[music] [music] Now, ladies and gentlemen, the United States of America read by the President Donald Trump has been making headway in relation to many things.
There are different reasons which are making the US make headwinds. Today there is something that happened with Kenyans who possess an American passport.
What is it that happened? So there there are two stories in this video which I want us to talk about. The first story is about the US government issues notice affecting.
So it's a it's a it's a big bro. So it's affecting Kenyans with American passport. And the second story is a bit different but also it involves the United States. Now this is about a US company that has revealed next action which is going to take and this is after rising cash 468 billion Nairobi Mombasa expressway suit. So there's a case that has been going on in regards to Nairobi Mombasa highway and one of the US companies was involved and unfortunately the company has lost this uh suit and I want to tell you more details of how an American company has found itself uh in legal matters in relation to the Nairobi Mombasa Expressway.

With that said, let me now put that picture on your screen so that you can see. And as you can see there, US government issues notice affecting Kenyans with American passports.
So this thing does not affect everyone.
We I want us to focus with Kenyans who have the American passports. This means this person has two identities. The first one is the person is a Kenyan. he he he is a Kenyan citizen or she but at the same time maybe the person has gone and stayed in the United States for a good while and has met the requirements to become a US citizen and ended up even getting a passport. So the person has maybe two passports a Kenyan passport and a US passport is a Kenyan citizen and at the same time a US citizen. US government announces passport revocation for individuals with huge child support debt.
This is a huge brew to a lot of people.
For you to be able to have moved from Kenya, went to the United States and became a citizen of the states, it means you have stayed there for quite a while. And when this happens obviously you must have already gotten kids or you moved there with children and when anyone who has children there's something which they usually get which is child support. Obviously not all of them but there are people who apply for this child support.
Now, the United States government has warned that individuals with US passports could face revocations if they owe huge child support debts in a move that could also affect some Kenyans living in America.
Most foreigners whenever they move to the United States and you have kids or you end up getting a child there, they end up usually taking this loan of child support. Most people think it's free but according to details you can see it's a loan and you have to pay it at at some point. Yes, it's it's to support you while raising your child but it's a dept and then at some point you'll have to repay it. Now the US government is it's saying like it's like people are taking advantage of this uh uh of this uh what can I call it of this uh system.
Yeah. The fact that it has been put in a way that they support you. So there are people who are taking advantage of it and these people they no longer fit to be US citizens. That's why they are saying if you are one of the people who owe huge amounts of debt in relation to child support we won't consider you as a worthy citizen and so we will have to configu your passport we will revoke your passport this means you will lose your citizenship basically the US department of state on Friday May 8 said it was working alongside the department of health and human services to enforce child support obligations through passport restrictions.
This is what they said and I quote in coordination with the US Department of Health and Human Services. The Department of State will revoke US passports of those who owe significant child support debts.
According to President Donald Trump's administration, Americans with large unpaid child support areas risks having their passports revoked unless they arrange payment with the relevant state child support enforcement agencies. So if you owe huge amounts of debt, you are supposed to start repaying immediately. go to the to your state's child support enforcement agency and come into an agreement of how you're going to pay this debt and if not you're going to end up losing your citizenship and this is only affecting foreigners for the original US citizens I don't think this is something that affects them because they can't lose their citizenship and they were born there they have stayed there so the announcement means Kenyans who hold American citizenship or duo Kenya US citizenship could be impacted if they fall under the affected category.
Those currently outside the United States when their passports are revoked would only qualify for a limited validity travel document allowing direct return to the US. So this means let's say you are out of the United States you had come Kenya to visit and then while you are on your visit in Kenya the US passes or declares that from this amount this person has a lot of debt.
If it happens when you out of the country, your passport will get revoked immediately and while trying to go back, you can only go there with a different type of visa which is not the normal one you had been used to.
You know, earlier on, let's say you are traveling as a citizen right now, you'd be forced to go in as a visitor.
And for the people who still will be in the United States, you are not safe because when it gets revoked, it means now you are living there not as a US citizen. Your days are numbered.
[snorts] According to the US government, the policy targets individuals with what what it describes as significant unpaid child support debt. So I want you to listen to this very carefully. the amount of money which they say this is too much for you to have child support.
So it's into Kenya ceilings 322,000 which is basically according to the details I can see here to be eligible for a US passport you must pay any out outstanding child support if you owe more than $2,500.
Federal regulations do not allow us to issue you a US passport. So if you owe loans in child support over 2,500 then you are in the risk of your passport getting revoked any time from now. So you should make arrangements on how to reduce your amount of loan and how to repay it eventually uh paying all of it and this for you to be safer and not to lose your citizenship. The US government has for years denied new passport applications for such individuals, but the latest notice reveals a renewed push targeting non-compliant parents. It is worth noting that the warning notice does not affect ordinary Kenyan passport holders who only possesses Kenyan citizenship but have plans to travel to the US. So this only affects people who have both citizenship the US or either US and Kenya. But for Kenyans who are there but they are not yet US citizens.
