Citizens have the constitutional right to record law enforcement officers in public spaces, and officers cannot legally prevent this recording or use threats, intimidation, or physical force to stop it; this video demonstrates a real-world example where a deputy attempted to assault an auditor exercising this right, highlighting the importance of knowing and asserting your First Amendment rights when interacting with law enforcement.

Good girl. Disengage.
Driveway shame?
Little Yeah, am I detained? No, sir. Okay, I'll talk to you. Try to be. Well, one of your deputies just assaulted me while I was exercising my constitutional rights.
What happened? She pushed me.
Where were you? I was on the easement.
Okay.
What would you like us to do about it?
I mean, if I assaulted her, what would happen?
We all know that's not going to happen, right? I wouldn't say you did that.
>> Exac- Well, she assaulted me.
>> to do the right thing. Do you mind giving me your identification? For what?
So that I could document this. Charges?
You going to charge her? We've got to investigate it first.
>> All right.
Yeah, I'm not going to identify myself right now. I'll do a formal complaint.
Okay. Do you know how to do that? I do.
I think so. You want to walk me through it? Sure. You can go to any of our precincts to get a formal complaint.
>> Which one is she out of? Uh the third, but any anyone will take it.
>> Well, but I want to know where she's out of. Who is her direct supervisor? You? I am not. Okay. And what is your name? I'm Lieutenant Matthews. What do you have a badge number, Lieutenant Matthews? 20.
20? Okay.
Um, do you have a business card? I will get you one. Okay, I appreciate that.
Um, there's a vehicle coming, so I just don't want to Thank you. Um, I'm going to give you the same, you know, in return. You know what I mean? But what I don't She So, she came out of her vehicle. I I'll tell you exactly a verbal kind of complaint, but I'll do it the formal way as well. But I was standing on the easement, okay? There's no sidewalk, and that's usually 15 ft from the center line of the road, all right? And she came over and she said, "Can I talk to you, sir? Can I talk to you?" And I was walking away. And I said, "No." And she said, "Well, you're allowed to record, blah, blah, blah."
And I said, "Okay." So, then I turn around and I got her identification, her name and badge number. Okay? And then, um, she was telling me that I'm trespassed from the property, but the owners of the property never told me I wasn't allowed on the property. Not that I ever stepped foot on the property.
>> I'll just stay. Okay? And I told her she doesn't have the authority unless they tell me that I'm trespassed. And they said, "Well, they don't want you on the property." And I said, just like that.
Okay. Then she said, "Well, now you're being trespassed." I said, "Great."
She's like, "Give me your identification." I said, "No, I'm not going to give you an identification verbal trespass. Okay. Now, I'll be arrested if I go back on the property.
Okay? I don't know I I don't want to go on the property anyway. Can can I get you that card? Is there anything else I can get for you?
>> Uh, the CAD number for this call.
Please.
And if you go right on the back of it, uh, exactly what district she works out of.
And then I'll find her supervisor and go from there. Sure. Thank you. And where are you from? What district are you? I'm at Precinct 4. Precinct 4? Okay. Um, do you work alongside her? Or you No, you're in a different district. Okay.
Does she not have a direct supervisor on duty?
That you know of?
I don't know where he's at. Who was the other uh, there was a this >> Sergeant Gaul. What is it? G A U L T Gaul. Do you know his identification number? If you don't, it's fine.
>> it.
Okay.
Why didn't he come and speak to Is that Is that the direct supervisor? No.
H 2 6.
And we all know that they would never ever push charges on these deputies [music] for assaulting a citizen like that.
This video turns into absolute chaos after a First Amendment auditor starts filming outside a mosque in Florida. A few people instantly get triggered by the camera, and before long an off-duty deputy working security shows up with a serious [music] attitude problem.
Instead of handling things professionally, the deputy immediately starts barking orders, threatening trespass, cursing at the auditor, and escalating the situation over someone recording in public. The auditor keeps reminding them he's on public easement and protected by the First Amendment, while also throwing plenty of sarcasm back their way. Now, honestly, the auditor was definitely pushing buttons and [music] making the situation more heated than it needed to be. But being loud, annoying, or disrespectful is not a crime. The bigger issue here is how quickly the deputy lost control over a guy holding a camera. Things finally calm down once a supervisor arrives and actually talks like a normal human being.
And honestly, that's what makes the earlier behavior look even worse.
If the supervisor could handle it calmly in 2 minutes, there was never any reason for the screaming match and threats [music] in the first place.
Yeah, they get concerned um with uh uh long-range video and whatnot, you know, due to uh terrorist issues and whatnot, you know, going on in the United States um Department of Homeland Security and uh training behind that.
So, is everything okay today, sir?
Everything okay?
Cuz this is private property. If you want to If you want to record, then you So, right right here, like if you come up the property there's signage and it says basically uh there's no commercial or private. Now, what I'm noticing is that you're not talking to me at all.
And I'm hoping like we can have a dialogue. Do you think we can do that, sir?
No? Okay. This is private property though.
>> Have a good day, sir. Thank you.
>> you want to record Watch your back.
Hey. Hey. Hey.
