[00:00:00]Um, the city of Fall River Licensing Board will come to order. It is Wednesday, May 26th at 5:00 PM. Sorry, Tuesday, May 26th at 5:00 p.m. To my right is Commissioner Michael Pereira.

[00:00:12]My name is Melanie Cadiro. Commissioner filling in for Chairman Gregory Brilliant, who cannot be here tonight.

[00:00:18]Before we begin, I would like to read the open meeting law. Pursuant to the open meeting law, any person may make an audio or video recording of this public meeting or may transmit the meeting through any media. Attendees are therefore advised that such recordings or transmissions are made are being made whether perceived or unpersceived by those present and are deemed acknowledged and permissible. The city charter section 9-18 mandates that all multiple member bodies developed and adopt such rules or policy for public comment. We have adopted such a policy which in short provides for citizen input on licensing board specific matters at the beginning of the meeting. There is a signup sheet that is located at the back of the room. Did we have anybody sign up?

[00:01:12]Therefore, you have to have a unanimous vote. So, anyone who would like to decide not to go forward with their petition tonight and wait for the three member board, you may do so, but must say so before we hear your petition, and it will be tabled for the next meeting.

[00:05:14]>> Yes. So, we've done multiple like boxing events, professional boxing and amateur.

[00:05:18]This is our first uh it's called Lit Summer. It's a community event during the day and then at night there's going to be a couple different like musical performances, small like I guess like five minute intervals. Um yeah, so this is our first time hosting this. I do have the police detail and a fire detail already >> already in place.

[00:05:39]>> Uh it's just like a community event during the day. Like it's no no charge or anything like [clears throat] that.

[00:05:57]>> Uh, I'm not too sure. I'm I'm pretty much kind of the um, you know, the, you know, he's renting my space. You know, I own the building. Um, >> but I mean, I think he said he's he's going to probably get closer to 300. We we take 413. That's uh, I work with Eugene Borges a lot on the building department.

[00:06:16]>> Yeah. and he comes in, he does the one day permit for me and uh we get the fire detail in place because of the historical landmark of the building. Um >> yeah. So I mean um I'm guessing they're okay. I mean I can get a >> they're No, no, no. They So they're currently going on. They're currently selling tickets.

[00:07:01]>> Okay. Uh so what troubles me is you advertise this event and you sold tickets prior to this board approving you.

[00:07:13]>> Uh I'll be honest with you, sir. Uh, like I said, it's it's um kind of like an outside entity coming in using my facility. So, >> you still need the license from this board.

[00:07:25]>> So, why would what what do you think that was a good business practice to do that?

[00:07:29]>> Uh, I I just believe maybe, you know, the guy doing it didn't realize that.

[00:07:33]And I've done boxing events before and we usually promote it. Um, I but I usually don't do like the liquor lights that I mean, we usually do our, you know, our posters and all that ahead of time. So we can, you know, >> yeah, I don't get the tickets.

[00:07:48]>> And wait, because this board has to approve any liquor >> sales and any entertainment for the event.

[00:07:53]>> That's just that's just for like liquor, right? When I do like my usual boxing show is like >> I can just I can put my you know, I don't do liquor or anything like that.

[00:08:03]>> No, I just uh contact Eugene and he does his one day permit.

[00:08:06]>> Okay. So And you don't sell liquor at the boxing events? You tell me. We did one uh our last pro show and they didn't say anything about this at all. So, this is this is the first of my understanding, sir.

[00:08:16]>> Yeah. Well, so it's it seems to me like it's everything is backwards with this particularly with this event.

[00:08:22]>> Okay. Because you're advertising it, you're selling tickets. It hasn't been approved by this board yet.

[00:08:27]>> Okay, that's one. Two is you haven't met with the police department for a safety plan now. And you haven't hired a detail yet because I checked today. There's no detail I'm hired. So, today you said you hired the police and fire. There's no police details.

[00:08:43]>> Um, so I would think that you would come to would have this. So, you're saying the people up there singing it's actually a rap um concept with a pretty Bubba Sparks pretty pretty significant and well-known um rapper. Okay. So, >> you could have 400 people show up. I mean, they could sell 300 tickets online, but another hundred could show at the door. You're selling tickets at the door. So you could have the neighborhood of 400 people and you can have 400 people in there. You can have 413 people in there, >> but you haven't hired a detail yet. And the way you'd said it, you know, uh the the police and fire details have already been um ordered, it sounds to me like would be one detail and you hire one firefighter. I think you you I can't know what was in your mind when you said that, but it sounded to me like you're hiring one detail and that you're definitely not going to be allowed to do hire one detail for rap concert. Okay.

