I saw it and I wanted to wait until I saw more information come about it because I didn't want to just, you know, knee-jerk react. But there is this North Carolina police officer and it looks like he has been reprimanded.
We're going to see all of the things that have transpired, why he's been uh reprimanded, and um yeah, let's see everything that has transpired because this as a concealed pistol license instructor, like y'all hear me say all the time, conflict avoidance is your most logical and prudent course of action. That goes even double for a person that's in the position of power.
Let's see what we learn today, people.
>> Turning to some new fallout tonight after a former Shelby police officer was caught on camera assaulting a woman.
Tonight, we've learned he's been fired and is now facing criminal charges.
>> Yeah. The State Bureau of Investigation charged 22-year-old Carson Haidider with assault, inflicting serious injury. He turned himself in just this morning and walked out on a $10,000 bond. But now, there are some strong words from the community.
>> That's right. Miles Harris is joining us live from Shelby after hearing from folks there. So, Miles, what is the reaction like tonight?
>> Well, Colin, Vanessa, beyond the legal consequences, this video really shook this community deeply. And >> hold on before I even let this continue.
Shout out to Bro, man. Hey, man. I I remember him. If you haven't seen him, his he went viral when his mom pulled up on him while he was doing this and she was like uh just pulled up on him. You know how like a mama would do and she just saying hi and stuff and he like say hey to D'Angela. Hey Dangela. I remember that man. I hope she doing well man. I know he love his mama just like I love mama. So just wanted to bring that out. Shout out to bro man. I remember you.
>> Now, a local pastor is speaking out and really raising questions about the training uh behind law enforcement here.
Now, that conversation really intensified after the video circulated widely online showing a little in the video. Former Shelby officer Carson Haidider seen grabbing the woman Sharia Moore, forcing her to the ground in what many viewers described as an unprovoked and excessive attack. Now, it spread quickly across social media, prompting the Shelby police chief and the Cleveland County District Attorney to request a full SBI investigation. Oh, >> now many in this community say what they saw on that screen raised serious questions not just about one officer but about how officers are trained in the first place.
>> Thanks.
>> There was no protection for her.
>> Yeah. And and so when you look at that video um you you have to wonder what what could have caused anybody to have that much rage because nothing in the video indicated she had a weapon.
>> Nothing indicated that she attacked him first. Um, the video rep says that she he threw her in the into some trash cans or something by the noise and began to pumme her with his fist.
>> Wow.
>> Now, Colin, Vanessa, we do want to note to you and make it aware that we can confirm that the two charges against Moore, they have been dropped, but she is still charged with breaking or entering. As far what is next, what what is next for Haidider, he is scheduled to be back here in court as early as tomorrow, which we of course will be updated here for you and keep you updated with any of those new developments as they do come in. But for now, reporting live out here in Shelby, I'm Miles Harris, WCNC Charlotte.
>> Yeah, certainly. So, a lot has changed since we brought this to you just last week. Miles, appreciate the update from Shelby.
>> Shout out to Miles, man. But dang, dog.
You had to punch her that many times, man. Hold on. Let's see if there's any additional information. We want to see if there's some more stuff cuz like they stated, he's facing criminal charges and he should be uh coming up in court very soon if he if he hasn't already. So, let's see if there's been any updates on that since then. All right. So, I was able to find some additional information from Southern Draw Law and I think that he will be able cuz if I'm not mistaken, he is an attorney. Like, so with that in mind, shout out to Southern Draw Law. I wanted to make sure I definitely give him his credit. But I wanted to react to some of his sentiments. I haven't seen too much. I just got like a quick like 20 second uh snippet. So, I just wanted to see if I agree with some of the things that he's going to position and then kind of go from there. But, um, yeah, I want to I want to get you all's take on this as well. So, let's go ahead. ified. But I would say that after the first strike, that's the line of demarcation between what I think they will ultimately say is me not necessarily the way to handle it, but not excessive like criminal excessive and then around the 13-second mark where you see the other officer come in, he is actually dragging her away and he says multiple times, like three or four times, I got her. Stop. He even says the kid's name, Carson. You can hear all of that in the body cam. And so these last four blows that are while the other police officer is actively trying to pull her away and protect her from the punches and then ultimately reaches out and pushes him. It's not until the senior officer pushes him that we actually see former officer Hider here realize that he's completely lost his temper.