Okay. Stop walking so close to us, okay?
That's very inappropriate.
Yeah. Are we good then?
We're going to have our uh Who was the original person who called you guys?
Well, I don't Yes. They're calling about him right now. Oh. We we possibly could have been Got it.
I'm wondering if there's any other Make you make me make contact with the two of What are you doing?
So what's the word though?
So what's the word? I don't know. You're just acting weird and putting your phone in people's faces.
>> Don't matter. Don't matter. That doesn't matter.
>> Yeah, this is private property though.
How can it be private property? Cuz it belongs to the mall.
Well, where's the sidewalk though?
Should I walk Should I walk in the middle of the street?
Should I walk in the middle of the street?
Yo.
Right, so I need a sidewalk, right?
Hey, I can be on the sidewalk, can I?
Yeah, but you can't There you have it.
There you have it. That's it. That's the end of this conversation.
That's the end. You can You guys can go back. No, they they manage this part.
Okay, but this is a private This is a private sidewalk. I keep saying the same thing.
>> So I know but why why on earth would you be shoving your phone in people's faces?
That's just weird.
>> I I haven't done that nor do I have any responsibility to tell you whatever I do.
>> I know, but that's extremely >> If I'm not breaking the law If I'm not breaking the law If I'm disruptive. not breaking the law Okay, you are a jerk. No, I'm pretty sure you are.
>> in your heart, man.
No, I'm just reasonable.
>> me names. Because you're acting like a jerk.
>> tough, but you're not.
No, I'm just being straight up with you.
I have not receiving insult from any of these officers but you, so you're the jerk. I'm just calling it back.
>> jerk.
You're the jerk.
People can say whatever they want, but it doesn't mean it's true. Well, this guy is calling me names. No, I'm just stating the facts.
>> You're the jerk.
So the Okay. But But you see the difference? The way you're telling me you're not calling me names and he's calling me jerk.
>> No, but the difference is that's not that's not professional. That's that's your feeling. That's not That's not professional. If you're if you're upset about that, then stop acting like one and stop acting like a jerk.
>> going to tell me what to do.
Well In in life you know what I mean.
>> in charge of this property, the property that we're standing on right now, they ask you to leave. This This is the >> Yes, this is their property. That's why they have the tables and everything there. So you want control of this. You want me to walk over there? Where's the easement?
There's no easement here.
>> to you got to talk to security >> of Glendale doesn't doesn't care about easement? Hardly not.
Well, that's the problem with that.
That's the problem with the city. But you got to have a You got to have a sidewalk. That's >> the only one who has a problem is you.
I'm not talking about I'm not talking to you. I'm talking to him. So if you get told to leave >> Are you the Are you the sergeant by the way? No, he's not. Okay, so let me just You're just a guy. If you get told to leave, what are you going to do?
I want to have the right to remain on the easement. You want to have the right, but you may not have that right.
So what are you going How can I How can I be If you get told that you do not have the right to be here because it's their private property and they tell you to leave, what are you going to do?
Uh this is not private property, man.
You got to have a easement.
With what? Easement. Easement. Easement area where you can rest your ass.
>> that? Where does it say that?
Most in the 50 states you you need to have easement. Where does it say that for California for the city of Glendale?
Where does it say that?
>> Well, let's find out and you you're you're the law enforcement.
>> You're the one that's telling me there has to be a >> but you're the law enforcement. I'm I'm not enforcing any law.
>> I don't? I'm not I'm not enforcing any law. But if you don't know that there has to be easement >> You You guys are the ones that are supposed to know, not me. You're the one saying >> But this is easement. You got to have easement for people. Why?
Because it's a right everybody has.
>> Where?
In this area right here. Where does it say that there has to be right? Well, that's that's your that's your that's your responsibility.
>> me. What are you saying now?
>> law for California law, as long as you're not providing a danger to the public you're allowed to walk in the street. Oh, so you want me to walk on the street and and sit on sit over there on the street?
>> As long as you're not providing Is that what you want? cars around you or sleeping Is that where you want me to go and sit over there? As long as you're not coming in a dangerous manner, you're more than welcome to do that. Oh, and you're going to be okay with that?
>> is. That's how the law is. And I won't be I won't get ticketed if I sit in the middle of the street? It's legal. If you sit in the street you don't provide a danger to the cars around you, you're allowed to do that.
You can walk in the street. That's how the law is.
>> This is funny, guys. Well, what happened if I don't leave it right now? What's going to happen? Well, if you don't leave the property right now, you could potentially be arrested for trespassing.
That's how people that are in charge of the property I could potentially Yes, that's up to them.
You wait over here.
I'm talking to I'm going to listen to this. This is about me.
Yeah.
All right, guys.
What's happening?
We're leaving now?
I don't know what to Okay, let's Okay.
But not on the Americana.
>> it.
I I This is not the Americana.
This is the sidewalk.
You got it.
This one's wild, folks. We've got a First Amendment showdown right on the sidewalk outside the Caruso property.
