But, he could have clipped their ends. He didn't have to cut all their hair off. He could have even added extensions. Like, the hairstyle is not It's just not appropriate for a beauty pageant.

[00:06:52]Like, my feelings were so hurt and I really wanted to cry because there was so much preparation getting ready for this pageant. They were so super excited. They were happy about their hair, but I just knew that putting them in the competition like that would literally have them standing out for >> You just answered my next question. How did they feel?

[00:07:10]>> They liked it, but I just knew that it it wouldn't [clears throat] allow them to stand out in the proper way for the show.

[00:07:17]>> Okay, I'm going to stop you right there, girl. At the end of the day, your kids like the haircut, and honestly, that's all that matters. And again, they could have still done the pageant. you were the one that decided against it because you had your own opinion about the haircut. For someone that says that there was a lot of preparation that went into this, it's kind of wild to me that you would approach a hair stylist and say, "Be creative, have fun, and not have a plan at all." So, at the end of the day, it's on you, girl.

[00:07:45]>> Like, for the for the >> the pageant, I really wanted them to be able to win and to have a good time. And it's like what's what what is that's not even the same little girls anymore.

[00:07:56]>> Well, you know what would really not help them win. Not entering the pageant at all.

[00:08:02]>> But okay, let me ask you this. You know what? Before I do address that, I will let you respond. Mr. Ellington, go ahead.

[00:08:10]>> When I when she dropped off the girls, they were in distraught. The hair was damaged and I had to work a miracle.

[00:08:21]So, what you're saying is you had to cut all that off to just get their hair to grow back, right?

[00:08:28]>> I had to [laughter] cut it as it was.

[00:08:31]>> This is reminding me of the time my son CJ when he was like five. He going to be mad I'm telling this story, but he was playing with his little friend and they were having fun and the friend had a low cut hair and my son wore a big big curly fro and they decided they wanted to be twins. Oh no.

[00:08:51]>> And so the little boy cut a whole patch out of his [laughter] head and and we had to go wear a mohawk. He had to wear a mohawk for like a whole year and cut all the sides down and wear a mohawk which is so funny cuz I just posted the picture the other day and I saw I was like this is so funny. This is when he got his hair cut off. Um, so I do understand when things happen and you got to work a miracle because whether a mohawk was in style or not, he was wearing one. Um, but I'm trying to understand how damaged this hair would be that you would have to cut this much off. Mr. Ellington, did you take pictures of the damaged hair where you could maybe show the mother, hey, listen, this was all in knots. This was This was Yeah.

[00:09:44]>> No. So when you got there and you didn't love the hair, but they felt cute, which is important, right?

[00:09:51]>> Yes.

[00:09:52]>> When you didn't like it, then what was the conversation? I I'm not paying you or either I paid you for this. I want my money back or what happened?

[00:10:04]>> I asked him for my money back. So I paid him when I dropped the girls off.

[00:10:08]>> How much was the service? It was $200. A hundred a piece.

[00:10:11]>> You paid him in advance?

[00:10:12]>> Yes. I paid him when I dropped him off >> because we have such a great rapport. I felt comfortable in doing it. I left to go get some things together for the pageant because the pageant was the very next day. So, I left to get things together and make sure we would be good to go once they came back from getting their hair done. So, he was already paid. I asked him for the money back. He said no because he didn't see anything wrong with the work. I let him know like their hair was not that damaged. You cut off their hair. you shave their heads and you didn't even like make sure that that was okay with me. I didn't ask for that. And then they were going to be in a pageant. If you knew that the hair was that bad, maybe after you cut it, trimmed the end, you couldn't add extensions, do curls, or anything like that. You had to >> That's what I was about to say. In today's day and age, nothing has to be permanent. It does.

[00:10:57]>> I mean, for one day, couldn't you have added a track or two or or 10?

[00:11:04]>> I I don't do basic ponytails or braids.

[00:11:07]>> It didn't happen. knew what she was getting into.