They don't have this passport and everything they are still very safe.
There's nothing to be worried about.
The US government advised affected individuals to contact state child support enforcement agencies immediately and arrange payment plans to avoid travel disruptions or passport cancellation. So if you know you fall under the category of owing more than 2,500, you should contact your state's child support agency to make arrangements on how you are going to repay your loan. So this is what they said. Contact the state where your debt is owed for options to repay. After you have paid the state, you will be eligible for a new US passport. Uh the US Department of State directed. So what's going to happen basically is first of all when they decide to say now let us roll out this thing. I'm not sure if it has already been rolled out or it's going to be rolled out at a particular date. But if it happens or if it has already happened, what you're supposed to do is contact your state uh child support agency, arrange on how you're going to repay the loan and whenever you are done repaying the loan, if you do it on time, you will have the chance to reapply for a US passport and you are going to get it.
So that's the first part of the video I wanted you to hear about. I wanted you to get a heads up and be prepared whenever it happens. And if you're not there and you know someone is there and has child children and is a US citizen, this is something that I believe can be very helpful to them. Now apart from that first story there's another second story I want us to go through and this one is not going to take much time and it's about how a US company uh revealed next action next action after losing cash 468 billion Nairobi Mombasa expressway suit now how did this happen there's a cap company called Everstrong capital now Everstrong capital is going to appeal a lun And this after it roasted cash 468 billion. This is a lot of money.
Incredible amount almost half a trillion.
And this is in relation to Nairobi Mombasa expressway suit. The United States infrastructure company Everrong Capital now says it is considering moving to the high court after losing a petition linked to the proposed cash for 68 billion Nairobi Expressway. Nairobi Mombasa expressway project. [snorts] This is after the public private partnership a PPP petitions committee declined to uphold its petition challen challenging the government's decision to cancel its proposal for the expressway construction.
In a statement, the company said it is disappointed with the Lulin but expressed its commitment to working with the government and I'm to working with the government to accomplish the multi-billion shillings infrastructural project. Now, these were the words, their words, and they quote, "We [snorts and clears throat] express our disappointment with the decision of the petitions committee declining to uphold a petition concerning the evaluation of the physibility report of the for the Usahi Nairobi Mombasa Expressway project." End of quote. the company said. Now they continued by revealing Everstrong is therefore evaluating all available legal avenues including a potential applications for review before the high court of Kenya. You know whenever a court rules out something that you did not you can go to the next upper court which which in this situation they have gone to the high court. Then after high court if they are not still satisfied they can go to court of appeal. If they are still not satisfied they can go to supreme court.
Now according to ever strong the ruling failed to address what is described as critical regal procedural and uh procedure procedural and investor related concerns surrounding the evaluation of the project physibility report. It went on to warn that continued uncertainty in the review of property financed infrastructure proposal could negatively affect investor confidence and increase the cost of securing long-term capital for national projects.
This is what they said and I quote, "We respect the institutional role of the committee but believe the decision reves significant questions of law procedure and investor treatment unanswered." The company said basically what they are trying to say but they using a lot of words is they did not feel that the case like the case addressed their concerns.
Yes, the court ruled in not in their favor, but they don't feel like any of their concerns were discussed or addressed appropriately.
The consortium included major infrastructure and consultancy companies from Kenya, Italy, Turkey, South Africa, Egypt, the Netherlands, Spain, and the US. Everstrong said the consortion consortium had already invested millions of dollars in technical studies, regal work, engineering, designs and financial planning following approvals and guidance from the Kenya National Highways Authority Kenha and the PP PPP unit. So whenever these people are given these tenders or they told to apply and uh you end up somehow feeling like you're going to win or you get the tender you start immediately on designing uh for example them they are saying they they already done technical studies legal work engineering designs regal work engineering designs and financial planning and this after they were already approved by Kenha. So now coming later to cancel the project already they have put a lot of money in it and they feel like this money should be compensated.
According to the proposal submitted by Kenha the project involved the construction of a 4 to six lane expressway connecting two of the country's largest cities built to international standards. So you know the current u expressway which is there it's just for a short distance. Now this expressway was supposed to move and connect Nairobi to Mombasa.
Everstrong argued that the expressway would significantly improve transport and logistics along one of East Africa's busiest trade corridors by reducing travel time lowering vehicle operation cost and improving road safety. Despite the regal set setbacks, Everstrong said it remains committed to engaging constructively with the Kenyan government and international investors to ensure the project is implemented. So these are developing a story. We're going to see how eventually it plays out if ever are going to finally get the tender to make go on with the project. if they're going to be thrown out completely and if they do will they be comp will they be compensated. Now they have said that they have said they going to go back to court. The court they going to go to how is it going to will it be in their favor? We are going to find out all those details in the coming days. But for the meantime, thank you very much for watching this video up to the end. I will be back with more updates.
