New Mexico lawmaker looks to address dynamic pricing at grocery stores

[00:00:00]Around the country, states are starting to crack down on so-called dynamic pricing in grocery stores. It's legislation that lawmakers tried to introduce here in New Mexico, but failed to pass last year. Who wants to go to the grocery store and have an experience like the stock market where things are just fluctuating hour to hour? Having cameras watching aisles, digital price tags, and using individual data to give you a price that it thinks that only you can pay or will pay actually creates a lot of chaos and instability at the grocery store.

[00:00:37]State Representative Sarah Silva introduced a bill in 2025 that looked to stop grocery stores from using algorithms to modify the price of food with digital price tags.

[00:00:48]This dynamic pricing model has come under scrutiny after companies were recently found charging online shoppers different prices for the same products.

[00:00:58]Last week a bill passed in Maryland making them the first state in the US to address the issue in grocery stores.

[00:01:05]I think it does include online shopping.

[00:01:07]So, if you're in like using Instacart and you have a different price there than you would if you walked into the store. I mean, that's important for seniors, for people with disabilities that just can't physically go into stores.

[00:01:19]And so, I really like that inclusion and I'll be looking at that language and how it compares to New Mexico. Can can we do something like that here?

[00:01:30]The new law in Maryland is expected to go into effect this fall.
