Public universities are open forums for debate protected by the First Amendment, which guarantees freedom of speech, religion, and peaceful assembly; law enforcement cannot arrest individuals for expressing religious beliefs in public spaces, even when complaints are filed, as such speech is constitutionally protected regardless of whether it offends others.

Out Of Control Officer Gets Humiliated For Not Knowing The First AmendmentAñadido:
Okay, come over to the car.
>> You're under arrest.
>> I am actually your under arrest. He's going to arrest me >> for what? Hate speech. First amendment.
Let's read the first amendment. But go ahead and arrest me then. Go ahead and arrest me for first amendment. See this man? He is out of control.
>> Yes. Yes. Go talk to other people because you are absolutely out of your realm. Public universities are meant to be open forums for debate, but sometimes campus police officers forget exactly how the Constitution works. A man is openly preaching his religious beliefs on a college sidewalk when an officer suddenly interrupts him based on a complaint from a passer by. Before asking any real questions, the officer immediately demands identification and threatens to arrest the preacher for causing a public disturbance. Notice how the citizen refuses to be bullied, pulling out his camera and boldly challenging the officer to actually make the arrest over legally protected speech. Well, Roman Catholics don't believe in the Bible alone. They they so they believe in >> No, not at all. Because we'd rather bother you so you don't go to hell and you're not going to be saved in Roman Catholicism.
Roman Catholicism has many things that it adds to the Bible and God is very explicit. Says that if you add anything to this word that you will have his curse.
Roman Catholicism does not believe in the Bible alone. It believes in tradition. It believes in the priests are mediators. Mary's a mediator. But the Bible says we have only one mediator. Well, Roman Catholic >> out about Jesus. So why be a Catholic then? which is counterfeit. Why is he a fake Christian >> fussing us out?
>> Yeah. Well, a Christian, it's out of the it's out of the heart that comes all manners of wickedness. I don't have that scripture memorized, but that's where all the filth of our mouths come out when our hearts are not right with God.
So, do you want to talk about faith or you would just want to swear at us?
>> No, I like transformers.
>> What's that? What does that mean?
>> Sure. God said in the beginning, God said, "For this reason, a man shall leave his father and mother and cleave to his wife, and the two shall be one flesh."
That's what the Bible says.
And that homosexuality is an abomination to God. And if you stay in that, you'll die in your trespasses and sins. See, you love it and you hate God because you love your sin. That's as simple as that.
>> Yeah.
>> People love their sin. is fine with with LGBT, sir.
>> Good. How you doing?
>> I got a complaint that you're creating a public disturbance by bringing this such a young lady to see your ID.
>> No. No, sir.
>> We did not. We have everything on there.
>> I'm going by what she said. I need your identification.
>> No, sir. No, sir.
>> We have freedom of speech.
>> Okay. Come over to the car. You're under arrest.
>> I am. Actually, you're >> under arrest. Can you talk one second just so I can get the >> Yeah, sir. Are you Are you his superior officer?
>> Talk to you for one second.
>> Yeah. the First Amendment. You cannot do this.
>> You will have a lawsuit on your hands.
Go talk. You should be You should be worried. You're on film and we have all the evidence. Thank you, sir. I appreciate that.
>> Cops who don't know the law.
>> So that's why Jesus said, "I am the way, the truth, and the life. Nobody could come to the father but by me. There's only way one way to be made right with God and that's through his son Jesus Christ. Do you believe that sir? You do?
Are you a born again Christian?
>> Yeah.
>> Well then you are not saved cuz Jesus said you must be born again. There's nothing no other way to be made right with God than to be born again.
Who's going to arrest me for what? Hate speech. First amendment.
Let's read the first amendment, especially on a public university.
Please quote for me the first amendment, but I'm not going to start. Congress shall make no law respecting the establishment of religion or prohibiting the free exercise thereof or abridging the freedom of speech or of the press or of the right of the people peacefibly to assemble and to petition the government for a redress of grievances.
So we are street preachers. We have every right to preach the gospel of Jesus Christ. Are you still arresting me, sir?
>> I'd like to get your side of the story unless you don't want >> We have it on film. We can like to get your side of the story of what happened when the young lady walked by. Did you tell her you she was going to burn it out?
>> No, we talked to her and said we said we asked her if she believes in Jesus Christ. She said she's Roman Catholic and by the freedom of speech that we have to preach the gospel of Jesus Christ.
>> But you know something we have said we say that people it doesn't matter even if I did. No, it does not officer. You do not understand the first amendment.
You do not understand the first amendment. You do not have a right to dictate to me when you you do not have a right to dictate. We are preaching the gospel of Jesus Christ. And the gospel of Jesus Christ says very clearly we talk to people by preaching the gospel of Jesus Christ.
