. And she intended to stay with him indefinitely.

[00:16:01]>> We really didn't. We had a whole lot of stuff going on as well. We needed to get you know figure out how where we were going to stay and what we're going to do and we just needed everything settled by the time school start.

We have a family emergency, so therefore, we're going to have to leave immediately and hope you'll consider, if you don't mind, we'll talk with you about it later and see what we can work out.

How did they damage the property? honor. Um after the uh July 26, 2 days later, the neighbors call me that there's a window open and the fence is opened and the girls have not returned to the home. So during that week, I had to work. On July 31st, I went to the property. It was my day off.

[00:17:21]The yard was 3 ft high. There was trash all over the place. So me and my son, my 19-year-old, we went out there to cut the yard. And as I'm cutting the yard, her mom arrives. The police got there and um I was trying to videotape before I left.

[00:17:37]>> I was trying to videotape the yard that I had cleaned the yard.

[00:17:39]>> Okay. Why did the police come?

[00:17:41]>> Because um Miss Eileen, while I was videotaping, she smacked me in the face.

[00:17:47]>> She smacked me in the face. And while I was trying to pick up the camera, she still kept on pushing me. And I have video.

[00:17:55]>> No, your honor, that isn't true. On that day on the 31st, what happened was that I showed up and my grandmother was waiting for me. Yes. Did you hit her while she was holding?

So, those are the cabinets that are in place.

We have a repair man who we have his witness statement explaining all the repairs that he made in the house that Janie refused to pay >> um to pay for. And we also volunteered to pay at least half of those for those repairs, labor. Ma'am, I'm sure that you can't lease someone's property, put your own fixtures in, pulling her fixture out, her cabinets. Then when it's time to leave, you take your cabinets and she's left with no cabinets.

At the time, my ex-husband was staying there. But they were frantic. they were getting kicked out of their current condo and they needed someplace that they could go and they only had like 3 weeks to get all their stuff out of their other house.

[00:26:25]So, I was made promises that there would be no late payments, that there would be nothing illegal ever going on, that everything would be fine. We came to an agreement. They signed the lease, everything else, and I let them in. They wanted it to be as of I wanted it to be as as of May 1st, but I had given them an extra week to go in and paint and get it ready to go. After the first month, they were starting to fall behind already. Within the second month, that's when I had heard the story and was told the story that she was found in the garage and needed to be taken to the hospital. At that time, I spoke to Stephen and agreed to let them stay there if she did 30 days of inpatient treatment. And then they had went for a couple weeks and never answered the phone. Uh when I did finally get in touch with them again, then I had found out that she had checked herself out after only 4 days. Um >> checked myself out of what?

She went ahead and kept that uh and then proceeded to put a restraining order against him so that you know to make him seem like he >> took his money and then put a restraining order. How do you feel about Yeah. Objection. Once again, there was a restraining order put up because that is what he accused me of. But even after the police looked into it, they found it all to be completely false. It never happened.

They were skipping out of school together and her son was punching holes in the walls along with her. We if you'd like to see the letter from the neighbor.

[00:41:12]>> No, never. My son did not smoke weed in the house. His friends did not smoke.

[00:41:16]>> And also our upstairs tenant said that she that's all what she could smell was pot. The kids were running up and down the stairs all the time. She didn't want to say anything because she had to live in the same property.

[00:46:50]Defendant Travis Farmer says David often traveled to third world countries to find people who didn't speak English, so he could treat them like his personal slaves. Travis insists David couldn't even decide what repairs he wanted, and he's counter suing for wages [music] and property payments.

These are friends that I've known in Mexico that I'm going back to see. I'm going down there on vac. I went basically what it boils down to free.

It went from windows and siding to doing drain tile around the exterior perimeter of the basement. One second, sir. Did you ever request that he do windows and tile?

[00:50:40]>> All right, sir. I would assume that he wanted me to do it, too, because that's the reason you said you had him there is for the upkeep of the house. So if you pointed things out and said something's wrong with the drain, something's wrong with the window. I would expect that that's what he wanted me to fix. Go ahead.

And he he's too cheap to spend any money on his house. Unless it's, you know, unless he's traveling off to to find some internet prostitute. He don't want to spend no money.

They finance you to get the stuff. Okay. I was I was financing it. Well, he called up get it now and told him that I had legally been evicted and that he was throwing my property out in the street. So, they had no choice. And I do have a statement from them here stating that he did. So, um he has >> He threw your things out in the street.

[00:55:56]No, he didn't throw him out in the street. He called the place and told them that he was going to throw them out in the street and they needed to come and get it. So therefore, I my my belongings were repossessed.
