Government subpoenas requesting personal information from election workers can face legal challenges based on statute of limitations, overbreadth, improper purpose, and First Amendment concerns, as demonstrated by Fulton County's motion to quash a DOJ subpoena for 2020 election worker information.

Fulton County STRIKES BACK Against Trump's DESPERATE Election PLOTHinzugefügt:
The Justice Department just subpoenaed the names, addresses, and contact information of thousands of Fulton County, Georgia election workers, poll workers, volunteers, even bus drivers for an election that happened 5 and a half years ago for which there's no evidence of wrongdoing. Certainly not by these people. Call it whatever you want to call it, but it really looks like what they're doing is making a list probably for purposes of intimidation.
We're going to talk about this and we're going to talk about the problems with doing things like this. We're also going to talk about why Trump is probably doing this. I'm Sean Kernikin. I'm joined by my law partner and co-host Brian Kabet on another installment of Civil Action on the Legal AF Network. If you're coming back to us and have watched this before, thanks for tuning in. >> Well, the grand jury in Fulton County, which is where Atlanta is located, which is the most populous county in Atlanta and the most left-leaning county in uh in Georgia, rather, um issued a subpoena asking for the names, addresses, personal telephone numbers, and other information for every single person who worked in that county on the 2020 election, including the volunteers.
These are the people that show up on the day of the election early in the morning, set up the polling booth, get the ballots, put them in their ballot boxes, the information for every single one of them. So, let's spend some time unpacking this in a couple different directions. First of all, Sean, let's talk about this whole grand jury issue, which is apparently a new tactic of the Justice Department and the Trump administration to blame the grand jury.
>> Yeah, that's true. This is a grand jury subpoena. So what they do is they they prepare their request for these things and they put it in front of a group of jurors and the threshold is very low and they say is it okay if we go ask for this stuff and then then and then those grand jurors say yes cuz they're explaining that the standard is very very very low. Um and you know the saying we've said it before and others have said it that you know a grand jury can indict a ham sandwich. Um that's because the standard is very low despite the fact that the Trump administration has even screwed that up a couple of times. But over here they did issue this subpoena and and the Trump the talking point of the MAGA world is that well the administration didn't ask for this stuff. The grand jury subpoenaed it. The grand jury is indicting so and so. The grand jury which which is exactly what Todd Blanch did on Sunday morning talk shows is he went on and he said, "We didn't indict um James Comey. The grand jury did." And believe me, I've done this for a long time. You get there's no judge in a grand jury room. There's no opposition. There's no defense lawyer.
There's nobody like that. They just get there and they say whatever they want and then the grand jury goes, "Oh, okay.
Okay.
>> Here it is. Okay.
>> Yeah, here it is. Where do we sign?
>> There is no evidence that anyone can present to a grand jury that there was election fraud in Fulton County." Okay.
>> Period. Yeah. There there there is none.
Um, and by the way, uh, this the the FBI already raided the, um, Georgia office where these the ballot materials will were kept earlier this year, I believe.
>> They have all the ballots, right?
>> They have that. Yeah, they have that. No word on what they found in there. I mean, look, spoiler alert, this is an intimidation tactic. That's why they're doing it. They're not necessarily doing it because there's anything there.
They're just doing it in order to be able to get their way to sort of modify how the midterms are. So, right, >> it's intimidation. It's intimidation, Sean. Like you said, that's the second point I wanted to bring up is one of the reasons they're doing this is they don't want uh they want they want people and they want people to be afraid about voting and they want them to be worried about it. And it's a whole part and parcel of a bigger scam that's going on here, which is to disenfranchise left-leaning voters.
>> Yeah. I mean, that that that's all it is. It's to justify whatever changes they're going to do or whatever weird crap they're planning on doing with the midterms with Trump's already talked about things and, you know, using troops, potentially calling off the election. He hasn't he hasn't ruled that out either. I mean, >> that's kind of terrifying stuff, but he hasn't ruled that out that >> women. Look, I'm not a conspiracy theorist, but you could definitely see Trump coming out and saying, "Oh, the war in Iraq in Iran is is is going, you know, in such a direction that we're very concerned about public safety, and we're not going to have people go to the polling booths on election day. So, you know, you're we're just going to have to postpone the election until the security is better." I mean, it's going to be patently illegal.
>> Oh, yeah. Yeah. Well, I want to talk about a couple of legal issues here. By the way, >> um, usually for most federal election crimes, the statute of limitations is 5 years. Not to say that there's any evidence of any sort of crime, but the statute of limitations is 5 years. We're at now like 5 and 1/2 years from when this election happened. So, and that's not just like a, you know, minor issue that that's potentially fatal to this investigation's entire basis.
>> Yeah. Unless unless he tries to use CO as a tolling of the statute of limitations, which would be ironic because he argued against tolling of the statute of limitations due to CO for his um New York state convictions.
>> That's right. Yeah, that's right. U that would be kind of ironic.