[00:11:10]>> I've styled her for 5 years.

[00:11:12]>> Yes.

He shaved off the back. So, at that point, I didn't even feel conf and he was also busy. He was booked. He told me he wasn't even available. That was the all the time that he had and that was it. There was nothing else for me to do.

[00:12:09]>> All right. And so you're suing him today for $5,400. Can you outline all of these expenses? This is the $3,700 we see right here.

[00:12:17]>> Yes. I have it all right here in my evidence. And then there I even missed out on an extra what? $20,000 because had they won the pageant that was 10 a piece.

[00:12:26]>> So you should have entered period. The defendant's right. That's what I've been saying this entire time. You still could have put them in the pageant. At the end of the day, what's really going to go against her is she said, "Have creative freedom." And she said it multiple times in her testimony. So, I have a feeling this is not gonna go her way.

[00:12:46]>> No, because the hair was terrible. They wouldn't have been one. It would have been good. That's not good work. I don't know what you're talking about. And that's not good work.

[00:13:28]Once a mother comes in, and this is a long-standing client, she's paid you in advance and says, "Wow, I don't like that." Even though you're booked up, >> you know, they have the pageant. Did you say, "Hey, give me a minute. I can try to figure something out."

[00:13:45]>> No. This is the creative vision that I was going for. And she wanted winners. Did it ever dawn on you because you knew how drastic this was going to be to call her, confirm or send her a picture of someone else wearing a similar style to go, "What do you think about this?"

[00:14:08]>> No. Cuz whenever I do her hair, it's always bold, innovative.

[00:14:13]Miss Williams, when you're suing for breach of contract and you're dealing with a situation where you feel like you paid somebody for a service you didn't get >> or they were unjustly enriched, we can only deal in the direct damages and what is foreseeable, right? The girls are beautiful. You may not have loved their hair for the pageant, but not entering them in the pageant, I think, was a little bit too far yourself. And the thing about it is you said you wanted them to feel confident and it sounded like they felt pretty. So why is it that you chose to take them out the pageant when they could have just stayed in even with their short hair? Or look, USE YOUR MAMA MAGIC POWERS. HONEY, I'D HAVE BEEN AT THAT BEAUTY SUPPLY. THE WAY I WOULD HAVE HOOKED THAT UP SO quick and had them ready for the pageant. Am I alone gallery?

[00:15:13]>> ALL THAT money spent, we not missing the pageant. And cute as they are, >> cut as buttons. I was worried that they would stand out for all the wrong reasons. And I didn't think that that hair even matched any of their looks or anything like that. And so I thought it would be best to not move forward because I thought that it would go wrong.

[00:15:36]>> Well, you thought wrong because I think it wouldn't have hurt them at all. At the end of the day, they are seven years old and it is a child's beauty pageant.

[00:15:48]Okay, you already paid for everything.

[00:15:50]They love the haircut. The kids were having fun and then you ripped that AWAY FROM THEM. HELL NO. [screaming] >> I'm glad the babies didn't care. I I'm one of those people, too. I'll cut my hair off in a minute and just grow it back is just hair. But they did have an obligation. They were in a pageant. And I think for that reason, you did owe the mother a a call, a question, something before you just delivered the children with this hairstyle. Once she didn't like it and didn't feel comfortable, even though the children felt pretty, she's the mother that's entering them into the pageant. She has a better understanding about what pageantss are looking for. And at that point, it doesn't seem like you even attempted to cure to mitigate the damage to somehow make this fiveyearlong client happy.

[00:16:42]It's almost like, oh well, I've served you for 5 years. You don't like the hairstyle. I don't know what to tell you. In that way, this court feels like you were not acting in good faith.

[00:16:54]And for that reason, judgment for the plaintiff, not for $5,400 because they could have gone to the pageant, but for the $200 you paid him for a hairstyle that was way [music] out of bounds. Judgment for the plaintiff for $200. Court is ajourned. All right.
