[00:00:26]All right, you entered a plea on August 16th to count two. The state waived count one and they also um you pled true to the uh each enhancement paragraph. You applied for probation. The court found there was sufficient evidence to find you guilty.

[00:02:51]Um well, I'm I'm sorry for for um for I'm sorry for picking up this person's ID that I that I that I that I took and I'm sorry that we did we did that to him and we used it.

[00:03:04]We picked it up on on a motel room. I'm sorry I'm sorry for for everything I I I I gave the guy money to to to to put so he he to pay him back at the when I was there and then he came back because his ID was used and and I I knew better to give it to anybody else.

[00:03:21]And I I I I and and um and to be used for something that, you know, wasn't wasn't right. It was just really cold outside at night and I found it in a in a in a parking lot at the gas station. That's not right to do.

[00:03:34]And and again and and uh uh the man got a bad foot. I I apologize to him myself if you allow me to.

[00:03:40]And um I know that I know that um I know that it's it's not it's not anything I can do about it now. It's this is where it's it's um it's it's at now. So I can only put my hands in God and and and me and and you and and whatever you all you should happen.

[00:03:57]And um uh I'm I'm I'm I'm I'm really um I'm Whatever happens to me today is what I get and I deserve so I'll put it in y'all's hands and God's hands. I'm sorry for that and when I'm um I'm so and and I I don't know what else to um Do y'all got my shaky on you? I can't really talk and my my mouth's kind of dry. And and y'all are going to just in in everything I whatever happens but I just really uh y'all are some really special people and y'all are all y'all lawyers and all y'all judge y'all are amazing people and y'all are like hell's angels like you know y'all y'all not not bad way but people at the gates of hell know when he was doing bad y'all send him to Oh, you're talking about the four horsemen?

[00:04:41]>> Well, I mean just just my my angels, you know, like my angels that that you know if you if you if you if people if they do something bad I know y'all see through it, you know, y'all got everybody here that's y'all see the same thing every day.

[00:04:52]And you know and and uh I can't >> Well, what I can tell you is I don't see anybody as criminal. I see everybody as a human being and I take each case on a case-by-case basis.

Every day I I've I've I've I've I've I've I've every day being locked up I've played this in my my mind over and over again. What I'm going to say to y'all and what I'm and and I can't And I just I can't I don't know what to say anymore.

[00:05:26]Now but but to to be released from y'all today and I know that I'm going to get I'm going to get whatever I get today and I'm going to I'm going to accept that and and it's and it's what I deserve and I'm very sorry for the victims that that that the the stuff you know that the stuff was used and you know All right, Mr. Mr. Lessing, here's the problem.

[00:05:48]Um This is what I tell a lot of people come before me.

[00:05:53]Your criminal history is like a credit report. Yes, ma'am. So, when people look at your credit, they decide should I lend you money, should I not lend you money. Yes, ma'am.

[00:06:00]So, I'm looking at your criminal history.

[00:06:03]1997, failed identify.

[00:06:07]1999, a theft and you were given deferred adjudication.

[00:06:11]And then you were revoked. I'm assuming they taught you not to steal, which everybody should know because everybody in school, you're taught you shouldn't take what doesn't belong to you. Yes, ma'am. And that's one of the commandments, right?

[00:06:23]>> Yes, ma'am.

[00:06:24]Then in 2002, burglary of a vehicle, you were sentenced on that.

[00:06:31]Then 2005, unlawfully carrying a weapon.

[00:06:37]And I believe they took all of these cases together cuz you also had a driving while license invalid. 2006, driving while license invalid. 2010, uh that was dismissed, driving without insurance.

[00:06:50]Then you had June 2010, possession of a criminal instrument.

[00:06:54]2012, possession possession of prohibited knuckles. I'm not taking that into consideration cuz it was dismissed.

[00:07:01]2016, driving while license invalid enhanced.

[00:07:06]And you received pre-trial diversion for that. What is 2000 That means that uh you completed whatever they wanted you to complete, so they dismissed it. Okay.

[00:07:15]>> And it's not officially a conviction.

[00:07:17]2019, theft under uh $100 enhanced.

[00:07:22]Uh 2020, you had the possession case, you released on bond.

[00:07:26]2022, driving while license invalid enhanced.

[00:07:31]Then we go to felonies.

