Viewers, amid continuing uncertainty over government formation in Tamil Nadu, TVK chief Vijay is holding a crucial meeting with the party's elected MLAs.
Now party leaders have arrived at the TVK headquarters in Pyanur, Chennai where all MLAs elected were asked to report this morning. Now viewers, this meeting comes at a critical time with the party still short of the majority mark and negotiations for support continuing behind the scenes and Vijay is expected to hold detailed discussions with the newly elected legislators on the next course of action and the evolving political situation. Now the chief minister elect is also likely to brief MLAs on the latest developments surrounding government formation while urging the party to remain united during this crucial phase. Now viewers the gathering is being closely watched as speculation continues over the timing of the swearing in ceremony and the final numbers backing the TV government.
Now viewers I'm being joined by my colleague Toya Zakshi Shakhar. Now Toya what is the latest update and are we looking at the flow test?
Well, of course that is the only way ahead uh you know to do the formation of the government uh Sabya but aim the ongoing political developments in Tamil Nadu where security arrangements as the TV is uh were reportedly scaled down with the additional police request. So Vijay himself has opted out the security and the convoy which was given to him as uh uh uh you know and the high level security as he is not uh you know ready to uh prove the majority. So now that uh where he has stated that until he proves the majority and until the swearing ceremony he will not be uh uh needing the convoy. that is why he has opted it out as of now. Uh in another key development where VCK has deferred its high level committee meeting uh uh that was scheduled to take place tomorrow where sources also indicate that uh to take uh the meeting is now likely to be held the day after tomorrow after the CPI and CPM take a decision regarding the current political situation in the state. But now that Vijay had reportedly sought a permission of VCK's two MLAs as a part of effort to secure the numbers you know for the government formation.
Uh as per you see that uh uh now that Vijay who is having 113 seats and uh uh 11 more seats required uh to you know form the government. uh you see in fact as a fact now that Congress is uh fully supporting TVK uh you know to form the government with having five seats in their hand. Now meanwhile uh you know the TVK has maintained that it has it it has emerged as a single largest party in Tamil Nadu and asserted that it's pos it's uh necessary uh you know for to form the government. Now that party sources also stated that TVK is prepared to constitute the council of ministers with Vijay has chief minister and prove >> well viewers on the floor.

Uh sir, TVK has 108 seats and shot off the 118 majority. Congress though have offered suff uh support but uh Vijay has met the governor's taking claim and uh can you walk us through the current constitutional position in this regard?
The governor has a constitutional duty to ensure that a stable government is installed in the state and stable government means a government which has a stable majority.
Now creating a majority is the job of politicians, political parties to be exact and it is their duty to cobble together some kind of an alliance if no party has got a majority and that exercise perhaps is going on.
But in the meantime, as I understand that the TVK leader um approached the governor and showed him a list of 108 + 5 or something. Um then the governor has said that no um he should show him the list of 118 and that is the majority.
You know the point is as I said the governor has a duty to ensure that a stable government is formed in the government in the state.
Now it is true that the TVK is the single largest party but there are certain guidelines um in existence for the governor to act in this kind of a situation.
One is that the governor has to see whether there was a pre-poleled alliance. In case no party gets a majority then the governor has to see whether there is a pre-pole alliance which has majority in that case they can the governor can swear in the leader of the major group. Um and if that is not possible, if that is not there then then of course he can see whether there is a post pole alliance that mean after the election results are out some alliance is formed to to to create a majority.
So that kind of a situation perhaps is there in Tamil Nad now because as I understand the TVK has a support of five the Congress members and maybe uh some others that means there is a post poll alliance uh coming up. So now the governor has to see whether this post pole alliance has the requisite um uh majority that is the number of um 118 members supporting this this this government or this leader that of course has to be seen by the governor. Uh see the point is um of course there is a little controversy about the action of the governor in not accepting the claim of the TVK when he has not actually produced a majority or has shown a majority list. You know way back in 1998 when Adhari Waji went to see Kar Naran who was the president uh in that election you know Waj's NDA was the biggest block although they did not get majority in that election they were short of majority Waji went to K Narayan and staked a claim to form the government but Narayan said no you must show me the list of supporters and the number number of members each party each of your allies has and after that Mr. Vajay went back and then ultimately brought a list um of members who formed a majority and then he was sworn in and that became a trend setting decision of the president so same thing is perhaps being done by the governor of Tamil Nad Mr. Darla because he also wants to see whether TBK leader enjoys a majority support in the house and that of course is the constitutional duty of the governor.
>> So sir uh this is a standard process or do you feel there is certain discretion also involved in this?
Well, you know, in this uh in this in this process, the governor has a discretion, but that governor how he how will he use that discretion? He uses his discretion uh in favor of installing a stable government.
He cannot arbitrarily use that discretion. That is not allowed. So, he has to use the discretion with utmost responsibility. And as I already said, I have already said that a stable government has to be formed and that is his um that is his uh that is his responsibility and therefore uh he has to see whether the TV has the support of 118 members of the assembly. Sir uh if the governor invites Vijay to form the government, does Vijay need to uh prove the majority on the floor of the house immediately or can he take uh oath first and then face a trust vote within a reasonable time? Well, if the governor is satisfied that TVK leader can form a stable government, then he can swearing swear him in as chief minister and the other ministers and ask him to prove his majority and the governor can set the date um for the assembly to meet and then ask the governor ask the chief minister to prove his majority on the floor of the house.
What happens if the arrivals emerge?
Suppose I'm giving you example DMK plus uh a AIA, DMK or the others and does the governor have uh to explore all possibilities or does a single largest party get the first right?
>> No, no, as I explained in the beginning, you know, the governor has to see whether there is a postpole alliance.
there can be two alliances as perhaps it appears to be in the case in the in in Tamil. Um so two postpone alliances are being formed. In that case the governor has to weigh um these two alliances and see whether see which alliance can form a stable government.