>> And I'm I'm more upset about this senior officer letting him do this for that long. You a brother. Like bro, why one?
you a black man, but two, why are you letting as a man him just without consequence with no ability to protect herself? Nothing. He's just whailing on her and you letting him do it unc like unconsciously just just undisturbed un like bro what? You let him go that long from the time where he was right here all the way up until he's over here and you wait that long it take 13 to 15 seconds before you intervene. Seriously, bro. He needs to be reprimanded as well, but fired but demoted. He needs to be demoted. Cuz if you're in this position and you don't recognize the the Oh my god, bro. You so weak. That's just weak.
I'm sorry. That's that that is very weak.
>> And it's obvious then that this is a problem. And they still I will say this is a small lady. She's like 5'4, I think, 120 pounds. I wouldn't say that she was fighting. I based on how she acts when she gets up. I believe what we have here is a person who is experiencing some mental health situation because it reminds me of the Sonia Massie case. Um you can kind of tell by some of the things it's not like like a person that's with it. This is just me, my experience, my opinion. A person that's with it would not be saying the things that she's saying after she's been punched in the face 10 times. She's still sort of out of it and trying to explain. I don't have a warrant. I don't Excuse me, sir. I don't like she's being way more polite than a person who it sort of registers just got their brakes beat off by the police.
Like she's not she's not like even I don't even think that her body is able to process the trauma that she's just experienced. So So let's just play that last clip when she first gets up again and you'll see what I'm talking about.
There's a real mismatch in what I would sort of assign to a an appropriate response by somebody who just had this happen to them and what this lady is doing. And so let's just kind of watch this for a second. This is what I mean.
>> I don't have a warrant. Excuse me, SIR.
>> NO. WOW. Excuse me.
>> No. Excuse me, sir. Like, >> put your hands on your back.
>> Put your hands behind your back.
>> Definitely.
>> So, now to the part that everybody wants to know, which is what is this guy going to be charged with? Because I do not think there's a world where they can't charge this guy criminally. And the reason I say that is the district attorney's office has already come out.
The police department immediately came out. The police department fired him within 24 hours after all of the initial investigation part was done by their guys. and the local sheriff's department has come out and distanced themselves because they're getting calls from the community. They're saying, "Wait, we're not involved in this in any way. None of these people were our people. Don't call us." Okay? So, there's a big effort to separate from this incident. And so, I do think that they are going to charge him criminally, >> but we don't have enough information to know whether this is going to qualify as a felony. And the reason I say that is because North Carolina has a kind of a weird assault structure. And so, the statutes are kind of murky on this. But let me pull up the North Carolina codes in question. They come from chapter 14 and we're going to look in the 30s here for the assault statutes and walk through them. And I'll explain what I mean by this. The two assault statutes are going to fall under 14-32 and 14-33.
Um 1432 covers assaults. And I just want to say it it I don't know I don't know what this lady's mental health classification is. if it ultimately becomes a scenario where they can classify her as a person with a disability, which may also, by the way, be the reason that they drop the charges because breaking and entering generally has a specific intent component where you have to prove that the person intended to do certain things and that they were breaking and entering in order to do that. So like her mental health situation may be such that they had difficulty proving that she was in the present state of mind to where she could form specific intent and that might be the reason that they dropped it. that also might be an opportunity for them to parlay that into an assault on a person with a disability depending on what the SBI investigation ultimately reveals. So if we look at the statute on the individuals with disability, we can see that a physical or mental disability such as decreased use of arms or legs, blindness, deafness, intellectual disability or mental illness. She may depending on her mental status qualify for that. Yep.
>> And then under subsection E here, it says any person who commits any aggravated assault or assault and battery on an individual with a disability is guilty of a class Felony.
A person committing an aggravated assault or assault and battery upon an individual with a disability. In the course of the assault or assault and battery, that person does any of the following, uses a deadly weapon or other means of force likely to inflict serious injury or serious damage to an individual with disability. So, I do think that you have serious injury here if we can classify this lady as a person with a disability, but I don't know.
That's what ultimately will be revealed in the SBI investigation. But assuming for a second that we don't have that, assuming for the second that they will not categorize her as a person with a disability, then you've just got your regular assault standards. And that's where it really gets confusing because they conflate serious injury and serious bodily injury and they don't mean the same thing. 32.4 assault inflicting serious bodily injury. If we look down here, we see that it's a class Felony, but serious bodily injury is defined as bodily injury that creates a substantial risk of death. So I don't think that we have that or that causes serious permanent disfigurement, coma, a permanent or protracted condition that causes extreme pain or permanent or protracted loss of impairment of the function of any bodily member or organ or that results in prolonged hospitalization. Well, we won't know that until the investigation either because we don't know whether, you know, if she had like a broken orbital bone and she's going to have migraines for the rest of her life, that might qualify as serious bodily injury under 14-32.4.