[00:07:33]You had the burglary of the habitation force in 2000 I'm sorry, 1999, you were given probation for For you were revoked, and then you were uh paroled on that.

[00:07:44]Then, in 2004, we have possession of controlled substance penalty group one less than 1 g.

[00:07:52]And then, you have a previous forgery of commercial instrument or check from 2006. You were revoked and sentenced to 6 months in the state jail facility, which means they place you on probation. You didn't do well, you were revoked. So, you've been revoked and placed on probation more than once.

[00:08:09]Then, we have theft of a vehicle sentenced to 10 months in the state jail facility.

[00:08:15]Then, you have theft under $2,500 enhanced. You were sentenced to 5 years, and you were paroled.

[00:08:22]Then, you have the assault public servant bodily injury in 2013. You were sentenced to 5 years.

[00:08:28]Then, you have Let me see what's here. These were dismissed.

[00:08:35]Then, you have this possession case enhanced as a habitual, and they reduced it, and now we're here for this instant case.

[00:08:44]So, while you're apologizing to tearing pages out of the Bible so you can remember what has been written, let me tell you what the complainant in this case is what's happening to her.

[00:08:54]This officer spoke with Annabelle Sedano. She stated that she is unaware of any damages or financial losses she experienced due to this offense and is not asking for restitution.

[00:09:05]She did know that her license had been stolen because someone used her information to rent a U-Haul in a game system.

[00:09:13]After reporting her stolen property, she was cleared from any financial responsibility of those charges and is still in the process of having that information removed from her credit.

[00:09:24]She stated that she does not believe the defendant should be given probation for what he did. She stated that she worked and saved in order to buy her own home, and the defendant's actions damaged her credit. She will be unable to buy a home until she clears this damage for her credit. So, here's the thing about that.

[00:09:43]You did your joyride on her credit card or whatever because you're saying that you needed a place to stay.

[00:09:50]>> No, no, no. And here's the thing.

[00:09:53]You took her credit. Her credit report is ruined. Whether you took it and gave it to somebody else or whatever happened, her credit is ruined. And guess what? She worked, saved her money so she can buy a house, and now she can't. Because everybody's looking at her credit report and it's horrible.

[00:10:10]Can I say something, ma'am? Sure. Um I I picked up the man's ID and and and I mean he squatted at the store with the Annabelle Sedano. A girl that just came in here, her name was Sherry Cooper. She had the Annabelle Sedano.

[00:10:22]>> Mhm. And she said she'd write a statement. Um with with with but she she's the one who she she the one in the video when the detective did did did this Are you Annabelle Sedano? And she said, "Yeah." I said, I said I said, "You're going to No, you're going to No, I don't want to go to jail cuz she said it was pregnant.

[00:10:38]Well, that that's the girl that had to get all that other stuff with her ID.

[00:10:43]Um I just picked the man's wallet up at the store, but but they threw that in there with everything else. And that was Sherry Cooper. And and she said she and she's right now she's got 7 years probation for the Annabelle Sedano. Mhm.

[00:10:54]And then when they bonded me out, they used Annabelle Sedano's ID to bond me out and I and I gave it to the detective and told them who used her ID. And and and and and and I gave them everything that they needed and um and and and and and she said she'd write a statement, but she already been to your courtroom and you gave her 7 years All right. um probation for it, ma'am.

[00:11:14]>> Is there any other questions for this uh defendant, State? Not from the State.

[00:11:20]Defendant, anything else? Just argument.

[00:11:23]All right, the court will hear arguments. Uh State?

[00:11:25]Yeah, actually you essentially went over what our argument was. He had a long criminal history. We have victims whose lives have been changed forever by his actions. Um he's been given multiple opportunities. He's not a good candidate for probation, so we're asking that you deny his application and sentence him to the 6 years.

[00:11:41]All right. Uh defense. Thank you, Judge.

[00:11:43]I would just point out that uh Mr. Lissie, uh as you can tell from the PSI, has the equivalent of a 7th grade education and health issues and probably most obvious uh mental health issues that uh at this time appear to be untreated. I I have no doubts as to his competence or sanity, but it it clearly uh Mr. Lissie suffers from uh mental health issues and past drug abuse.

[00:12:12]He uh did acknowledge his guilt uh to this fraudulent use case.

[00:12:18]Uh Mr. Lissie does want me to point out this is a sensitive way and I know the court did it glossed over a large chunk of dismissals in his criminal history that were in the interest of justice.