We have it all here on evidence and you will go ahead and arrest me then. Go ahead and arrest me for first amendment.
Go ahead and arrest me for the first amendment. We have the right to proclaim the gospel of Jesus Christ.
>> Possible to see the video.
>> You're not going to listen on.
>> Well, it doesn't matter. Yes, it is.
>> I'll have to stop it.
>> Would you be okay with that with seeing the video?
>> Um, no. I'm not okay with that right now because I have it filming right now. But I I mean, if you arrest me, we'll certainly use that for evidence. But we did nothing. Well, he said he he started to put his hand right because I feel I have >> No, you have no you have nothing. You do not have a right to do that. First amendment says because we preach the gospel of Jesus Christ and the gospel of Jesus Christ says that if you are dead in your trespasses and sins you are going to go to hell sir that includes you and that includes what's that >> and drowning in that >> and drowning in your own mother's told me that my mom has told me that >> see you are an officer you are an officer you do not have a right you are hindering me now as witnesses this man is now you are representation of the state. You can leave now. This is a public >> do you see this man? He is out of control.
>> Yes. Yes. Go talk to other people because you are absolutely out of your realm.
>> You are out of your realm. Thank you officers. I appreciate you for protecting us from a man who does not an officer who does not understand the law.
>> Thank you.
>> Give me one second.
>> Fair enough.
>> Yeah.
like >> Oh, yeah. I have the He will have a lawsuit on his hands.
>> There's no creating a public disturbance.
>> What time did we get here today?
>> What's that?
>> What time did you guys get here?
>> Oh, why do you need to know?
>> I'm just curious.
>> My Let me see. My my video >> says we started >> a little bit later.
I love it. I love it.
>> Boy, that that that officer is a little unhinged.
>> We've been here for about an hour for a few minutes.
>> All right.
>> Yeah. And I also have a body cam.
>> You know, >> I do too.
>> I do it for protection for officers that don't understand the law.
I appreciate you protecting me from an officer that's a little bit unhinged.
>> Who's the supervising?
>> Who's the supervisor here?
>> She's going to be the next Just a moment. She'll Yep.
>> She'll she'll be discussing it.
>> Okay.
How you doing?
>> Not too bad. Good. Sergeant Ryan, just got out here. So, >> sounds like maybe a woman was offended by something you said.
>> Maybe. So, but the point of the First Amendment is that we have the right that sometimes >> the first I know what the First Amendment is.
>> Okay. Very good. I'm not I'm not suggesting that you don't have the right to be here.
>> Of course not.
>> If we get a complaint, as you know, this isn't the first time we've been down here while you guys have been here.
>> Um, so we need to figure out how we're going to rectify the situation because >> rectify what situation?
>> Well, the the woman was was concerned.
Okay.
>> About what?
>> And >> we didn't approach her. We didn't approach her. We say to anybody that's walking by, if you're not in Christ, you're dead in your trespasses and sins.
>> How do you know that you aren't in Christ? What's that?
>> How do you know that she's not?
>> They told me. They tell me. But it doesn't even matter. The first amendment does not rest upon people's agreement with my free speech. You understand that? If you look at the constitutional law and various court decisions in the Supreme Court, my right to proclaim in a public area is I mean, it's not absolute. I can't yell fire in a in a theater, but I can preach the gospel of Jesus Christ. And part of being a Christian is that if somebody is telling me that they don't believe or whatever, I can say to them that if you're going to die in your trespasses and your sins, the Bible clearly says that a person will go to hell if they don't have faith in Jesus Christ.
>> Okay?
>> So, you know, you may not like it, sir, but it is still true.
>> That's nobody suggesting that it's not true. So, I I hope that you I'm glad.
Thank you for taking time because that officer is certainly unhinged and he does not know the law and he was ready to put his hands on me and I appreciate that you guys intervene.
>> Here's here's the thing. We're on a college campus. We get a call. We have to come. You know that just like I've had I've had the police I've had the police call on me so many times for my first time.
>> We get a call. We get a call. And you're you I don't have to tell you you're in an environment where people don't necessarily believe what you're saying.
Of course not. They don't have to believe what you're saying. You don't have to believe what they're saying because you guys have had I've been out here. You guys have had plenty of dialogue, right? Um and that's the great thing about, you know, the US. We can we can agree to disagree. We can disagree.
We could do whatever. And and it >> be pretty boring if we all believe.
>> Yeah. And people will often use governmental force to try to suppress other people's freedom of speech. And that's the instance here is that she made false accusations against us. I mean, if you arrest me, then I would use that as evidence to show that we even still, we are Christians. We believe in what the scripture says. But there are people that have the first amendment right to say pretty much anything that they want. We don't have those telling anything I don't already know. The things that are said to us are protected by First Amendment as well, right?