But if we don't have that, if we don't have medical diagnosis and medical information that documents that sort of injury that would qualify under the statute, then we're not looking at felony battery or assault at all, then we're moving on to 14-33, which is the misdemeanor statute. And this is where it gets confusing because if you look at subsection C down here, it talks about unless the conduct is covered under some provision of law providing greater punishment, any person who commits any assault, assault and battery or a frey is guilty of a class A1 misdemeanor if in the course of the assault, assault and battery or a freight he or she inflicts serious injury upon another person. But notice here how under subsection one it says inflicts serious injury upon another person. You might look at that and think, well, how is serious injury different than serious bodily injury that you mentioned in the last statute?
And that's where it's a little murky.
And I said it's murky because under 14-33 C1, the legislature doesn't go as far to define what serious injury means like it did in 32. And so the appellet courts have sort of said, "You'll know it when you see it." Whereas in 32.4, they specifically define serious bodily injury. There was a case called State versus Griffith where the court found serious bodily injury when you had a concussion, numerous lacerations, swallowing difficulties, constant headaches, that kind of thing. which is why I said if there's like a broken orbital or something like that that would cause some sort of chronic issue, this could ultimately be based on the medical diagnosis a felony case. So I think the way that I would interpret that is that any sort of visible injury that you can see like the black eye we see and the lip being busted and the blood loss and that kind of thing that would probably fall under serious injury, but unless it's attached to some long-term medical diagnosis, it might not rise to the level of felony serious bodily injury as classified under 32.
So, it will be interesting to see how ultimately the FBI defines through their investigation what the extent of the injury was and what this person's classification was as to whether or not the charges that I believe will ultimately be brought will be on some misdemeanor level or some felony level.

Shout out to Southern Draw Law. I appreciate him for that um that synopsis and you know a quick breakdown just to give us some information and let us know what what the possibilities of what he could be charged with are. And I got exactly what he meant by that like just for a serious injury, serious bodily injury. Um I understand like them having to define it and then the other ones is a little bit more just murky, a little bit more vague. So that way it doesn't have they usually don't want to have it as defined as serious bodily injury because it can be so broad. So it gives more of a broad discretion. So it that makes perfect sense. And then also too depending on if they are able to cooperate and find out if she's um if she has any mental illness because if she does have some mental illness, oh I'm telling you right now and which it looks like she does, it's about to be a wrap. Dude's going away like he's getting that good felony like good felony. But man, hey I appreciate a few things I do appreciate.
So, I want to make sure that we do account for these things. One, the police department got rid of him and after 24 hours from following their investigation. Shout out to that police department. A lot of times we see where they drag their feet. They don't hold people accountable or they try to shield them. They didn't do that. And then on top of that, all of the other ones that may be connected to that department, like let's say the sheriff's office or the prosecutor's office, stuff like that, they also came out and repudiated all of these things, too. they came out and um they gave their uh what is it the what's the correct term to use? They disavowed it. So they disavowed it and with that it makes it more it makes it it shows that they have more uh dignity and more appreciation for their community overall. Because if the community reached out to them and they like, "Hey man, this ain't got nothing to do with us. We got rid of." And then the other police department that actually has something to do with it like, "Hey, he gone." And then the DA like, "Oh yeah, he gone, but he ain't going nowhere. For real, for real. He in that jail. He going to jail." They like, "All right, we good. We good. We we we appreciate y'all." You know, the police, the the the pastors, all of them, they like, "Yeah, we we we appreciate that."
But this is how you build trust in the community. Stuff like this is how you build trust in the community because they will from that they will take that when they see that that the police departments will actually hold them accountable sometimes. Now, we ain't just going to give a blanket check on that. Like, all right, we ain't giving no blank check, but what we are going to say is that we're going to acknowledge the times where they do do the right thing. So, shout out to them for being able to do the right thing. Shout out to the community for applying that pressure. And shout out to uh Southern Draw Law for providing us the context of what could potentially happen and what he could potentially be charged with.
And um yeah, man. This is it's sad. It's definitely sad. But I appreciate everybody that was tapping in and tuning in to this video. This is it's unfortunate, man. This is unfortunate, but this is this is the reality. This is why I try to tell people conflict avoidance is your most logical and prudent course of action. I think the officer would have would have still had his job if he would have listened to reason. if we would have taken that principle and and implement it.
