When protests escalate into civil unrest, governments must balance the constitutional right to peaceful protest with public safety measures such as curfews and law enforcement interventions, as demonstrated by the Delaney Hall standoff where Governor Sherrill implemented a curfew while emphasizing that protesters have both a right and a duty to protest peacefully.

Delaney Hall protests escalate for 2nd straight nightAdded:
The Delaney Hall standoff is escalating.
Tear gas, rubber bullets, and a nightly curfew is now in place.
>> And Governor Murphy is Gerald is warning outside agitators to stay home. Noel Lilly joins us live from Newark outside the immigration detention center with the latest details. Noel.
>> Yes, the city of Newark's mayor announced that curfew would be in place for the half-mile area surrounding Delaney Hall from 9:00 p.m. until 6:00 a.m. And that's until further notice.
So, we don't know how long that curfew will be in place. But again, you can see here this is why the area on the Raymond's Avenue outside of that Delaney Hall federal detention facility is blocked off and is creating some confusion for drivers. You can see this trucker here speaking with police. I believe they are going to let him through. They're really only letting 18-wheelers through this area. So, it is closed to pedestrian traffic if you're someone who needs to come through here.
Now, we want to get to some video of where this all began. You can see video from last night. Police were seen shooting rounds of tear gas into the crowd and protesters pushed down barricades. Now, to be clear, these protests have been going on all week. It started off with protesters pushing back against ICE agents as we saw supporters of ICE and anti-ICE protesters. However, eventually the New Jersey State Police were brought in. The New Jersey State Attorney General addressed and said that state police were directed to do minimal hand-to-hand interactions. But some protesters showed us photos of injuries they say came from rubber bullets. Both pro- and anti-ICE groups were seen and eventually officers with riot gear moved in.
Delaney Hall reopened as a federal detention center in 2025, so just last year. Earlier this month, family members of people detained here by ICE called for the release of their loved ones.
They said they're enduring poor living conditions like live worms in their food and overcrowding in the facility. The Department of Homeland Security, however, has disputed these claims. New Jersey Governor Sherrill spoke and said she would not give ICE a pretext to expand their operations at Delaney Hall or across the state, but also called for protesters to comply with lawful orders from law enforcement.
>> Here in America, you have a right to protest and a duty to do so peacefully.
The work doesn't stop here. I'm going to keep working with our federal delegation to demand answers. I'm going to keep using every tool at my disposal to get full access to Delaney Hall. And I'm going to keep working for better conditions inside of this facility until it's closed for good. So today I'm calling on the Department of Homeland Security to do the following. Restore visitation for families. Provide appropriate care and medical for all detainees, especially the most vulnerable. Give detainees a meaningful chance to review their cases. Stop pressuring them into signing deportation documents.
>> Now, as for last night's protest, the governor also released a statement writing in part, quote, "I do not know why these individuals attacked or what they wanted to accomplish, but I refuse to let these dangerous actions detract from New Jersey's dedication to ensuring public safety, keeping people safe from ICE, and that the people detained inside Delaney Hall are treated with dignity."
Now, back here outside of Delaney Hall, you can see again some folks being led through, but others being turned away here. Again, Doremus Avenue is closed to pedestrian traffic, so you can see state police communicating with drivers trying to let them know what's going on for folks maybe who have not been following this story. We'll continue to keep you posted on it all because things may be quiet now, but we'll have to wait and see if protesters return. And of course with that curfew in place, we'll have to see how that all pans out. We do also know that the New Jersey governor has said that many of the arrests were from people that came from outside of New Jersey. For now in Newark, Noel Lilly, CBS News New York.
>> All right, Noel. Thanks very much.