>> So, that's something that we deal with as police officers as well. You're not the only one that deals with that, right?
>> Well, thank you. I appreciate you doing your job. I I I recognize that, you know.
>> Yeah. Thank you so much. And what's your name?
>> Uh, Officer Ryan or Sergeant Ryan.
>> And your badge number?
>> 11.
>> 11. And what's your name?
>> Officer, what's your name?
>> My card, sir.
>> What's your name? And your badge number.
>> This This guy's a little unhinged. I I He makes me very nervous for both.
>> I'm I'm just saying he he makes me nervous. He has a gun.
>> He He makes me very nervous.
>> This is a very strange man.
>> He's got his business. Where's your business card? It has >> I don't I don't want your business.
Well, yeah. You know, actually, I do. If you do anything further, if you Oh, what a case number for this, too.
>> For a case number. Why? Cuz I am Am I under arrest?
>> I'll give you a case number.
>> Is there Am I under arrest?
>> I'm documenting.
>> Am I under arrest? You're not under arrest. Okay. Then then why is there a case number?
>> I'm going to write something up on it.
Do you want it?
>> No. It has nothing to do I've done nothing wrong.
>> I've done nothing wrong.
>> You're good. Well, this this man's a little he's a little unhinged. He makes me very nervous. He's intimidating.
>> Yeah. Well, he needs to be respectful.
He's laughing. He has a gun. He's a very intimidating man. He seems he seems he seems mentally unstable to tell you the truth. And he makes me very nervous.
>> I understand what you're saying.
>> But the way you're saying it, >> no, because I'm afraid of a man with a gun who I believe is unstable.
>> Nothing's going to be >> Well, he started to put his hands on me.
I appreciate that. And you know, you you know, you guys are reasonable and that's why you're keeping him away because he's he's he's something's not right.
>> You know, in in the future, if we could just keep things civil, >> try to keep things respectful.
>> Of course, and that is respectful.
>> They're respecting you and you're respecting them.
>> See, see, there we go. There we go.
Officer, there's a good example of what we put up with. Thank you, son. Thank you, son. attention.
>> So we That's how you saw what's that?
>> Oh, I did not use any profanity. I did not use any profanity. Diaz. Yeah. Go away.
>> Um, >> thank you. Thank you, officer. I appreciate that.
>> So, what's your first name?
>> I don't need to give you my name.
>> Okay.
>> Yep.
>> All right. Well, I gave you my name.
>> Yep.
>> Right.
>> Yep. But I don't need to give you I don't you I'm not I've not done anything wrong. I don't need to give you any information.
>> It was a general rule. reidentify everybody we deal with. That's your take care. Go get some help.
>> Go get some counseling, sir.
>> So, he's going to go.
>> So, why won't you cooperate with us?
Just give me >> I'm not I'm not not cooperating because I've done nothing wrong.
>> Can I just explain what's going on with him?
>> Yeah, that would be really good to know.
>> He has a female complaintant. Okay.
Based on this whole burning hell statement >> that that a person >> Would you mind if I finish?
>> Oh, no. Go ahead. Yep.
>> That she's alleging you said to her multiple times. I don't know whether or not that's true or not. I just got here.
>> But if I did say that, it doesn't matter. But no, but that's a good question.
>> Right. But let me let me finish with just go with this.
>> So we just show up as a third party. She wants to make complaint. You are right that very speech is protected under the first amendment. Understood.
>> Understood. Right. But when someone calls the police, we still have an obligation to go whether or not fair enough. Fair enough.
>> Whether or not the alleged act is protected under the constitution.
>> I I understand that, sir.
>> So to kind of circumvent what was going on and kind of ease the situation, bring a little peace to the camp.
>> We still have to service her complaint.
So we have to understand it more.
>> So we have to at sometimes contact the court and say, "Hey, this is what we were presented with."
The problem lies that if we don't know who you are, >> Mhm.
>> right, then how do we sort that whole?
>> Well, I've I've talked to officers in other times and other places. I gave an officer last week, one of my brochures, so you know, he he he has my email address. People generally know me.
>> Who was that officer?
>> But I I don't know. But here's here's here's the question. Here's the question, though. Yeah, >> even if I did say, which I do not allege that I said anything that is beyond my freedom of speech, even if I did say to a person what she alleges that I said, you're going to burn in hell forever.
>> You have no authority or right to say that I cannot say such things to people.
>> Yeah, I didn't say we did.
>> So, what's the problem?
>> If someone complains, we have to come and investigate. We're not saying that you can't say it's in burning, though.
>> Okay.
>> You've done your investigation. No, we actually haven't.
>> Okay. What's your investigation?
>> We we haven't finished because we have to identify all parties involved. That's that's >> not at all. I have not done a traffic stop.
>> No, this is very different than a tram am I being detained?
>> We we No detained.