[00:09:38]>> We have uh I'm going to make it when if I do make a recommendation to pass this, I'm going to I'm going to make it with a stipulation to have four police details from 5 to 12:30. That's going to be my stipulation if I do make it. And I'm not sure if I'm going to do it yet. I would think that you would have a safety plan for this event of this uh magnitude because it's a it's a jump. It's you're definitely making a leap from a boxing show.

And I think we're going to defer over to to >> But I will say about business practices, that's not for us to judge. If you can sell as many tickets, if we don't improve the liquor license and the event can't happen, then you're just out of money. So, I'm not going to stop you from promoting an event prior to coming in front of the board. I don't think that's our right to do that. Um, but I am concerned that you said you had a police detail and a fire detail, and I'm hearing that we do not. So, >> yeah, I apologize for that. I thought my wife had those in place already. She So, my wife's like she does all that stuff usually. Uh, no, no matter what, I was planning on calling them tomorrow and just confirming. So, I I have multiple boxing events coming up in the future. I work with you guys all the time. Uh, I promise you, I'm really I have four children. I'm really not trying to have this big crazy thing. To be honest with you, sir, uh, my wife didn't even really want to do this event because, like you said, it is a step different from us.

[00:11:02]I'm very transparent. If you don't approve us, >> she'll probably be happy to be honest with you. I'm just [clears throat] I'm being completely transparent with you.

[00:11:08]the man who is doing the event with us, your boy Loco is his name. It's kind of weird to say, but uh he's doing it. Uh it would be unfortunate for him. Uh he's a friend of mine. I like the guy. Um I work with another guy who says that he, you know, it's a good event. He does community during the day, then he does the, you know, thing at night. I asked him his advice. Do you think I should host it? Do you think it's okay? Uh I have four children. I I have probably 60 kids in my gym right now doing youth boxing class. like I don't want to promote anything that's bad and it's going to give me a bad reputation. I don't want that at all. I think I do good for the city and and have a good reputation with the city. Uh so that's all I can ask for. Um like I said before, it doesn't really hurt me if you don't approve me. I'm not saying that to be cocky or anything like that. I respect all you guys. Um my boxing events is my biggest thing. Uh that's my livelihood. It's what I do. So uh you know we you were here when I you me for my last pro event. Uh we promoted that well before that was never brought up.

[00:12:02]Anything like that. Uh, I always work with Eugene Borges and Glenn. I make sure my inspections are done. I make sure the fire safety is all good. Um, nobody had told me that I needed like a safety meeting with the police. That's that's the God's honest truth. Um, I actually am talking I usually talk to Samantha Barbosa, but there's a new girl now. I'm talking to her about my gate show.

[00:12:24]>> Yeah. Yeah. So, I usually talk to Samantha Corner, but there's a new girl now. My wife's in talks with her for my show that's happening at the gates August 8th. Uh, I plan to have like a safety meeting about that. Uh, I've done the battleship before. We've done pretty big events. Like I said, obviously, uh, this is a whole new territory for me.

[00:12:45]I'll be honest with you. I'm just being transparent with you guys. Uh, I'm married. I've been married for almost 10 years. I'm not trying to. It's fine.

[00:12:51]Like, you don't want to prove me, I'm okay. Uh, I'll have to tell this guy that he has to go somewhere else. Um, but I hope this doesn't affect anything in the future. Uh because the only time I do do liquor uh is when I do my pro boxing events at my hall was once twice a year max.

So as one member of this of this board, as one commissioner of this board, I do have an issue with you advertising um events prior to approval from this board as one member. Okay. I don't think it's appropriate. I don't think you should do that and I hope you don't do that in the future. But, you know, Mel and I certainly disagree on that. That's fine. That's what we that's what uh a board is for. Um the other the other thing is is um is this an event center or is it a gym?

[00:13:42]>> Uh it's it's it's it's a little bit of both. I I mean it's it's a gym, but uh I host you know upstairs I have the basketball court and I host boxing events up there.

[00:13:50]>> Yeah. Well, that's my point because we've allowed boxing events and and and in the past and the city has and liquor.