>> So that's that's one issue, the statute of limitations. What's the next issue, legal issue? Well, the next legal, I think, news on this is that Fulton County um has filed a motion to quash um and it ba basically attacks this subpoena as overroad, unduly burdensome, uh used for an improper purpose, privacy concerns. Um and and you know, I don't know which one of these to sort of start with and which which one of them is the most >> first amendment concerns because it involves voting and people working on voting.
>> Yeah. And and uh I mean I predict that there is going to be if he if a judge doesn't quash the entire subpoena, they'll quash most of it.
>> Oh yeah, it'll certainly get narrowed.
That's what I think would would happen here. And it often happens even in our world when you see a super over broad subpoena. It gets narrowed. And that's probably what's going to happen here.
And I and I think it's important, you know, let's not discount the first amendment component you talked about.
Let's not discount the privacy issues that that I mentioned because this is, you know, things that identify people and we've already seen some others involve election workers who've been targeted and harassed and their lives have been kind of turned upside down based on debunked claims. And we don't want we we don't want more of that to happen. Nor do we want people to be intimidated from voting.
>> So, let's let's go let's spend a little more time on this motion to quash.
Emotional squash, by the way, if we haven't adequately explained it before, is a process by which you you squash a subpoena. They call >> squash like a like a vegetable. I don't like squash. I don't like squash, zucchini, eggplant. I I don't know why.
>> Well, yeah.
>> Is that different? Is emotion of quash different? Yeah. Those weird words.
>> And it's it's not it's not a game that rich people play either.
>> Oh, that's funny. Yeah.
>> So, uh let's go back to Fulton County where this is all coming out of. Um Rudy Giuliani who is knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knock knocking on heaven's door right now and god bless him good luck to you Rudy I hope you know a guy who was America's mayor until he tied up with this guy um he was working as Trump's personal lawyer after the election and he went in front of a committee and he made all kinds of outlandish false claims which I think in part at least led to his disbarment as a lawyer uh and then he went after these two um pole workers a mother and daughter Ruby Freeman and her and her daughter Sheay Moss Okay. And claimed that they I I think the claim shot was that they pulled um dozens of fake ballots out of a suitcase. Right.
>> Yeah. And like ran it through the machines or something like that. Yeah.
>> The two of them did one of the most American things they possibly could do when they're accused of this kind of fraud. They filed a lawsuit.
>> Yeah.
>> And how did that turn out for for Rudy?
>> Uh not good. Not good for Rudy. Um but not well.
>> Yeah. Yeah. Not well, not good. It didn't go well for Rudy, much like the last few years have been for him. He's in the hospital now. Our best to Rudy Giuliani. But um yeah, these are the folks I was talking about, by the way, that by by him pedalling these types of lies and conspiracy theories, their their lives have been really harmed. You know, they they >> Well, they got $148 million judgment, which was ultimately settled, which I think after Rudy filed bankruptcy. So, what's interesting about that, Sean, is that, you know, I had a chance to to peek at the motion that the um that Fulton County filed. And in the motion, they talk about this incident with the mother daughter, and they say that Trump for years has, you know, um um gone through this this completely debunked theory about election fraud and keeps going over and over again. And what they said specifically is that Trump has obsessively propagated the debunk conspiracy theory that Fulton County stole the election from him. So he's blaming them and has made it clear that he seeks retribution against those who refused to indulge his basis claim. But then listen to this. But then the post, the Trump post that they quote in the motion goes on to say that Trump said that Ruby Freeman, that's the mother, should have to pay Rudy Rudy back reparations and called for her and top church officials to be prosecuted for the political crime of the century. So, the timeline is that I just want to I apologize for taking some time with this, but I think it's important people understand that these claims of Rudy Galani come out right after the election. You know, he testifies about them and then a couple years later, they get this giant judgment. So, we're like in 2023, they get this giant judgment against Rudy Giuliani. He files bankruptcy. So, that's all years ago. And in 2025, the president posts the statement that that these people should have to pay Rudy back for reparations and that she should be prosecuted along with um Georgia officials >> years after this has already been >> How wild is that? Can you believe that?
And people look at this and go, "This is entirely normal. This guy is, you know, mentally stable. He's totally fine." I mean, it's just so crazy. It's just so crazy. So, you know, th this is clearly, you know, part of the reason they want this stuff is this is what they want to use it for. They want to intimidate people and kind of keep pushing these theories. And by the way, there's an issue over whether whether the boxes of records should be returned and the government is resisting that. Um, we don't know yet if the FBI is going to be forced to return it, but but they've been resisting so far. Uh, you know, my suspicion, again, not to to uh hypothesize too much here or be a conspiracy theorist, but my my my gut tells me it's because they want to take it and say, "We found some awful things in here. Uh, we're not going to show it to you, but believe me, we know that there's fraud. You know, it's a typical Trump talking point, typical typical Trump tactic." So, you know, we'll see what happens here in the northern district of Georgia. Um, stay tuned and we'll cover it. And this is an interesting issue. Uh, I know it involves an election from a long time ago, but the motivation here is out of Trump's desperation for what he sees, you know, the freight train that's coming at him during the midterms. So stay tuned. We'll cover this. I'm Sean Kikin. That's Brian Kabet. This has been another installment of Civil Action on the Legal AF Network.