>> When you tra when you stop somebody with a car, you are detaining them, right?
>> Here's the thing.
>> Do you understand? Am I correct?
>> We're not here for a law lesson. We're here just to talk with you.
>> I know, but you just use an illustration.
>> We would not have come here had we not got a complaint. You understand that, right?
>> Of course. People complain all the time.
We knew you were here, right? Cuz we got we had someone call in and we said, "He's legal to be there."
>> Mhm.
>> You didn't see us hanging out here and bothering you, right? You guys are reasonable. We didn't do a We didn't do anything. We're here because somebody complained and our responsibility to our students is that when they make a complaint, whether against you or another student or a faculty member, is to rectify the situation and try to figure out what's going on. Okay.
>> This isn't your first time here. You know, I I graduated from here actually.
>> You know, you know that you've got um plenty of students who either agree or disagree with you. This isn't like some epiphany that we're learning this today, right? Like I've been down here when kids have been yelling and doing all the things and we just watched it happen.
>> But like at the end of the day, it makes it much easier if we can just identify you and be like, "He's all set and be done." Like we're not trying to cause problems for you. In fact, we've never caused >> problems. I guess I'm I am being kept you safe by being here. Right. When off like we've had officers here when students are in your face and they're screaming and they're being silly and they're acting a fool. We're here to keep you safe.
>> Sure.
>> Right. Sure.
>> So at the end of the day, we're just doing our job. Yep.
>> We're not telling you you can't say you're going to burn in hell because if that's what you believe and that's what the scripture tells you, then that's what you believe and the scripture tells you. It doesn't mean that everybody, >> right? We know that. Of course. Of course. Otherwise, we wouldn't be here.
If I would have believed it, there would be no reason, >> right? Like I told you before though, if we all believed the same things, it'd be a pretty boring world, right? If everybody looked the same and acted the same and believed the same things, then >> yeah, >> we we'd look like a bunch of robots running around here, right?
>> Sure.
>> There would be no no you and no nothing.
So again, we're not trying to cause you any problems, but you make our lives a little easier when I can just say, "Yep, I spoke to John Smith and >> then you could call me John Smith."
>> Well, that's an example. And you know, but I don't I guess I'm call you John Smith. I don't think it really works.
>> I'm being stubborn here. You're just being what's I am being uncooperative because I've done nothing wrong. And >> you're not saying you did.
>> Yeah, I know you're not. But I don't need to give you my ID.
>> We have We have a responsibility to document when we talk to people. You can call me John.
>> Whether whether we whether we agree this call or whatever >> or if we're protecting you or we're protecting someone else, we have a responsibility to identify.
>> Yeah. But I don't have a responsibility to give you my name, >> right? Do I understand that?
>> Yeah. Thank you. I'm not trying to be belligerent or anything.
>> You're not being belligerent. I mean, we're just trying to cooperate.
>> I appreciate it. And I have cooperated except I just don't want to tell you my name just because I don't believe I' I've done anything wrong. No, exactly.
>> Why wouldn't you?
>> Well, well, that's that's a very um >> You didn't do anything wrong.
>> It's a kind of a manipulative way of saying that. I I am innocent.
>> Sure. So why should I tell you anything?
>> Why not? Just cuz we're two citizens.
>> No, because you are not citizens. You have a gun. You are an officer. This is a big mistake that police make. You try to say that you are just Joe citizen.
You are not. You all have guns. You have a responsibility, right? You are not just Joe Citizen.
>> Good to see you again.
Golly, that is a lesson in civil rights of trying to say when the the law tries to go beyond what we have the authority to do.
>> I thought maybe you were in trouble. I saw you guys.
>> Jesus died for us today so we could have eternal life. God called us. Yeah, we're here visiting enjoying the beautiful day >> before God is judgment. We've all sinned. We've all broken his commandments to Jesus that we can be forgiven. Every knee shall bow every me of your name.
>> Alicia. Yeah. Did we talked last semester, didn't we? Is everything going all right?
>> God bless you. for Christ and the power of God is salvation to all who believe.
>> We've all broken the gospel and wait for him, but the gift of God is eternal life, Jesus Christ our Lord. And God called us all to turn away from our sins and believe in him to be saved.
>> Having a firm grasp of your civil rights is the only way to shut down an unlawful threat from law enforcement. The initial officer let his emotions take control, trying to use the threat of handcuffs to force the preacher into silence.
Fortunately, the citizen held his ground until a supervising sergeant arrived to clean up the mess. The sergeant correctly admitted that the campus police could not punish someone for their religious message. Even if other students found the words offensive, she still tried to smoothly convince him to hand over his name. But he smartly exercised his right to remain anonymous since he had committed no crime. Hit that subscribe button to keep studying your rights and we will catch you in the next breakdown.