[00:13:57]Um I believe it's because it's related to your gym and I would hope that the the the you're running these things to support your gym >> 100%.

[00:14:07]>> Okay. To buy boxing gloves to buy boxing gloves for the kids and rap and everything else, right? Okay. And I'm sure you are. I'm not I'm not I'm not questioning that. But again, but I think it's a leap now that you're doing it.

[00:14:39]>> All right. So, again, I don't think does it say that on the permit at all that at at five? What? So, from 5 to midnight, it's 21 or over.

[00:14:50]>> Oh, 8. I'm sorry. From 8 to midnight, it's it's going to be 21 years old or older. So, there's going to be someone checking IDs at the door.

[00:15:10]>> Um, I'm just going to be completely honest with you guys. uh the guy that I'm work, you know, the guy loc that I'm working with. Uh I don't You said five police details.

[00:15:20]>> Four. I don't even think he's going to be able to afford that. So, if that's the case, it's probably just going to be a wash. I'm just going to have to tell him. Um cuz usually for a boxing event, we do the one police detail with the with the rate for the alcohol. And we've never had any issues uh with four. If I'm doing something my own show like the Gates and the Battleship, I've had six, seven, eight before. Uh and that's a lot for one guy, you know, but I've done it.

[00:15:40]Uh and I've done it and I pay the departments on time. You can ask them.

[00:15:43]I'm always one of the first checks to be there. Uh I never give them a hard time.

[00:15:46]They never ask me chasing me from down.

[00:15:48]Um I've just I've done a lot to try to be a good community member and and be good to the police departments and the fire departments. Um you know, I worked in public safety myself. So, um yeah, listen, I mean, at the end of the day, if you if you don't want to approve me this, >> I'm making I'm still making a decision while I'm going to make the motion, but the motion is going to have a stipulation to it.

[00:16:08]>> Yeah. I just I I can probably guarantee with four police details he's not with with the rate for the police details with alcohol, which is totally fine.

[00:16:16]Obviously, you guys have to get paid. Um he's not going to be able to afford that. So, it's just going to be >> I think I would like to hear from Detective Bonus what she thinks is appropriate for this event as far as number of police details.

[00:16:28]>> So, to be honest, that's not something that we would typically put a number on.

[00:16:31]Obviously, this is going to be contained inside of your business. There's not going to be anything flowing outside of the business.

[00:16:36]>> Okay. So for us as far as like a safety plan goes if you already have a safety plan that you're working on with someone that's your event coordinator. I mean at most we would ask for maybe a copy of that if you wanted to forward it to us but it's not something that we would really require.

[00:16:49]>> All right. And I'm willing to have a meeting with you guys if you guys wanted to have a meeting and kind of like set something up. And I can I probably should have brought him. Um I didn't think it would, you know, be like this.

[00:16:58]Um but I understand your concerns with me stepping outside of the boxing realm technically. Um so I totally get it. Um it's justified. Um, >> well, I'm worried about the safety of the city because we typically have What night is it?

[00:17:11]>> July 11th, I believe it's a Saturday night.

[00:17:13]>> Saturday night. There there are a minimal amount of police officers that work the street at night there. If there is a disturbance and there's one police officer, he's going to need backup.

[00:17:23]>> And to get back up there, I would hopefully they're going to get there in a pretty good amount of time.

[00:17:28]>> But if there's already a number of police officers there, they can back each other up and and and call the uh situation. Okay.

[00:17:34]>> Okay. I mean, I'm a fan of Bubba Spock.

[00:17:37]I have no problem with him. I am. But but the uh >> I just think whether it's was a rock concert, a rap concert, or any kind of thing of that nature, it's it's a it's a leap from a boxing show. I think a boxing show is more family orientated. I know your daytime stuff is going to be family. But I think >> that's the only reason I'm doing it, not talking.

[00:17:56]>> Yeah. Yeah. No, no, it's going to be a more family oriented, you know, boxing and now it's going to be a concert. We don't know where people are going to be coming from. Are they going to be forever? And it and and I think Heather, I think it does come out of the building because you're dealing with parking down there. Three 400 people parking. You're dealing with people leaving the event.

[00:18:15]Um it's been my it's been my experience with with nightclubs and when people there there's problems with people leaving events that liquor being served.

[00:18:24]There's fights in the parking lot.

[00:18:25]There's people not leaving on time. One good thing there's not much residential down there. So that's that's good.