[00:12:28]Um that uh those cases He he he talked about it.

[00:12:34]But that those cases that I know the court did gloss through those and did not consider those or did not consider those completely in when looking at the criminal record, we don't deny any of the convictions or the revocations of So um all that being said uh I do think that the alternative plan for probation that probation's been put in place um substance abuse counseling and mental health counseling and um tools uh employment. Uh Mr. Lissie does have employment lined up at a car wash.

[00:13:06]Um that uh he could benefit that the community could benefit from uh the resources that the county has to get him back on the straight path.

[00:13:18]Um so we would ask the court to strongly consider Mr. Lissie's application for the probation. All right. I just want to hear and see if you want to go on the stand.

[00:13:28]>> I'm sorry, I didn't know what to say about that.

[00:13:41]And we got um And it's right next to it is the him hopes I can get my ID and get everything done. Um I I I did after I mean all all this stuff I got involved with probation. And those I get those times that whenever I just found bad street.

[00:13:55]And then that's the 100 miles from it's really just you know um but now I want to be taking medication for the problems I I I I my office just they just took me off my drugs and then and then you have to get off and you got to really try to get back on them. You you don't shouldn't you try to you know get there and back to to follow out the door, you know, and you set set up for being there and um I've been I've been to prison, you know, they sent me to hell burning hell chemist unit. That's where they they they they taught me, you know, what right and wrong is. So and then I you know I'm I'm I'm really just I'm terrified. I'm you know, they sent me to hell burning hell chemist unit.

[00:14:29]And then and I I've I've had my head good man. I'm I'm I'm sorry. David Manostas public servant he saved my life. He took the drugs out of my mouth cuz I didn't want to go to jail for it and he beat it out of my mouth and banged his head on the wheel of the car and then I understand he saved my life.

[00:14:44]So bless his heart. And Annabelle Sedano, I'm sorry. I can give her I give the the the five people a whole rundown of the girl where she used her stuff at and and and and get her back on happy if we can. She had probation she she she she you know she cuz she she probation you gave her probation for it recently and she said that she'll she'll she'll she'll she will write a statement saying it you know that I did take the ID when the officer said was this Annabelle Sedano?

[00:15:08]She said yes. I said no, it's not her. I didn't want to go to jail. She said she wasn't pregnant. She had a baby and she did she she named the baby after me.

[00:15:16]We're doing it for doing it for for for so she didn't have a baby in jail.

[00:15:20]And and I I just I I I'm all the dismissals, I worked with the people and they got my cases dismissed. I really don't I really something can't say but I'm going to say anyways because I don't want to go to prison. I don't really want to go to prison and and I got I got another address right here. Um in Medina Medina and I got the address and the phone number you can call her. It's It's um right here I have the address. All right, Mr. The list of Before we even consider those addresses, it would have to result in me placing you on probation. Yes, ma'am. I'm not going to place you on probation. Um you bargained for 6 years with the state. Uh I'm going to sentence you to 4 years in the prison. Give you credit for any time served. There's a $500 fine, time and money run concurrent, taking consideration 2022 CR2713.

[00:16:14]Showing you what's entitled to trial court certification of defendant's rights to appeal. Did you review that with your attorney? Did you understand it and did you sign it?

[00:16:22]Because this is plea bargain agreement because I followed your plea bargain agreement and because you waived your right to appeal, you do not have the court's permission to appeal. Do you understand?

[00:16:30]And in your sentencing, Mr. uh Lissy, I took into consideration uh what you said, what your attorney said, what the state has said and what I read in the PSR report. Good luck to you.

[00:16:41]Thank you very Joey Lee Lissy stood before Judge Boyd after admitting to fraudulent use of another person's identification. But the hearing quickly turned emotional and unusual. The courtroom paused when Judge Boyd noticed he had torn Psalm 91 directly out of a Bible, leading to a sharp lecture about respecting books and responsibility.

[00:17:00]Lissy apologized repeatedly, blamed bad decisions, drugs, and other people involved, while nervously admitting he expected punishment. Judge Boyd remained calm but firm as she reviewed his long criminal history and explained how the victim's damaged credit ruined her chance to buy a home.

[00:17:17]Despite the defense arguing mental health struggles and asking for probation, Judge Boyd rejected it and sentenced him to 4 years in prison, reminding him that repeated chances had already been given.