The subject is just standing there recording, doing nothing illegal, and suddenly security and law enforcement swoop in claiming it's private [music] property and he can't film. Total confusion ensues. The officers and security struggle to explain what's private versus public easement, shout over each other, and drop [music] vague references to Homeland Security concerns, basically making things up as they go. [music] Meanwhile, the subject stays calm, pointing out he's on a public sidewalk, asking for clarification, and asserting his rights.
It's classic. Cops or security trying to bully someone on public property with zero legal basis, no clear citations, and inconsistent enforcement. Meanwhile, the subject is unfazed, filming everything, calling out the nonsense, >> [music] >> and showing just how ridiculous overreach looks in real life. Bottom line, you can't just tell someone to stop recording [music] on a public sidewalk. The subject had every right to be there, and these officers proved once again how confused and unprepared they are when it comes to civil rights. Pure audit content.
In this intense showdown, a citizen exercising their rights is met with hostility as officers attempt to assert control without legal justification.
Tensions rise when demands to step away escalate into baseless threats of detainment. And tell me, which officer do you think was the biggest tyrant?
Hey, you don't want to open my car right now.
It's not your car.
Take it easy, man. It's not your car.
It's my car.
>> No, it's not. Step away from my car.
Don't tell me what's in my car.
>> Get away from my car. Or what?
Get away from my car.
>> Or what? Who are you?
5072 Yep, you got everybody out here.
Get everybody out here.
You going to break or something? What are you doing? I have a subject here >> Oh, yeah.
Harassing you?
What the heck?
Harassing you?
>> [laughter] >> You're a funny girl. Yeah.
Okay.
Yeah, get a sergeant out here or lieutenant or whoever's the highest ranking guy out here.
Harassing you.
I'm on a public sidewalk harassing you.
You're the one stepped out all aggressive.
Get away from my car.
>> Yeah, get away from my car.
>> It's my car.
>> No, it's not.
>> Yeah, it is.
I pay for it. Get away from my car. What a funny girl.
There's nothing you can do.
Get away from my car.
Jokester.
You must be from another planet. Yeah, I think you are, too.
I am.
I'm from the planet of reality. You're right. You can You can step away from me. No, I I can step. I can I might be detained. What's that? Am I being detained?
>> No, but you're harassing me and you should probably stop. You can go.
Yeah, I can go.
>> Go. I'm not I'm not blocking you. Go.
Okay. You don't want to be harassed, as you say I'm harassing you. Go.
Go.
Have you heard of that thing called Oh, wait. Wait a minute. Wait. Wait. Wait.
Whoa. Hold on. Hold on. Yeah. Um when I became a US citizen, they taught me something about freedoms. Yeah. Yes, that's right. I remember those things.
Uh I remember the What is it? Uh first amendment?
What's that? Oh. Oh, you don't know? No, what did you say?
>> Oh, but you just say I'm harassing you.
You Do you know something about Let's see. It starts with a F R E E Well, you can Exactly. Exactly. You know what it is? I do I know exactly what it is.
Exactly what it is.
So, who are we waiting for?
Right.
So, we want to have a chat?
You want to have a chat?

You don't want to send any man?
Oh, there they come. Great.

Where's the sergeant?
Where's the sergeant? Who is he?
Officer or deputy, say.
Am I Am I detained? Am I detained?
Am I detained?
Am I detained? Yes or no? I'm not I'm asking you to step away. I'm not I'm not going to comply with your request. Am I detained? Am I detained?
That's right. Then if I'm not detained, I can stand wherever I want. Are we Are we done here?
From who? You're in my bubble, sir. In your bubble? You're funny.
>> [laughter] >> In your bubble.
Okay.
Bubbly bubbles.
>> [laughter] >> In your bubble.
Well, maybe I want to burst your bubble.
Out of my car, sir.
Step away from my car. That's my car.

Cuz you showed me attitude. Oh. Do you see how it works? You're going into my car with my personal >> you in public? Are you in public?
Are you in public? Are you in public?
No expectation of privacy.
I'm going to do exactly what I'm allowed to do. Freedom of speech. Get back in your car and get lost.
If we're done talking.
I don't have to. I'm not detained.
I'm not detained.
I'm free man. I'm free man. If I want to go, I'll go. If I want to stay, I'll stay. If I want to get in your face and educate you about my rights, I will.
Oh, you sure?
You want to try it? Some of your boys tried. Go inside there and ask for my name.
I just went in there and got public records. Okay? They tried.
Guess what happened?
Release. No charges.
No charges. The bastard who arrested me by one of your gangsters didn't even have a guts to put his name on a criminal citation.
Right.
Go inside and ask.
Go inside and ask. I'm not scared. Go.
You'll find out. Call your sheriff.
He'll tell you who I am. Tell him a short little guy with a Russian accent, okay? Who has the guts and the balls to stand up to any tyrant.
And then you'll know who I am.
I am not detained. I'm free to move around as I please. Especially tyrants like you who don't even have the respect to identify themselves. You're going to tell me to step away from your car when you're in public? Go behind the cage.
Okay?
Go behind the cage.
Exactly.
Get lost.
That's how it happens.
Tyrants come, tyrants go.
Piss off.