[00:18:30]>> Yeah. They usually utilize Pearl Street garage. Yeah, Pearl Street garage and like that lot around there. Usually for my boxing events, it's never an issue.

[00:18:37]>> No, I don't think it would be an issue with a box. I think with a concert, it could be different. That's my point. I'm trying.

[00:18:42]>> Yeah, all your all your points are valid. If my wife is here right now, she'd probably be clapping for you. Um, >> well, I'm I'm I'm going to make the motion. I'll make the motion to approve this application with a stipulation. Get >> I was going to say I mean, the event isn't until July. So, I mean, if it's something that you guys wanted to entertain, have table it until the next meeting and then we could have conversation about it. See if there's something more that he could be doing before he comes in front of the board again. [clears throat] Obviously, that's entirely up to you guys.

That they hire four police details that approve it and hire four police details. And if you'd like to meet with these guys and find out where you're going to put the details, if you can afford the details, um that's that's the motion on the floor.

I'm not going to be like taking care of that stuff. You know what I mean? He the his he has to pay for his details. Like that's part of what we're doing here. Uh which is why >> that actually troubles me a little bit either that we [clears throat] have somebody coming in from the outside and running a vet and you place.

My sister-in-law was at the event as a vendor uh selling chocolates and stuff and I asked her how it went and she said it was pretty good. Um obviously at night the scene changes a little bit obviously there's rap music going on and lights and stuff um from like the daytime where you know kids are there but um >> which event was held at the cultural center the day event or the concert?

[00:20:33]>> Both at the cultural center. Yeah. Um >> well I've been at the cultural center where there's been bands and discos and things of nature and I've been there and I've responded to riots at the cultural center.

[00:20:45]>> I understand. Yeah. No. So I just want to make sure just for my cuz this is my livelihood and uh this is all I do. Um I just want to make sure that this doesn't affect anything in my future for my boxing events and my family events. Uh cuz like I said, this is how I feed my kids. Um and I I think I do a really good job of keeping things orderly. Um >> yeah. So yeah, totally up to you guys.

[00:21:07]Whatever whatever you guys want, whatever decide the motion. So, >> I can't I can't second that motion. I think for police details is excessive.

[00:21:16]Um, and would price them out of this event considering they had this event last year but at a different location.

[00:21:35]So, >> I see >> I think if we're going to be at odds, we're going to have to table this. um until we can get Greg back. And I know that um you're selling tickets and our next meeting is usually on the third uh Wednesday of the month, which would be pretty close to this date. So, we might have to entertain a special um meeting [clears throat] earlier in the month.

I'll probably bring the guy with me next time if we do, you know, come back or I to be honest with you guys, I'm going to try to talk him into getting another venue also because of this. Um that'll be unfortunate, but it is what it is. I got to do, you know, it is what it is. But yeah, no, I will definitely come back for whatever you guys need, table or talk about whatever.

Um >> yeah, no, I'm definitely, like I said, uh this isn't uh you know, I'm working with an outside entity, but like I said, I should have brought my wife with me to back me up a little bit, but she's over there with the kids. Um this is what we do. And like I'm going to keep trying to do boxing events and they're great events and they help kids and like I said, I got 60 kids in my gym right now, not paying a dime to train.

[00:22:37]You know what I mean? Yeah, >> I'm not saying that to try to get your guys heartstrings and just it's just it's the truth. I do charge people to box, but um you know, I have a nonprofit organization. It's all towards my youth.

Um, he's been working on site at Jay's Wine and Fine Spirit, uh, Jay's Wine and Spirits, also in Fall River, for the last few years with no issues at the state or local level. So, he's already familiar with this community and the responsibilities of selling alcohol. Um, he'll also be alcohol tip certified before this goes to the ABCC just to have another layer of experience. Um, he is purchasing the store with another principal, Naomi Patel, who's not here tonight. Okay. Um, but she's also an owner of a different store in Fall River, Globe Liquors. Um, so she's also an industry veteran and also respons uh familiar with her responsibilities. And because they take underage sales so seriously, they're investing in a state-of-the-art ID scanning machine. So, education goes a long way. But now with fake IDs being so prevalent, and I go before the ABCC and we see the holograms that they make, it's really crazy now. Um, having a scanner is what I always like to see.

Um so again they have that experience um education and the ID scanner which the ABCC likes to see as safeguards.
